In other words, there is a time in the universal law of a nation that controls the life of an individual. For example, it has come to an era when the laws determine the treatment methods, not the knowledge and conscience of professional medical personnel, to make decisions about medical care for terminally ill patients. Ultimately, these problems sometimes result in the destruction of the conscience, which is the backbone of their human dignity, by making decisions against individual conscience. In other words, as the law and the conscience of each individual come into conflict, it develops into a conflict between law and conscience. Therefore, the legal approach to solving the problem from a uniform viewpoint on a society composed of individuals is not a fundamental solution to the problem because it infringes on the conscience of the individual, the last resort of human dignity. This is because there is a great risk of mass production of a 'culture of death' that degrades human dignity and life. This study will focus on examining the conflict between the law and the conscience of the individuals while excluding the conscience of the medical personnel. The analysis of this study is based on two types of research: ‘Act on Patient Determination of Life-Sustaining Treatment System for the Patients in Hospice and Palliative Care’ and ‘Act on Medical Treatment Sexual Impulse for the Sex Offenders.’ Furthermore, by reviewing misleading legal content, which may transfer responsibility to medical staff, this study seek to understand conscientious objection and examine the ethical justification of conscientious objection.
