Every person has his own dignity and value and he has a right to pursue his own happiness at the same time. Students are also humans who have the same rights as adults have. Nevertheless, students' basic rights as humans have been trespassed. It is natural that the students who have not been treated properly cannot treat the others properly. Indeed, they might have a great number of distrusts. Students are the subject of education. They have relatively week power in keeping their rights. Moreover, they are governed and controlled by the teachers' unique authority at school. These school system makes the teachers' orders have absolute power on students' lives. Therefore, if some of the students' Constitutional rights are confined or restricted, students themselves are gradually "conditioned" by the strict school system. Most of the schools still follow the traditional and hierarchical authorities in their way to control students. Even with this unfair school system, we have not studied on this problem deeply yet. Only when this issue is treated by mass media, people start to think it is necessary to be discussed. But when it was on the issue, this serious problem was not fully discussed or even ignored. I found it is more than important to analyze how much students' basic rights have been trespassed by teachers. This study is based on the questionnaire which was to third-year-students of 6 middle schools in Gimhae, Kyung Sang Nam Do. Frist of all, the questionnaire was to find out how well students understand the meaning of their basic human rights. I divided the rights into the following 6 categories : rights to be free from violence, rights to keep their privacy, rights to have a freedom of assembly, rights to express their opinions, rights to be educated, rights to be equally treated. Through concrete research, I could find that 32.05 % of the students even didn't know the meaning of "students' basic rights" and 51.1 % of them knew a little about what their basic rights were. To the question that asked "Have you ever gotten the education about students' basic rights·", 44.9 % of the students answered "Yes" and 44.4 % of the students answered "No". On the contrary to my expectation, there were fewer cases of "left-out among classmates" called "Wangdda" in Korean. Furthermore, trespassing students' privacy by teachers rarely occurred. What students felt as trespass of their basic rights were "corporal punishment", restriction on their hair styles, "shortage of the reflection of their opinions", "shortage of facilities and "favorism to particular students". In order to improve these problems at schools, special efforts to acknowledge and approve students' basic rights should be delivered in various ways. Teachers should try hard and be active in improving students' weak position at schools and the atmosphere to respect students' basic rights must be constructed. To add, special programs to educate both teachers and students on this matter should be created.
