본 논문에서 상표법 제73조 제1항 제2호와 제3호에서 판단하는 상표의 유사 여부와 상표의 동일성 판단에 대한 차이점에 대하여 고찰하였다. 이와 관련된 대법원 판례와 상표심사기준을 검토하였다. 또한 불사용취소심판에서 상표의 동일성 판단과 관련되는 마국, 유럽 및 일본의 상표법과 판례를 근거로 우리 상표법과 비교하였다.

As represented in Supreme Court’s precedents, it is difficult to disentangle similarity of trademarks in the Trademark Act, Article 73, Section 1, No. 3 and their likelihood of confusion in No. 2.
