□ 연구의 배경
〇 환경규제는 다양한 규제방식으로 발전되어 왔으며, 명령통제식 규제수단에서 나아가 점점 다양한 경제적 유인수단이 도입되면서 피규제자들의 친환경적 행위유도의 관점을 띄게 됨

〇 본 연구는 환경규제 준수 및 친환경 경제행위를 보다 효과적으로 유도할 수 있는 인센티브 제도 개선 및 도입 방안에 대하여 연구하는 것을 목적으로 함
〇 환경규제를 준수하거나 친환경 경제행위를 하고자 노력하는 행위자가 그렇지 않는 경우에 비해 받을 수 있는 이익을 상대적으로 증가할 수 있는 우리 실정에 맞는 효과적인 인센티브 강 화방안에 대하여 제시함을 목적으로 함
〇 본 연구는 총론적 연구에 국한하고 각론적 연구는 후속 연구과제로 남김
□ 연구의 방법
〇 기존 문헌들을 통하여, 인센티브제도의 의의와 범주를 파악한 후, 현행 규제 전반에 대한 규제유형별, 문제 영역별 인센티브 제도에 대하여 분석함
〇 이러한 개념범주를 전제로, 각 규제수단의 효과 및 인센티브 부여방식에 대하여 공무원 등 관련 공공부문 담당자 및 전문가들에 대한 의견조사를 실시하였음
〇 외국제도와의 비교분석을 위하여 미국, EU, 독일, 네덜란드, 영국, 일본의 환경규제에서의 인센티브수단에 대하여 조사·분석을 실시하고, 외국 제도에 대한 면밀한 조사·분석을 위하여 네덜란드, EU본무, OECD 국외 현지 조사를 수행하였음
II. 주요 내용
□ 환경규제에서의 인센티브의 의의
〇 환경규제 인센티브의 의의
- 인센티브의 관점은 명령통제식의 규제수단보다는 시장적 유인 규제를 통해 발전되어 왔으며, 환경규제의 목적을 법을 준수하는 데에서 나아가 친환경적 행위유도를 효과적으로 극대화하고 자 하는 정책목적을 반영
- 규제설계 여부에 따라 규제준수율의 정도가 달라질 수 있으며, 나아가 규제가 정책목표를 효과적으로 달성하였는가 여부도 달라질 수 있는데, 이는 보다 근본적으로는 규제가 수범자의 행위를 효과적으로 변화시키는 힘으로 작용하였는가라는, 즉 인센티 브를 적절하게 부여했는가의 문제
- 따라서 여기서는 규제방식에 따른 분류를 떠나, 정책을 담고 있는 틀인 규제를 통하여 친환경적 경제행위를 효과적으로 유도할 수 있는 적절한 규제설계방식의 하나로서 인센티브라는 통 합적 관점에 입각하였음
〇 환경규제 인센티브의 종류
- 인센티브의 종류에는 행정, 경제, 평가에 의한 인센티브로 나누어 볼 수 있는데, 행정적 인센티브는 규제준수에 드는 부담을 경감함에 의하여, 경제적 인센티브는 가격 시그널에 따라 비용 부담의 감소를 통하여, 평가에 의한 인센티브는 수행성과나 외부적 인식 및 평가의 향상을 통해 주어짐
- 각각의 종류에 해당하는 것으로는, 첫째, 행정적 인센티브에는 조사부담 경감, 허가기간 연장, 적용기준 완화 등이 있으며, 둘째, 경제적 인센티브에는, 환경세, 배출권거래제, 오염배출부과 금, 보조금 부과 및 삭감, 금전부담 경감, 보험료 경감, 예치금, 손해배상제도, 조달에서 우선지위 부여, 재정원조, 사금융 투자 기회, 금전제재정도 감면 등이 있으며, 셋째, 평가에 의한 인센 티브에는 정보공개, 라벨링제도, 상벌제도 등이 있음
〇 환경규제 인센티브의 재정
- 친환경적 경제활동을 위한 인센티브를 부여하기 위하여는 이를 위해 필요한 재정이 뒷받침되어져야 하는 반면, 환경오염에 부과되는 비용과 저감 및 개선을 위한 인센티브를 통해 얻어지는 이익은 또 다른 재원이 될 수 있으므로, 양자간의 관계에 대한 고려를 통해 인센티브 제도를 현실화시키는 방안을 모색할 필요가 있음
〇 환경규제 인센티브 간의 결합
- 환경정책상 목적을 가장 효과적으로 달성할 수 있는 규제수단의 선택과 각각의 장단점을 고려한 다양한 규제수단간의 조합에 대한 고려가 필요하며, 잘 조합된 제도의 결합은 인센티브효과 를 높이는 반면, 그렇지 못한 결합은 인센티브 효과를 저하시킴
□ 현행 환경법령상의 인센티브제도 분석
〇 환경규제의 종류와 인센티브
- 환경규제의 종류에는 크게 나누어, 명령통제식 규제, 시장적 유인 규제, 자발적 규제로 나누어 볼 수 있으며, 각 규제수단은 장단점을 보유
- 명령통제식 규제는 일률적인 행위기준으로 적용상의 공평함으로 도모할 수 있으나 분산오염원에 대한 관리비용이 상당하고, 최저기준 이상의 개선행위 유도가 어려우며, 오염자의 자발적 행위유도를 기대하기 어려운 상황에서 적용하는 것이 효과적임
- 경제적 유인규제는 가격체계를 통해서 경제적 부담이나 이익을 제공함으로써 지속적으로 일정한 방향의 행위를 유도 또는 억지하는 효과를 가지는데, 제도 운영의 사회적 비용이 적게 들지 만 투자가 어려운 상황에서는 효과를 기대하기가 어려우며 경 제능력에 따른 역진적 효과를 가질 수 있음
