나. 정책 제언(1): 민간의 자율적 데이터 활용기반 조성
1) 데이터 유관 법령 재정비
첫째, 개인정보보호법의 조속한 추가 개정이 필요하다. 개인정보보호법상의 정보통신서비스 특례조항과 일반조항 간의 화학적 결합을 위한 법개정 추진이 필요하다. 특히 개인정보 사전 동의 규제의 합리적 개정을 전제로 개인정보 주체의 실질적 자기결정권과 관련한 개인정보 이동권, 프로파일링 대응권 조항의 도입이 추진되어야 한다. 또한, 개인정보 보호법 개정 필요성에 대한 정기적인 연구와 검토를 법률에 규정하는 방안도 고려해볼 수 있다.
둘째, 각 부처의 데이터 정책과 관련한 갈등 내지 이견을 국가 전체 데이터 산업 정책과 개인정보보호정책이 균형 있게 조정될 수 있는 거버넌스 체계 수립이 필요하다. 단기적 방안과 중장기적 방안을 구분하여 수립하되 데이터 정책과 관련한 각 부처의 이견 내지 갈등을 신속히 조정할 수 있는 정부조직 차원에서의 방안 마련도 포함할 필요가 있다.
2) 데이터 활용 테스트베드 확대 · 개선
스타트업, 중소기업, 대학, 연구소 등 기술 · 비즈니스 혁신 주체에 필요 데이터를 제공하는 테스트베드 확대 구축이 필요하다. 테스트베드에서는 공공 · 행정 · 데이터댐 데이터를 포함하여 금융, 통신, 의료, 에너지, 교통, 유통 등과 같이 민간에서 거래와 활용에 대한 수요가 높은 데이터를 결합 · 비식별화 조치 후 제공되어야 한다.
테스트베드의 기획, 설계, 구축 단계에서는 다양한 기업, 연구자 등 데이터 활용 주체의 수요조사와 참여가 필요하다. 현재 빅데이터 플랫폼은 사업 참여주체 단위로 분절되어 있는데, 이를 전산업, 전주제, 전범위의 비정형 빅데이터로 확장이 필요하다. 또한, 테스트베드의 성공적 운영을 위해 ICT 규제샌드박스 중 데이터 관련 규제샌드박스와의 연계가 필요하다.
3) 데이터의 안전한 이종결합 환경 조성
첫째, 안전한 데이터 이종결합이 가능한 환경을 조성하기 위한 기술의 연구개발 및 상용화에 투자가 확대되어야 한다. 개인정보의 비식별 조치의 안정성을 담보할 수 있는 SW · HW 기반 보안기술의 기술개발을 통해 데이터 이종결합을 통한 부가가치 창출 기반이 구축될 것이다. 특히 동형암호의 경우, 전산업에 활성화되려면 알고리즘 개선뿐만 아니라 동형암호 하드웨어 가속기 또한 개발이 필요하다.
둘째, 데이터 플랫폼(거래소) 및 데이터 중립지대에서의 이종데이터 결합 기능을 정의하고, 민간에서 구축하여 운영할 수 있는 제도적 장치를 마련해야 한다. 플랫폼 또는 중립지대 내 데이터 결합 전문기관 지정(구축)을 통해 다양한 산업의 데이터 이종결합을 활용한 데이터 기반 맞춤형 서비스 창출이 가능해질 것이다.
4) 데이터 활용 전문인력 양성
첫째, 산업별 데이터 활용 전문인력 교육프로그램을 확산해야 한다. 산업별 데이터 특성을 이해하여 인공지능 기술을 활용할 수 있는 맞춤형 커리큘럼 개발 및 HW · SW 인프라가 확충되어야 하며, 중소기업의 데이터 산업 생태계의 진입장벽을 낮추기 위해 도메인 지식을 갖춘 재직자 대상의 데이터 활용 전문 교육 프로그램 추진이 필요하다.
둘째, 지역특화 데이터 산업 생태계 활성화를 위한 혁신 클러스터 구축이 필요하다. 이는 곧 데이터 기반 연구 및 창업을 지원하고 지역정주형 고급인력 일자리를 창출할 수 있는 산학연 상생 클러스터 구축을 의미한다. 또한, 인공지능 및 데이터 활용 인재양성 프로그램과 연계하는 지자체 및 공공기관 데이터 전문관 제도가 필요하다.
