따라서 약침 기술의 발전을 위해서는 지금까지 출원된 약침 특허기술을 분석한 자료를 구축하는 것이 필요하다. 이에 본 연구는 약침액 관련 특허 정보를 검색 및 분석하고, 특허의 최종상태, 약침 제조에 사용된 약재, 치료 대상이 되는 병증 등을 포함한 국내 약침 특허의 현황을 파악함으로써 약침의 임상 활용 증대 및 새로운 약침 개발을 위한 기초자료를 마련하고자 한다.
제안 방법
최종 포함된 특허를 대상으로 먼저 특허의 개괄적 특징을 살펴보았으며, 세부적으로는 1) 국제특허분류(IPC, 2017.01판 기준)에 따른 약재 분석 2) 병증별 분석 3) 추출법에 따른 분석 및 4) 특허의 최종상태에 따른 분석으로 나누어 진행하였다.
약침 특허에 사용된 한약재의 분류를 파악하기 위하여 국제특허 분류(IPC)를 분석하였다. IPC는 대부분 Section A(생활필수품, 농업)에 포함되어 있었으며, A61K(의약용, 치과용 또는 화장용 제제)가 큰 비중을 차지하고 있었다.

대상 데이터
첫째, 특허에서 수행되는 실험에 대한 문제이다. 본 연구에서 선별된 82건의 특허 중 27건의 특허가 실험을 수행하지 않거나, 약침 및 주사의 형태가 아닌 세포 대상이나 경구투여 등의 방법으로 실험을 한 경우였다. 이러한 특허들의 경우, 특허의 주제가 단순히 ‘조성물’ 또는 ‘약학적 제제’와 같이 표현이 되어있는 경우가 대부분이었으며, 약침을 주 활용목적으로 하지 않거나, 임상 활용 방법을 명확하게 제시하지 않은 것이 대부분이었다.

약침에 대한 특허정보를 검색하기 위하여 한국특허정보원이 운영하는 특허정보검색서비스 키프리스(Korea Intellectual Property Rights Information Service, http://www.kipris.or.kr/)와 한국과학기술정보연구원이 제공하는 NDSL(National Digital Science Library, www.ndsl.kr)의 특허정보 데이터베이스를 사용하였고, 검색어는 ‘약침’, ‘pharmacopuncture’, ‘aqua acupuncture’, ‘acupoint injection’으로 하였다.
총 379건의 특허가 검색되었고, 이 중 중복 검색된 특허 48건을 제외한 331건의 특허를 포함 및 제외 기준에 따라 선별하여 249건 [국내 특허가 아닌 것(n=3), 한약재를 사용하지 않거나 한약재가 아닌 일반 식품 등을 사용한 특허(n=173), 제조방법만 언급한 특허(n=26), 약침이 주된 특허내용이 아닌 것(n=47)]을 제외하여 총 82 건을 최종 분석 대상으로 삼았다(Fig. 1).
성능/효과
1. 설정된 포함 및 제외기준에 따라 국내 약침 특허를 선별한 결과 총 82건이 선별되었으며, 그 중 약침과 관련된 실험이 없는 것이 27건, 치료 대상이 동물인 것이 9건으로 확인되었다.
2. 특허의 최종상태를 분석한 결과 등록 35건(42.7%)과 거절 22 건(26.8%)이 큰 비중을 차지하였으며 출원 연도에 따른 특허 개수 변화에는 뚜렷한 경향을 나타내지 않았다.
3. 국제특허분류(IPC)에 따라 분석한 결과 A61K(의약용, 치과용 또는 화장용 제제)가 대부분을 차지하고 있음을 알 수 있었다. 약침 제조에 사용된 약재는 봉독, 인삼속, 참당귀속, 작약과 순으로 많이 사용되었으며 앞에 제시된 일부 약재를 제외하면 대부분의 약재는 1, 2건밖에 사용되지 않았다.
4. 특허에서 제시된 병증을 분석한 결과 관절질환, 골질환 등의 근골격계 질환이 가장 많았으며, 치매, 퇴행성 신경질환과 같은 신경질환이 다음으로 많이 확인되었다, 그 외에도 호흡기, 소화기, 피부 등 다양한 계통의 질환이 확인되었다. 또한 실험에 rat, mouse, human 및 각종 세포를 모델로 실행된 실험이 대부분을 차지하고 있었다.

IPC는 대부분 Section A(생활필수품, 농업)에 포함되어 있었으며, A61K(의약용, 치과용 또는 화장용 제제)가 큰 비중을 차지하고 있었다. 그 외에도 참당귀속(Angelica), 작약과(Paeoniaceae) 등의 약재가 자주 사용되었다. 봉독, 인삼과 같이 자주 사용되는 일부 약재들과는 다르게 1건만 확인된 약재들이 대부분을 차지하고 있음을 알 수 있었다(Fig. 3). 그리고 복합방으로 제조된 약침 특허중 처방명을 명시한 특허가 3건이 있었으며 각각 황련해독탕, 갈근 해주탕, 의이인탕이 있었다.
특허에 사용된 약재를 IPC에 따라 분석한 결과, 동물성 약재(봉 독, 오공 등) 및 식물성 약재(감초, 복령, 인삼 등) 등 다양한 약재가 사용되었다. 사용된 약재 중 봉독(A61K 35/64; 곤충; 예/벌, 말벌, 벼룩)이 가장 자주 사용되었고(n=14), 그 다음으로 인삼속(A1K 36/258; 인삼속(Panax); 예/백삼, 홍삼) 약재가 많이 사용되었다 (n=13). 그 외에도 참당귀속(Angelica), 작약과(Paeoniaceae) 등의 약재가 자주 사용되었다.

최근 국내 학회지에 게재된 약침논문 분석7,8)에 따르면 현재까지 약침 논문 수는 지속적으로 증가하는 경향을 보이고 있으나, 너무 다양한 종류의 약침 연구가 이루어짐으로써 오히려 개발에서 임상 연구 및 임상 적용까지 이어지는 연구가 없음을 문제점으로 든 바 있다. 또한 이들 논문에서는 동일한 약재를 사용하여 동일한 실험을 진행한 중복 연구가 많이 이루어진 문제 또한 지적하였다.