- 자발적 규제수단은 직접적 규제수단이 기업에 지나친 부담이 되는 경우 규제의 본격적 시행 이전에 기업 자유의지에 따른 개선을 유도함으로써 규제저항은 낮지만 이행을 담보하기 어려 우므로 성과에 대한 인센티브와 결합할 것이 요구됨
- 우리나라 환경규제의 경우, 대부분이 명령통제식 규제에 해당하며 (90% 이상), 배출허용기준 위반율은 (대기가 8.7%, 수질이 7.9%: 2014년 기준), 배출부과금의 징수율은 (대기는 85.2%: 2014년 기준, 수질은 16.6%: 2014년 기준)로 상당히 낮은 편이었으나 최근에 다소 상승됨

- 최근의 규제개선정책의 흐름 하에 제시되어 온 스마트규제는 과학적 정보에 기반한 규제, 규제들 상호간의 관계, 입법에 대한 경제, 사회, 환경적 영향을 분석하는 통합적 평가에 관심을 두고, 보다 피규제자의 관점에서 규제부담을 최소화하면서 준수 율을 높이는 방향에 대하여 논의됨
□ 환경규제의 인센티브제도의 효과성에 관한 의견조사
〇 조사의 목적
- 환경규제 및 인센티브제도의 효과성을 파악하기 위하여는 규제에 따른 개선실태를 사실적으로 밝히는 조사가 필요하나, 이와 관련된 선행 연구의 부재로 관련 실무가 및 전문가들의 의견을 통해 간접적으로 파악하고자 함
- 관련 실무가는 관련 분야 공무원 및 공공 영역 종사자를 대상으로 하고, 관련 전문가는 학계 및 연구기관 종사자를 대상으로 함
〇 조사 내용 및 결과
- 환경규제 준수의 영향요인으로서, 대기업은 기업 이미지 등 평판에, 중소기업의 경우, 과징금·과태료 등 금전제재에 의해 더 큰 영향을 받는다는 의견이 다수
- 환경규제의 소요 비용에 관하여, 기업의 입장에서 더 큰 비용 부담이 되는 방식으로는 명령통제 방식이, 규제당국의 입장에서 더 부담이 되는 방식에 관하여는 공무원 등 집단은 경제적 유인규제방식이라는 의견이 다수인 반면(64.2%), 전문가 집단 은 명령통제방식규제라는 의견이 다수(72.5%)
- 구체적 예로는, 배출기준 초과시 과징금 등 부과, 배출부과금, 배출권거래제 가운데, 규제당국에게 가장 큰 비용부담이 되는 것으로는 공무원 등 집단은 배출권거래제를(45.5%), 전문가 집 단은 배출기준 초과시 과징금부과(52.5%)라는 의견이 다수였음
- 기업의 경제행위의 개선효과로서, 명령통제방식규제가 기업의 단기적인 오염물질 배출저감노력을 유인하는 효과가 더 큰 반면, 경제적 유인방식의 규제는 장기적인 친환경적 경영혁신 노력을 유도하는 효과가 더 크다는 의견이 다수임
- 오염비용의 사전·사후 부과방식 중에서는 사전부과 사후 환급 방식이 기업과 규제당국 모두에게 비용부담이 더 큰 반면, 장기적인 친환경영영 유도효과는 더 크다는 의견이 다수(단기적인 오염배출감소 효과의 경우는, 공무원의 경우는 사후 부과방식 이, 전문가의 경우는 사전 부과방식이 더 크다는 의견이 다수)
- 중소기업에 대하여는 환경규제를 유연하게 적용하는 것이 합리적인 것이라는 의견이 그렇지 않다는 의견보다 약간 우세하며, 부담완화를 위한 효과적인 인센티브 방안으로는 오염방지시설 의 설치 및 기술지원을 꼽은 의견이 다수임
- 동일 정책목적을 위한 복수의 환경규제 운용시 규제효과에 관하여는, 공무원의 경우 경우에 따라 다르다는 의견이 중복규제로서 규제효과가 반감된다는 의견에 비해 더 많음에 비해, 전문 가의 경우 중복규제로 규제효율성이 떨어진다는 의견이 다수임
〇 환경규제 인센티브 개선방향에 대한 의견
- 환경규제의 효과적인 운영을 저해하는 요소 중 가장 많이 나온 의견은 과태료 등 제재수단이 약하여 행위억지 기능을 못한다는 의견과 중복규제, 현실에 적용하기 힘든 비현실적 규제 등의 문제에 관한 것임
- 환경규제의 인센티브작용을 강화하기 위하여 제시되는 의견에는 다양한 행정적 인센티브, 경제적 인센티브, 평가에 의한 인센티브 방식이 제시되었으며, 환경성과에 따른 행정제재 부과시 부담경감이나 세재헤택 등 경제적 이익에 대한 우대 및 우수기 업 평가 및 홍보 등에 관한 의견이 다수 제시됨
□ 외국 환경규제에서의 인센티브제도의 비교분석
〇 미국
- 일찍이 이산화황, 이산화질소의 배출권거래제를 도입한 미국은 제도의 효율적 운영을 위한 인센티브 효과를 고려해 왔으며, 예를 들면, 지역 청정공기 인센티브시장 프로그램의 경우, 배출 권의 가격이 지나치게 올라가면, 벌과금, 프로그램의 억지력, 인센티브의 측면을 고려하여 수정할 수 있도록 함
