○ 장례지도사 등 장례인력 양성과정에 다양한 가족에 대한 이해도와 성인지 감수성을 높일 수 있는 커리큘럼이 포함되어야 함.
○ 1인 가구, 비혼, 딸만 있는 가족 등 가족이 다양해지고, 가족 내에서 이미 성별 위계와 가부장적 가치관이 흔들리는 변화가 발생하고 있고,인식조사결과에서 드러난 바와 같이 성 불평등한 장례문화에 대한 불만과 변화의 욕구도 상당히 높음. 장례인력의 양성에 있어 교육내용과 커리큘럼은 변화하는 가족 문화와 성평등 가치에 맞추어 업데이트되어야 함. 다양한 가족에 대한 이해와 성인지 감수성은 교육내용에 반드시 반영되어야 함.

○ 장례인력 양성과정에 있어 교재 컨텐츠가 개발되어야 함은 물론, 그간 문제의식 없이 무비판적으로 답습한 장례에 있어서의 가부장적이고 성차별적 문화에 대한 성찰과 개선을 위한 연구 및 대안적 장례 콘텐츠 개발이 앞으로 지속적으로 이루어져야 함. 장사법 제33조의4에 근거한 장사지원센터의 업무에 이미 “장사정책・장례문화의 연구 및 콘텐츠 개발”이 이미 규정되어 있음. 정책적 관심과 노력이 필요한 부분임.
다. 헌법 가치에 맞지 않는 가부장적이고 성 불평등한 장례문화 관련 법제의 개선
○ 호주제도가 폐지되었음에도 불구하고 장례에서는 “주상(主喪)” 또는 “상주(喪主)”라는 이름으로 장자와 장손이 3일의 장례 기간 동안 “호주(戶主)”와 유사한 지위를 부여받고 가부장적인 의례를 시연함. 장례가 끝나고 나면 제례에서 이들은 “제주(祭主), 제사주재자”로서 명절과 기일마다 반복적으로 의례를 시연하게 됨. 민법에서 호주는 폐지되어 삭제되었으나 상주와 제주는 아직도 법제에 명시되어 유지되고 있음.가정의례준칙 상 장례 관련 규정은 간소화의 방향과 방식이 잘못되어 애도의 본질은 사라지고 불합리하고 전근대적인 의례에 가부장성과 성 불평등한 절차와 역할은 명맥을 유지하고 있음. 존치여부에 대한 근본적인 고민을 포함하여 헌법가치에 부합하지 않는 전근대적이고성 불평등한 요소들은 걷어내는 작업이 필요함.
라. 성평등한 장례문화 확산을 위한 홍보・캠페인
○ 성평등한 장례문화 확산을 위한 홍보・캠페인도 필요한 부분임. 장례문화는 간소화와 대안적 방식, 자연장, 수목장 등 인식 개선과 문화확산이 필요한 여러 이슈들이 있음. 전반적인 장례문화에 대한 성찰과 우리 사회의 변화에 맞는 장례문화의 확산을 위한 정책적 노력이 함께 이루어져야할 것임.
2. 가부장적 혈연가족에서 다양한 개인과 가족으로
○ ‘혈연 가족’이라는 협소한 기준만으로 장례의 자격과 권한이 부여되는 현행 장례문화가 가족형태 및 구성, 관계의 다양성에 적절히 조응하지 못하는 한계를 노출함에 따라 향후 이와 관련된 법・제도 개선이 요구됨.
가. 가족 형태와 관계없이 누구에게나 최소한의 추모 보장
○ 삶을 다하고 떠나는 사람과 떠나보내는 사람 누구나 최소한 인간으로서의 존엄이 보장되어야 함. 어떠한 죽음이라도 마지막 가는 길까지는 존중받고 보살펴질 권리가 있음. 고령화와 가족 변화, 개인화를 맞이하고 있는 일본과 대만은 이미 사회보장체계에 장례를 포함하고 있음. 최소한의 마지막 존엄은 가족 형태와 관계없이, 그리고 가족에 의존하지 않고도 보장될 수 있어야 함. 장례는 돌봄의 마지막임. 돌봄의 부담을 가족으로부터 국가와 사회가 덜어가는 것처럼 돌봄의 마지막인 장례도 사회와 국가가 최소한의 보장을 고려하기 시작해야할 것임.
