In order to maintain the rule of the company, the company makes and controls various regulations and institutes them. Among them, none of the disciplinary regulations that impose sanctions on workers' actions have been set by law. In addition, as companies institutionalize it and operate it on their own, many problems arise in South Korea, where the proportion of small and medium-sized enterprises is high, such as workers' human rights and rights are restricted or violated. According to Article 10 of the Constitution of our country, all citizens have dignity and value as human beings and have the right to pursue happiness. Article 34 (1) stipulates that all citizens have the right to live a human life. The dignity and values of individuals must be respected when disciplining workers in an enterprise. In addition, human life must not be destroyed by discipline. Corporate discipline should not violate the rights of individuals guaranteed by the Constitution. However, you may experience severe stress, which can lead to loss of human value or damage to your dignity if you are disciplined for any reason. In addition, bullying in the workplace may destroy human life after disciplinary action. Therefore, it is necessary to enact relevant laws to conform to the spirit of the constitution, even if discipline is necessary for corporate order. However, as there are currently few laws on disciplinary action, cases of abuse of disciplinary power are often occurring in general companies. In the past, Korea was a time when there was a desperate need for a lack of workers or skilled workers due to a social culture that values human affection socially and economic growth from 1970 to 1990. This is because disciplinary action is not important or has been partially limited in times when skilled workers or highly educated workers are absolutely necessary in companies. The importance of discipline was not a very important issue in business. Today, however, there are more workers with higher educational backgrounds due to higher quality standards in schools such as overseas study, more college students and more opportunities for companies to choose and hire workers as they become more difficult to get a job. In addition, workers are increasingly moving from companies to work that suits their aptitude in an atmosphere of working life in one workplace. This phenomenon often occurs in some companies, such as controlling workers, abusing corporate disciplinary action for management purposes, or abusing their disciplinary rights with unorganized disciplinary regulations and un-professionalized disciplinary committees. Companies should use their disciplinary rights to maintain work efficiency and rule, but their disciplinary rights are being abused and workers who have been disciplined are suffering from human rights violations and are under severe stress at work. Therefore, it is necessary to take an important look at the disciplinary action of an individual entity. Although it cannot be completely supplemented as a precaution against disciplinary action, I think it is necessary to pay attention to disciplinary action and define it as a law. Among them, I think the most problematic is the formation of a disciplinary committee that determines disciplinary action. Currently, most companies have a disciplinary committee that focuses on company-side. The company-oriented disciplinary committee is determined by the company’s will. In an environment where the employer can unilaterally exercise the personnel rights and the disciplinary rights for most of the worker subject to disciplinary action, it is practically not easy to use the remedy system for disciplinary action or raise an objection while working. In addition, there is no choice but to accept most of the decisions made in the absence of a system to appoint an attorney or receive legal assistance. Even if workers apply for relief and receive relief, it is also a problem that they are marked as stigmatized within the organization and cannot work smoothly. Therefore, it is most important to prevent discipline from being abused. In particular, public officials with guaranteed status or workers of state-run enterprises are subject to disciplinary procedures through state agencies. However, in general private companies, there are few cases where a general disciplinary procedure other than dismissal is filed through state agencies. The reality of Korean companies is that, in the case of disciplinary action, if there is a labor union, the function is able to represent some workers, but if there is no union, it may be considered that there is no function at all to represent the position of the workers. In Korea, the social security system is significantly lower than in advanced countries and there is less interest in workers' disciplinary action. In addition, when disciplining workers, psychological and material losses are high but institutional supplementation is insufficient. Among the disciplines, disciplinary dismissal in particular is an important punishment that corresponds to the death penalty compared to a general criminal offender. Nevertheless, when looking at the cases that have been filed with state agencies (Labor Commission, etc.), the number of complaints against unfair dismissal is increasing. It is important to get relief after disciplinary dismissal, but I think it is more important to prevent it. The function of representing workers' positions on disciplinary procedures should be supplemented by law. In addition, the fact that the company may abuse the disciplinary right because it does not know the rules well, or because there is no sanction system in place, it must reflect the reality that the disciplinary right is used as a means to control workers. Even in the case of workers, even if they are aware of the abuse of the disciplinary right, they do not know the remedy system, or in most cases, the disadvantage is reduced to continue working even if they are aware of it. To prevent this from happening, it is necessary to establish the mandatory contents of the employment rules for disciplinary action in accordance with the law, and to secure the effectiveness of the penal provisions for the next violation. For example, as necessary items for the composition of the disciplinary committee, punishment for abuse of disciplinary rights, such as the number of members, participation of employees or external experts who can represent workers in the number of members, and participation of union officers in the case of labor unions. I think it is necessary to apply strictly so that a claim for damages can be made. That way, the abuse of disciplinary rights by employers will be prevented and the rights and interests of workers will be protected.