- 또한 환경규제 위반에 대한 벌금에 있어서도 배상적 요소와 징 벌적 요소를 구분하여, 현실적인 정화 및 복구 소요비용, 당사자의 부담능력을 반영하면서도 당사자의 오염방지 노력 등 여부를 벌금수준에 반영함(BEN System)
〇 EU
- 1987년 세재, 부과금, 배출권거래제 등이 중요한 환경정책수단이 될 수 있음을 공표한 후, EU 통합 환경세와 부과금제도를 시도하였으나 현실화되지 못하고 각국의 국내 정책에 따름
- 통합오염관리제도를 통한 배출원별 수준에 맞는 개별적 기준제시를 가능케 했으며, EU 단위의 온실가스 배출권거래제를 실시 중이나 현재 초과공급상태로 계획된 유상할당이 연기됨
- EU단위의 에너지등급표시제, 에코라벨제도, Euro topten, 소매포럼 등 다양한 소비자의 친환경제품 판단을 위한 정보제공제도와 환경상, 녹색사과상 등 수상제도 등이 있음
〇 독일
- 전통적으로 명령통제식 규제수단에 기반한 규제체계를 가지고 있어 연방단위에서 비교적 다양한 인센티브제도가 운용되지는 않고 있으나, 주단위의 제도들 가운데 주목되는 제도들이 있음
- 바이에른 주 환경협약은 환경경영시스템 도입 기업들에 대해 재정 및 다양한 환경법의 적용상의 부담을 완화하는 제도를 시행함
- 방류폐수에 대한 부과금은 폐수시설 및 오염저감에 사용되도록 하고 있으며, 정수시설 확장에 따른 비용 등을 부담금에서 지원 할 수 있음
〇 네덜란드
- 네덜란드는 EU국가 중에서도 가장 광범위한 환경세제를 운영하여 왔으나, 최근에 재정개혁으로 일정부분 범위가 축소되었고, 에너지협약, 환경협약 등을 선구적으로 운영해 옴
- 지하수세, 수도세, 폐수처리부담금, 청정수계부담금, 수질오염부담금 등 다양한 물관련 부과금을 운영하여 확고한 재정을 확보하고 이는 주로 해당 지역에서 관리되며 사용됨
- 대기중 NOx에 대한 배출권거래제는 통합오염관리제도와의 관계에서 사실상 인센티브를 제공하지 못하여 최근에 중단됨
〇 영국
- 영국은 90년대 중반 이후 환경기반시설 확충노력의 일환으로 물처리 서비스를 민영화하였으며, 매립세, 통합부담금, 기후변화 부담금, 배출권거래제 등의 경제적 유인수단들을 개발·적용함
- 영국은 온실가스저감과 에너지효율성 향상을 위한 기술개발, 관련 사업투자, 소비 증가를 위해 관련 정보의 제공에 기반한 다양한 인센티브제도를 시행중이며, 에너지절감이나 탄소배출저감 부분이 구체적 이익으로 환원될 수 있도록 제도 설계됨
- 환경관리시스템의 개발 및 적용기업의 행정부담감소, 펀드와 연금 기금 등을 통해서 공적 자금이 녹색경제로 투자될 수 있도록 하고 있으며, 중소기업에 대한 환경컨설팅 바우처제도, 기술혁신의 시장확산을 위한 환경이노베이션 자문그룹, 폐기물의 자원화를 위한 산업체 간 매칭 물질교환을 통한 공생프로그램 등을 운영함

- 친환경제품과 서비스시장에서 세계적으로 높은 비중을 차지하고 있으며, 관련 녹색조달정책, 보조금, 감세, 환경기술인증제도 등을 시행해 왔으며, 주로 선도기업프로젝트, 경제단체의 자발적 협약에 의한 정책이 수행되어 왔으나, 최근에 관련 세재개편에서 지구온난화대책, 환경관련 투자촉진을 위한 방향을 제시함
- 최근 저공해 차세대 자동차 판매증가를 위한 각종 세재경감, 금융우대 조치 등을 실시하여 해당차 점유율이 24%까지 올라간 바 있으며, 「지구온난화대 책추진법」에 의한 자발적 배출거래제, 「환경배려계약법」에 의한 환경배려계약 등 기업의 자발적 노력의 유도와, 「환경배려촉진법」에 의한 환경정보의 의무공개, 환경투자 촉진을 위한 금융기관의 사업성평가방법 개발 노력을 추진해 옴

- 특정 정책목적을 위하여 관련 주체들에게 부과된 각 부담금 등으로 확보된 재정은 시장왜곡효과를 방지하고 개별 행위자인 기업의 입장에서 오염에 따른 비용부담 대신 오염방지에 투자하는 유도가 가능하도록 개별 행위자에 보다 직접적으로 영향을 미칠 수 있는 재정사용목적이 제시될 필요가 있음
〇 인센티브 혼합(Mix)에 대한 고려
- 각각의 규제수단 간의 조합들에 대한 사안별 분석을 통해 중복규 제로 규제효과가 떨어지는 경우에는 이를 통합하거나 폐지하고, 서로 다른 규제수단들 간의 결합을 통해서 행위유도력을 증진시 킬 수 있는 경우에는 보완적 규제수단을 도입할 필요가 있음
- 성공적인 제도결합이 되기 위하여는 적어도 하나의 제도에서 행위자가 행동을 변화를 줄 수 있도록 충분한 유연성을 부여 하여야 함
〇 환경규제 평가체계의 확립