나. 가족관계 변동에 따른 가족범위 확장
○ 가족관계의 변동에 대응하지 못한 채 장례의 주체로서 사실혼, 비혼 동거 가족, 공동체 등을 배제한다면 결국 그 부담은 국가와 지자체가 감당해야 함. 이미 문제되고 있는 무연고 장례의 이슈에서 기존의 제도 밖의 다양하고 새로운 관계의 당사자들이 기꺼이 하고자 하는 마지막 돌봄으로서의 장례와 추모의 기회를 허용 받지 못하는 문제는 조속히제도개선을 통해 해결되어야 함.
○ 이를 위해서는 혈연과 법률혼으로 이루어진 가족 중심의 장례 관련 법규들의 개선이 필요함.
○ 장사법 제2조 제16호의 정의규정이 정비되어야 함. 동거인, 사실혼관계 등을 명시하면서, 시신인수 여부를 확인은 순서대로 하도록 하는 규정의 모호한 해석이 발생하지 않도록 하여, 장례 의사가 있는 자가 장례를 치를 수 있도록 규제가 풀려야 함. 사망진단서의 교부를 받을 수 있는 배우자와 혈족 중심의 가족 범위 역시 확대되어야 함. 의료법 제17조는 비혼 동거당사자의 사망진단서를 포함한 각종 의료 진단서의 교부 자격 문제가 모두 연동되어 있음. 범위에 “환자(본인)가 지정한 자”를 포함하는 것으로 접근하는 방안도 생각해 볼 수 있음.
다. 후견제도의 보완 등-사후자기결정권 보장을 위한 제도적 보완
○ 비혼, 1인 가구, 제도 밖의 친밀한 관계에 있는 당사자들이 자신의 죽음 이후 장례 등을 부탁하고 준비할 수 있도록 제도적 편의를 제공하여야 함. 현행 임의후견제도는 피후견인이 사망하면 대리권이 종료되므로, 사후의 자기 결정권을 보장받을 수 있도록 정비와 보완이 필요함. 신탁제도, 유언제도의 활용도를 높이고, 후견인의 사후사무처리를 위한 제도적 보완이 강구되어야 함. 또한 후견비용의 부담을 경감시켜 이용의 장벽을 낮추기 위한 방안이 필요함.
3. 의례와 절차 중심의 장례에서 추모와 애도가 있는 장례로
○ 의례와 절차에 압도된 고비용, 고부담 장례문화 개선을 위한 정책적 개입도 요구됨. 이와 관련해서는 고인에 대한 추모와 남겨진 가족들에 대한 위로를 중심으로 다양한 애도가 가능하도록 돕는 지원 체계 및 사회적 여건 마련이 필요함.
가. 고비용 장례문화 개선
○ 장례의 간소화와 고비용 문제의 해결은 상업화된 장례와 의례 중심의 장례에서 벗어나 대안을 모색하는 데에 있어 중요한 요소임. 현실적으로 고비용 장례문화의 문제는 가장 이용자들의 피부에 와 닿는 이슈이며,인식조사결과에서도 그 필요성에 압도적인 동의가 있었음. 고비용 장례문화는 장례비용이 없어 시신인수를 거절해서 가족이 있음에도 무연고장례로 갈 수밖에 없는 안타까운 사례의 주요 원인이기도 함. 고비용 장례문화의 개선을 위한 정책적 지원으로는 작은 장례식 캠페인이라든지, 작은장례 정보센터 운영을 통한 가격 공시, 다양한 장례식을 지원하는 시설,업체 정보 제공 등을 제언할 수 있음. 공공의료기관, 시민청 등 공공시설을연계한 다양한 장례식을 위한 공간을 제공하는 방안도 필요함.
