성과중심 인사관리는 경쟁이 치열한 생산물 시장에서 경영성과 제고를 통해 생존․발전하여야 하는 기업과 성과에 상응하는 공정한 보상․처우를 원하는 근로자의 필요에 따라 등장하였고, 이러한 필요성이 없어지지 않는 한 앞으로도 지속될 것이다. 성과중심 인사관리는 노사협력의 요소 외에 노사 갈등의 요소를 안고 있다. 왜냐하면 성과중심 인사관리는 사용자의 주관성․자의성이 내재된 성과평가에 토대를 둔 경우가 많고 이로 인해 근로자의 근로조건이 침해될 수 있기 때문이다. 성과중심 인사관리에 따른 근로자의 근로조건 침해를 방지하고 노사 갈등을 줄이기 위해서는 노동법학의 측면에서 이 주제에 대한 연구․검토․분석이 필요하다. 그러나 그동안 노동법학 측면에서의 이에 대한 연구가 활발하지 않았고, 연구된 결과물도 부분적인 분석에 그치고 있다. 이에 이 논문에서는 성과중심 인사관리에 따른 노동법상 쟁점과 과제에 대하여 종합적인 분석을 시도하였다. 성과중심 인사관리는 “근로자에 대한 성과평가 결과를 핵심적인 사유로 하여 징계 아닌 인사처분을 하는 인사관리”를 의미한다. 성과평가는 “근로자에 의한 근로 제공의 결과를 대상으로 사전에 설정된 평가지표에 의하여 절대적 달성수준이나 상대적인 등급을 측정하는 행위”를 의미한다. 성과평가는 법적 성질상 사용자의 재량이 인정되는 사용자의 고유권한에 속한다. 그러나 사용자의 성과평가권은 헌법․근로기준법․민법 등에 의한 제한을 받는 상대적인 권리이다. 왜냐하면 사용자의 재량권 남용으로부터 근로자를 보호해야 할 필요성이 인정되기 때문이다. 성과평가 처분은 근로기준법 제23조제1항의 ‘그 밖의 징벌’ 개념에 포함된다는 점, 성과평가로 인한 근로자의 권리침해를 신속․ 공정하게 구제할 필요가 있다는 점을 고려할 때 노동위원회의 부당해고 등 구제심판과 부당노동행위 구제심판 대상에 해당한다. 또한 사용자의 성과평가 재량권은 헌법 등에 의한 제한을 받는 상대적인 권리이므로 사법심사의 대상이 된다. 성과평가가 정당하려면 실체적 정당성과 절차적 정당성 요소를 모두 갖추어야 한다. 실체적 정당성 측면에서는 평가기준설정, 평가방식, 평가자, 평가단위, 평가항목, 평가대상기간 및 횟수 등의 측면에서 정당성을 갖추어야 한다. 절차적 측면에서는 평가기준설정에 근로자나 노조의 참여가 있는 경우, 평가정보에 대한 근로자의 열람권 및 정정요구권을 인정하는 경우 정당성이 강화된다. 성과평가에 대한 근로자의 절차적 권리를 보장하기 위해서는 성과평가의 내용을 취업규칙의 기재의무사항에 포함하여야 하며, 성과평가 사항을 노사협의회 협의사항에 포함하여야 한다. 사용자가 시용근로자 본채용 거부사유로 성과평가 결과를 제시하는 경우에 성과평가의 정당성은 일반적인 성과평가의 정당성 요건보다 완화될 수 있다. 기간제 근로자 계약갱신 거절사유로 제시된 성과평가의 정당성을 판단할 경우에는 사용자가 근로계약 시에 향후에 성과평가를 실시하고 이를 갱신 거절 사유로 한다는 내용을 명시하였는지 여부, 기간제로 근무한 전체 기간이 성과평가 대상기간에 포함되었는지 여부 등이 고려되어야 한다. 성과주의 임금체계의 대표적인 형태인 성과연봉제도가 적법성을 갖추기 위해서는 연간 산정된 연봉액을 최소한 12로 나눈 금액으로 월 1회 이상 일정한 기일에 근로자에게 지불하는 등의 요건을 갖추어야 한다. 