The title of this doctoral dissertation is the applicability of the precautionary principle under the convention on biological diversity and its protocols to synthetic biology. Therefore, the general aim of this doctoral dissertation is to ascertain the role played by the precautionary principle in the relationship to synthetic biology and to acknowledge the evolution of technologies associated with synthetic life, cells or genomes, as well as their possible negative consequences on the conservation and sustainable utilization of biological diversity under the aforementioned international environmental agreements. Although, there are a large number of international environmental agreements addressing specific aspects of synthetic biology issues, however, there are a lot of gaps in the process of implementation of the above-mentioned regulatory mechanisms. Specifically, this doctoral dissertation aims to answer the question whether it is necessary to adopt new international legal documents to regulate components, organisms and products resulting from synthetic biology technologies or whether it is possible to adjust the synthetic biology to the aforementioned international environmental agreements taking in consideration the potential gaps and overlaps with applicable provisions of the convention, its protocols and other important environmental agreements related to synthetic biology techniques. Consequently, the discrepancies could arise in situations where the components, organisms and products deriving from synthetic biology techniques do not fall under the regime established by a certain international environmental agreement. In this context, one of the problems related to the synthetic biology techniques is the lack of a clear definition of synthetic biology. Additionally, it is necessary to mention that the Convention on Biological Diversity and its protocols do not contain a legal provision regarding the definition of synthetic biology. However, the Convention on Biological Diversity approaches and develops the concept of "biosafety" by means of Article 8(g) and Article 19(4) since a large part of negotiations on the concept of “biosafety” were focused on the development of the answer to Article 19(3) and on the implementation of the Cartagena Protocol on Biosafety in the nearest future. Therefore, the living modified organisms derived from the synthetic biology techniques represent the living modified organisms derived from biotechnology. The living modified organisms deriving from the synthetic biology techniques fall under the scope of definition of living modified organisms provided by the Cartagena Protocol on Biosafety. Resultantly, the living modified organisms deriving from the existing synthetic biology techniques are deemed as living modified organisms resulting from biotechnology. Nowadays, there are a number of international environmental agreements, which contain provisions on mechanisms, procedures or institutions supposed to approach potential negative impact associated with the application of synthetic biology techniques, but where there is no specific guidance for their application. Accordingly, most of regulatory mechanisms approached in the present thesis were developed before the term synthetic biology became internationally used. In this regard, a few existing international environmental agreements are very wide to address some of the present issues related to synthetic biology. However, gaps still exist regarding the practical implementation of these international environmental agreements in order to ensure the conservation and sustainable use of biodiversity, and the fair and equitable sharing of benefits deriving from the use of genetic resources. In the nearest future, there will be needed discussions in international fora on how to address potential negative impact of the components, organisms and products resulting from synthetic biology techniques of very low probability but very high magnitude. It is necessary to mention that further discussions may be needed whether and when the advances supposed to hold in the industry of synthetic biology will lead to the emergence of new gaps. In sum, this thesis develops an analysis of the legal provisions, which provide for the applicability of the precautionary principle under the Convention on Biological Diversity, Cartagena Protocol on Biosafety, Nagoya – Kuala Lumpur Supplementary Protocol on Liability and Redress to the Cartagena Protocol on Biosafety, and the World Trade Organization Multilateral Agreements. Particularly, the Paragraph 9 of the Preamble to the Convention on Biodiversity represents a legal provision similar to provision of Article 15 of the Rio Declaration, which together enshrined the “precautionary approach”. Therefore, the above-mentioned fundamental legal provision can also be found in the contents of Article 1 of the Cartagena Protocol on Biosafety, which acknowledged and established the precautionary principle as a cornerstone of the respective international environmental agreement. Correspondingly, the objective as established in Article 1 is considered to be in accordance with Article 15 of the Rio Declaration. Although, the modern biotechnology is supposed to bring many benefits to the international community, however, it still can bring very serious damage to the surrounding environment if the modern biotechnology will be developed and used without taking precautionary measures for the protection of environment. Appropriately, the developed countries have a significant biosafety industry, a regulatory framework to govern the use of biotechnology and a risk assessment mechanism, while the developing countries are forced to cope with difficulties concerning the consolidation of modern biotechnology and its regulation at the national level. At the moment, the modern biotechnology represents an internationally established industry, and the genetically modified organisms are traded outside the border. This fact shows that there is a necessity of establishing and strengthening the international regulations. This doctoral dissertation represents a theoretical and practical legal research analysis of the applicability of the precautionary principle under international environmental agreements to synthetic biology. Therefore, the entire doctoral dissertation is based on documentary research of textbooks, monographs, papers, reports of international organizations, essays selected during my doctoral degree course. Additionally, the methodology combines the study course and analysis of a diversity of academic research works, international environmental agreements, directives, laws, cases referring to the precautionary principle and environmental protection, conservation and sustainable use of biological diversity, as well as regulation of components, organisms and products derived from synthetic biology techniques.
