국내 창업생태계는 최근 창업·벤처기업의 증가, 창업투자의 증가 및 다변화, 글로벌 지표의 호전 등 긍정적으로 발전하고 있다. 이는 지난 20여년 간 정부가 다양한 제도와 정책으로 창업생태계를 지원한 것에 힘입은 바 크다. 하지만 국내 창업생태계는 여전히 금융접근성의 부족, 기술창업의 부족, 정부 의존 과다, 사업실패 후 사회안전망의 미흡, 글로벌 확장 미진 등의 문제점을 안고 있다. 이에 따라, 20여 년간 이어진 국내 벤처·창업 관련 법·제도를 전반적으로 검토하고 개선할 필요성이 제기된다.

본 연구의 목적은 ICT 분야 창업 환경 변화에 발맞추어, 20여년에 이르는 국내 창업 관련법·제도의 내용과 성과를 파악하고, 혁신적이고 지속가능한 창업생태계 조성을 위한 관련 제도정비 및 개선방안을 도출하고자 한다. 크게 벤처기업 관련 법률 및 제도 현황을 파악하고, ICT분야 기업을 대상으로 설문조사를 수행하여 제도를 평가하며, 벤처·창업 관련 제도의 개선 방안을 도출한다. 연구 목적 달성을 위하여 문헌연구, 설문조사, 전문가회의 등이 수행되었다.
연구결과, 국내 벤처·창업과 관련한 법·제도는 크게 창업지원법, 벤처특별법, 기술혁신 촉진법, 1인 창조기업법, 조세특례법 등을 들 수 있다. 대표적으로 창업지원법은 창업의 정의 및 지원사업, 창업절차의 간소화, 창투회사 및 조합, 액셀러레이터, 보육센터 등의 내용을 담고 있으며, 벤처특별법은 벤처확인제도, 모태조합 및 한국벤처투자조합, 벤처집적지, 벤처기업 관련 특례 등을 다룬다.
벤처·창업 관련 제도에 대한 ICT 중소기업들의 인식을 설문조사로 확인하였는데, 정책자금, 보조금, 세제혜택과 같은 직접지원에 대한 인식과 활용, 그리고 만족도가 높게 나타났으며, 벤처확인제도를 이용하는 주된 이유도 기술성·사업성의 대내 홍보 효과 외에 정부의 지원 수혜로 꼽혔다. 제도 이용과 성과에 대한 회귀분석의 결과에서도 벤처확인 자체는 기업 성과에 영향을 미치지 않으나, 벤처확인제도를 통한 정부의 직접지원이 매출, 고용, 혁신, 해외진출에 긍정적인 영향을 미치는 것으로 나타났다.
이러한 분석결과에 따라, 제도 개선 방안으로 연구기관 창업투자 기능 확보를 통한 기술창업 활성화, 민간투자자 위주로 조세제도 개편, 실패 안전망으로서의 스타트업 공제제도의 도입, 민간투자와 기술창업 위주로 벤처확인제도 개편 등을 제시하였다.

First, venture- and startup-related laws and systems were reviewed, focusing on the Startup Act, the Special Act on Venture Businesses, the Technology Innovation Promotion Act, the One-Person Creative Business Act, and the Special Taxation Act.
Then, a survey of small- and mid-sized ICT companies was conducted to check their awareness and use of such systems. According to the results, their levels of awarenes and use of and satisfaction with direct aid such as policy funds, subsidies, and tax benefits were estimated to be high. Among existing systems, tax benefits and startup procedure simplification were highly evaluated while employment, M&A, and collectionrelated systems (KONEX) were poorly assessed. The businesses had great expectations of new systems such as re-startup support and M&A, with venture companies and young businesses that were founded less than three years ago showing high interest in investor-related systems such as accelerators, angel funds, and crowd funding.
The effects of government support and the venture certification system on business performance were also analyzed empirically. According to the results, venture certification itself did not have any effects on sales and employment, even with loan-based certification having a negative effect. However, the venture certification system was found to have positively affected businesses’ entry into overseas markets and patent application. In particular, the positive effects of R&D-based certification on companies’ entry into international markets are deemed to be significant. In the context of government support, direct aid and tax benefits have positive effects on sales, employment, patenting, and overseas expansion. Direct financial aid to businesses is deemed to have enabled firms to use more resources and to attain better performance. Given the close relationship between the venture certification system and government direct support, government support, tax benefits, and so forth are deemed to have helped companies secure financial resources and achieve better performance while the venture certification system itself is not considered to have directly affected business performance.
Based thereon, we identified and presented ways to improve venture and startup- related legal and policy systems, taking into account the aforementioned issues such as a lack of access to financial systems, a shortage of technology-based startup, excessive reliance on the government, a scarcity of social safety nets, and insufficient global expansion.
First, crafting provisions on concurrent offices for faculty members and researchers at universities and research institutes, reflecting startup performance in faculty assessment systems, and helping universities and research institutes offer startup funds were presented to activate technology-based startups. In particular, enabling universities and research institutes to provide startup funds (venture capital, etc.) is deemed to be an effective way to react to technology-based startup-related issues such as long-term commercialization and risky high-technology business.
Second, ways to boost private investments were proposed herein to alleviate startups’ heavy reliance on the government. As analyzed via the analysis of the survey of companies, local startups rely heavily on the government’s financial support and accordingly produce different business results. However, government subsidies and tax benefits are considered as a simple financing system and therefore can be effectively replaced by private investments. In case private investments are activated, the startup ecosystem can be converted into a private sector-led structure. To promote private investments, we proposed more tax benefits for investors, relaxation of regulations on the percentage of mandatory investments and overseas investments by venture capital funds, and easing of stake regulation to support corporate venture capitals.
Third, this study presented ways to set up social safety nets that are used in case of startup failure. It was proposed that relaxing regulations on joint surety, tax nonpayment, and tax collection, which have recently been key areas of interest in policy-making, be expanded for regional credit guarantee organizations and savings banks and that sunset laws be extended. The mutual aid system for startups was also proposed to be introduced to ensure economic stability and to help entrepreneurs stage a comeback after business failure.
Fourth, this paper presents how to improve the usefulness of the venture certification system and to make it more effectively differentiated from others. The venture certification system should shift its focus from guarantee/loans to private investments. In addition, a new type of startup certification, businesses founded via core technologies developed by universities and research institutes, should be included as policy beneficiaries. Guarantee- and loan-type certification can be integrated and operated in the current INNOBIZ system through which policy agencies’ capabilities to assess technical performance will be continuously utilized.
Lastly, given the effects of ‘the Special Act on Venture Businesses’ on the local venture ecosystem, the system is projected to be ceaselessly maintained. Therefore, the permanent use of the Act needs to be discussed on a long-term basis. It can merge with the Startup Act or be reborn as a new permanent statute. Or, its legal prescription can be extended. Considering the temporary nature of the Special Act on Venture Businesses and differences between general startups and innovative startups, more policy discussions need to be made in the future.
