본 연구는 수사권의 합리적 배분 문제에 대해서 우리나라의 현행 수사구조에 내재한 문제점과 합리적인 수사권 구조를 도출하기 위해 외국사례 등을 비교분석하여 우리 실정에 맞는 바람직한 경·검 간의 수사권 배분을 위해서 경찰 내부를 개혁하는 방안을 모색하는데 그 연구 목적을 두었다.

수사구조의 문제는 국민의 기본권보호와 직결되는 중대한 사안으로 경찰과 검찰 사이에 권한을 주고받는 차원에서 다룰 문제는 아니다. 이제까지는 수사구조에 대한 대부분의 논의가 수사의 효율성 측면에서 경찰과 검찰 사이에 권한을 형식적으로 나누어 균형을 맞춘다는 형태로 논의 되었다면, 본 연구는 국민의 기본권보호 차원에서 우리나라의 수사구조가 어떠한 방향으로 개선되어야 하는가를 모색하였다.
현행 우리나라의 수사구조는 모든 수사권력(공소권 포함)이 검사에게 독점되어 있는 형태다.“절대적인 권력은 절대적으로 부패 한다.”는 영국의 정치학자 액튼(Sir W. Acton)경의 말처럼 수사권도 한 기관에 집중되게 하면 그 기관은 절대 부패할 것이며, 그로 인한 국민들의 인권침해가 계속될 것이다. 이와 같은 현상을 사전에 방지하기 위하여 최소한 수사구조는 견제와 균형, 분권이라는 권력분립의 원칙에 맞게 수사권이 여러 기관에 분산되는 구조가 되어야 할 것이다. 그런데 우리나라의 수사구조는 검사에게 독점적인 수사권을 부여하여 사법경찰을 지휘하는 형식을 취하고 있어 검사가 수사권·공소권을 독점하는 형태로써 경찰의 수사권은 대폭 제한되고 법정에서 증거능력도 갖지 못해 검찰과 경찰 간 중복수사로 인해 국민들은 수사기관에 의한 인권침해와 막대한 시간적, 정신적 피해를 보고 있는 게 현실이다. 이러한 문제를 극복하고 국민의 기본권 보장과 수사의 효율성 및 수사기관의 책임성 확보 차원에서 수사구조는 바람직한 방향으로 개선되어야 한다. 또한 경찰이 일정부분에서 독자적인 수사권을 행사하여 법원의 직접적인 통제를 받는 책임수사구조로 개선되어야 한다.
마지막으로 경찰은 수사권 독립 후 권한 남용을 방지하기 위해서는 경찰 내부 수사시스템뿐만 아니라 경찰행정시스템 전체를 국민이 신뢰할 수 있을 때까지 뼈를 깎는 각오로 개선하여야한다. 그러기 위해서는 경찰이 첨단과학수사의 역량을 확충하고 우수한 수사 인력을 확보하여 전문적이고 책임 있는 수사역량을 강화하는 한편, 수사의 공정성 확보 및 인권보장을 최우선으로 하는 경찰조직으로 거듭나야 할 것이다.

This study, which is about the social issue of the reasonable distribution or adjustment of investigation rights, aimed at seeking the desirable adjustment of investigation rights between the police and the prosecution in accordance with Koran situations and finding out a way for the internal reformation of the police that will be granted independent investigation rights in the future. To this end, the study examined problems of Korea’s current investigation system, presenting a reasonable investigation system, and compared and analyzed Korean investigation system and practical affairs with those of other nations.
The issue of distribution of investigation rights is an important matter directly related to the protection of people's basic rights, but it is not a matter which should be discussed from the perspective of conflicts between the police and the prosecution over investigation rights. So far, most discussions on the investigation system were carried out in a way in which, in the aspect of efficiency, investigation rights were shared between the police and the prosecution, making a balance between both sides. This study, however, discussed how Korea’s investigation system should be changed in order to protect the people’s basic rights.
In Korea’s current investigation system, all investigation rights (including indictment rights) exclusively belong to the prosecution. As British political scientist Sir W. Acton said, “Power tends to corrupt, and absolute power corrupts absolutely,” if any one organization exclusively has investigation rights, the organization will corrupt absolutely, inevitably invading the people’s human rights. In order to prevent this in advance, the investigation system should be changed in a way in which investigation rights should be distributed to several organizations in accordance with the principle of checks and balances and the principle of separation of powers. However in Korea’s investigation system, investigation rights are exclusively granted to the prosecution, apparently letting prosecutors to lead judicial police. As the prosecution exclusively has investigation rights and indictment rights, the police’s investigation rights are largely limited and the police’s investigation documents lose its eligibility as evidence at the dependent’s denial, forcing the police and the prosecution to carry out dual investigations. Therefore, the people’s human rights can be infringed by investigational organizations, and the people are significantly damaged in time and mentality. In order to resolve this problem and to secure the protection of the people’s basic rights, the efficiency of investigation, and the responsibility of investigational organizations, the investigation system should be improved in a more reasonable direction.
Finally, in order to prevent the abuse of investigation rights after the independence of the police’s investigation rights, not only the investigation system of the internal police but also the entire police administration structure should be improved with all the efforts to a degree to gain the people’s trust. For this, the police should further expand its capability of using high-end technologies in investigation and secure excellent manpower for investigation, thus enhancing its capability of conducting a professional and responsible investigation. Furthermore, the police should be innovated in a way in which securing the fairness of investigation and protecting human rights are primarily considered.
