한국노동시장은 1997년 경제위기 이후 지난 20년간 중요한 구조적 변화를 겪어왔다. 구체적으로 노동시장 유연화가 강조됨에 따라 위기 직후 정리해고, 근로자파견이 허용되었고 기존에 주류를 이루던 연공급제를 대신하여 연봉제가 널리 확산되었다. 이러한 일련의 노동시장유연화는 기업의 인건비를 줄여 경영합리화에 기여하기도 했으나, 한국노동시장에서 기간제, 단시간, 파견, 사내하도급과 같은 비정규직의 비중을 증가시켜 노동시장 양극화에 관한 논쟁을 불러일으켰다. 비정규직의 개념에 대해서는 국제적으로 통일된 기준이 없으나, 일반적으로 정규직에 비해 그 근로조건이 상대적으로 열악한 것으로 알려져 있다. 따라서 국가별로 비정규직에 대한 다양한 고용보호법제를 시행하고 있으며, 비정규직 근로조건 개선에 관한 노동조합의 적극적인 역할 또한 요구되고 있는 상황이다. 한국의 경우 2007년 비정규직보호법이 입법화된 이래로 법 개정을 통해 지속적으로 강화되고 있으며, 노동조합들도 연합단체를 중심으로 비정규직 근로조건 개선에 관심을 가지고 있다. 한편, 이러한 법, 제도적 조치에도 불구하고 한국노동시장에서 비정규직의 비율이 여전히 높은 이유에 대한 연구도 비정규직 활용의 효과분석을 중심으로 진행되고 있다. 이러한 배경을 바탕으로 본 논문은 한국노동시장에서의 비정규직의 개념과 현황을 살펴본 후, 그 경제학적 특징을 노사관계, 기업의 선호, 법 제도라는 세 가지 관점에서 실증분석 하였다. 제2장에서는 OECD, ILO 및 외국의 비정규직 개념과 2002년 노사정위원회에서 결정된 비정규직의 8가지 유형에 대해 살펴보고, 유형별, 성별, 연령별, 산업별, 업종별로 비정규직 비율, 임금수준, 노사관계 현황, 국제비교를 제시하였다. 그리고 한국의 고용보호법제의 수준을 OECD지표와의 비교를 통해 통하여 살펴보았으며, 비정규직에 관한 다양한 주제의 선행연구들을 검토하였다. 구체적으로 노동측면에서는 개별 근로자의 비정규직 선택 요인, 산업재해를 다룬 선행연구를, 기업선호측면에서는 기업의 비정규직 고용동기, 비정규직에 대한 인사관리에 관한 선행연구를 검토하였다. 더불어 한국의 대표적인 고용보호입법인 비정규보호법의 효과를 검토하는데 요구되는 한국의 노동시장 유연화 및 고용보호와 관련된 입법연혁을 간략히 살펴보았다. 제3장에서는 노동조합이 정규직과 비정규직 간의 임금격차를 줄이는지 여부를 무조건부 분위회귀를 활용한 RIF-OB 등 임금분해를 통하여 살펴보았다. 분석방법으로서 임금분해가 사용된 이유는 다음과 같다. 만약 고용형태별 임금격차가 생산성 차이로 인해 발생된 것이라면 이러한 임금격차는 차별이 아니며 인적자본량에 따른 차이일 뿐인 반면 임금격차가 생산성과 무관하게 오로지 고용형태가 비정규직이기 때문에 발생된 것이라면 이는 차별에 해당하며 개선되어야 할 사항이다. 