-「행정규제기본법」은 기존규제에 대한 심사의 경우, 구체적인 심사기준이 법률로 제시되어 있지는 않고, 신설, 강화시 실시하는 규제영향분석제도가 대강의 평가기준을 제기하고 있으나, 각 규제종류에 따른 성격과, 규제운용에 있어 피규제자의 규제준수, 장 ·단기 규제효과, 복수의 규제들간의 상호관계에 관한 관점이 반영된 평가체계가 마련될 필요가 있음
〇 집행력 담보를 위한 금전제재의 현실화
- 환경규제 위반에 따른 금전적 제재수단이 정책목표 달성을 위한 행위 억지력을 발휘하기 위하여는, 규제의 시행에 필요한 행정비용이 고려되어져야 하며, 규제가 피규제자의 행위에 대해 억지력을 발휘할 수 있도록 규제의 비준수로 인해 부과되는 경제적 제재수준의 정도가 법을 준수하지 않아도 얻을 수 있는 경제적 이익보다 더 높은 수준에서 설정되어야 함
〇 자발적 개선행위 평가 및 보상의 체계화
- 환경규제 위반이나 준수여부에 대한 정보를 포함하여 기업의 친환경적 성과를 평가할 수 있는 환경정보의 체계적 운영과, 이에 근거하여 행정적, 경제적, 평가기반의 인센티브 등의 다른 인센티브제도와 결부하는 방안을 모색할 필요가 있음

- 명령통제식 규제에서부터, 경제적 유인규제, 자발적 규제 등 우리나라 환경규제 전반에 있어, 자발적인 행위를 유도할 수 있는 인센티브제도를 총체적으로 분석함으로써, 기존의 경제적 유인 수단 중심으로 논의되던 환경규제의 유도적 기능에 대한 이론적 논의의 외연을 보다 확장함
- 환경규제에서의 인센티브제도에 관한 여러 외국의 제도를 전반적으로 분석 정리하여, 모범사례와 비교자료를 제시함

O Environmental regulation has evolved in various directions. In recent years, “command and control” regulation has been gradually replaced by a new approach based on economic incentives, laying greater emphasis on the inducement of environmentally-friendly behavior among the regulated.
O However, while regulatory strength has been steadily increased over the years, generally proportionally to the extent of violations and pollution, the reduction of compliance burden and compensation for voluntary improvement, rapid corrective actions or environmentally-friendly economic activities are yet to be systematically considered.
□ Purpose of This Study
O The purpose of this study is to explore ways to improve the environmental incentive system in Korea so that they can more effectively encourage regulatory compliance and environmentally-friendly economic behavior.
O Its goal is to propose an effective strategy to strengthen incentives that is adapted to the current situation in Korea, which award
greater benefits to those who comply with regulations or make meaningful efforts toward more environmentally-friendly economic activities than those who do not.

O For comparison with countries outside Korea, incentives used as environmental regulatory instruments in the US, EU, Germany, Netherlands, UK and Japan are reviewed. For more accurate understanding of systems in place in these countries, field-based research was conducted internationally in Netherlands, at the EU Headquarters and the OECD.

