선사가 발행하는 선화증권 에는 ‘Shipper's Load and Count’, ‘Said by Shipper to Contain’의 문언을 명시하고 있다.

The commercial customs and practice in the Middle East on the basis of Islam originates in the Islamic culture, which, therefore contradicts that in the western cultures. In general commercial customs and practice incessantly changes year by year, but the commercial customs and practice in the Middle East was originally formed at the 7th century according to the Islamic law created by the Prophet, Muhammad. The purpose of this study is, upon examination of the social backgrounds of the Middle East countries and the originality of the commercial customs and practice, to excerpt its characteristics and further activate our trade with the region. To accomplish the above objectives of the study, this study consists of the following chapters: Chapter 1 refers to necessity, methods and scope of the study Chapter 2 refers to the social backgrounds of the Middle East region Chapter 3 refers to the originality of the commercial customs and practice of the people in the Middle East Chapter 4 refers to the characteristics of the commercial customs and practice of the people in the Middle East Chapter 5 refers to the summary and conclusion The Prophet, Muhammad established the Islamic community in A.D. 610 by a revelation of Allah, abolished the high Riba business, and legalized the business based on Mudarabah. The Mudarabah base at last yielded the unique financial principle of the existing Islamic banks. Upon advent of the Islam, the arabic customs and practice have been completely maintained in accordance with the Islamic principle, which shall not tolerate any customs and practice which contradicts the Islamic principle. The commercial customs and practice of the people in the Middle East show the following the characteristics as regards negotiation customs, settlement, transportation and insurance: First, as for the negotiation customs, Korean traders shall try to intimately converse with them and reinforce the possible friendships for the mutual benefit. They are inclined to violate the scheduled date for negotiation, and have nothing to hurry up as they behave according the Allah's willingness. Their emotion is so optimistic and the expression of opinion is so sophisticated that impulsive speech and behaviors are prohibitive in the negotiation. Second, as for their contractual customs and practice, any contract whose objectives are dubious against good public order and customs of their society shall become null and void owing to lack of illegalization. Especially the Riba business is interdicted and in case of uncertainty being intrinsic in the contractual object the contract shall also become null and void. Furthermore, if any element of contract be defective, it shall invalidate the contract so along as the other party refuse it. Third, as for the settlement of account, most transactions are performed on the L/C base, but remittance base is preferred in the trivial amount of account. The contents of L/Cs from the Middle East are sophisticated and require too many accompanied documents. They require confirmation on the transport documents by the arabic consuls or stationed in the country. Sometimes insurance companies or shipping companies ask for certification by the authorities that certify the foreign trader has not any relationships. Fourth, as for customs and practice of transportation, the Gulf countries require the foreign exporters to ship goods on the vessel of United Arab Shipping Co. The other countries designate the vessels of specific shipping lines. In case of shipment being made on board the vessel of 15 years or more on the scheduled shipping date, the exporter shall pay a 1% of invoice amount to the importer and the importer request the exporter to specify the amount. Should any amendment on the original B/L be made, it shall not be accepted, and be deemed to be defective, finally be dishonored. In general the notations such as ‘Shipper's Load and Count’, ‘Said by Shipper to Contain’ are operative on the B/L, which intend to discharge the shipping lines from the defective cargoes. However, L/Cs from the Middle East shall not allow such notations, and they will be deemed to be defective notations. Accordingly we must allege that they be deleted on the L/C. Fifth, as for the customs and practice of insurance, conventional rates are excluded in contracting for cargo insurance, instead, premiums are low and competitive. Much as they import goods on the CIF basis, they forcibly let foreign exporter effect insurance from their own insurer. The traders in the Middle East countries request foreign exporter to pay the premium for 125% of L/C amount with a 1% deduction, and the nego bank shall confirm the deduction in negotiating the draft. It is important for us to understand the peculiar customs and practice of the Middle East traders and to do business with them without any violation of their customs and practice. Particularly they are allergic to sympathy or begging more than death, and have strong self-respect. Therefore, in negotiating with them we'd better try to cheer up their self-respect and build up the reliability with them. In view of their lives being maintained on their religion, they are confident that Islam is superior to any religions. By showing Korean etiquette and by approaching their superiority for Islam, gaining their strong confidence will be the shortest way to the Middle East trade.
