The purpose of this study is to examine the historical meaning of the Korean Sign Language Act by looking at the background and process of the enactment and to clarify the tasks and direction of the Korean Sign Language Act based on the perception of the deaf. The Korean Sign Language Act was enacted in 2016 to guarantee the language right of deaf people, who use Korean Sign Language as their first language. However, the enactment and enforcement of the law does not mean that the aim is achieved. At the point of writing it is the fourth year of the Korean Sign Language Act's implementation, therefore, it is important to understand the perception of the deaf people, who are the primary subjects of the law. The results of this study will provide useful data to the deaf society, competent ministries and enforcement agencies. In addition, by looking at the background and process of the Korean Sign Language Act, and the occurring changes concerning the language rights of the deaf from their perspective, the government will be able to determine in which direction the implementation has to go. Besides, deriving social welfare implications through the enactment of the Korean Sign Language Act led by the deaf, will provide new implications for the deaf. This study seeks to contribute to further research by compensating the limitations of previous studies, by exploring the background, process, and changes of the enacted movement and by revealing the perception of the deaf' language right. It is also intended to provide necessary information for the deaf community by describing the views of policy-makers. As for this research, the case study method has been selected, and the research is carried out through literature analysis and in-depth interviews. In order to ensure the effectiveness of the Korean Sign Language Act, above method is appropriate to reflect the views of deaf people who are the primary subjects of the law and the perspective of the policy-makers who implement the law. The data was collected and analyzed through literature collection before and after the enactment movement and in-depth interviews with deaf people and the policy makers. Data analysis for in-depth interviews is conducted using common analysis methods used in various qualitative research methods. The results of this study is as following; First, the background of the enactment movement in form of a literature analysis is described by the perspective change on disability, the adoption of the United Nations Convention on the Rights of Persons with Disabilities, and the recognition of signed languages abroad. Meanwhile, the background of the enactment movement perceived by the deaf party was "low acceptance of sign language," "response to social disapproval," "lack of respect for deaf people", "limits of social welfare policies" and "poor guarantee of basic rights." Second, the enactment process was examined focusing on the main strategies of enactment, and the major issues and difficulties in the enactment process. The process of enacting by the actors began when the Korea Association of the Deaf established a committee for research and enactment of the Framework Act on Korean Sign Language, followed by a Joint Countermeasure Committee to secure sign language rights, focusing on information culture of the disabled. Four bills were proposed as a result of the two group's enactment movement. As relevant research of the ministry was ordered, and the bill was deliberated by the National Assembly the four bills have been consolidated by the Committee of the Ministry of Education, Culture and Tourism and after partial revision the bill was enacted. During the enactment process, the main strategies were identified as “confirmation as government tasks”, “led by the parties concerned”, “solidarity with people with disabilities and civic groups”, and “cooperation with the competent ministries”. Major issues in the enactment process were found to be the "competent ministry," "implementation of Korean Sign Language as a subject" and "major terminology" while difficulties were found to be "lack of public awareness," "the lukewarm attitude of the parties directed involved" and "the idling of bills in political situations." Third, the results on the changes, tasks, prospects and directions since the enactment of the Korean Sign Language Act were as follows. After the enactment, changes related to the language rights of the deaf were found to be 'very insignificant'. However, there were also "some positive changes" such as the increased pride of the deaf by securing the official language status of sign language, the revitalization of sign language research and the provision of public interpretation. In addition, it was noticed that relevant policies and implementation was formed under the initiative of the state. The future tasks the Korean Sign Language Act has to deal with are topics such as "securing the effectiveness of the law," "revision of the bill," "improving and expanding the quality of translation services," "recovering the mobility of deaf communities," "participation guarantee of deaf people and improving accessibility," and "the willingness of the competent ministries and enforcement agencies." The outlook for the Korean Sign Language Act is positive and contains topics such as "recognition of sign language" and "changing deaf lives," while the direction for the Korean Sign Language Act was "respect for deaf people," "resolving linguistic inequality," and "a society that communicates in sign language." Based on the results of the study, I present the conclusion and the discussion part. The theoretical, policy and practical implications of the research, limitations of the research, and suggestions for follow-up research are described as well.
