우리 사회는 지식정보사회를 넘어 인공지능과 인터넷이 연결된 제4차 산업혁명을 향해가고 있다. 최종적으로는 제4차 산업혁명을 넘어 인공지능 기반의 초지능혁명으로 융합과 초연결사회로 전환된다. 이러한 초연결사회는 빅데이터와 인공지능의 연계 그리고 데이터 마이닝을 통한 기계학습 등이 매우 중요한 위치에 놓이게 된다. 더욱이 빅데이터는 제4차 산업혁명과 초연결사회에서 주요한 자원이다. 이러한 빅데이터는 형태에 따라 정형데이터와 비정형데이터가 있다. 최근 빅데이터 분석은 전통적인 정형데이터보다는 비정형데이터가 더 중요하며, 그 활용도도 높아졌다. 데이터 수집의 주체로서는 국가와 민간으로 나누어 살펴볼 수 있다. 또한 빅데이터 관련 법률로는 국내는 공공데이터의 제공 및 이용활성에 관한 법률과 국외는 유럽연합의 일반 데이터 보호 규칙을 중심으로 고찰하였다. 따라서 빅데이터 분석을 위한 데이터 마이닝을 함에 있어서 정형데이터에서는 개인정보보호쟁점과 비정형데이터에서는 지식재산권 쟁점이 발생한다. 더욱이 지식재산권쟁점으로는 저작권법상 데이터 마이닝의 허용여부와 인공지능의 저작자해당여부 및 인공지능의 작성물에 대한 저작물해당여부 그리고 인공지능의 데이터베이스제작자여부 등을 중심으로 고찰하였으며, 특허법상으로는 인공지능의 발명자성 등을 고찰하였다. 또한 비정형데이터인 저작물에 대한 저작재산권은 개인의 재산권에 해당된다. 따라서 데이터 마이닝을 저작재산권제한사유로 규정하더라도 재산권침해에 대한 이슈는 여전히 남아 있다. 이를 해결하기 위하여 본 논문에서는 보상금제도에 대한 입법론을 통한 해결방안을 제시하고 있다. 이외에도 수집데이터로서 인공지능의 작성물을 활용한 경우에 인공지능의 법적 지위에 대하여 인공지능의 저작자해당여부 및 발명자성 등을 중심으로 고찰하였다. 또한 인공지능의 작성물에 대한 저작권법상의 보호방향을 제시하였다.

Our Society is heading beyond the Knowledge Information Society to the stage for the fourth industrial revolution, which is highly connected with Artificial Intelligence and the IoT. Ultimately, our society will surpass the fourth industrial revolution and move on to super-intelligence integration based on the artificial intelligence and hyper-connected society. As big data and artificial intelligence are closely connected, machine learning by data mining will play a pivotal role in the hyper-connected society. Moreover, big data are major resource in the Fourth Industrial Revolution and the hyper-connected society. The big data can be divided into structured data and unstructured data. According to a recent analysis, unstructured data are more important than structured data, and the utilization of the unstructured data are more than the structured data. The subjects collecting data might be divided into government and individuals. This Article explores the Act on Promotion of The Provision and use of Public Data domestically and General Data Protection Regulation internationally. Hence, the data mining for big data analysis results in intellectual property issues in terms of unstructured data and issues on the protection of personal information in terms of structured data. In addition, under the Copyright Act, this Article analyzes whether or not data mining is permitted, whether or not the artificial intelligence can become an author, whether or not creation by artificial intelligence can be considered as a copyrighted work and whether or not the artificial intelligence is regarded as a database producer. Moreover, under the Patent Act, this Article examines whether or not artificial intelligence can become an inventor. Furthermore, the economic rights of an author on the copyrighted work, which are unstructured data, constitute his/her property. Therefore, even if data mining falls under the limitation to protection of economic rights, the issue of infringement of his/her property rights still remains. In order to solve the issue, the Article proposes the legislation of a remuneration system. In addition, the Article examines the legal status of artificial intelligence, focusing on whether artificial intelligence can be regarded as an inventor or an author in a case in which artificial intelligence‘s creations are utilized. The Article proposes how to amend the Korean copyright law in connection with the protection of the artificial intelligence's works.
