Since the democratization in 1987, two presidential impeachments have occurred in Korea. In the United States, the archetype of presidential system, for the 230 years after the first president, three presidents, including Andrew Johnson, Bill Clinton, and Donald Trump, were impeached in the House of Representatives, but the Senate acquitted impeachment. After the Third Wave, there was the presidential impeachment almost every year in Latin America. Also, several countries in other regions have impeached the president. The frequent occurrence of the presidential impeachment in the constitutional regime characterized by institutional stability that guarantees the fixed term of the president is an important phenomenon that needs to be analyzed.
South Korean case would be significant because it experienced the failure and success of the presidential impeachment with a 12-year interval. The two cases in Korea have important implications for the comparative study of the presidential impeachment. First, the case of the impeachment of President Roh Moo-hyun is a rare case in which the impeachment motion passed by the parliament with overwhelming support faced with the nation-wide public resistance(‘popular shield’). Also, the impeachment case of President Park Geun-hye is characteristic in that It was initiated by massive protest, not by the congress, and that public protest led to the division of the ruling party, which was the main factor for the passing of the impeachment by the parliament. This study examines the causes of the occurrence and success of the presidential impeachment in Korean democracy through a comparative analysis of two cases.
This study starts with the premise that the impeachment of the president is a political process. Also, the interactions among major actors in the impeachment-game would be a more critical factor as the determinant for the occurrence and success of the impeachment. According to previous studies, three factors are among the most crucial factors for the presidential impeachment process. It is a common factor that first, economic downturn or political scandals have drastically lowered the president's approval rating. Second, the president has lost support in the parliament (‘legislative shield’) and fails to prevent the impeachment process. Finally, social movement that demands the president's ouster deployed. For three factors, the impeachment cases of President Roh Moo-hyun and President Park Guen-hye were different.
First, On March 9, 2004, the impeachment of President Roh Moo-hyun initiated with submitting the impeachment motion by 159 members from the coalition of the opposition parties, including the Grand National Party and New Millenium Party. It was the first impeachment case for the president during the modern political history. The reasons for impeachment attempt for the president Roh Moo-hyun were the corruption, the economic fiasco, and the violation of the electoral law. However, this last one was the main reason for the impeachment. The impeachment attempt by the opposition coalition suffered from the nation-wide backlash. The opposition parties were defeated dramatically in the 17th General Election(April 15, 2004) that occurred amid the Constitutional Court's impeachment trial. On May 14, 2004, the Constitutional Court dismissed the impeachment accusation.
The impeachment of President Park Geun-Hye began on December 3, 2016, with the submission of the impeachment motion by the 171 members from the opposition parties. On December 9, 234 members out of 299 members of the congress attended approved the impeachment. The impeachment of President Park Geun-Hye based on the five constitutional violations and the four cases of the law's breach. Among the most pressing reasons for the public waves of anger were corruption and the abusive privatization of the power, which revealed with the Park Geun-hye and Choi Soon-Sil gate. It was the most common reason for presidential impeachment in previous impeachment cases, including the United States. On March 10, 2017, the Constitutional Court unanimously approved President Park Geun-hye's impeachment, and President Park Guen-hye dismissed.
The most crucial feature of President Park Geun-hye's impeachment case is that the popular protest led to the impeachment process. In the early stage of the impeachment process, the opposition parties were reluctant to take an impeachment action. Due to the composition of the seat of the parliament, the impeachment motion would fail to get passed if the ruling party built a solid legislative shield without division. The public rage exploded after JTBC reported on Choi Sun-sil's tablet PC. On December 3, 2016, more than 2.3 million people from across the country held candlelight demonstrations and demanded the impeachment of the president Park while Congress hesitated to act. So Congress took action. In this regard, two cases of the presidential impeachment were different from each other.
There are also commonalities between the two cases. During the impeachment process, both President Roh Moo-hyun and President Park Guen-hye confronted the parliament and lost their ‘legislative shield’ to contain the impeachment process. Both presidents might have been able to stop the resolution of impeachment proceedings in congress but have taken a strategy against congress. Both impeachments attempted when the president's approval rating was low. In this regard, it can be said that both cases followed the typical pattern of impeachment in other countries.
Although it was not in the case of the impeachment of President Roh Moo-hyun, the factor behind the impeachment of President Park Guen-hye was a political scandal. In the impeachment of President Park, ‘Park Geun-hye and Choi Soon-sil Gate’ caused a massive social protest along with a drastic drop in approval ratings, and the ruling party's division resulted in the loss of legislative shields, which eventually led to the impeachment. In the case of the impeachment of President Roh Moo-hyun, there was a nation-wide public mobilization against the impeachment led by the opposition coalition. On the other hand, in the case of President Park Geun-hye's impeachment, a nation-wide social protest put the press on the opposition coalition and the ruling party’s minority forces to start the impeachment process. In President Roh Moo-hyun's impeachment, the nation-wide backlash, and the results of the 17th National Assembly election(defeat of the opposition parties) served as a ‘popular shield’ to resist impeachment. On the other hand, in the case of President Park Geun-hye's impeachment, public protest played a role in emasculating the ‘legislative shield.’ It can be confirmed from both cases that the success or failure of impeachment hinged on the bipartisan national support.
Typically impeachment attempt is likely to fail if the mass movement fails to secure the parliament's response or if the parliament's efforts to impeach the president could not gain public support. Lesson from the two cases in Korea is that the presidential impeachment would succeed in following the public-led path, with congressional response(‘the street->the institution’). Congress led impeachment with public reaction could be a possible path to follow as well. However, it is difficult to gain broad popular consensus with the partisan frame. Therefore, president Roh Moo-hyun's impeachment case can be classified as the ‘partisan impeachment’, whereas the president Park Geun-hye's impeachment classifies as ‘popular impeachment.’ The success or failure of the two impeachments diverged on this point.
