It is the purpose of this thesis to focus on one particular aspect of judicial review within the WTO: The Standard of review. This legal concept determines how much deference international adjudicators should give to the national fact-finding and legal determinations. For this purpose, I argues for a strong proceduralist bias for the standard of review which could include a so-called "deliberation-test". Under the general analyzing structure of the standard of review, there are many possible factors affecting the appropriate standard of review, but two of the most basic factors are: (1) the nature of the question involved, i.e., the difference between question of facts and that of law, and (2) the particular WTO agreements involved. for purely legal issue, the standard of review should be de novo; and (2) for factual issues, i.e., the establishment or evaluation of facts (which could include mixed question of fact and law). The key issues of standard of review analysis have also been traditionally divided into these two basic categories(question of fact and law).
