미국에서 희귀질환의 개발 및 인센티브 부여를 목적으로 1983년 희귀의약품법이 입법되었고, 이와 더불어 진단 기술의 호전으로 희귀질환 환자수의 증가하면서 제약회사는 희귀의약품 품목 개발 및 연구에 매우 적극적이다. 하지만, 고가의 희귀의약품 개발은 정부 측면에서 보건 분야의 재정 부담과 국민 의료비를 증가 시키는 데 큰 역할로 작용한다. 우리나라 또한 소수의 희귀질환자를 위한 고가의 의약품에 급여 혜택을 주는 것은 매우 중요한 결정이 될 것이다.

우리나라는 연구 개발 단계에서 희귀의약품 지정을 허용하고 있지만, 의약품 개발국의 허가 이후 진행이 되며, 허가가 되어도 고가의 치료약제의 보험 급여라는 큰 장애물을 건너뛰어야만 실제로 처방이 가능하다. 그럼에도 불구하고 국외에서 개발된 의약품의 수입에 의존하는 우리나라는 허가 및 급여 결정을 위한 자료 및 결정을 위해 선진 의약품 개발국의 결정을 많은 부분 참고하고 있으며 이로 인해 발생하는 검토 기간은 실질적으로 우리나라 환자에게 치료의약품의 접근성에 큰 장애로 작용하며 환자는 치료시기를 놓쳐 생명을 잃게 되는 결과를 초래할 수 있다.
이에 시판 허가 전 동정적 사용에 대해 분석해 본 결과, 미국과 유럽, 호주와 우리나라의 희귀의약품 동정적 사용은 각 정부에서 제공하는 가이드라인을 근거로 각각의 국가별 제도에 맞게 정의하고 있었다. 프로그램 종류와 주최자, 가이드라인내용, 비용 지불, 승인여부 등이 국가별로 상이함을 확인하였다. 우리나라는 미국과 동정적 사용제도에 대해 유사한 범위로 허용하고 있으며 임상시험용 의약품 치료목적 사용과 응급사용 목적을 대상으로 임상시험에 준하는 기준으로 사용하도록 가이드하고 있다. 우리나라의 동정적 사용에 대한 가이드라인은 미국, 유럽, 호주에 비해 내용이 매우 부족함을 확인하였다. 이에 실제 현장에서 동정적사용을 진행 및 책임을 져야하는 임상의와 제약회사측은 많은 제한점과 위험을 부담하며 조기도입프로그램을 진행해야 한다. 이에, 우리나라에서 지원 가능한 조기도입 프로그램의 범위를 확대하고, 동정적사용의 시작 전에 해당 대상 질환과 적합한 환자군 선별기준 및 진행 중에 관리 및 수집해야하는 근거자료 및 환자의 보호 조치에 대한 내용 그리고 종료 시 필요한 자료의 제출과 관리에 대한 내용을 포함하여 가이드라인의 재구성 하며, 독립적인 희귀의약품 전문 위원회를 만들고 이를 통해 확립된 가이드라인을 구축하는 것을 제안하고자 한다.
본 연구를 통해, 우리나라와 해외의 희귀의약품 지정 및 시판 허가, 급여체계와 시판허가 전 동정적 사용에 대해 이해할 수 있었다. 희귀질환의 심각성을 이해하고 희귀의약품의 신속한 도입을 위해 시판허가 전 동정적 사용을 기존 보다 좀 더 일찍 도입 하고, 동정적 사용의 기회를 확대 실시해야할 것이다. 이러한 동정적 사용은 정부와 제약사, 임상의의 적극적인 협업에 의해 활성화 될 수 있을 것이다. 정부는 상대적으로 질환의 정보가 열악한 희귀질환에 대한 정보를 제약사와 공유하고 동정적 사용에 대한 계획을 함께 할 수 있어야 할 것이다.

Pharmaceutical company became proactive and accelerated for research and development of orphan drugs since 1983 when orphan drug act legislated in US, with increasing number of patients with rare disease due to diagnostic technical improvement. However, R&D for high price of orphan drug took a key role for financial burden and increasing national healthcare accounts as government perspective.
This study investigated early access system with compassionate use and relevant policy for orphan drug in order to increase treatment access of orphan drugs. We focused on the system for drug registration, before and after marketing authorization, and compared the early access system with other countries such as EU (UK and French), US and Australia to find the improvement of compassionate use for early access of orphan drug. This study was conducted by theoretical review and in-depth interview with clinicians and employees at pharmaceutical company.
The system and decision for registration and marketing approval (reimbursement) for orphan drug in Korea were dependent by other countries’ decision as Korea is not an orphan drug development country and imported the drugs developed in other countries such as EU and US. Orphan drug is designated by the criteria of each country, disease severity was the common criteria among them. Generally the data of drug efficacy and safety profile is the major decision makers for registration and marketing approval , but orphan drug is limited to provide such data due to small population of patient to lead clinical trials (phase III). The regulatory authority has partly skipped evaluation efficacy and safety. Orphan drug can be approved without pharmaco-economic study result under the healthcare consideration policy with four serious illnesses such as cancer, cardiac health disease, cerebral disease and rare disease in Korea. In US, drug registration and marketing approval can be approved by expert committee in the R&D phase, and EU has the similar process for registration with US but additional data collection for safety profile in post marketing phase is required and put it on re-review process. In Australia, the review process of orphan drug registration by TGA is the same as other drugs, but try to consider treatment access with LSDP which provide drug cost for rare disease. In Korea, we also allow to process the review for orphan drugs designation in the R&D phase, but all process of drug registration and marketing approval can be proceed after decision making from the country where drugs developed. Korea government is keen to refer the decision from other countries where the drug developed, so review timeline takes longer time than other countries. The longer review process and time point can make patients with rare disease die due to no treatment option available in Korea.

US, EU, Australia and Korea have defined compassionate use in each of their guideline including type of program, the contents of guideline, payment and approval (review). Compassionate use in Korea is opened as US one with investigational new drug use for treatment and emergency purpose. Korean guideline has limited information compared to the rest of countries, and describes mostly how to apply the application to MFDS, so executer at pharmaceutical company or clinicians may get confusion how to manage compassionate use properly. This should be very clear for early treatment access for patients with rare disease. Hence this study recommended that compassionate use need to be expanded with some additional types adopting the one from EU or Australia, and redesign with clear guideline including criteria of eligible patient, data collection required during and after program and patients protection. Independent clinical committee for orphan drug can be established to make a guideline for compassionate use.

Patients with rare disease are not only waiting for marketing approval to survive with the only treatment option.
