2010년 10월 채택되어 50개국의 비준·가입·수락·승인하면 발효될 예정인 「유전자원 접근 및 이익공유에 관한 나고야의정서」에서는 유전자원 (유전자원과 연관된 전통지식도 포함) 접근 시 자원보유국의 사전통보승인(PIC)을 받고, 자원이용으로 발생한 이익을 상호합의조건(MAT)에 따라 자원제공국과 공평하게 공유하도록 하고 있으므로, 자원보유국의 생물자원 주권강화 및 이익공유 요구에 따라 해외 생물자원 이용으로 인한 추가 부담 발생 등이 예상된다. 특히 이익공유에는 생물유전자원 이용뿐만 아니라 파생물 이용도 포함되므로, 의약품, 기능성 화장품 및 기능성건강식품 등의 보건산업분야에서 파급효과가 가장 클 것으로 예상된다. 따라서 우리나라에서도 국가 생물주권 강화를 위한 우리나라 자생생물자원의 조속한 발굴 및 해외 생물자원에 대한 체계적 접근전략을 마련할 필요가 있으며, 국가차원에서 생물자원을 종합 관리할 수 있는 시스템 마련을 통해 원산지국 주장 등에 대비할 필요가 있다. 본 연구에서는 「나고야의정서」가 보건산업분야에 미치는 영향을 조사하였다. 한약재 시장에서의 피해액은 연간 130억원, 건강기능식품 시장에서의 파급효과는 연간 240억원, 화장품산업에서의 피해액은 년간 40억원, 천연물신약 의약품시장에서는 연간 100억원의 파급효과가 있을 것으로 파악되었다. 이와 함께 본 연구에서는 「나고야의정서」와 관련된 국내 전통지식 맟 생물자원 DB 현황을 조사하였다. 전통지식에 대해서는 특허청의 「한국전통지식포털」이 개설되어 있으며, 그 이외에 각 부처별로 그들의 고유 소관업무에 따라 다양한 생물정보포털들이 운영되고 있었다. 교육과학기술부에서는 「국가자연사연구종합정보시스템」과「국가생명연구자원통합정보시스템」을, 농림수산식품부에서는 「농업유전자원정보센터」, 「해양생물종다양성정보시스템」, 「국가생물종지식정보시스템」을, 그리고 국토해양부에서는 「한국해양생물다양성정보시스템」을 구축․ 운영하고 있다. 또한 「생물다양성협약」을 주관하는 환경부에서는 「한반도생물자원포털」을 개설하여 운영하고 있다. 외국의 경우 미국 국립생물정보센터(NCBI)가 전 세계에서 가장 많은 생물정보를 보유한 기관으로 알려져 있으며, 그 이외에 미국의 농무부, 캐나다, 일본 등에서도 생물자원에 대한 정보 시스템을 갖추고 있다. 캐나다 경제개발혁신부의 지원을 받는 국제생명바코드협회(iBOL)는 생물자원들의 유전자서열을 DNA 바코드화하여 고유번호를 부여함으로써 생물자원의 분류에 이용하도록 하고 있다. 또한 자원보유국인 브라질과 인도에서도 Gene Bank 구축,종자은행 설립 등 약용식물 보존에 심혈을 기울이고 있다. 특히 중국에서는 약용식물의 과량채취 및 서식지 파괴등으로부터의 약용자원 보호를 위해 DNA 바코드를 이용한 약용식물의 분자인증 방법이 활발히 연구되고 있다. 이와 같이 해외 자원보유국들이 생물자원에 대한 주권강화를 준비하고 있으므로, 국내에서도 보건산업의 피해를 최소화하기 위해 식품의약품안전청을 중심으로 이에 대응해야 할 것으로 사료된다. 