This study examines the history of patent system focusing on the impact of patent policies on the Industrial Revolution, and finds the optimal patent model in the era of the 4th Industrial Revolution. In accordance with the established theory that the patent policy needs to take into account characteristics of each industry, it suggests an ideal patent model limited to the software field, more particularly to the AI(Artificial Intelligence)-related invention. As AI was introduced into the invention process and the role of it has been gradually increased, various problems complicated to solve in current patent law are expected to appear. However, if we expand the boundary of patent system indiscriminately to settle these problems, patent rights would be difficult to be justified and public liberty might be relegated, which reduce social welfare. The issue of finding an ideal patent model has been discussed for a long time. Many scholars have tracked the relationship between innovation and patent policy through surveys, empirical analysis, or several historical evidences. Others have analyzed the impact of several policy tools. However, it is difficult to set an ideal patent model without understanding the mechanism of patent policy through the whole history. Although similar researches were often undertaken in Korea, there have been few attempts to discover the mechanism of patent policy through the assessment on the role of patent in the Industrial Revolution. In the history of patent policy, a series of flows in which the patent system was expanded(extending patent scope and strengthening patent protection) and then contracted(narrowing patent scope and weakening patent protection) has been repeated regularly. Given that a series of flows constructs one cycle, these cycles has been repeated based on Industrial Revolution. When the next Industrial Revolution begins, a new GPT(General Purpose Technology) accelerates technological innovation and increases demands for patent right. In this situation, the policy makers have incentives to strengthen patent protection and extend the boundary of patent system. However, to expand the patent system beyond a threshold level causes inevitably the problem of patent abuse. Such problems would present when the pace of innovation is slowing. At this time, policy makers try to balance the patent system by developing doctrines to raise the patent bar and to weaken patent protection. This study interprets that this one-cycle flow of patent policy forms a “patent paradigm” and explains it using the theory of scientific paradigm suggested by Thomas Kuhn. In summary, each patent paradigm is created based on the Industrial Revolution, and the period of a patent paradigm has been also shortened as the period of the Industrial Revolution is shortened. With the recent emergence of a new GPT, represented by AI, the 4th Industrial Revolution began. It means that we are at the beginning of a new patent paradigm. The pace of innovation is accelerating. Demands for the patent right is being increased significantly. And the global trend is positive to extend patent scope and strengthen patent protection to this innovative technology. The new Industrial Revolution is again providing incentives to expand the patent system. If so, has it been reasonable choices in terms of increasing social welfare to expand and contract patent system following incentives of technological innovation? The answer for what is an appropriate role of patent system in the 4th Industrial Revolution has to be found in this historical lesson. If such a change in patent policy was a reasonable choice, we need to adopt the similar policy once again which extend patent scope to include AI-related inventions and provide strong patent protection. Otherwise, despite of those attractive incentives, we should be careful of the expanding and focus on balancing the patent system by developing policy tools to ensure public liberty. Through the assessment on the impact of patent policy in each Industrial Revolution, it was concluded that the repeated change in patent policy was never effective in increasing social welfare. While the positive evidence from strengthening patents was uncertain, the opposite was clearer. The patent system was not always necessary or enough to generate a huge wave of the Industrial Revolution. Most innovations started where patent protection was weak or absent. Netherlands and Switzerland, for example, achieved industrial development without patent protection. The U.S. in the 19th century and Japan in the 1950s-1980s also successfully caught up with advanced technologies through some “free ride” under a weak patent protection. On the other hand, to strengthen patents beyond a threshold caused necessarily the problem of abuse. As a cycle of the Industrial Revolution shortens and the role of patents in each industry increases, the problem of abuse appears faster and stronger. From these empirical evidences, should we adopt the weakest patent protection possible? It is true that some countries such as the Netherlands, Switzerland and Japan have been developed with the strategy of cheap riding under weak patent protection. Nevertheless, in the 1950s and 1970s when Japan took the opportunity for economic growth, American entrepreneurs were hard to operate their businesses with weak patent protection. In the U.S., the policy was not effective for economic growth and industrial development. Thus, it can be concluded that neither too strong nor weak patent protection is suitable for industrial development. To promote innovation, the patent model should be designed balancing the interests of patentees and potential patentees. According to several utilitarian approaches, the relationship between innovation and the strength of patent protection presents an “inverted U” shape. The ideal patent system is that maintains the proper degree of protection corresponding to the middle section of the inverted U-shaped graph. However, the proper degree is a variable concept that depends on the economic structure of society and the characteristics of each industry. Patent policy should be designed considering this situation. Based on the empirical analysis, the characteristics of the software industry, and the economic structure of modern society, it is concluded that the proper degree of the patent protection should be maintain lower than general expectations. It means that a contracted patent system which could be found commonly at the end of the Industrial Revolution is appropriate. In other words, it should be difficult to obtain patents, and the scope of patent right interpreted narrowly to prevent redundancy of research and make full use of the market power. This paper suggests some policy proposals on AI-related inventions which are divided into step of patent examination and patent enforcement.
