본 연구의 목적은 발달장애인 공공후견지원 사업과 사업 참여 주체들의 경험을 심층적으로 파악함으로써 발달장애인 공공후견지원 사업(이하 공공후견지원 사업이라 함)의 실제를 이해하는 것이다. 본 연구는 ‘발달장애인 공공후견지원 사업은 어떻게 운영되고 있으며, 사업 참여 주체들은 어떠한 경험을 하고 있는가?’라는 연구 질문을 바탕으로 Stake(1995/2000)가 제시한 질적 사례연구 방법을 적용하여 수행하였다. 본 연구에서는 독특성과 공통성을 포함한 경계를 지닌 사례로 ‘서울시를 중심으로 한 발달장애인 공공후견지원 사업’을 선정하였다. 질적 사례연구는 사례의 내용을 이해하기 위해 다양한 정보원을 활용하여 자료를 수집하는데 본 연구에서는 문서고찰, 심층인터뷰, 초점집단인터뷰 등을 활용하여 자료를 수집하였다. 문서고찰은 공공후견지원 사업과 관련된 문헌과 자료, 보고서, 기사 등을 통해 자료를 수집하였다. 공공후견지원 사업의 참여 주체는 다양하다. 그중 주요한 참여 주체인 피후견인과 후견인의 후견지원 과정과 경험을 사실적으로 파악하기 위해서 심층인터뷰를 실시하였다. 또한 공공후견지원 사업을 연계하여 진행하는 기관들의 업무에 대한 통찰력을 얻고 참여자들의 다양한 의견을 수렴하기 위해 후견감독인, 발달장애인지원센터와 공공후견 법인, 서울시 발달장애인 공공후견제도 지원사업의 실무자를 대상으로 초점집단인터뷰를 실시하였다. 수집된 자료는 Stake(1995/2000)가 제시한 범주의 합산, 직접해석, 유형의 성립, 자연적 일반화의 방법을 통해 분석하였고 6개의 대범주와 24개의 소범주가 도출되었다. 주요 연구결과를 요약하면 다음과 같다. 첫째, 발달장애인들은 위태로운 상황 속에서 후견인과 연결되고, 후견인들은 발달장애인에 대한 익숙함과 이들을 돕고 싶은 마음으로 후견활동을 시작한다. 후견인과 피후견인의 만남은 후견지원 기관의 실무자들에 의해 지원되는데 실무자들은 모두 장애인에 대한 관심에서 후견 업무를 시작하여 공공후견 사업을 지원하고 있었다. 둘째, 공공후견지원 사업은 여러 기관이 순환적으로 서로 연결되어 톱니바퀴처럼 맞물린 역할을 하고 있었다. 공공후견지원 사업의 교육과 홍보를 진행하는 서울시 발달장애인 공공후견제도 지원사업 수행기관, 최초로 후견신청을 접수하고 최종적으로 후견감독사무보고를 하는 시군구, 후견심판 청구지원을 하는 발달장애인지원센터, 후견인을 양성하고 후견활동을 지원하는 공공후견 법인의 실무자들은 서로 연계하고 협력하며 일하고 있었다. 셋째, 본 연구에 참여한 공공후견인들은 피후견인의 필요에 따른 후견사무를 지원하고 있었다. 이들은 크게 가족과 친구 같은 정서지원자, 일상의 필요를 채우는 조력자, 보호자가 필요한 상황에서의 법적 옹호자, 소소하지만 막중한 재산관리자의 역할을 하고 있었다. 넷째, 후견인들의 의사결정 지원을 위한 노력과 피후견인과의 의견 조율에 대해 분석한 결과 후견인들은 피후견인의 욕구를 파악하기 위해 직·간접적인 노력을 하고 있었다. 그러나 이들은 피후견인의 자기결정을 존중하면 복리에 문제가 발생할 수 있는 현실에서 갈등하며 ...

