The Islamic community in the Middle East, on a basis of Islamic belief, consists of Umma(Islamic community), and is eccentric in its behavior and sentiment. The identical principle and trade customs rule the Islamic cultural community, and the community renders us lots of potential export market of one billion of population. Under such circumstances, we need to study systematically the juridical aspect of trade contract and its customs in the Middle East. In the mean time, The Middle East forms quite different cultures from the western cultures. The Middle Easterners adhere the commercial customs and practice originating from the Islamic doctrines by Prophet, Muhammad in 7c, while others undergo changes year by year. The commercial customs and practice in the Middle East shall also conform to the Islam, which rejects any international customs and practice contradicting them. In general, the Muslim from 36 countries whose population range over billion - one fifth of the world population nationally embrace Islam, and 56 countries over the world consist of 50% Muslim or more. The Muslim adhere to the Shari'a, and the Quran, and prophet's memoir - Hadith wholly rules the religious life in Islamic community. The purpose of this study is, upon careful examination of internal and external literatures and periodicals, to suggest business customs and relative excerpts from the Quran & the Hadith, to analyze the historical backgrounds of the business customs in the Middle East, and, to give some considerations on the business customs. In order to attain the above purpose, the existing literature and data were used to comparatively analyze both international and Islamic business negotiations. The analysis, therefore, made it possible for me to suggest the characteristics of the Sharia and countermeasures against pending problems on trade with the Middle East. The scope of this paper has been confined to the study of the business customs in the Middle East and business negotiation. This paper consists of six Chapters: Chapter 1 refers to the objectives, methods and scopes of the study. Chapter 2 refers to social and cultural backgrounds of Islamic community in the Middle East. Chapter 3 refers to comparison of business customs in the Middle East with those of cross cultures. Chapter 4 refers to analysis on trade with the Middle East. Chapter 5 refers to some problems on trade with the Middle East, and suggestions of countermeasures. Chapter 6 refers to summary and conclusion suggesting the necessity of our trade extension for Islamic community and emphasis of government policy for trade promotion into the community. In concluding contract, Islamic contract is based upon the principles of Uberima Fides, free contract and autonomous decision by parties, therefore, Korean negotiators shall prepare for the Islamic requirements for contract rather than we have preconception for different business customs. In performing contract, the Muslim have ideas that contract is performed according to In Sha Allah, so it's safe for Korean exporters to manufacture goods upon examination of L/C. As for delivery of goods, the Muslim emphasize the exact delivery of weight, etc. in accordance with the revelation of the Quran. and they also adhere to marine transportation. The L/C from the Middle East countries generally stipulates that commission deduction clause be inserted in the credit, and a few countries (such as Bahrain, Kuwait, UAE, etc.) permit the L/C to deduct 7~9% of Riba. The Muslim' boycott against Israel is so austere that our traders shall abide by the creed. If any evidences regarding Israeli passage be found during sales promotion or transport of vessel, the merchandise shall not pass through the customs in the Middle East countries. As for prevention & adjustment of trade disputes, the Muslim prefer their settlement or compromise according to the revelation of the Quran, and Korean traders shall maintain friendly private confidence with the Islamic traders. Our government policy toward the trade with Islamic community shall be performed on the basis of overall and systematic training for our traders who are engaged in the trade with Islamic community. Especially we should bear in mind that Islam dominates the whole life of the Islamic community. The government shall concentrate careful attention into the development of the merchandise durable in the high temperature and suitable to their religious life. The muslim are so dubious and lay importance in the practical details of trade contract that the investment towards the community shall be induced by the government in the form of joint venture. We shall build up close diplomatic relations with religious leaders in the community, and also pay political attention to the Islamic community.
