Through it, this research intends to seek improvement of adult guardian system for people with developmental disabilities, a main group of the system, from an angle different from the aged. 이전의 금치산 및 준금치산제도는 판단능력이 불충분하여 혼자서는 거래 등을 할 수 없는 자의 행위능력을 제한하고, 불이익을 초래할 수 있는 거래로 재산을 잃는 것을 방지하여 사회생활상 필요한 행위를 할 수 있도록 본인을 원조하는 후견인 및 보좌인을 선임하여 지원하는 제도였다. 금치산 선고를 받은 자에게는 후견인이 선임되어 본인이 혼자서행한 행위의 경우에는 후견인이 모두 취소할 수 있었으며, 후견인은 법정대리인으로서 본인을 대신하여 필요한 법률행위를 실행할 때에는 보좌인의 동의를 얻을 필요가 있었으며, 동의를 얻지 않고 실시한 행위는 취소할 수 있었다. 하지만 요건 등이 어려워 실제로 이용하는 데에는 많은 어려움이 따랐으며, 무엇보다 ‘금치산 및 준금치산’이라는 용어에 대한 부정적인 이미지가 뿌리 깊게 남아 있어 제도의 개선이 계속해서 요구되었다 [3].