따라서 우리는 임금분해를 통하여 임금격차를 이러한 차이적 부분과 차별적 부분으로 분해한 후, 노동조합이 차별적 임금격차를 줄이는지를 분석하였으며, 무조건부 분위회귀를 적용하여 평균적인 수준에서의 임금격차 뿐 만이 아니라 무조건부 임금분위별 격차 역시 살펴보았다. 분석결과, 대다수의 임금분위에서 노동조합이 조직된 사업장에서 오히려 고용형태에 따른 차별적 임금의 비율이 더 큰 것으로 나타났다. 이는 노동조합이 이러한 임금차별을 확대하거나 최소한 생산성과 무관한 임금격차해소에 영향을 미치지 못한다는 것을 의미한다. 일반적으로 임금균등화기능을 가진다고 알려진 노동조합이 오히려 고용형태에 따른 차별적 임금격차를 오히려 확대시킨 이유는 무엇인가? 첫째, 제조업과는 달리 노동수요의 임금탄력성이 큰 서비스업에서의 고용이 확대되면서 노동조합의 협상력이 상대적으로 약화되었다. 둘째, 노동조합의 조직률이 낮은 서비스 산업에서의 노동공급이 증가하면서 파급효과로 인해 비정규직의 임금이 감소하게 되었다. 셋째, 비정규직 이용에 대한 사용자와 노조의 이해관계를 들 수 있다. 즉 1997년 위기 직후 대량 정리해고를 겪은 바 있는 노동조합은 조합원의 고용유지에 지대한 관심을 가질 수 있다는 점에서 비정규직의 낮은 근로조건을 묵인하는 대신 정규직 조합원의 고용보장이나 임금상승을 약속 받을 가능성이 있다. 넷째, 단체협약을 통해 고용형태에 따른 임금격차를 완화시킬 비정규직 노동조합 조직률이 낮은 것 또한 중요한 이유가 된다. 제4장에서는 정부의 법제도적 규제에도 불구하고 한국노동시장에서 비정규직의 비중이 여전히 높은 이유를 인사관리자의 노동생산성에 대한 주관적 인식이라는 비경제적 사유를 중심으로 검토한다. 다수의 선행연구들은 경제적 사유에 주목하여 비정규직의 활용이 노동생산성, 매출액, 인건비 등에 미치는 영향을 분석하여 왔다. 그러나 내부노동시장이 강한 특징이 있는 한국에서 비정규직 증가 이유로서 경제적 사유 뿐 만 아니라 조직규범·인식·관행과 같은 비경제적 사유를 함께 고려할 필요가 있다. 따라서 본 연구는 1997년 경제위기 이후 기업조직 내에 확산된 비정규직 고용형태로 인해 성립된 내부노동시장의 인식, 관습이나 규범이 기업의 성과인식에 긍정적인 영향을 미쳤기 때문에 비정규직을 지속적으로 선호한다는 가설을 제시한다. 다시 말해, 비정규직 근로자의 활용이 기업의 재무적 성과에 긍정적인 영향을 미쳤다면 그 기업의 비정규직 활용도가 증가할 것으로 예상할 수 있는 것처럼, 비정규직 활용의 확대·일상화에 따른 내부노동시장의 가치관, 사회적 인식으로 인사관리담당자의 생산성에 대한 인식이 긍정적으로 형성되었다면 비정규직 고용규모가 일정수준 이상 유지되리라 예상할 수 있는 것이다. 가설의 검증을 위해 본 연구는 비정규직 비중이 인사관리자의 주관적 노동생산성 인식에 미치는 영향을 선행연구들이 제시한 여러 방법론을 활용하여 실증적으로 분석하였다. 분석결과, ...

