This article intends to illuminate the necessity of women"s right to abort in the context of legal regulation of abortion in Korea. In spite of the prevalence of women"s abortion, it is notable to see the discourses to explain, defend, or affirm the women"s action to abort seems almost nil in the society. The article discovers and problematizes the condition of ‘linguistic impasse" or "aporia" where the women"s abortion is situated. Moreover, this is the situation where the frame of ‘pro-choice v pro-life" in the West does not seem to fit. The article proceeds to discuss the multiple facets of the abortion right. It reviews the privacy right, equal protection, anti-subordination theory, equivalent right, and reproductive rights. This work also attempts to interpret women"s action to abort within the context, and finds the notion of ‘choice" as if she were an individual to make a decision is misleading. Rather, the action is a very construct of the power relations surrounding her. Based upon this examination, it concludes that what the Korean society and legislation lack is not so much the respect for the life of fetus as the respect for the women - body, sexuality, and their being. Thus, the regulatory statutes in Korea ought to be revised so that they recognize the reasons for having abortion realistically, and to be replaced by new measures that eventually de-criminalize a pregnant woman"s decision to abort within proper conditions. It also suggests transformation of the direction of the abortion policy, that is, from the control of abortion to that of unwanted pregnancy. Women-centered reproductive policy will benefit to all.