□ Purpose of Incentives in Environmental Regulation
O Purpose of Environmental Compliance Incentives
- The approach to environmental regulation has progressively shifted away from traditional command and control regulation to incentive regulation based on market incentives. Such a shift reflects the new policy goal of moving beyond simple compliance to effectively induce environmentally-friendly behavior.
- Regulatory design affects the rate of compliance as well as the ability of a regulatory regime to ultimately attain its goal. The fundamental question is whether a regulatory mechanism is capable of changing the behavior of the regulated community; in other words, whether incentives are awarded in an appropriate manner.
- Hence, in this study, independently of the type of approach, all regulatory schemes and instruments designed to induce environmentally-friendly economic behavior under the larger policy framework are considered incentives.
O Types of Environmental Incentives
- Environmental incentives may be classified into three main
types: administrative, economic and evaluation-based incentives. Administrative incentives reduce burden associated with
compliance with environmental regulations. Economic incentives are intended to reduce costs of compliance through price signals. Finally, evaluative incentives reward compliant entities through improvement in performance and external recognition, reputation and evaluation.
- To cite concrete examples, administrative incentives may take the form of reduced inspection burden, extension of permit periods or application of preferential rules. Economic incentives can range from environmental taxes, emissions trading and air emission or wastewater discharge fees to subsidies, reduction of monetary burden and insurance fees, deposit requirements, damage compensation programs, priority considerations in government procurement tenders, financial assistance, opportunities for investment in private loans and reduction of monetary penalties. Lastly, evaluative incentives include information disclosure requirements, environmental labelling and various reward and punishment schemes.