현재 식품의약품안전청에서의 「생약종합정보시스템」(Herb Medicine)을 개선하여 DB에 건강기능식품 원료나 화장품 원료로 사용되는 생물자원에 대한 정보를 포함시킨 통합 DB (가칭 「식약생물자원정보시스템」 IGIFAD)을 구축할 필요가 있다. 여기에는 생물자원에 관련된 정보뿐만 아니라, 파생된 부가정보, 즉 유전자(DNA 바코드), 추출물, 전통지식 정보등에 대한 정보를 제공하여야 할 것이며, 상세정보는 원천 DB와 연계(링크)하여 활용할 수 있도록 구축되어야 할것으로 판단된다. 이와 함께 「나고야의정서」를 이행하기 위해 관련 법령들도 재정비해야 할 필요가 있다. 2013년 2월에 발효예정인 “생물다양성 보전 및 이용에 관한 법률(안)”에 따르면, 환경부가 PIC 발행 및 MAT 체결을 주관할 수 있는 국가책임기관(CNA) 역할을 할 수 있도록 규정되어 있다. 국가 생물자원을 효율적으로 관리하기 위해서는 생물자원의 실시독점권(특허)을 심사하는 특허청을 단일 점검기관 (CP)으로 하는 방안을 검토할 수 도 단일화할 수 있으며, 이 경우 특허청을 점검기관으로 하는 방안도 검토될 수 있다. 그렇지 않고 각 부처별로 점검기관(CP)을 설치하는 경우, 식품의약품안전청은 의약품, 식품, 화장품 제조에 이용하는 유전자원의 점검기관(CP)으로서 이의 수출ㆍ수입 및 반입을 관리 규제해야 하므로, 이와 관련된 법령들을 정비해야 한다. 따라서 약사법 및 화장품법에서「나고야의정서」를 포괄할 수 있도록 “멸종위기에 놓인 야생 동ㆍ식물의 수출입 허가” 조항을 “동ㆍ식물 유래의약품의 수출입 허가”로 개정하고, 건강기능식품 원료 및 성분인정에 관한 규정 및 천연물신약연구개발촉진법 등을 개정하여 「나고야의정서」를 반영해야 할 것이다. 나아가 의약품, 건강기능식품 및 화장품의 제조 원료로 사용되는 생물자원들은 식품의약품안전청에 원료신고 시, 생물학적 성상 뿐만 아니라, 화학적 성상, 유전학적 성상 및 지적 서지사항을 포함하여 신고하도록 함으로써, 「나고야의정서」 대응 DB 구축에 활용할 자료들을 확보함과 동시에 이의 위품 감별 및 원산지 감별에 활용할 수 있도록 하여야 할 것이다. 이러한 「식약생물자원정보시스템」 DB를 구성함에 있어서, 초기 구축비용은 10〜15억 정도가 소요될 것으로 사료된다. 초기 구축 뿐만 아니라 앞으로의 DB 정보를 보완, 보정해 나가기 위해 생물학 분야, 특히 생물분류학 분야의 전공자, 약학 또는 한의학 분야의 전공자, 그리고 전산학분야 전문가 등 3명의 전문요원이 필요할 것이다. 무엇보다도 보건산업 영역에서 이용되는 생물자원의 주권 확립을 위해 이들의 유전정보인 DNA 바코드를 확보해야 할 것이다. 특히 동아시아권의 한국, 중국 및 일본 등 유사한 전통지식과 이를 기반으로 하는 생물자원의 활용 역사는 「나고야의정서」에 따른 이익공여에 있어서 아주 미묘한 갈등이 발생할 수 있으므로, 현재 식품의약품안전청에서 보관하고 있는 생약표본으로부터 유전정보를 찾아 국산 생물자원임을 밝혀나가는 작업부터 우선 실시해야 할 것이다.