The purpose of this study is to understand the reality of the public guardianship support project for the developmentally disabled (hereinafter referred to as the public guardianship support project) by in-depth understanding of the public guardianship support project for people with developmental disabilities and the experiences of participants in the project. This study was conducted by applying the qualitative case study method suggested by Stake (1995/2000) with the research question 'How is the public guardianship support project for people with developmental disabilities operating, and what experiences do participants in the project have?'. This study selected 'Public Guardianship Support Project for the Developmental Disabled in Seoul City' as the case with boundaries including uniqueness and commonality. In this study, as the qualitative case studies collect the data using various information sources to understand the contents of the case, data were collected using document review, in-depth interview, and focus group interview. Through document review, data from related literature, official material, reports, and articles were collected. The participants of the public guardianship support project are diverse. In-depth interviews were conducted to have practical understanding over the process and experiences of the wards and guardians, who are the main participants among them. Additionally, in order to gain insight into the work of institutions in connection with the public guardianship support project and to collect various opinions from participants, a focus group interview was conducted with guardianship supervisors, support centers for people with developmental disabilities and public guardianship corporations, and those working in Seoul's public guardianship system support project for people with developmental disabilities. The collected data were analyzed through the methods of category summation, direct interpretation, type establishment, and natural generalization(Stake, 1995/2000), and 6 large categories and 24 small categories were derived. The main research results are summarized as follows. First, people with developmental disabilities are connected with guardians in a precarious situation, and guardians start guardianship activities with the desire to help them and familiarity with them. The meeting between the guardian and the ward is supported by the hands-on workers of the guardianship support organization, who started guardianship work out of interest in the disabled and have supported the public guardianship project. Second, various institutions were cyclically connected to each other and played a role that interlocked like a gear in the public guardianship support project. Seoul Metropolitan Government's public guardianship system support project implementing agency that conducts education and promotion of public guardianship support project, local governments that receive applications for guardianship at the initial stage then submit the final report on guardianship supervision, Support Centers for the Developmentally Disabled that support guardianship adjudication claims and the practitioners of the public guardianship corporations, which train guardians and support guardianship activities were working in association and cooperation with each other. Third, public guardians who participated in this study were supporting guardianship affairs according to the needs of the ward. They played the role of emotional supporters like family and friends, helpers who provide daily needs, legal advocates in situations where a guardian is needed, and trivial but significant role of property managers. Fourth, as a result of analyzing the efforts of guardians to support decision-making and coordination of opinions with the ward, the guardians were making direct and indirect efforts to understand the needs of the ward. However, they were conflicted in the reality that problems in their welfare could arise if they respect the self-determination of the ward. There were guardians who would support decision-making or act on behalf of decision-making. On the other hand, the wards said that they were coordinating or conforming to the opinions of the guardians through experience and trust with the guardians. Fifth, the public guardianship project showed different results for each participating subjects. After the selection of the guardian, the emotional state and the lifestyle of the ward become stable. Then they could get prepared for independence through financial protection with the help from the reliable helper. On the other hand, guardians and practitioners said that they are experiencing personal rewards while undertaking guardianship, and they are accumulating understanding and practice experiences of guardianship. Finally, as a result of analyzing the complaints and difficulties of guardianship support organizations, guardians expressed the financial burden by their responsibility, unresolved and recurring problems, conflicts between responsibility and reality, and limited support due to the absence of information and mentors as grievances. In addition, it was possible to confirm the difficulties of unfamiliar legal terms and procedures of the guardianship system, and the difficulty of imbalance of necessary resources for guardians and practitioners. Practical and political suggestions related to the main findings of this study are as follows. First, the main contents of the practical recommendations are about establishment of education on the public guardianship system and counseling channels for people with severe developmental disabilities, training of competent guardians for people with developmental disabilities, formulating the role of public guardian, providing monitoring and supervision of guardianship activities, and providing information and reinforcing refresh education to strengthen the capacity of public guardians. Next, the main contents of the political recommendations are about the preparations over an organization in charge of guardianship, a plan to expand the power of attorney for personal protection of the ward, and a budget and manpower support for smooth public guardianship support. The significance of this study is to understand the reality of the public guardianship support project using qualitative case studies, and to describe the complex guardianship system in a narrative style so that readers can easily understand. Also, the significance of this study can be found from the fact that it aims to suggest a development plan for the public guardianship project in Korea by introducing cases from developed countries. However, this study contains limitations that the city of Seoul was restricted regionally, the research participants were selected only for the ward who can communicate, and data collection couldn't be done by matching the guardian with the ward. Before anything else, it is unfortunate that the observation, an important type of data collection method in case studies, could not be performed due to the COVID-19.

In addition, it was possible to confirm the difficulties of unfamiliar legal terms and procedures of the guardianship system, and the difficulty of imbalance of necessary resources for guardians and practitioners. Practical and political suggestions related to the main findings of this study are as follows. First, the main contents of the practical recommendations are about establishment of education on the public guardianship system and counseling channels for people with severe developmental disabilities, training of competent guardians for people with developmental disabilities, formulating the role of public guardian, providing monitoring and supervision of guardianship activities, and providing information and reinforcing refresh education to strengthen the capacity of public guardians. Next, the main contents of the political recommendations are about the preparations over an organization in charge of guardianship, a plan to expand the power of attorney for personal protection of the ward, and a budget and manpower support for smooth public guardianship support. The significance of this study is to understand the reality of the public guardianship support project using qualitative case studies, and to describe the complex guardianship system in a narrative style so that readers can easily understand. Also, the significance of this study can be found from the fact that it aims to suggest a development plan for the public guardianship project in Korea by introducing cases from developed countries. However, this study contains limitations that the city of Seoul was restricted regionally, the research participants were selected only for the ward who can communicate, and data collection couldn't be done by matching the guardian with the ward. Before anything else, it is unfortunate that the observation, an important type of data collection method in case studies, could not be performed due to the COVID-19.