성과주의 임금관리 차원에서 화이트칼라 근로자에 대하여 근로시간 규정을 적용 제외하는 미국식 화이트칼라 이그젬션 제도를 우리나라에서 도입하고자 할 때에는 임금감소의 문제, 보상 없는 연장근로의 문제, 과로사의 문제가 발생하지 않도록 하는 방안이 강구되어야 한다. 동종유사업무를 수행하는 정규직과 비정규직의 임금차별의 예외사유로 성과가 제시되는 경우, 성과평가제도가 비정규직에게 명시적으로 불리하게 설계되어 있다면 합리성이 부정된다. 성과에 영향을 미치는 요소 중 채용기준․조건 및 채용방법․절차의 차이 자체만으로는 정규직과 동종유사업무를 수행하는 비정규직 간에 임금차이를 두는 합리적인 사유로 인정하기 어렵다. 채용기준 등을 평가지표에 포함하여 성과평가를 실시하고 그 결과를 제시하는 경우에 합리성을 인정하여야 한다. 동일가치노동을 제공하는 남성과 여성의 임금차별의 예외사유로 성과가 제시되는 경우, 직접적으로 성과평가를 실시하여 그 결과를 제시하여야 합리성을 인정받을 수 있으며, 성과에 영향을 미치는 요소인 학력․경력․근속년수만을 이유로 임금차이를 두는 것은 합리성이 없다. 성과주의 임금관리 원칙에 따라 지급된 성과급적인 금품은 실적 변동에 따른 금액변동 등이 있더라도 노동의 대가임이 분명하므로 임금에 해당한다. 근로자의 성과가 현저히 저조하여 사용자가 교육훈련․배치전환 등 성과 향상을 위한 조치를 취하였으나 개선되지 않아 사회통념상 근로관계의 계속을 기대할 수 없을 정도에 이른 경우에는 저성과는 해고사유에 해당하며, 저성과를 이유로 한 해고는 기업질서 위반에 대한 제재처분이 아니므로 통상해고이다. 저성과를 판단하는 지표는 크게 중대성과 지속성으로 구분할 수 있으며, 중대성이 강하면 지속성에 대한 요구가 약하고 중대성이 약하면 지속성에 대한 요구가 강하다는 점을 고려하여야 한다. 저성과 여부는 통상 성과평가 과정을 통해 판단되므로 성과평가가 객관적이고 공정한 평가기준에 따라 이루어진 것인지를 엄격하게 확인하여야 한다. 저성과자 해고가 정당성을 갖추려면 저성과라는 사실의 존재, 교육훈련기회 부여와 인사이동의 해고회피조치 등 고용유지노력이 있어야 한다. 기업의 경영사정 악화로 경영상 해고가 불가피하게 된 상황에서 해고 대상자를 선정하는 경우에 기업이익 관점에서 성과를 우선시 하는 것은 어려워진 경영사정을 극복하는데 도움이 되는 기준이므로 타당하다. 성과연봉제를 취업규칙으로 도입하는 경우에 제로썸 방식은 근로자들 간에 유․불리의 충돌을 가져오므로 불이익 변경에 해당한다. 플러스썸 방식은 사안에 따라 다르게 판단해야 한다. 기존의 임금수준을 최저한도로 하면서 성과평가에 따라 추가로 지급하는 방식이라면 그것은 불이익 변경에 해당하지 않으나 불특정한 일부 근로자들이 기존의 임금보다 더 적은 임금을 받게 되는 방식이라면 그것은 불이익변경에 해당한다. 사용자가 관리직 등 일부 근로자에 한하여 성과연봉제를 적용하는 취업규칙을 도입하고자 할 때에는 전체 근로자의 과반수로 조직된 노동조합이나 전체 근로자의 과반수의 동의를 받아야 한다. 왜냐하면 관리자가 아닌 근로자도 승진을 통해 장래 언젠가는 성과연봉제도 도입에 따른 영향을 받는 위치에 설 수 있기 때문이다. 현행 근로기준법 제94조의 규정 해석 상 성과연봉제도 도입 시 사회통념상 합리성 법리를 인정하기는 어렵다. 성과연봉제를 도입하여야 할 긴박한 경영상 필요성이 존재하는 등 근로자의 집단적 동의 면제를 인정하는 것이 불가피하다면 해석이 아닌 입법을 통해 명문화하는 것이 바람직하다.

