본 논문의 목적은 이와 같이 발생하는 하자로 인한 분쟁을 최소화 하고자 「민법」, 「집합건물법」, 「주택법」 및 「공동주택관리법」 등 관련 법률의 하자담보책임(瑕疵擔保責任) 제도를 연구하여 그 개선방안을 제시하는데 있다.
공동주택은 분양계약(分讓契約)을 언제 체결하느냐에 따라 주문주택(注文住宅) 분양방식인 선분양․후시공과 판매주택(販賣住宅) 분양방식인 선시공․후분양으로 구분할 수 있다. 분양시점에 따라 분양계약의 법률적 성질과 분양에 따른 하자담보책임이 달라져야 하는 것이다. 그런데 선분양(先分讓) 제도는 지나칠 정도로 사업주체를 보호하는 측면이 크다. 그리고 수분양자가 하자로 인한 위험을 감수하는 특정물 도그마(dogma) 이론을 집착한 형태다. 따라서 주문제작(order production) 방식의 관점에서 선분양 제도를 살펴보았다. 반면에 후분양(後分讓) 제도는 임대주택을 제외(임차인에게 최초로 인도한 준공시점 그 즈음을 하자담보책임기간으로 기산하기 때문이다)한 미분양된 재고주택(在庫住宅) 등의 하자담보책임은 완공된 건물 그 자체를 직접보고 계약을 체결하는 관점에서 살펴보았다.

이와 같은 방식으로 건축하여 완성된 공동주택에서 미시공하자와 변경시공하자가 있으면 약정위반이므로 입주자가 언제나 하자보수를 청구할 수 있는 반면, 공사상 잘못으로 인한 부실시공으로 발생하는 균열 및 누수 등의 시공하자(일반적인 하자)는 실제로 하자 현상이 발생해야만 하자보수를 청구할 수 있다.
「주택법」에서 규정한 공동주택의 분양에 따른 하자담보책임기간은 제척기간(除斥期間)으로써의 효력은 없다. 또한, 하자로 인한 손해배상 등에 관한 규정조차 미흡하여 소송과정에서 「집합건물법」이 재판규범으로 채택되는 경우가 허다하다. 그리고 내력구조부의 하자담보책임을 공동주택이 붕괴되거나 붕괴될 우려가 있는 등으로 규정하여 법원에서는 오히려 「건설산업기본법」을 근거로 하자보수책임을 판결하기에 이르렀다. 이런 점에서 보면, 「주택법」상 하자담보책임은 그 전부를 재검토해야 할 만큼 개선할 부분이 많다.
이와 같은 문제를 개선하고자 공동주택에 대한 전문적·체계적 관리와 공동체 문화 활성화 지원으로 공동주택 관리문화의 새로운 장을 여는 기틀이 될 「공동주택관리법」 제정안이 2015.8.11. 법률 제13474호로 제정(시행 2016.8.12.)되었다. 「공동주택관리법」 의 조문은 총 10장 102조문으로 구성되어 있다. 이 중에서 공동주택의 하자담보책임 및 하자분쟁조정은 제6장에서 제1절 하자담보책임 및 하자보수(제36조부터 제38조까지)와 제2절 하자심사 및 분쟁조정(제39조부터 제51조까지)에서 규정하고 있다.
「공동주택관리법」은 그동안 「주택법」상에 미흡했던 공동주택의 하자담보책임 및 하자분쟁조정과 관련한 규정을 상당부분 개선하였다. 그러나 이와 같은 개선조치에도 불구하고 여전히 문제점으로 남아 있는 부분이 있다. 이와 같은 문제점은 그 자체를 보완하거나 근거규정을 마련하는 등 제도개선이 필요하다.

A Study on the Improvement of the Defects Liability

The number of whole housing in Korea at the end of 2015 was 16,303,520 and the number of collective housing such as apartment, row housings and multi-house hold housing are 12,064,320 that cover 74%.
Even if a collective housing is the representative residential place residing about 300 thousand households annually, defects and dispute due to poor construction still exist. However, the cause of a variety of flaws such as cracks, subsidence, breakage, water leak, condensation and elimination in finishing materials as well as in a variety of structural materials such as the foundation of established collective housing, framing, facilities, finishing and landscape architecture makes the ceaseless dispute between the occupants expecting the collective housing without defects and the project operator supplying collective housing.
The purpose of this study is to minimize the dispute for the defects and to suggest the solutions for system improvement by researching defect liability systems under the related laws such as “Act on the Management of Collective Housing” and “Act on the Ownership and Management of Aggregate Buildings”.
Collective housing can be classified as parcelling-out first and construction later which is the type of pre-sale housing and parcelling-out later and construction first which is the type of home sales according to the time when the contract of parcelling-out has been made. Depending on the time of parcelling-out, the legal feature of contract and the defect liability by parcelling-out should be differentiated. However, pre parcelling-out system has a tendency of protecting the project operator too much, and it is a type of compacting Specific Thing Dogma theory that purchasers consider the risk by defects. Therefore, pre parcelling-out system has been reviewed in the aspect of order production. On the other hand, the aspect that the system of parcelling out later regards defect liability for example, unsold stock housing excluding rental housing as the object of contract for parcelling out as the completed building itself is valid.(Because the period of time that initially delivers to lessee is regarded as the defect liability period)
The contract of parcelling-out for collective housing is definitely a sales contract following transfer of ownership. However, seller's liability for warranty has not been considered in “Act on the Management of Collective Housing” and “Act on the Ownership and Management of Aggregate Buildings”.
Whether it is a type of pre parcelling-out or parcelling-out later, all are classified as defect liability depending on the parcelling out in the same as newly constructed collective housing. When considering those factors, it can be regarded as a contract without regular name in the form of products supply contract combining sales and contract for work.
When reviewing who construct the collective housing in our company in the process of construction, one of the types is ‘parcelling-out with direct construction’ that the person who parcels out a building directly constructs collective housing and distributes, the other type is the construction under the contract for work that the person who parcels out a building does not construct directly and make a contract with other constructors. Recently, as the construction environment has been diversified, many business entities such as developers or housing reconstruction association are constructing the collective housing in the form of construction under the contract.
If non-construction defects and alteration-construction defects have been found in the completed collective housing constructed with those methods, the occupants can ask for repairing defects because it can be regarded as contract violation, however, regarding the construction defects (general construction defects) such as cracks and water leak caused by fraudulent construction due to the faults in construction, the repairing defects can be asked when the actual defects have caused.
The defect liability period by parcelling-out of collective housing specified in “Housing Act” does not have validity as period of exclusion. In addition, “Act on the Ownership and Management of Aggregate Buildings” can be selected as Entscheidungsraum in the course of civil litigation process due to the lack of provisions on compensation for damages and due to the defects. In addition, by regulating the defects liability for warranty of proof-stress structure as the collapse of collective housing or having the possibility of collapse, the responsibility of defects have been decided in the court on the basis of “Framework Act on the Construction Industry”. When reviewing in the aspect, the defects liability for warranty in “Act of Housing” has many things to be improved as it should be reviewed.
In order to improve such problems, “Collective Housing Management Act” enactment that will be the foundation to accept the culture of collective housing management by professional and systematic management and the support of community culture promotion has been enacted as the law No. 13474 (2016.8.12 implemented).
The article of “Collective Housing Management Act” is made up of total 10 chapters and 102 articles. Regarding defects liability for warranty and mediation of disputes on defects has been regulated in the chapter 6, the clause 1, defect liability for warranty and conciliation of dispute on defects (from the article 36 to the article 38) and examination of defects and mediation of disputes on defects in clause 2 (from the article 39 to the article 51).
