This study is an endeavor to propose specific measures to resolve problems with the regulation of medical advertisements run by hospitals and clinics which will take effect in the future. In response to that, this study look into how various medical ads of hospitals and clinics are run on TV, newspapers, magazines, internet, outdoor medium, etc, and analyze the regulation related to the present medical advertisements in an attempt to present specific measures in relation to the boundary of medical advertisement from the perspective of specific requirement of medical service and how such regulatory control must be determined for different types of advertisement media. This study was conducted in two ways to achieve the objective of research. First, a theoretical consideration was made to figure out the overall concept of medical ads, such as the definition and necessity of medical ads and the change in the medical industry and advertisement environment, etc, and the trend of change. Second, the analysis was conducted on how various medical advertisements are being run depending on the type, on the basis of some preceding studies and materials released by related organizations, in order to identify the problem with medical advertisement and explore the measures for the regulation. Along with that, current regulations of medical advertisement were analyzed in relation to this study. The findings of this study led to the following conclusions: First, there has been a change in the perspective of medical advertisement. People were more inclined to demand more discretion and tolerance for medical ads because they want more and high quality medical information as a result of the increasing consumer empowerment, along with the shift from the advocacy of strict regulation of medical ads which are considered different from ordinary commercial ads toward the market-oriented position which consider the medical service as a commercial product. There was a strong tendency to assert the expansion of discretion and tolerance for medical ads. Second, the basic data of consumer organizations' survey in May 2005 and the direct survey of broadcasting monitoring conducted in this study suggested that the regulation of medical advertisement run by hospitals and clinics was not effectively enforced. This was considered to be attributable to the failure to reflect the diversification of medium enabled by the advancement of information and communication technology, such as the internet, personal mobile communication, etc, which was the most problematic aspect in the regulation of law. Third, the change in the ruling of court has become unavoidable in the wake of the ruling of the Constitutional Court which found the Clause 3 of the Article 46 of Medical Law and the Article 69 pertinent to the punishment unconstitutional. The Court has been criticized for being inclined to rule in favor of legal stability, rather than the marketing perspective. Along with that, the provision in the Article 47 of medical law which bans the advertisement for purposes other than academic purpose, and the Section 6 of the Clause 1 of the Article 21 under the ordinance pertinent to the medical law(which defines the attraction of patients for profit purpose as an indecent behavior) were found not to match the perspective of medical ads on the marketing base.