Performance-based personnel management has emerged as companies need to improve their managerial performance for survival and growth in a highly competitive product market, while workers want fair compensation and treatment commensurate with their performance. Therefore, personnel management based on performance will continue to exist as long as such need and desire of employers and workers persist. Performance-based personnel management has elements of conflict as well as cooperation between labor and management. This is because performance-based personnel management often depends on the performance evaluation based on subjective and discretionary opinions of employers, which may undermine workers’ working conditions. In order to prevent degradation of workers' working conditions and reduce labor-management conflicts arising from performance-based personnel management, this topic should be examined from the perspective of labor law. However, study in this area has not been active and the findings so far seem to be limited to partial analysis. Against this backdrop, this paper attempts to provide a comprehensive analysis on the issues and challenges of performance-based personnel management in labor law. Performance-based personnel management refers to personnel management that involves personnel actions, excluding disciplinary ones, mainly based on the results of performance evaluation of employees. Performance evaluation is to measure absolute levels or relative grades of achievement of individual workers based on a set of evaluation indexes for the outcomes of the provision of work by workers. Performance evaluation is by its legal nature an employer’s right in which employer’s discretion is recognized. However, the right of employers to evaluate workers’ performance is a relative right restricted by the Constitution, Labor Standards Act, and the Civil Act. This is because the need is recognized to protect employees from the abuse of discretion of employers. Personnel actions based on performance evaluation are subject to the remedy procedure at the Labor Relations Commission for unfair dismissal and unfair labor practice, in that such personnel actions are included in the concept of the ”other punishment“ in Article 23 paragraph 1 of the Labor Standards Act and that the infringement of the workers’ rights through performance evaluation needs to be promptly and fairly remedied. In addition, as the employers’ right for performance evaluation is a relative right restricted by the Constitution, it is subject to judicial review. For a performance evaluation to be legitimate, it requires both substantive and procedural justification. With regard to substantive justification, it should be justified in terms of the criteria and methods of evaluation, evaluators, the units and items of evaluation, evaluated period, and the number of evaluations. From a procedural standpoint, the legitimacy is enhanced when workers or trade unions participate in setting the evaluation criteria and when the workers’ right to access and request to correct the evaluation information is recognized. To ensure the procedural rights of workers in performance evaluation, the content of the performance evaluation should be included as one of the mandatory items to be specified in the rules of employment and also in the consultation agenda of the labor-management council. If an employer presents performance evaluation results as a ground to refuse the regular employment of a worker who is hired under a probationary period, the legitimacy requirements of the performance evaluation can be less strict. When determining the legitimacy of the performance evaluation presented as a ground for a refusal to renew a fixed-term employment contract, the following aspects should be considered: whether the employer notified the worker at the time of employment contract that performance evaluation would be conducted and that the evaluation results could be used as a ground to refuse the renewal of the contract; and whether the entire period the employee worked under the fixed-term contract is covered in the evaluation. For a performance-based salary system, a typical form of the merit pay, to gain legitimacy, it should meet the requirements such as paying workers at least once a month on a fixed date by dividing by no less than twelve the annual rate. If Korea introduces the American-style white collar exemption system, which exempts white collar workers from working time rules, to promote a performance-based salary management system, consideration should be given to devise measures to prevent wage reductions, unpaid overtime work, and death from overwork. In the case of differences in performance being presented as a basis for an exception to non-discrimination in pay between regular and non-regular workers who carry out same or similar kinds of work, if the performance evaluation system explicitly puts non-regular workers at a disadvantage, the exception cannot be justified. Among the factors affecting the performance, differences in recruitment criteria, conditions, methods, and procedures cannot justify wage gaps between regular and non-regular workers who perform the same or similar kinds of work. Such wage gaps may be justified only when the factors including recruitment criteria are included in performance evaluation indexes and the results of the evaluation are presented. In such a case where performance evaluation results are presented as a ground for an exception to non-discrimination in pay between men and women who provide work of equal