O Financing of Environmental Incentives
- An incentive system to encourage environmentally-friendly economic activities requires financial resources to support its operations. As fees charged to polluting entities and economic gains from awarding incentives for reducing pollution and improving environmental performance can be additional sources of financing, these revenue elements and indirect profits must be also considered when designing and implementing an incentive system.

- For greater effectiveness, regulatory instruments that are most appropriate to the goal must be chosen and then combined together, if necessary, by taking into consideration the respective advantages and disadvantages of each instrument. A good mix of regulatory instruments can magnify the effects of incentives, while the opposite is true with poorly-paired instruments.
□ Analysis of Incentives under Current Environmental Regulatory Framework
O Types of Environmental Regulation and Incentives
- There are three main types of approach to environmental regulation: command and control regulation, incentive-based regulation and self-regulation. Each of these approaches has their own strengths and weaknesses.
- The command and control approach, although it guarantees greater fairness and equity in the applications of rules thanks to uniform standards, results in high costs of managing nonpoint pollution sources. Also, this approach rarely leads to the improvement of environmental performance beyond minimum required levels. Therefore, command control regulation may be a suitable option only in situations where voluntary efforts toward environmental improvement cannot be expected.
- The economic incentive-based regulation aims at encouraging or discouraging certain desirable or undesirable behaviors on a sustained basis by imposing economic burden on, or providing benefits to, regulated entities through price systems. While social costs are minimal for its operation, an economic incentive-based scheme may not be effective in a situation where the level of investment is low. Also, depending on economic capacity, this approach can lead to an opposite outcome.
- Self-regulation is an approach used when direct regulatory means are expected to impose excessive burden on companies. Frequently adopted during a phase-in period before the roll-out of a regulatory framework, this method seeks to encourage firms to make voluntary efforts to improve their environmental performance. Although the level of regulatory resistance is low, there is no real guarantee of actual compliance under this approach. Therefore, to induce effective changes in environmental behavior, this approach needs to be coupled with performance-linked incentives.
- In Korea, environmental regulation is mostly command and control regulation (over 90%). The rate of violation of emission or discharge limits (air emissions: 8.7%, water discharge: 7.9% as of 2014) and incidence of payment of exceedance fees (over 90% paid only basic emissions fees and about 50% were charged an exceedance fee as of 20**; 9.5% paid wastewater exceedance surcharges as of 2013) remain quite low.

□ Opinion Survey on the Effectiveness of Environmental Incentives
O Survey Goals
- Although the evaluation of the effectiveness of environmental regulations and incentives should be ideally based on actual data on performance improvement, due to the lack of existing studies on this topic, indirect insights were gained through the survey of opinions of officials and experts.
- Officials surveyed are government employees and other public-sector employees. Experts are either academics or researchers.
O Results
- According to the vast majority of respondents, the biggest influence factor for compliance with environmental regulations was the image and reputation of company for large corporations and fines and other monetary penalties for small and medium-sized enterprises.
- As for the cost of environmental regulation, most government employees (64.2%) were of the opinion that the command and control approach was costlier for companies than for the regulatory authority, while the economic incentive-based approach was costlier for the regulator than for companies. An important majority of expert respondents (72.5%), however, believed that the command and control regime was costlier for the regulator.
- The opinion of government employees again differed from that of experts concerning the costliest scheme for the regulator. The
former selected the emissions trading scheme (45.5%) over other choices such as the imposition of fines for exceedance of air emission or water discharge caps and basic emissions or discharge fees. For the latter, however, the imposition of fines was the top choice (52.5%).
- Regarding the effect of a regulatory approach on the improvement of economic activities of companies, the consensus was that while the command and control approach has mostly a short-term effect of triggering the effort to reduce the emission and discharge of pollutants, economic incentives tend to encourage long-term efforts toward the improvement of environmental performance through management innovation.
- Between advance pollution charges and postpaid charges, many respondents were of the opinion that advance charges coupled with subsequent refunds, although heavier in terms of cost burden both for companies and the regulator, are more effective in inducing environmentally-friendly business practices over a long term (concerning short-term effects on the reduction of emissions and discharges, government employees indicated that postpaid charges were more effective, while experts felt that advance charges were more effective).