다. 정책 제언(2): 수요자 중심의 공공데이터 전주기 혁신
1) 공공데이터 재사용 원칙 수립 및 활성화
첫째, 공공 부문이 보유한 데이터를 공익적 목적에 한해 활용할 수 있도록 데이터 재사용 원칙을 수립하고 정부가 이를 보장해야 한다. API 등 실시간으로 데이터를 제공할 수 있는 기술적 기반을 마련하고, 연구자들의 요청에 즉각적인 회답이 가능하도록 제도화하는 등의 인프라 구축과 함께, 공공 부문은 물론 연구기관, 연구기금 등 정부 재원이 투입된 데이터는 연구자들에게로의 자유로운 공개를 원칙으로 해야 한다.
둘째, 민간정보 활용에 있어서 필요한 기술적 조치를 명확히 하고 활용 절차의 투명성과 책임성 확보를 위한 법적 기반을 마련해야 한다. 익명처리, 가명처리, 차등 프라이버시 등의 개인정보보호 강화기술을 개발 · 적용하여 연구 · 통계 기록 등의 목적을 위한 개인정보, 민감정보, 상업적 기밀정보 등의 안전한 분석과 활용을 도모해야 한다. 또한, 정보주체의 권리를 침해하지 않는 선에서 공익적 목적에 한하여 보호된 데이터를 재사용할 수 있는 법적 기반을 마련해야 한다.
2) 공공데이터 전주기 고도화
첫째, “데이터의 질”을 고도화하고 수집처를 다양화하기 위해서 “활용된 데이터”의 결과가 수집 및 유지 · 파기 등 전 단계에 공유되어야 한다. 이는 데이터 댐 관련 사이트의 사용자 관련 메타데이터 확보 및 분석을 통한 어떤 데이터가 가장 많이 활용되는지를 모니터링하는 것이다.
둘째, 데이터 환류체계에서 데이터의 종류에 따라 생성, 공급, 피드백 과정을 명확히 모니터링 해야 한다. 이에 따라 필요한 도구나 시스템, 또는 프로세스 및 규약의 필요성 등을 정의하는 것이 필요하다.
셋째, 데이터 활용을 통한 성과 사례의 공유 및 결과 데이터 수집이 필요하다. 구체적으로 데이터 댐 등 사업에 수집된 데이터 활용 사례를 공유할 필요가 있으며, 이는 일회성에 그치지 않고 지속적으로 수집해야 한다. 원천데이터의 활용 결과(소위 품질 및 성능, 활용의 효용성 등)와 원천 데이터의 분석 적용 결과(2차 가공데이터) 역시 관리할 필요가 있다.
넷째, 실효성 있는 데이터 표준화 지원, 데이터 거래를 위한 표준계약 지원 등 데이터 거래 비용 완화 및 데이터 플랫폼 · 거래소 활성화를 추진하고 SaaS 기반 육성 · 지원을 통해 데이터 전주기 인프라를 고도화해야 한다.
라. 시장 조정자로서의 정부 역할 제언
정부의 역할은 (1) 데이터 생태계 조성을 위한 제도적, 기술적, 경제적 인프라 제공, (2) 수요자 중심의 공공데이터 제공 및 수요 충족형 데이터 거래 환경 조성, (3) 다양한 시장참여자 및 이해관계자 사이의 지속적 논의와 조율을 통하여 데이터 생태계의 원활한 작동을 가능하게 하는 환경 조성 등을 생각해 볼 수 있다. (2)와 (3)에 집중하였을 때, 데이터 생태계에는 다수의 정부부처 및 공공기관이 직 · 간접적으로 관여하고 있어 효과적 정책 집행을 위해서는 구심점이 필요하며, 수요자가 필요로 하는 데이터와 실제 공급되는 공공 데이터 간 미스매칭 문제가 발생하는 바 이를 해소할 수 있는 조정 체계가 필요하다. 이에 시장 조정자로서의 정부 역할을 제언하면 다음과 같다.
