This study examined the types and frequencies of housing lease disputes and mediation outcomes using 4-year housing lease dispute data from the Housing lease Dispute Mediation Committee of the Suwon branch of the Korea Legal Aid Corporation. This research also investigated dispute prevention strategies in other countries and reviewed the problems of current prevention and mediation procedures in Korea to provide suggestions for the improvement on the prevention and mediation of the housing lease disputes. Findings revealed that housing lease-related disputes were mainly regarding deposit return (39.38%), landlords’ repair/maintenance obligations (19.44%), and tenants’ restoration obligations (16.55%), which sum up to 75.37% of all dispute cases (n = 1,334). The average amount involved in disputes was found to be less than 10 million won, except for the ones for deposit return disputes. This study showed that the main cause of housing lease disputes are (a) unclear rights and obligations of the landlord and tenant that are not specified in the housing lease contract, (b) ambiguous regulations in the 「Civil Act」 or 「Housing Lease Protection Act」, which is difficult to complement the deficiency of the housing lease contract, and (c) the landlord or tenant’s failures of abiding by the legal obligations. Based on the findings, suggestions for the improvement of housing lease dispute prevention and mediation procedures were provided as followings. First, it seems necessary to improve the standard housing lease contract. A detailed contract written from the anticipations of the possible future disputes will allow us to prevent housing lease disputes effectively. Second, it seems beneficial to legislate move-in and –out investigations in 「Housing Lease Protection Act」 for both landlords and tenants. The check-list from the move-in and -out inspections can be used for the proof of the condition of the premises, which would take a crucial role in dispute resolutions. Third, 「Housing lease dispute prevention and resolution standards」, specific recommendations and protocol for the negotiation and mediation procedures, should be developed. Fourth, a new regulation on the rights and obligations of the landlord and tenant should be established in the 「Housing Lease Protection Act」 to ensure a peaceful residence of the tenant as well as the landlord's rights to maintain the premises. The legal regulations will complement the insufficient contract between the two parties. Fifth, the budget for the housing lease mediation project should be increased and allocated separately from any other legal aid projects. The increased budget and independence of the Housing Lease Dispute Mediation Committee of the Korea Legal Aid Corporation will lead to the improvement of the effectiveness of dispute prevention and mediation. Furthermore, from a mid- to long-term perspective, it seems necessary to separate the Housing Lease Dispute Mediation Committee from the Korea Legal Aid Corporation and operate three public institutions, the Korea Legal Aid Corporation, Korea Land and Housing Corporation, and Korea Real Estate Board systematically. Lastly, further research on the prevention and mediation procedures for housing lease disputes should be conducted. Prior research and legislative movements on housing lease disputes have focused on the protection of the tenant's security deposit and period of residence, leaving both landlord and tenants’ obligations unspecified. Thus, in-depth follow-up studies on this topic are called for. We hope that the culture for an advanced housing lease contract will prevent and settle disputes through a reasonable resolution.