한국노동시장은 1997년 경제위기 이후 지난 20년간 중요한 구조적 변화를 겪어왔다. 구체적으로 노동시장 유연화가 강조됨에 따라 위기 직후 정리해고, 근로자파견이 허용되었고 기존에 주류를 이루던 연공급제를 대신하여 연봉제가 널리 확산되었다. 이러한 일련의 노동시장유연화는 기업의 인건비를 줄여 경영합리화에 기여하기도 했으나, 한국노동시장에서 기간제, 단시간, 파견, 사내하도급과 같은 비정규직의 비중을 증가시켜 노동시장 양극화에 관한 논쟁을 불러일으켰다. 비정규직의 개념에 대해서는 국제적으로 통일된 기준이 없으나, 일반적으로 정규직에 비해 그 근로조건이 상대적으로 열악한 것으로 알려져 있다. 따라서 국가별로 비정규직에 대한 다양한 고용보호법제를 시행하고 있으며, 비정규직 근로조건 개선에 관한 노동조합의 적극적인 역할 또한 요구되고 있는 상황이다. 한국의 경우 2007년 비정규직보호법이 입법화된 이래로 법 개정을 통해 지속적으로 강화되고 있으며, 노동조합들도 연합단체를 중심으로 비정규직 근로조건 개선에 관심을 가지고 있다. 한편, 이러한 법, 제도적 조치에도 불구하고 한국노동시장에서 비정규직의 비율이 여전히 높은 이유에 대한 연구도 비정규직 활용의 효과분석을 중심으로 진행되고 있다. 이러한 배경을 바탕으로 본 논문은 한국노동시장에서의 비정규직의 개념과 현황을 살펴본 후, 그 경제학적 특징을 노사관계, 기업의 선호, 법 제도라는 세 가지 관점에서 실증분석 하였다. 제2장에서는 OECD, ILO 및 외국의 비정규직 개념과 2002년 노사정위원회에서 결정된 비정규직의 8가지 유형에 대해 살펴보고, 유형별, 성별, 연령별, 산업별, 업종별로 비정규직 비율, 임금수준, 노사관계 현황, 국제비교를 제시하였다. 그리고 한국의 고용보호법제의 수준을 OECD지표와의 비교를 통해 통하여 살펴보았으며, 비정규직에 관한 다양한 주제의 선행연구들을 검토하였다. 구체적으로 노동측면에서는 개별 근로자의 비정규직 선택 요인, 산업재해를 다룬 선행연구를, 기업선호측면에서는 기업의 비정규직 고용동기, 비정규직에 대한 인사관리에 관한 선행연구를 검토하였다. 더불어 한국의 대표적인 고용보호입법인 비정규보호법의 효과를 검토하는데 요구되는 한국의 노동시장 유연화 및 고용보호와 관련된 입법연혁을 간략히 살펴보았다. 제3장에서는 노동조합이 정규직과 비정규직 간의 임금격차를 줄이는지 여부를 무조건부 분위회귀를 활용한 RIF-OB 등 임금분해를 통하여 살펴보았다. 분석방법으로서 임금분해가 사용된 이유는 다음과 같다. 만약 고용형태별 임금격차가 생산성 차이로 인해 발생된 것이라면 이러한 임금격차는 차별이 아니며 인적자본량에 따른 차이일 뿐인 반면 임금격차가 생산성과 무관하게 오로지 고용형태가 비정규직이기 때문에 발생된 것이라면 이는 차별에 해당하며 개선되어야 할 사항이다. 따라서 우리는 임금분해를 통하여 임금격차를 이러한 차이적 부분과 차별적 부분으로 분해한 후, 노동조합이 차별적 임금격차를 줄이는지를 분석하였으며, 무조건부 분위회귀를 적용하여 평균적인 수준에서의 임금격차 뿐 만이 아니라 무조건부 임금분위별 격차 역시 살펴보았다. 분석결과, 대다수의 임금분위에서 노동조합이 조직된 사업장에서 오히려 고용형태에 따른 차별적 임금의 비율이 더 큰 것으로 나타났다. 이는 노동조합이 이러한 임금차별을 확대하거나 최소한 생산성과 무관한 임금격차해소에 영향을 미치지 못한다는 것을 의미한다. 일반적으로 임금균등화기능을 가진다고 알려진 노동조합이 오히려 고용형태에 따른 차별적 임금격차를 오히려 확대시킨 이유는 무엇인가? 첫째, 제조업과는 달리 노동수요의 임금탄력성이 큰 서비스업에서의 고용이 확대되면서 노동조합의 협상력이 상대적으로 약화되었다. 둘째, 노동조합의 조직률이 낮은 서비스 산업에서의 노동공급이 증가하면서 파급효과로 인해 비정규직의 임금이 감소하게 되었다. 셋째, 비정규직 이용에 대한 사용자와 노조의 이해관계를 들 수 있다. 즉 1997년 위기 직후 대량 정리해고를 겪은 바 있는 노동조합은 조합원의 고용유지에 지대한 관심을 가질 수 있다는 점에서 비정규직의 낮은 근로조건을 묵인하는 대신 정규직 조합원의 고용보장이나 임금상승을 약속 받을 가능성이 있다. 넷째, 단체협약을 통해 고용형태에 따른 임금격차를 완화시킬 비정규직 노동조합 조직률이 낮은 것 또한 중요한 이유가 된다. 제4장에서는 정부의 법제도적 규제에도 불구하고 한국노동시장에서 비정규직의 비중이 여전히 높은 이유를 인사관리자의 노동생산성에 대한 주관적 인식이라는 비경제적 사유를 중심으로 검토한다. 다수의 선행연구들은 경제적 사유에 주목하여 비정규직의 활용이 노동생산성, 매출액, 인건비 등에 미치는 영향을 분석하여 왔다. 그러나 내부노동시장이 강한 특징이 있는 한국에서 비정규직 증가 이유로서 경제적 사유 뿐 만 아니라 조직규범·인식·관행과 같은 비경제적 사유를 함께 고려할 필요가 있다. 따라서 본 연구는 1997년 경제위기 이후 기업조직 내에 확산된 비정규직 고용형태로 인해 성립된 내부노동시장의 인식, 관습이나 규범이 기업의 성과인식에 긍정적인 영향을 미쳤기 때문에 비정규직을 지속적으로 선호한다는 가설을 제시한다. 다시 말해, 비정규직 근로자의 활용이 기업의 재무적 성과에 긍정적인 영향을 미쳤다면 그 기업의 비정규직 활용도가 증가할 것으로 예상할 수 있는 것처럼, 비정규직 활용의 확대·일상화에 따른 내부노동시장의 가치관, 사회적 인식으로 인사관리담당자의 생산성에 대한 인식이 긍정적으로 형성되었다면 비정규직 고용규모가 일정수준 이상 유지되리라 예상할 수 있는 것이다. 가설의 검증을 위해 본 연구는 비정규직 비중이 인사관리자의 주관적 노동생산성 인식에 미치는 영향을 선행연구들이 제시한 여러 방법론을 활용하여 실증적으로 분석하였다. 분석결과, 종속변수가 서수적 이산변수인 점을 감안하여 활용된 패널 순서형 프로빗 모형을 포함한 모든 기수적 또는 서수적 모형에서 사업장의 비정규직 구성비율이 높을수록 인사관리자는 노동생산성에 대한 긍정적인 인식을 가진다는 결과를 보여 본 연구가 제시한 가설이 어느 정도 타당함을 확인되었다. 이는 비정규직법상 차별금지, 정규직전환 등 정부의 규제만으로는 한국의 비정규직 문제를 해결하는데 한계가 있으며, 따라서 비정규직을 선호하도록 하는 한국기업의 내부노동시장 구조, 인식, 관행을 변화시키는 방안을 포함한 종합적인 대책이 필요하다는 정책적 함의를 제시한다. 제5장에서는 한국의 대표적인 고용보호법제인 비정규직보호법이 다양한 유형의 복리후생 지급률에 미치는 영향을 이중차분법(DID)과 선택편의를 제거하는 데 유용한 성향점수매칭(PSM)을 결합하여 분석하였다. 우선 표준 이중차분법 결과를 유의한 회귀결과를 중심으로 살펴보면, 비정규직보호법은 법정 및 비법정 복리후생에 부정적인 영향을 미치는 반면 경영참가 복리후생에는 긍정적인 영향을 미치는 것으로 나타났다. 그러나 표준 이중차분법은 법의 적용대상이 비정규직 근로자라는 특정집단이라는 점에서 처리에 대한 배정이 무작위적이지 않다는 한계를 가진다. 따라서 본 연구는 처리 집단인 비정규직과 가장 유사한 비교집단을 구성하기 위한 반사실적 분석기법인 성향점수매칭을 이중차분법에 결합시켰다. 분석결과, 비정규직보호법은 대부분의 법정 및 비법정 복리후생의 지급률에 부정적인 영향을 미친 것으로 나타났다. 