첫째, 데이터 생태계에 초점을 맞춘 정책 협의체 및 정책 추진체계 마련해야 한다. 협의체는 (1) 민간 수요자의 시각이 반영될 수 있어야 하고, (2) 정책 현안에 관한 협의에서 나아가 실제로 실행될 수 있도록 하는 실행력 확보가 핵심 관건이 될 것이다. 주기적인 협의 및 추진체계의 마련에 더해, ‘해커톤’ 등의 방식을 참조하여 여러 이해관계자들 사이의 브레인스토밍을 통한 의견도출 및 협의 마련 방식을 주기적으로 병행할 수 있을 것이다.
둘째, 국가 최고데이터책임자(CDO)가 필요하다. CDO는 최고 의사결정자와의 원활한 의사소통이 가능하고 중앙정부 · 공공기관에 대한 강력한 권한을 통해 국가 데이터 전략을 이끌 수 있는 사람으로, 각 정부 기관에 대한 데이터 공개 및 데이터 정책을 통솔 · 관리할 수 있어야 할 것이다.
셋째, 데이터 수요자의 의견수렴을 위한 창구를 마련해야 한다. 수요자가 원하는 데이터의 유형, 내용, 분류 체계 등 세부적이고 구체적인 사항에 대해 지속적, 반복적으로 의견을 청취할 수 있는 창구 마련이 필요하다. 또한, 수렴된 의견이 공공데이터의 제공과정은 물론 민간 시장에서의 거래환경 조성에 어떻게 반영될 수 있을지 협의하고 추진할 수 있는 장치의 마련이 필요하다.

1) Rearrangement of data-related laws
First, there is a need to amend the Personal Information Protection Act additionally as early as possible. It is necessary to promote law amendment for the chemical combination of exceptional and general clauses on information and communication services in the Personal Information Protection Act. In particular, there is a need to adopt clauses on the right to data portability and the right to respond to profiling in relation to the self-determination right of the personal information owner assuming the reasonable amendment of the pre-consent regulation with regard to personal information. A measure to prescribe regular examination and review on the need for the amendment of the Personal Information Protection Act by law may be considered as well.
Second, it is necessary to establish a governance system by which conflicts or different views in relation to data policies between government agencies can be arbitrated by the national data industry policy and personal information protection policies in a balanced manner. In addition to establishing measures by dividing them into short-term and mid- to long-term measures, a measure at the government organization level by which different views or conflicts between government agencies in relation to data policies can be rapidly arbitrated needs to be included as well.
2) Expansion and improvement of testbeds that use data
It is necessary to expand and build testbeds that provide the required data to technical and business innovation-requiring entities such as startups, small and medium enterprises (SMEs), universities, and research centers. In the testbeds, highly demanded data used in transactions in the private sector such as finance, communication, medicine, energy, transportation, and logistics including public, administrative, and data dam-related data should be combined and de-identified prior to provision.
The planning, design, and building stages of a testbed requires the participation of the main actors of data use such as various companies and researchers. The current big data platform is segmented by unit of the main actor that participates in the project.
Nonetheless, it needs to be expanded to unstructured big data at the level of all industries, topics, and scopes. In addition, there is a need to link with data-related regulatory sandbox among ICT regulatory sandboxes for the successful operation of the testbed.
3) Creation of an environment where heterogeneous data are safely combined
First, the investment in research and development for technology and commercialization should be expanded to create an environment where heterogeneous data are safely combined. The value-added creative foundation will be established through a heterogeneous combination of data via the technical development of software and hardware-based security technology that can guarantee the stability of the deidentification measure of personal information. In particular, there is a need for not only improving algorithms but also developing a homomorphic encryption hardware accelerator to promote homomorphic encryption in all industries.
Second, the heterogeneous data combination function at the data platform (data exchange) and neutral data zone should be defined, and an institutional system built and operated by the private sector should be put in place. Data-based customized services can be created using heterogeneous data combinations from various industries through the data combination-specialized designation (build) within the platform or neutral zone.
