The purpose of this study is to understand the fairness of the controversial college entrance exam and the meaning of equal educational opportunities in Korea, and to find an alternative to ensure fairness in the college admission process based on John Rawls' Theory of Distribution Justice. Currently, the Comprehensive Student Record Admission System(CSRAS) among the nation's college admission system has been excessively expanded to a device for preoccupying outstanding students at top universities, showing polarization of the admission process, and showing no fair opportunity in choosing the college admission system. In addition, the results of the selection process for the top-ranked universities are biased toward specialized purpose high schools, which is no different from the formal equal opportunity of the CSAT, where meritocracy is the criterion for evaluation. This is why the initial purposes to introduce CSRAS, putting emphases on potential abilities of students and reducing the educational gap by giving equal opportunities to all, have lost and disappeared. The fairness of the College Scholastic Ability Test can be found in the principle of equality, the first principle of the Lawls' theory of justice. The fairness of CSRAS can be found in the differential principle, the second principle which is linked to Theory of Distributive Justice. Among the second principles, the principle of fair opportunity has same context that CSRAS should pursue in the aspects that it focuses to adjust the differences from the social environment and reduce the difference in the starting line with practical opportunities through procedural supplementation. Furthermore, fair opportunity equality is completed with consideration for the least beneficiaries of the marginalized class, which is equivalent to ‘positive discrimination’ in our college admission system. In the end policy measures will be made to ensure fairness in the implementation of CSRAS. Based on Rawls' Theory of Distributive Justice, the results are as following. First, fair opportunities and free choices should be given to all applicants with the balanced application of the college entrance system of the CSAT, CSRAS, and high school record both at the top universities and local universities. In particular, social consensus on the fairness and procedures of each admission screening should be reached and reflected in the students selection process, and the government should strive to settle the screening process with proper coordination and management. Once a sufficient understanding and agreement of the screening process is made, it is expected that the common culture of what appropriate screening process for fair opportunity and equality is will be settled. Second, fairness in practical opportunity and equality should be ensured through procedural supplementation to reduce differences in starting lines from the social environment in the comprehensive evaluation of CSRAS. High schools in South Korea are ranked by different school curricula, resulting in qualitative differences in student records because of the different educative power of high schools, which can damage college applicants no matter how their potentials are high because of their schools. Therefore, it is not rational to evaluate an individual's ability, potential capacity and future growth potential on the same basis as the results from the different school curricula. Only when an agreement is reached on the criteria for the assessment accordingly, the purpose of introducing CSRAS can be put into practice. Third, regulation and expansion of minimum beneficiaries are necessary for the implementation of fair opportunity and equality. The implementation of fair opportunity and equality is to mitigate the inherent natural background by applying the differential principles to the minimum beneficiaries of the disadvantaged class. In Rawls' Theory of Distributive Justice, the minimum beneficiary range extends not only to the underprivileged but also to those whose income and wealth levels are below the middle. It is necessary to operate the selection process beyond the positive discrimination screening for the underprivileged by expanding the scope of minimum beneficiaries, and it can be realized through diversification of the college entrance system. Furthermore, the fair opportunity and equality can be implemented only when opportunities for department selection are expanded through the expansion of the positive discrimination for social integration with the underprivileged and fairness in educational opportunity and equality will be secured in the distribution of college entrance opportunities.