한편 이러한 효과는 시계열적으로 2010년보다 2014년과 2018년에 더 큰 것으로 관찰되는데, 이는 복리후생을 차별금지대상으로 명확화 한 2013년 법 개정에 의한 것으로 보여진다. 반면, 경영참가 복리후생에 대한 추정결과는 통계적으로 유의하지 않는데 이는 법 시행이 노동조합이나 근로자의 경영참가에 영향을 미치지 않음을 의미한다. 비정규직보호법이 복리후생지급에 부정적인 영향을 미치는 이유는 다음과 같다. 우선 직접적 경로로서 사용자가 비용절감을 위해 근로기준법 등의 예외사유를 활용하여 법정 복리후생을 감소시키거나 임의로 지급여부를 결정할 수 있는 비법정 복리후생을 축소시킬 가능성이 있다. 간접적 경로로는 법 시행으로 기업이 고용을 줄이거나 노동관계법의 적용 대상이 아닌 비정규직 유형으로 근로형태를 전환하여 복리후생이 축소될 가능성이 제기되며, 사내제도로 구현되는 복리후생의 특성을 고려할 때 노동조합조직률이 현저히 낮은 한국에서는 기업의 이러한 복리후생축소를 저지할 집단적 영향력이 크지 않을 것으로 예상된다. 한편 시간적 경로로서 복리후생을 차별금지대상에 포함시킨 2013년 비정규직보호법 개정이 복리후생지급률에 부정적인 영향을 미친 것으로 보여 진다. 본 연구는 한정된 비정규직 관련 선행연구들을 감안할 때 경제학적 관점에서 한국의 비정규직 노동시장에 관한 실증적 증거와 유용한 함의를 제공한다는데 그 의의가 있다. 오늘날 비정규직은 산업, 업종, 기업규모에 관계없이 광범위하게 활용되고 있으며, 정부는 비정규직의 정규직 전환 의무화와 정규직 전환 보조금 등 다양한 제도를 시행하고 있다. 따라서 향후로도 비정규직 노동시장의 구조와 관련된 노사관계, 기업행태, 정부정책에 관한 심도 있는 연구가 지속되어야 할 것이다.

The Korean labor market has experienced significant structural changes during the past 20 years since the 1997 Asian financial crisis. Specifically, since the crisis, the labor market's flexibility has been emphasized, causing the legalization of layoff and dispatched employment and the proliferation of an annual salary system in place of the seniority-based system that was once in the mainstream. Such changes in relation to labor market flexibility have contributed to the rationalization of management through a reduction in enterprises' labor costs but have raised the controversy over the polarization of the labor market through an increase in the proportion of irregular forms of employment, such as temporary, part-time, dispatched, and subcontract workers. No international standard guides irregular forms of employment. In general, the employment conditions for such workers are poor relative to that of regular workers. Therefore, employment protection legislation (EPL) for irregular workers has been implemented in many countries, and trade unions need to play an active role in improving their working conditions. In Korea, since its enactment in 2007, the Irregular Worker Protection Law has been continuously strengthened through amendments, and the federation of trade unions has also expressed interest in improving irregular workers' working conditions. Meanwhile, studies on why the proportion of irregular forms of employment in the Korean labor market remains high despite stricter legal and regulatory oversight have been conducted mainly by analyzing the effects of utilizing irregular workers. Given this background, this dissertation examines the concept and presents the conditions of irregular workers in the Korean labor market. Such workers' economic characteristics are empirically analyzed from the three viewpoints of labor relations, enterprise preference, and EPL. In Chapter 2, we describe the concept of the irregular worker in OECD, International Labor Organization (ILO), and overseas countries and the eight types of irregular employment forms agreed on in 2002 by the Korea Tripartite Commission for labor, management, and government. We present irregular workers' wage levels, current industrial relations situation, international comparisons, and proportions by type, gender, age-specific groups, industries, and occupations. We then examine the degree of EPL in Korea by comparing OECD indicators and analyzing previous studies on various topics related to irregular workers in the Korean labor market. Concretely, in terms of labor supply, previous research that addressed the selection factors related to irregular forms of employment of individual workers and industrial accidents are reviewed. Meanwhile, regarding