A study on improving the damages system of public construction bid collusion : focusing on calculating the damages원문보기

Bid-collusion damage suits for public construction works has increased compared to the past, but they are still not active compared to the imposition of penalties, which are administrative sanctions by the Fair Trade Commission. This is because it is relatively difficult for public institutions, which are victims of public construction bid collusion, to prove the specific amount of damage caused by bid collusion in damages litigation. The plaintiff, who is the victim of the bid collusion, applies for an appraisal to prove the specific amount of damage caused by the settlement, and the court mainly selects an economist as an appraiser for the calculation of the amount of damage. In comparison, it is necessary to calculate the amount of damage in consideration of multiple factors. In the bid collusion litigation of public construction works, most of the damages are calculated using econometric analysis, but there may be cases where the results of the analysis are not objectively reflecting actual damages, so that the actual damages are excessive or underestimated. Therefore, this study first examines the general matters of the bid-collusion system and the bid-collusion damage compensation system for public construction works, and theoretically and empirically on the methodology for calculating various bid-collusion damages. In addition, it examines the problems of the methodology for calculating damages in relation to bid collusion, the punitive damages compensation system introduced in the recent Fair Trade Act, and the proposed system for compensation for damages introduced in relation to bid answering for public construction works. The problems of the domestic bid-collusion damage compensation system and improvement plans are presented through comparative legal consideration. Subsequently, through the analysis of precedents and actual appraisal cases related to the bid-collusion damage suit for public construction works, the institutional problems of the bid-collusion damages suit, the problem of the evaluation method, and the problems of the court's procedural control were analyzed. Reflecting the characteristics of the public construction work, it is intended to present a reasonable and scientific method for assessing the amount of damage in line with the actual amount of damage. Lastly, as a procedural improvement plan for calculating damages, the system for collecting data related to the assessment, control of the courts for the assessment process, a plan for direct and indirect participation of experts in the calculation of damages in the assessment process and litigation, and improvement of the government bidding information system It proposes a method of rationalizing the calculation of the amount of damage through the company and promptly closing the lawsuit through a settlement settlement decision.