- The number of respondents who believed that a flexible application of environmental rules was desirable for small and medium-sized enterprises was slightly higher than that of those who opposed it. A large number of respondents opined that setting up facilities and providing technical support toward the
prevention of pollution was an effective incentive for lowering regulatory burden on companies.
- With regard to operating several environmental regulation schemes for the same policy goals, government employees answered that its effectiveness depended on individual cases. Experts, on the other hand, expressed the opinion that double regulation would lessen regulatory effectiveness.
O Opinions on Ways to Improve the Environmental Incentive System
- Some of the issues that were most frequently pointed out by respondents as hurting the effectiveness of regulation were fines and other penalties that are not significant enough to have a deterrence effect on environmentally-undesirable behavior, double regulation and unrealistic rules that are difficult to implement or apply in a real-world setting.
- To strengthen the environmental incentive mechanism, a wide variety of incentive methods were proposed by respondents regarding administrative, economic as well as evaluative incentives. For administrative sanctions based on environmental performance, respondents offered a range of proposals, including easing regulatory burden and awarding tax benefits and other economic benefits. Respondents also offered input on evaluating companies and advertising and promoting those companies with strong environmental performance.
□ Comparison with Environmental Incentive Systems in Major Countries
o US
- In the US, an emissions trading scheme for sulfur dioxide and nitrogen dioxide has been in place since early on. For more efficient operation, the incentive effects of the program have been consistently considered. For example, in the case of the Regional Clean Air Incentives Market program, when the unit price of emission rights rises excessively, it can be adjusted by taking into account fines, the deterrence capacity of the program and the various incentives.
- Furthermore, for fines imposed for violation of environmental rules, compensatory and punitive elements are clearly distinguished. The amount of a fine, although based on actual cleaning and restoration costs and a company’s ability to pay, also reflects whether and to what extent the company is making efforts to prevent pollution (BEN System).
O EU
- In 1987, following an official announcement that taxes and charges and emissions trading programs can be important instruments for environmental policy, the EU made the attempt to impose union-wide environmental taxes and charges, which ultimately proved unsuccessful. Environmental taxation is, therefore, left currently to the government of individual member states.
- By setting up a comprehensive, global pollution management system, the EU authority has made it possible to issue separate guidelines according to the source of emission or discharge of pollutants. A union-level emissions trading scheme is currently in operation, but due to excess supply, the planned auctioning of allowances has been postponed.
- Various EU-level systems providing consumers with information needed to evaluate the environmental friendliness of products such as energy efficiency grades, eco-labels, Euro-topten and the Retail Forum have been set up, along with programs like the European Business Awards for the Environment and the Green Apple Awards.
O Germany
- The German system, since a long time based on traditional command and control-type regulatory schemes, comparatively lacks in variety of incentive components at a federal level. However, at the state level, there exist a number of noteworthy incentive programs.
- The Bavarian Environment Agreement, for instance, is an initiative to ease financial burden and the burden of compliance with the various environmental laws for companies introducing an environmental management system.
- The revenue from charges on wastewater discharges is used to support the operation of wastewater treatment facilities and pollution reduction programs. Costs associated with expanding water cleaning facilities are also covered by funds generated from wastewater discharge fees.

- The environmental tax system of Netherlands is unique even among EU states for its exceptional breadth. However, in recent years, the scope of taxation has been considerably reduced in some areas, in conjunction with the latest fiscal reform. Netherlands continues to play a pioneering role in the union, in such areas as energy and environmental agreements.
- Various water-related charges and fees, ranging from underground water tax and water supply fee to wastewater treatment contribution, clean water system contribution and water pollution contribution, provide a solid source of revenue. These charges and fees are managed, collected and used at a local level.
- The emissions trading program for atmospheric NOx was recently pending, as it failed to provide real incentives in relation to the global pollution management system.
O UK
- In the U.K., water treatment services were privatized in the mid-1990’s as part of an effort to expand basic environmental infrastructures. Economic incentives such as a landfill tax, global contribution, climate change contribution and the emissions trading scheme have been developed and implemented.
- Under the goal of cutting greenhouse gas emissions, developing energy efficiency improvement technologies and increasing investment and consumption in related business projects and products, a wealth of incentives, designed based on relevant data, are currently offered in the U.K.. The system is conceived in such a way as to be able to convert the reductions in energy use and carbon emissions into concrete profits.