labor demand, we review previous studies on the effect of enterprises' employment motivation and personnel management on irregular workers. In addition, we briefly review the history of legislation in Korea related to labor market flexibility and required employment protection to determine the effect of the Irregular Worker Protection Law. In Chapter 3, we analyze whether trade unions reduce wage discrimination between regular and irregular workers through wage decompositions, such as RIF-OB, which utilizes unconditional quantile regression (UQR). The reason for using wage decomposition as the method of analysis is as follows. If wage disparity by employment form is attributable to differences in productivity, such a disparity is not discrimination but a difference resulting from human capital. In contrast, if wage disparity by employment form is irrelevant to differences in productivity, this disparity represents discrimination. The objective of this chapter can be achieved by using the wage decomposition method, which applies this reasoning. Concretely, we provide an analysis of whether trade unions reduce wage discrimination between regular and irregular workers through RIF-OB, which utilizes UQR. The result of the analysis shows that, in most wage percentiles, the proportion of discriminatory wages among employment forms is greater at the workplace at which a trade union is organized. Therefore, trade unions worsen wage discrimination by employment form or, at least, cannot affect the reduction in wage disparity that is unrelated to productivity. Although trade unions are generally known to have the function of equalizing wages, then why do trade unions expand discriminatory wage disparity by employment form? First, unlike in the manufacturing industry, employment in the service industry, with high wage elasticity of labor demand, has expanded, and the trade unions' bargaining power has relatively weakened. Second, irregular workers' wages decreased because of the spillover effect caused by an increase in labor supply in service industries with a low organizational rate. Third, the interests of employers and trade unions in irregular worker utilization are closely related. Immediately after the 1997 Asian financial crisis, trade unions that experienced significant dismissals developed a strong interest in maintaining employment for their members. Therefore, instead of tolerating low working conditions for irregular workers, they are likely to promise employment guarantees or wage increases for union members, most of whom are regular workers. Fourth, another important reason is that the irregular worker's organizational rate—which can alleviate wage disparity resulting from employment forms through collective agreements—is low. Chapter 4 examines the reason the proportion of irregular workers is still high in the Korean labor market, despite various government regulations, by focusing on personnel managers' subjective perceptions of labor productivity, which is a non-economic reason. Many previous studies that focused on economic reasons analyzed the effect of irregular employment on labor productivity, turnover, labor costs, and so on. However, when analyzing the reason for the increase in irregular workers in Korea—which still has a strong internal labor market—considering not only economic reasons but also non-economic reasons, such as organizational norms, perceptions, and practices, is necessary. Therefore, this study proposes the hypothesis that the perceptions, customs, and norms in the internal labor market