It is necessary to expand organ donations of the deceased, as more ethical problems are emerging from the increase in organ donations from the living. As the legal and ethical discussions on donation after circulatory death (DCD) as a field with the potential to expand such domestic organ donation are being held, the need for a social consensus is increasingly highlighted. Organ DCD refers to the donation of an organ from a patient whose spontaneous blood circulation has stopped due to cardiac death. In this study, we aimed to examine whether there are legal and ethical obstacles or medical uncertainties for expanding the practice of DCD. By law, death is recognized as cardiac death, and brain death is recognized as an exception for organ transplantation. Although circulatory death precedes brain death, this paper presents a discussion to begin the process of reaching an ethical and legal agreement on whether or not circulatory death can be recognized as death. Successful implementations of DCD, including Category III DCD, in other countries are currently being reviewed to introduce Category III DCD in Korea.

⁹⁾ 특히 살아있는 자의 기증의 경우에는 재정적으로 취약한 상태의 기증자가 선의의 기증보다는 금전적인 이해관계로 유인이 될 수 있는 추가적인 우려가 있다.¹⁰⁾ 윤리적 논쟁의 영향을 완전히 받지 않는 것은 아니지만 사망한 자의 기증은 동의에 대한 심리적으로 강압적인 영향을 미칠 수 있는 여지가 적다.

대상 데이터

우리나라에서는 카테고리 IV만 실행된다.^{2, 8)} 본연구에서는 한국이 추구해야 할 장기기증의 유형인 카테고리 Ⅲ DCD는 뇌사에 대한 신경학적 기준을 완전히 충족하지 못했지만 치명적인 뇌손상을 입은 후 순환기 사망을 기다리는생명유지 치료환자를 대상으로 한다. 이러한 상황에서 가족구성원은 두 가지 독립적인 동의를 할 수 있다.

성능/효과

¹⁾ 한 연구에 따르면 이러한 DBD 감소의 이유는 호스피스 및 완화의료 또는 임종 시 환자의 연명의료결정에 관한 법률의 제정 때문이라고 한다.²⁾ 이 법률 이전에는뇌사 가능성이 있는 환자의 연명의료를 중단하는 합법성이 불분명했고, 환자의 뇌사판정과정은 환자나 그 가족이 뇌사자기증에 동의해야만 진행할 수 있었다. 본 법률의 시행으로 환자와 그가족은 장기기증과 상관없이 뇌사선언 없이도 연명의료를 중단할 수 있게 되었다.
이러한 법률의 변화는 환자와 그 가족에게 장기기증에 대한 자유 의지를 정당하게 부여했지만, 한국에서 DBD 를 감소시킨 것으로 보인다.⁴⁾ 그러나 이제는 불가역적 뇌손상을 당한 환자의 가족이 환자가 뇌사로 볼 수 없더라도 연명의료를 포기할 수 있으므로 카테고리 Ⅲ DCD 옵션은 이전보다더 적합하다고 할 수 있다.
위스콘신 대학의 후향적 연구에 따르면 카테고리 Ⅲ DCD 환자의 신장이식 성공률은 환자 생존율과 이식편 생존율(graft survival rate)로 측정했을 때 신외-DCD 이식 전 기간(pre-extrarenal-DCD-transplant period)(1980~1992)에서 신외 DCD 이식 후 기간(post-extrarenal-DCD-transplant period)(1993~2008)까지 크게 증가했다. 또한 두 번째 기간 동안 DCD와 DBD 신장이식 환자 사이에 환자생존 또는 이식 편 생존에 큰 차이가 없었다.¹⁴⁾ 이와 유사하게, 스위스 취리히대학에서 카테고리 Ⅱ, Ⅲ 및 IV DCD 신장이식을 조사한 단일사이트 연구와 non-heart-beating kidney donations에 관한 미국 신장데이터 시스템 데이터베이스(United States Renal Data System database)의 조사는 둘 다 중요한 DCD와 DBD 신장이식 환자 간의 장기이식 생존율에서 유의미한 차이가 없었다.
연구에서 1993년부터 2008년까지의 기간을 살펴보면 DCD와 DBD 췌장 이식 환자와 폐 이식 환자 간에 환자 생존율과 이식편 생존율에서 유의미한 차이가 없었다. 반면에 간 이식에서는 DCD와 DBD 환자 사이에 환자 생존율과 이식편 생존율 모두에서 유의미한 차이가 있었다.¹⁴⁾
위스콘신 대학의 동일한 연구에 따르면 DBD의 신장 및 신외 장기 이식이 필연적으로 DCD보다 더나은 결과를 얻을 수 있지만 DCD 수혜자는 성공을 측정하는여러 범주에서 DBD 수혜자와 큰 차이가 없음을 보여주었다. 연구에서 1993년부터 2008년까지의 기간을 살펴보면 DCD와 DBD 췌장 이식 환자와 폐 이식 환자 간에 환자 생존율과 이식편 생존율에서 유의미한 차이가 없었다. 반면에 간 이식에서는 DCD와 DBD 환자 사이에 환자 생존율과 이식편 생존율 모두에서 유의미한 차이가 있었다.
사람들에게 많은 가능성을 보여주고 있다. 의학적 발전과 경험은 카테고리 Ⅲ DCD 환자의 이식수술 성공률을 향상시켰을 뿐만 아니라 신장 외에 폐, 췌장 및 간과 같은 장기를 더 많이 사용할 수 있게 했다.
첫째, 소아 환자의 뇌는 성인 환자의 뇌보다 더 탄력적인경향이 있기 때문에 동일한 평가기준을 사용하여 뇌 손상의심각성 또는 비가역성을 정확하게 판단할 수 없다. 또한 부모는 기부에 대한 대리 동의를 할 수 있지만 아동의 직접적인 동의는 불가능하다.