나. 죽음과 장례에 관한 일상적 준비를 지원하는 사회분위기/문화 조성
○ 장례문화의 개선을 위해서는 경황없이 업체를 통한 전형적인 의례에 따르게 되지 않도록 본인 또는 가족이 미리 자신의 장례를 생각해보고 준비하고 기획하는 문화의 정착이 함께 이루어져야 함. 이를 위해서는 정책적으로 건강가정지원센터 등과 연계하는 등의 방식으로 개인 또는 가족이원하는 장례를 준비, 계획할 수 있는 프로그램을 마련 및 제공하는 방안도 생각해볼 수 있음. 또한 사전장례의향서 작성 엔딩노트 등, 삶의 마무리를 위한 준비 등의 활동에 정책적 관심과 지원을 강화하여야 할 것임. 아울러 제도적으로 유언제도, 앞서 언급한 신탁, 사후사무처리 등 삶을 마무리하는 데에 제도적 툴을 마련해주는 노력도 함께 이루어져야 할 것임.

Funeral rituals, among families, have acted as a mechanism in which gender inequalities are maintained and reconfirmed via patriarchal formalities and procedures. Despite that, in the name of traditions, customs, and a private family culture, they have been overlooked or passively supported in the context of policy and systems. However, it is necessary to review whether such a funeral culture accords with the value of gender equality oraccepts changes in family systems. In connection with practicesand funerals that have been manualized in the life-ending industry, it is also required to review frameworks and contextsassumed by related legal systems, to examine how they areimplemented in our daily lives, and to seek ways to improve them, from gender perspectives. This paper is designed to look intofuneral culture-related issues from gender perspectives and in terms of family changes and to identify policy and institutional measures for their improvement.
This study was conducted in the following ways. Experts’ opinions were reflected through advisory meetings, reviewing local and foreign literature, data, and legal systems. Focus group interviews(FGIs) were held with those who have ever attended the funerals oftheir family members or relatives over the past three to five years,as well as with thirty related activists, in order to gather opinions(assessment and alternatives) on Korea’s funeral culture and to prepare questions for research on the status of Korea’s funerals. Anonline survey of about 1,300 adults in their twenties through fifties was carried out to figure out the status of Korea’s funeral cultureand their attitudes towards an alternative funeral culture andpolicies. The results were analyzed thoroughly for this study.
FGIs produced and identified the following results and implications, respectively:
First, interviewees are found to have experienced a patriarchal and gender-discriminatory funeral culture. In the process of carrying out male-dominated rituals and procedures, women are marginalized or isolated while in the patriarchal funeral culture, there isdiscrimination between the father’s side and the mother’s side. Inparticular, gender roles are unreasonably separated in rituals and procedures. Such funeral practices are involuntarily chosen and implemented through commercialized and standardized productservices offered by mutual aid companies and funeral directors.
Second, in Korean society, three-day funerals are generally held at funeral halls under the guidance of mutual aid companies and funeral directors. Such a routine leads to standardized funeral services, funeral culture based on rituals and procedures, and a commercialized funeral culture where the focus is placed on purchasing predetermined rituals and procedures that are not planned based on survivors’ choice and participation. In the process, the dead are not properly revered or mourned, causing the deceased and survivors to be isolated.
Third, the current funeral culture is also characterized by blood ties, typical families, and patriarchal family order. Therefore, the culture is found to have failed to reflect not only realities facingsingle-person households, single-parent families, cohabitation, defacto marriage-based families, and others but also changes in typical families.
Fourth, identifying the diverse limitations of the current funeral culture, it is found that the culture needs to be enhanced byreflecting realities facing families and changing attitudes. Inconnection therewith, participants propose that unnecessary procedures and formalities be removed, focusing on the remembrance of the deceased and consolations to survivors, and that real sorrow be expressed via one-day funerals, advance funeral services, photo exhibitions, receptions, and so forth,rather than simply following predetermined rituals and formalities.