formed by irregular employment and that spread throughout the organization after the 1997 crisis have a positive effect on enterprises' perception of performance. In other words, if the perception of personnel managers' productivity is positively shaped by the values and social perceptions of the internal labor market formed through the expansion and routine utilization of irregular workers, the scale of irregular employment is expected to be maintained in the firm at higher than a certain level. To test this hypothesis, this study uses various methodologies suggested by previous studies to empirically analyze the influence of the change in the irregular worker rate (IRR) on the perception of subjective labor productivity, along with control variables. As a result of the analysis, in all of the cardinal or ordinal models, including the panel ordered probit model that considers the ordinal discrete dependent variable, a higher proportion of irregular workers in the workplace make it more likely that human resource (HR) managers positively recognize labor productivity. This result shows that the hypothesis presented in this study is valid. Therefore, government regulations, such as no discrimination under the Irregular Worker Protection Law and the employment form transition to regular workers in the public sector, have limitations when attempting to solve the regular worker problem. Thus, a comprehensive policy alternative is needed that includes ways to change the structure, perceptions, and practices of internal Korean labor markets that encourage irregular employment. Chapter 5 analyzed the effect of the Irregular Worker Protection Law—which is the representative EPL of Korea—on the payment rate of various types of welfare benefits. Specifically, proposals from the literature were adopted, and the difference-in-difference (DID) method was utilized, which is useful for analyzing the introductory effect of institutions or laws, combined with propensity score matching (PSM), which is mainly utilized to eliminate a self-selection bias from a causal analysis. The results of a standard DID analysis show that law enforcement has a negative effect on statutory and non-statutory benefits and a positive effect on management participation benefits. However, because the subject of the application of the law is a particular group called the irregular employment form, it is impossible to be randomly assigned to participate in treatment. Therefore, in this study, PSM, which is a counterfactual method for constructing a comparison group that is most similar to the treatment group, is combined with DID. The results show that the law has a negative impact on the payment rate of most statutory and non-statutory benefits. These effects are observed to be greater in 2014 and 2018 than in 2010. In contrast, estimates of management participation benefits are not statistically significant, indicating that law enforcement does not affect the management participation of trade unions or employees. The Irregular Worker Protection Law has a negative effect on welfare benefits payments for the following reasons. As a direct route to reducing labor costs, employers can reduce statutory benefits by applying exception rules of the Labor Standards Act. Alternatively, employers can decrease non-statutory benefits by deciding to pay voluntarily. As an indirect route, in response to enforcement of the law, employers could decrease welfare benefit expenditures by reducing employment or switching to irregular employment forms that are not subject to labor