「Nagoya Protocol on Access to Genetic Resources and the Fair and Equitable Sharing Of Benefits Arising from their Utilization to the Convention on Biological Diversity」, which was adopted on Oct., 2010 and will enter into force on the 90th day after the date of deposit of the 50th instrument of ratification, acceptance, approval or accession by States, requires the prior informed consent (PIC) for access to genetic resources of the Party as well the mutually agreed terms (MAT) for the fair and equitable benefit-sharing from their utilization. Following this Protocol, the States rich in genetic resources will strengthen their biological sovereignty and ask the fair and equitable benefit-sharing, which will bring extra burden in the use of foreign biological sources. Because this Protocol not only includes genetic resources but their derivatives for benefit-sharing, there will be the greatest impact on health industry producing natural drugs, functional foods and functional cosmetics. In order to take actions against this Protocol, it is required to find Korean endemic genetic resources for keeping biological sovereignty, to establish the systematic approach mechanism for the access to foreign genetic resources, and to develop the national information system for managing the domestic genetic resources. First of all, the impact of Nagoya Protocol on health industry was investigated. The increased extra burden was estimated as 13 billion Won(bW) in herbal medicine industry, 24 bW in functional food industry, 4 bW in functional cosmetic industry, and 10 bW in natural product pharmaceutical industry. The current status of the biological resource DBs related to Nagoya Protocol in Korea were also surveyed and compared. For the traditional knowledges, 「Korean Traditional Knowledge Portal」(KTKP) has been already opened by Korean Intellectual Property Office (KIPO) in accordance to the agreement of World Intellectual Property Organization (WIPO). Several Korean portals serve the biological resource informations depending upon their duty of each governmental department, including 「Korean National Research Information System」(NARIS) and 「Korea Bio-resource Information System」(KOBIS) under Ministry of Education, Science and Technology (MEST) 「RDA Genebank」, 「Marine Life」 and 「Nature」 under Ministry for Food, Agriculture, Forestry and Fisheries (MIFAFF), 「Korea Marine Biodiversity Information System」(KoMBIS) under Ministry of Land, Transport and Marine Affairs (MLTM), and 「Species KOREA」 under Ministry of Environment (MOE). The latest website deals with wildlife biological resources in accordance to Convention on Biological Diversity. National Center for Biotechnology Informations (NCBI) of US has been known to possess the vast amount of biological informations in the world. International Barcode of Life (iBOL), supported by Canadian Ministry of Economic Development and Innovation, also collects gene sequences of worldwide biological resources and grants barcode index number (BIN) for each sequence. It also manages The developed countries including Canada and Japan operate their own genetic information systems for biological resources. Brazil, India and China having the rich biological resources start to keep their own resources by constructing gene bank as well as seed bank. Recently in China, the researches on molecular discrimination of herbal medicines using DNA barcodes are eagerly investigated in order to protect the biological resources from over-collection and habitat destruction. Taking actions against foreign countries' strategy for strengthening biological sovereignty and minimizing the impact of Nagoya Protocol on domestic health industry, 「Herb Medicine」 website of Korea Food and Drug Administration (KFDA) should be expanded to biological ingredients used in functional food industry and functional cosmetic industry, and improved to the integrated portal site, namely tentative Integrated Genetic Information for Food and Drug (IGIFAD). New portal site should provide the biological informations as well as additional informations including genetic informations (DNA barcode), chemical informations for derivatives (extract or chemical constituents) and knowledge informations (documentations and publications), which can be linked with the original DB sites. The modification of legislative measures should be also made for implementing Nagoya Protocol. Korea already prepared the 「Law of Biological Conservation and Utilization」, which will effective from Feb., 2013. According to this law, MOE will play a role of Competent National Authority (CNA) responsible for issuing PIC and contracting MAT. For the efficient management of national biological resources, it is one way to assign Korean Intellectual Property Office as a single Check Point (CP) which can evaluate the intellectual properties of biological resources. In another case, each governmental departments can share the roles of CP depending on their own business. In that case KFDA will take the mission of CP in the field of food, drug and cosmetic industry, the Pharmaceutical Affairs Law, the Cosmetic Law, and the Law for New Natural Medicine Research and Development Promotion should be revised to cover the KFDA's mission as an CP. By amending the regulations and guidelines, it will be an way to include biological, chemical and genetic information of biological ingredients when registering the food, drug or cosmetic products. Those informations can be enrolled in KFDA's portal site and used for discriminate the authenticated one from adulterant one. The initial construction of new KFDA's portal was assumed to cost around 1〜1.5 bW. For further correction, supplementation and management of genetic information, at least 3 specialists should be involved in this work, who major in systematic biology, pharmacy or oriental medicine, and computer science. Most of all, the first action against Nagoya Protocol should be the collection of genetic informations of biological resources used in health industry, because it is imagined that there will be some delicate conflicts in benefit-sharing between east Asian countries including Japan and China, due to the similar traditional knowledge and medicinal history. Thus the DNA barcoding of the endemic medicinal herbs preserved in KFDA should be the most important against Nagoya Protocol.