Fifth, in order to improve funeral culture by reflecting changing attitudes and realities facing families, social attitudes towards funerals should be revised, making necessary efforts at an individual level. At the same time, legal systems should beenhanced, reflecting realities facing individuals and families thathave experienced various lives.
For this study, a survey on the status of Korea’s funeral culture and on citizens’ awareness of an alternative funeral culture andpolicies was conducted, producing the following results:
In connection with gender inequality exposed by Korea’s funeral culture, the following issues were raised. A majority of participants think that men act as chief mourners or key decision-makers while women play secondary and auxiliary roles in the process of conducting funerals. A higher percentage of respondents are against Korea’s hierarchical funeral culture characterized by roles differentiated by gender, arguing that such a culture should change and does not reflect recent changes in family structure. In terms offuneral procedures and formalities, they recognize the problems of funerals featuring empty formalities and vanity and high costs. A bigger percentage of respondents agree that high-cost funerals should be avoided, simplifying formalities and procedures. A higher portion of female and young participants recognize the problems of the current funeral culture characterized by gender inequality and empty formalities and vanity, agreeing that such a culture should change. In particular, there are statistically significant differences by gender in the area of improving funeral culture. Specifically,more women than men are found to demand gender-equal,low-cost, and simplified funerals.
Citizens’ attitudes towards an alternative funeral culture were also explored, showing that there is a gap between Korea’s current funeral culture and what people really want. In other words, respondents demand gender-equal and simplified funerals based on close relationships or various funerals customized to individual needs, rather than the current funeral culture characterized by gender inequality and empty formalities. More women than men ask for gender-equal funeral systems but both highly recognize needs for an alternative funeral culture. Reflecting a gap betweenKorea’s current funeral customs and what people really need, a higher percentage of participants acknowledge the needs forappropriate policies.
Based on such research results, this paper delivers the following policy suggestions in order to improve Korea’s current funeral culture featuring patriarchy and gender inequality and to promotefuneral culture properly reflecting changes in families and society.
First, policy and institutional efforts are required to promote funeral culture without gender hierarchies and discrimination. Funeral experts training programs should include curricula that improve gender sensitivity and the understanding of various types of families, conducting research on changing a gender-discriminatory funeral culture and developing alternative funeral contents. Legal systems should also be revised in connection with a patriarchal and gender-discriminatory funeral culture that is not in harmony withwhat the Constitution promotes. Moreover, a PR campaign shouldbe implemented to disseminate a gender-equal funeral culture.
Second, revising legal systems, the focus should shift from patriarchy and blood ties to alternative systems that reflect changes in family and society in order to enable a variety of individuals and family members to honor the memory of the deceased. Institutional and policy considerations are required to enable everyone to properlyrevere the memory of the dead, regardless of family types. Takinginto account changes in family relationships, it is necessary to revise legal provisions whose focus is placed on families based on legal marriage and blood ties. Guardian systems should also be revised to enable ‘singles,’ ‘single-person households,’ and ‘those who maintain close relationships out of the system’ to ask and prepare for funerals in advance. In the same vein, institutional reforms should beimplemented to ensure posthumous self-determination.
Third, funeral services should shift their focus from rituals and procedures to remembrance and mourning. Policy intervention is also required to improve funeral culture characterized by rituals, procedures, heavy burdens, and high costs. In connection therewith, necessary support systems and social conditions should be set up to enable various forms of condolences to be used, focusing on the remembrance of the deceased and consolation to survivors. It isnecessary to create a social atmosphere and culture where citizensare supported to casually prepare for deaths and funerals. To this end, policy support including programs and training should bestrengthened, establishing institutional arrangements such as last wills, trust, and posthumous business management, and so forth inorder to help prepare for deaths.