laws. Moreover, considering the feature of welfare benefits implemented as an in-house system, the collective impact of employees in Korea—with a significantly low organization rate—that can discourage employers from reducing welfare benefits is not significant. Meanwhile, in the time series, the 2013 revision to the law that clarified welfare benefits as the object of discrimination prohibition seems to strengthen the negative impact on welfare benefits payments. In relation to irregular worker problems, from an economic perspective, this dissertation is meaningful in that it provides empirical evidence and useful implications considering the limited research on Korea's irregular worker labor market. Today, the irregular worker is employed extensively regardless of industry, occupation, or enterprise scale. In addition, the government implements various schemes, such as public sector employment for transition and regular worker conversion subsidies. Therefore, research on the structure of the irregular worker labor market in terms of industrial relations, corporate behavior, and government policy should continue in the future.

The results of a standard DID analysis show that law enforcement has a negative effect on statutory and non-statutory benefits and a positive effect on management participation benefits. However, because the subject of the application of the law is a particular group called the irregular employment form, it is impossible to be randomly assigned to participate in treatment. Therefore, in this study, PSM, which is a counterfactual method for constructing a comparison group that is most similar to the treatment group, is combined with DID. In contrast, estimates of management participation benefits are not statistically significant, indicating that law enforcement does not affect the management participation of trade unions or employees. The Irregular Worker Protection Law has a negative effect on welfare benefits payments for the following reasons. As a direct route to reducing labor costs, employers can reduce statutory benefits by applying exception rules of the Labor Standards Act. Alternatively, employers can decrease non-statutory benefits by deciding to pay voluntarily. As an indirect route, in response to enforcement of the law, employers could decrease welfare benefit expenditures by reducing employment or switching to irregular employment forms that are not subject to labor laws. Moreover, considering the feature of welfare benefits implemented as an in-house system, the collective impact of employees in Korea—with a significantly low organization rate—that can discourage employers from reducing welfare benefits is not significant. Meanwhile, in the time series, the 2013 revision to the law that clarified welfare benefits as the object of discrimination prohibition seems to strengthen the negative impact on welfare benefits payments. In relation to irregular worker problems, from an economic perspective, this dissertation is meaningful in that it provides empirical evidence and useful implications considering the limited research on Korea's irregular worker labor market. Today, the irregular worker is employed extensively regardless of industry, occupation, or enterprise scale. In addition, the government implements various schemes, such as public sector employment for transition and regular worker conversion subsidies. Therefore, research on the structure of the irregular worker labor market in terms of industrial relations, corporate behavior, and government policy should continue in the future.
