This study is written as an effort to establish counterintelligence(CI) tasks as a main area of national security. The purpose of this study is to suggest policy implication for systematizing the functions of CI and resolving the national security threats by examining CI failure cases in the formation and development of the CI policies of the U.S. FBI. The result of the CI failures is inherently different from that of diplomatic or market failure. Diplomatic or market failure has a chance to overcome afterward, but the CI failure, which is directly linked to national security, has no chance to recover. CI policies, which started under false assumptions, make negative effects on the identity and culture of CI, and eventually lead to various causes of CI failures. This study was conducted in review of cases for eight decades out of 110years of FBI history in light of consistency, persistence and path-dependency. This study focused on three major variables- security environment, CI policy, and CI failure- of three respective historical phases. The first phase(FBI's CI Formation) was set up from 1935, when FBI was established, to the death of FBI Director Edgar Hoover. In this phase, Hoover's long-established law enforcement culture has become an FBI's organizational culture and identity. The second phase(FBI's CI Recession) was set up from Hoover's death to the 9/11 terrorist attacks. The government and Congress have banned FBI's domestic intelligence activities to prevent FBI's abuse of power and minimize violations of civil rights. As a result, CI function has been shrinking for nearly 30 years. The third phase(FBI's CI Reformation) was set up from the 9/11 attacks to the passage of the Freedom of 2015. The U.S. has enacted the Patriot Act of 2001 after 9/11 and the Intelligence Reform Act of 2004(IRTPA), and improved the Intelligence Community System, and increased the budget and personnel. U.S. homeland security, however, has still been not free from New Terrorism. The motivation for spying against the U.S. was mostly ideology in the 1940s and in the early 1950s. It was, however, money from the mid-1950s to the 9/11 Attacks. There were also a few who betrayed the U.S. with disgruntlement and altruism. After 9/11, the spy aspect was characterized by illegal agents and insider threats. The FBI has experienced three times the politicization of CI in history: the First Red Scare(Labor Revolution, Anarchism), the Second Red Scare(communist's infiltration in the U.S. federal government), and COINTELPRO(socialist and anti-government movements). In response to these challenges, the FBI had been accused of violating civil liberties and abusing power. To avoid criticism from Congress and the media, the Attorney General's Guideline(1976) and the Carter's Executive Order(1978) banned the FBI's domestic intelligence activities. These policies caused the absence of domestic intelligence, and eventually spawned many spies in the 1980s and 1990s. The intelligence function is incompatible with the law enforcement function. The reason is that the former collects information and neutralizes the adversaries, while the latter collects criminal evidence and takes legal action. Since 9/11, there has been discussed about the operating agency of domestic intelligence function, but it is still recognized as an auxiliary means of law enforcement, according to political convenience rather than rationality. In December 2004, Congress passed IRTPA and created the new position of the DNI. In addition, the term ‘National Intelligence’was defined as “all information regardless of the source, including information gathered within and outside the United States.”Despite this efforts to take various steps for information reform, insider threats and Lone Wolves have been constantly occurring in America. It is the wide evidence that CI reforms are by no means perfect. In conclusion, this study suggests some policy implications for minimizing CI failures. First, decision makers(legislative, executive, and judiciary) should decide a reasonable balance point of “National Security vs Civil Liberties”prior to a policy decision. Second, the policy of CI, which was enacted under poor assumptions, produces poor results. Third, CI agency should take strict precautions against the politicization of CI and protect Civil Liberties. Fourth, the absence of domestic intelligence provide an important cause of CI failures. Finally, public relations activities are essential to gain national trust and support.
