This study began with the recognition that the use of copyrights by the dancers was significantly lower, unlike various cultural and artistic fields that were developed through the active use of copyrights. The Copyright Act is a basic system that recognizes the value of culture and arts and guarantees the protection of creators' rights. The purpose of this research is to promote dance copyrights by investigating dancers' awareness in the matter of copyrights and identifying their educational status.
In order to investigate disputes over copyright issues, the researcher analysed both the current laws over dance copyright and the court's standards for judgment. In addition, through in-depth interviews with dancers with more than 10 years of experience in choreography, the researcher sought to know the awareness level of dance copyright and the development plan. Furthermore, the current status of education was conducted based on the survey of university subjects. The resulting conclusions are as follows.
First, we need to understand that dance and play are two different subjects. Accordingly, these two should be viewed from different angles. Music, language, etc. are defined differently in the Copyright Act. So, each has its own basis of copyright owing to its different characteristics. Dance has distinct characteristics different from theatrical works and thus needs to be dealt in separately.
Second, the level of awareness of dance copyrights among dancers is very low. Contractual agreement related to dance choreography was made just to satisfy formal rules, keeping copyright matters at bay. Contracts underlying rights were often not prepared unless public institutions were involved.
Third, it was found that dancers feel the need for education on dance copyrights. All of the respondents said that education on dance copyrights is needed for reasons such as protecting choreographers' choreography, protecting dancers' economic rewards, and the proper use of works in artistic activities.
Fourth, the results of the survey of the Korean University's undergraduate department showed that the respondents had no knowledge of dance copyright because of lack of education on dance copyright.
Studies have shown that the dance copyrights are still in the early stages of development. In particular, as discussed in the paper, Korean dance, unlike other dances has a lot of controversy over the use of copyrights in the unique transfer process. In future, it is necessary to establish the correct criteria after thorough study in the subject. In addition, if a specialized institution on dance copyright is established, the limitation of the use of dance copyrights will be relaxed and this will serve as a stepping stone for future education purposes. This study shows that the implementation of dance copyrights will protect the dancers' creativity and as well as raise awareness of dance among them. The researcher opines the discussions and interest in dance copyrights should be continued.