value, the performance evaluation should have been directly conducted on the affected workers. Such wage gaps cannot be justified if they are based solely on educational attainment, career experience, and the length of service. Any money and valuables paid as a kind of merit-pay and according to performance-based salary management principles are considered wages even if the amount changes depending on the performance, as they are paid in return for labor. If a worker’s performance has been significantly poor and the measures taken by the employer to improve the worker’s performance such as training and relocation have been futile, and if the poor performance reached the extent that the continuation of the labor relations cannot be expected by common social norms, such poor performance constitutes a ground for a dismissal. Such a dismissal is an ordinary dismissal as it is not a sanction for violating corporate order. Seriousness and continuity are the two factors that determine poor performance. It should be considered that when the seriousness is significant the demand for continuity is weak, and vice versa. Since poor performance is usually determined through the performance evaluation process, the performance evaluation should be strictly verified whether it is conducted based on objective and fair criteria. In order to justify a dismissal based on poor performance, the poor performance should be verified and the efforts to retain employment of the worker such as training and relocation should have been made by the employer. In the event that dismissals are inevitable due to worsening management situations, the company is justified to focus on performance of workers when selecting the workers to be laid-off, as this may be one of the means to overcome managerial difficulties.
In case where a performance-based salary system is introduced as rules of employment, a zero-sum method amounts to an unfavorable change of rules of employment since it works in favor of some workers and against others. A plus-sum method should be evaluated on a case-by-case basis. It is not an unfavorable modification if the existing wage level is set as a minimum and additional payment is made according to performance. But if some unspecified workers are paid less than the existing wage level, it is an unfavorable modification. When introducing the rules of employment that apply a performance-based salary system only to some workers, such as managerial positions, the employer should obtain the consent of a labor union consisting of more than the majority of the workers or the majority of all workers. This is because workers who are not currently in managerial positions can be promoted in the future, then they will also be affected by the performance-based salary system. Considering the legal principles and the interpretation of Article 94 of the Labor Standards Act, the introduction of a performance-based salary system in Korea is hard to be justified by social norms. If workers’ collective consent should be inevitably exempted to introduce a performance-based salary system because of such as urgent corporate managerial demands, it would be desirable that this should be specified by legislation rather than interpretation.
Performance-based personnel management has emerged as companies need to improve their managerial performance for survival and growth in a highly competitive product market, while workers want fair compensation and treatment commensurate with their performance. Therefore, personnel management based on performance will continue to exist as long as such need and desire of employers and workers persist. Performance-based personnel management has elements of conflict as well as cooperation between labor and management. This is because performance-based personnel management often depends on the performance evaluation based on subjective and discretionary opinions of employers, which may undermine workers’ working conditions. In order to prevent degradation of workers' working conditions and reduce labor-management conflicts arising from performance-based personnel management, this topic should be examined from the perspective of labor law. However, study in this area has not been active and the findings so far seem to be limited to partial analysis. Against this backdrop, this paper attempts to provide a comprehensive analysis on the issues and challenges of performance-based personnel management in labor law. Performance-based personnel management refers to personnel management that involves personnel actions, excluding disciplinary ones, mainly based on the results of performance evaluation of employees. Performance evaluation is to measure absolute levels or relative grades of achievement of individual workers based on a set of evaluation indexes for the outcomes of the provision of work by workers. Performance evaluation is by its legal nature an employer’s right in which employer’s discretion is recognized. However, the right of employers to evaluate workers’ performance is a relative right restricted by the Constitution, Labor Standards Act, and the Civil Act. This is because the need is recognized to protect employees from the abuse of discretion of employers. Personnel actions based on performance evaluation are subject to the remedy procedure at the Labor Relations Commission for unfair dismissal and unfair labor practice, in that such personnel actions are included in the concept of the ”other punishment“ in Article 23 paragraph 1 of the Labor Standards Act and that the infringement of the workers’ rights through performance evaluation needs to be promptly and fairly remedied. In addition, as the employers’ right for performance evaluation is a relative right restricted by the Constitution, it is subject to judicial review. For a performance evaluation to be legitimate, it requires both substantive and procedural justification. With regard to substantive justification, it should be justified in terms of the criteria and methods of evaluation, evaluators, the units and items of evaluation, evaluated period, and the number of evaluations. From a procedural standpoint, the legitimacy is enhanced when workers or trade unions participate in setting the evaluation criteria and when the workers’ right to access and request to correct the evaluation information is recognized. To ensure the procedural rights of workers in performance evaluation, the content of the performance evaluation should be included as one of the mandatory items to be specified in the rules of employment and also in the consultation agenda of the labor-management council. If an employer presents performance evaluation results as a ground to refuse the regular employment of a worker who is hired under a probationary period, the legitimacy requirements of the performance evaluation can be less strict. When determining the legitimacy of the performance evaluation presented as a ground for a refusal to renew a fixed-term employment contract, the following aspects should be considered: whether the employer notified the worker at the time of employment contract that performance evaluation would be conducted and that the evaluation results could be used as a ground to refuse the renewal of the contract; and whether the entire period the employee worked under the fixed-term contract is covered in the evaluation. For a performance-based salary system, a typical form of the merit pay, to gain legitimacy, it should meet the requirements such as paying workers at least once a month on a fixed date by dividing by no less than twelve the annual rate. If Korea introduces the American-style white collar exemption system, which exempts white collar workers from working time rules, to promote a performance-based salary management system, consideration should be given to devise measures to prevent wage reductions, unpaid overtime work, and death from overwork. In the case of differences in performance being presented as a basis for an exception to non-discrimination in pay between regular and non-regular workers who carry out same or similar kinds of work, if the performance evaluation system explicitly puts non-regular workers at a disadvantage, the exception cannot be justified. Among the factors affecting the performance, differences in recruitment criteria, conditions, methods, and procedures cannot justify wage gaps between regular and non-regular workers who perform the same or similar kinds of work. Such wage gaps may be justified only when the factors including recruitment criteria are included in performance evaluation indexes and the results of the evaluation are presented. In such a case where performance evaluation results are presented as a ground for an exception to non-discrimination in pay between men and women who provide work of equal value, the performance evaluation should have been directly conducted on the affected workers. Such wage gaps cannot be justified if they are based solely on educational attainment, career experience, and the length of service. Any money and valuables paid as a kind of merit-pay and according to performance-based salary management principles are considered wages even if the amount changes depending on the performance, as they are paid in return for labor. If a worker’s performance has been significantly poor and the measures taken by the employer to improve the worker’s performance such as training and relocation have been futile, and if the poor performance reached the extent that the continuation of the labor relations cannot be expected by common social norms, such poor performance constitutes a ground for a dismissal. Such a dismissal is an ordinary dismissal as it is not a sanction for violating corporate order. Seriousness and continuity are the two factors that determine poor performance. It should be considered that when the seriousness is significant the demand for continuity is weak, and vice versa. Since poor performance is usually determined through the performance evaluation process, the performance evaluation should be strictly verified whether it is conducted based on objective and fair criteria. In order to justify a dismissal based on poor performance, the poor performance should be verified and the efforts to retain employment of the worker such as training and relocation should have been made by the employer. In the event that dismissals are inevitable due to worsening management situations, the company is justified to focus on performance of workers when selecting the workers to be laid-off, as this may be one of the means to overcome managerial difficulties.
In case where a performance-based salary system is introduced as rules of employment, a zero-sum method amounts to an unfavorable change of rules of employment since it works in favor of some workers and against others. A plus-sum method should be evaluated on a case-by-case basis. It is not an unfavorable modification if the existing wage level is set as a minimum and additional payment is made according to performance. But if some unspecified workers are paid less than the existing wage level, it is an unfavorable modification.