4) Training professional personnel who can use data
First, education programs for professional personnel for each industry should be expanded. A customized curriculum that can use AI technology after understanding the data characteristics by industry should be developed, and the hardware and software infrastructure should be expanded. There is also a need to promote professional education programs to use data for incumbent employees equipped with domain knowledge to lower the entry barrier to the data industry ecosystem for SMEs.
Second, the innovation cluster for the vitalization of the regionally specialized data industry ecosystem needs to be built. This means that the win-win cluster of industry, academe, and research institutions is built to support data-based research and startup and create jobs for advanced technical personnel who settle down in the region. In addition, a data specialist system in local governments and public agencies is needed to link with programs of training talented individuals who use AI and data.
C. Policy proposal (2): Life cycle innovation of consumer-oriented public data
1) Establishment and vitalization of reuse principle of public data
First, the data reuse principle should be established to utilize data held by the public sector for the public benefit goal, and the government should assure this. Along with building the infrastructure such as establishing the technical basis for providing data in real time using an application programming interface (API) and institutionalizing a system that enables immediate response to the researcher's request, data as to where the government fund is inputted such as the public sector as well as research institutions and research funds should be freely disclosed, in principle.
Second, the technical measures required to use the information from the private sector should be clarified, and the legal basis for ensuring the transparency and responsibility of the use procedure should be put in place. The secure analysis and utilization of private information, sensitive information, and commercially confidential information should be promoted for purposes of research and statistical record by developing and applying the technology to reinforce private information protection such as anonymization, pseudonymization, and differential privacy. In addition, there is a need to establish the legal basis for reusing protected data only for public purposes it does not infringe the right of the information subject.
2) Upgrading the life cycle of public data
First, the results after “using data” should be shared in all stages including collection, retaining, and discarding of data to upgrade the “data quality” and diversify the sources of data. This is to monitor which data are most widely used through user-related metadata securing and analysis in the data dam-related sites.
Second, the creation, supply, and feedback procedures should be clearly monitored according to data types in the data feedback system. Accordingly, it is necessary to define the required tools or systems or process and protocol needs, etc.
Third, there is a need to share cases of achievements through data utilization and collect outcome data. More specifically, cases of using the collected data in the data dam project, etc., which should be collected continuously rather than as a one-off event, need to be shared. The result after utilizing source data (so-called quality and performance, utilization efficacy, etc.) and results of analysis and application of source data (secondary processed data) should also be managed.
Fourth, effective data standardization support, mitigation of data transaction cost including support of standard contract for data transaction, and promotion of data platform and exchange are required; the data life cycle infrastructure should also be upgraded through SaaS-based promotion and support.
D. Proposal of government roles as a market coordinator
The government roles are: (1) providing institutional, technical, and economic infrastructure for data ecosystem creation; (2) providing consumer-centered public data and creating a demand-fulfilling data transaction environment; and (3) creating an environment where the data ecosystem is working properly through continuous discussion and coordination among various market participants and stakeholders. When concentrating on (2) and (3), the pivotal role is needed for effective policy execution because multiple government agencies and public institutions are directly or indirectly involved in the data ecosystem.
It is also necessary to have an arbitration system for addressing the mismatch between consumer-required data and supplied public data. Accordingly, the following government roles as a market coordinator are proposed:
First, the government should establish policy consultative groups as well as a policy promotion system focusing on the data ecosystem. The consultative group should (1) reflect the viewpoint of consumers in the private sector and (2) ensure the executive power to resolve pending policy issues instead of remaining only in the consultation stage as the key tasks. In addition to the periodic consultation and promotion system, a hackathon method can be used so that opinions are derived through brainstorming among diverse stakeholders, and other consultation methods will be conducted in parallel on a regular basis.
Second, a national chief data officer (CDO) is needed. The CDO is a person who leads the national data strategy through strong rights toward the central government and public institutions, with good communication with top decision makers. The CDO should be able to lead and control data disclosure and data policies for government agencies.
Third, a window for collecting opinions from data consumers should be put in place. It is necessary to provide such window by which continuous and repeated opinions can be heard for detailed and concrete matters such as consumer-needed data categories, content, and classification systems. There is also a need to put in place a mechanism for consulting and promoting how the collected opinions are reflected not only in the supply process of public data but also in the creation of transaction environment in private markets.