- Through the development of an environment management system and reduction of administrative burden on regulated firms and through various funds and pension funds, public funds are invested in the green economy. Programs in place to assist firms include the environmental consulting voucher program for small and medium-sized enterprises, environmental innovation consulting group aimed at accelerating the market diffusion of technological innovations and the materials exchanges whereby companies exchange their surplus resources against resources matching their needs, allowing the recycling and reuse of industrial waste.

A green procurement policy, subsidies, tax reduction and the environmental technology certification program have been the key components of environmental regulation in Japan. While environmental initiatives have been carried out mainly in the forms of leading company projects and voluntary agreements with economic organizations, during the recent reform of related taxes, a series of global warming countermeasures were proposed along with directions for accelerating environment-related investment.
- More recently, under the goal of promoting sales of next-generation low-emission cars, various taxes were lowered or remitted entirely, with financing deals offered at preferential rates. These measures successfully boosted the market share of low-emission cars, to as much as 24%. Meanwhile, through such programs as the voluntary emissions trading scheme pursuant to the Act on Promotion of Global Warming Countermeasures and the Environmental Consideration Agreement pursuant to the Environmental Consideration Agreement Act, the Japanese regulator is encouraging voluntary participation in the effort of environmental protection among firms. Meanwhile, the disclosure of environmental information is mandatory in Japan, pursuant to the Act on Promotion of Environmental Considerations. Finally, to promote environmental investment, efforts are currently underway for the development of a business potential evaluation model for use by Japanese financial institutions.
□ Policy Proposals for Legislative Improvement
O Improving Regulatory Fairness
- When incentives produce effects of varying strengths depending on the regulated entities, there is a need for more detailed consideration according to the type of entities and the individual situation facing them. Particularly, in the case of small and medium-sized enterprises, it may be necessary to provide them with consulting services to help them understand and comply with environmental regulations and improve management in a way that meets the policy goal.
O Allocation of Fiscal Revenue Generated from Regulation
- For fiscal revenue generated from the various charges and fees levied for a specific policy goal, the intended uses of funds must be identified and stipulated so that they may be allocated toward the prevention of market distortion and to help firms invest in reducing pollution rather than just shouldering the cost burden of pollution; in other words, in a manner to produce a direct impact on individual actors in environmental efforts.
O Considerations on Structure/Combination of Incentive
- By analyzing the various structure/combination(mixes) of regulatory instruments and schemes individually, according to their intended goal, those that constitute double regulation and decrease regulatory effectiveness must be consolidated or eliminated. Meanwhile, if different regulatory instruments can gain in incentivizing power when paired together, they must be introduced together as complementary instruments.
- In order to successfully combine regulatory schemes, at least one of them must be allowed enough flexibility so as to effectively produce changes in the behavior of the regulated.
- The Framework Act on Administrative Regulations does not stipulate concrete criteria for the evaluation of existing regulations, while it sets forth general guidelines for the analysis of regulatory effects, performed on newly-enacted regulations or regulations that are amended to increase the stringency of existing requirements. Therefore, there is a need for a comprehensive evaluation system which reflects the characteristics of the various regulations and takes into consideration the issue of compliance from the perspective of regulated entities.
O An Evaluation Framework for Environmental Regulations
O Monetary Sanctions which Can Realistically Guarantee Compliance
- In order for monetary sanctions for environmental violations to be able to enforce desirable behavior in accordance with the policy goal, administrative costs associated with the implementation of related rules need to be considered. Moreover, monetary sanctions need to be in amounts sufficiently important so that economic costs of non-compliance far exceed profits that can be gained while remaining in non-compliance.
O A Comprehensive Action for Systematic Evaluation and Compensation
- A systematic administration of environment related information to evaluate companies including compliance or breach by companies, environmental protection and based on that find a mechanism to link admistrative, economic and evaluation based incentives with other incentives.

- By analyzing a comprehensive range of regulatory incentives used in Korea to encourage voluntary participation in environmental efforts, ranging from command and control to economic incentive-based regulation and self-regulation, this study broadened the horizons of theoretical discussion on the inducement of compliance in environmental regulation.
- The highlights of incentive systems in place in major countries around the world are provided so that they may be benchmarked as best practices and compared with the Korean system.
