공공기여를 위한 사전협상제도는 대규모 부지인 1만㎡ 이상의 토지를 대상으로 시행되어 오다가 국토계획법 개정으로 중소규모인 5천㎡이상으로 확대 적용되고 있다. 용도지역이나 도시계획시설의 변경을 우발적 이익으로 보고, 용적률 증가분의 40~60%에 해당하는 토지의 금전적 가치를 사회환원할 공공기여 총량으로 설정하여, 개발에 필수적인 공공시설과 지역사회의 환경개선이나 지역균형발전 지원을 위해 배분한다. 협상조직은 지자체별로 조금씩 차이를 보이나, 공공과 민간, 외부전문가 등으로 구성되는 협상조정협의회를 중심으로 이루어진다는 점에서는 큰 차이가 없다. 협상은 타당성 평가, 예비협상, 본협상, 협상결과 이행의 단계로 진행된다. 타당성 평가과정에서는 도시계획변경의 필요성과 합리성을 검토하며, 예비협상 과정에서는 민간이 제안한 구체적인 도시계획변경 및 공공기여계획과 민간의 사업계획을 검토하여 협상의 범위나 방향을 조율한다. 본 협상단계에서는 개발계획을 검토 조정하고, 부지내외에서 확보할 공공시설 및 공익시설의 위치, 규모, 성능 등을 합의하게 된다. 협상결과 이행 단계에서, 공공은 협상안을 도시계획절차를 거쳐 지구단위계획을 결정하게 되면, 민간은 공공기여에 대하여 이행보증방안을 마련하여 기부를 약정하게 된다. 협상은 민간의 제안에서 비롯되며, 협상 당사자간의 합의를 이루지 못하거나 협상완료는 하였지만 후속절차 진행이 주민반대나 행정절차 등의 사유로 지연되거나 이행되지 못하는 경우도 있다. 이에 본 연구에서는 공공기여를 위한 사전협상제도 협상과정과 협상이행과정에서 발생하는 다양한 문제점과 장애요인을 점검하여 민간개발사업의 원활한 진행과 활성화를 위한 개선방안을 찾고 개발사업의 성공적 진행이 가능한 방안을 제안하고자 다음과 같이 세부적인 연구를 수행하고자 하였다. 첫째, 도시계획변경 사전협상으로 야기될 수 있는 다양한 장애요인 추출을 위하여 사전협상제도 및 공공기여와 관련된 선행연구를 통해 나타난 다양한 문제점과 해결방안을 도출하였다. 둘째, 전문가를 대상으로 설문조사를 통한 FGI를 진행하고,그 이후 AHP분석을 진행하였다. 먼저 본 연구와 관련된 전문가 대상을 추출하고, 일반설문을 통하여 전문가 개별로 민간개발사업의 공공기여 제고를 위한 사전협상제도의 개선방안에 대하여 FGI를 진행한 후, 요인들을 추출하여 관련 분야의 전문가들을 대상으로 쌍대비교법을 통하여 계층화 된 사전협상제도의 개선방안 요인에 대하여 상대적인 중요도를 분석(AHP 분석)하였다. 셋째, 공공기여 개선방안요인에 대하여 우선 선행연구에서 사용된 요인들에 대하여 초기추출, 분류한 후 관련분야의 다수 전문가들과 토론을 통하여 추가, 제거한 후 최종 개선방안요인을 선정하였다.그리고 누락 된 부분들은 없는지 재검정을 통해 본 연구에 사용될 최종 개선요인들을 정리하였다. 넷째, 설문의 응답자 수가 적으므로 이후 분석에 앞서 정규성 검정을 진행하였다. 정규성 검정 방법은 응답자 수가 30명 미만으로 좀 더 보수적인 Shapiro-Wilks 방법을 이용하였다. 수집된 자료가 정규성을 충족시켜주지 못하므로, 본 설문조사의 데이터를 이용한 분석은 비모수 통계분석의 형태로 진행하였다. 설문조사는 전문가 19명으로 진행하였으며, 모두 일관성 지수(C.I)가 0.1 이하로 통계제외자는 없으며, 19명을 대상으로 2개 그룹으로 나누어 일반설문에 대한 실증분석을 하였다. AHP 분석 결과 상위평가지표 여섯 가지 중 ‘신속한 협상 의사결정’,‘협상의 투명성과 공공성 확보’가 가장 중요하다고 나타났다. 반면 ‘공공기여량 산정방식 개선’은 상대적 중요도, 절대적 중요도 모두 가장 낮은 값을 보여 가장 적게 중요하다고 여겨짐을 알 수 있다. 중위평가지표를 살펴보면, 중위지표는 ‘협상과정 공개’, ‘찬성, 반대 의견청취’, ‘공공측 의사결정자 개선’, ‘‘협상 기준의 명확화’, ‘협상완료 후 사정변경에 따른 협상변경’이 중요하게 나타났다. 반면 ‘공공기여량 산정방식 개선’의 중위평가지표와 ‘공공기여 제공방법 개선’의 중위평가지표는 중요도의 순위에 다소 차이를 보였다. 최종 하위평가지표는 ‘공공측 담당의 업무연속성 보장’, ‘개발사업 유형별 세분화된 기준 마련’, ‘협상회의록 공개’, ‘협상완료 후 이행단계의 신속한 처리’, ‘주거취약지 주거환경개선사업 지원’, ‘공공측 사전협상 전담부서 설립’, ‘사업성 악화 등 사후적 협상변경 가능한 근거마련’ 항목이 공통적으로 높은 순위를 보인 것으로 나타났다. 반면 ‘주민대표회 구성’, ‘시민토론회 확대’, ‘협상조정협의회 인원의 확대’, ‘사업구역 시도단위 공공기여 제공’ 등의 항목은 공통적으로 낮은 순위를 보였다. 위에서 분석한 결과를 바탕으로 다양한 문제점에 대한 해결 방안으로 첫째, 민간개발사업의 사전협상에 의한 사업장기화를 방지하기 위하여 공공과 민간의 신속한 의사결정이 중요하며, 이러한 사전협상의 신속한 처리를 위하여는 공공측의 업무담당자의 업무연속성 보장과 전담부서 설립으로 전문성 강화가 필요하다. 둘째, 사전협상과정이나 협상결과에 대하여 주민의 반대로 인하여 사업이 자연되거나 협상이 완료되었음에도 후속 절차가 지연되는 것을 방지하기 위하여는 협상과정의 투명성과 공공성 확보가 필요하다. 협상과정에서의 주민들에게 충분히 공개되어 투명하게 협상이 진행되므로서 협상이후에 절차가 신속히 추진될 수 있기 때문이다. 협상과정을 충분히 공개하고, 공공기여를 전제조건으로 진행되는 사업이므로 찬성하는 주민들의 의견도 충분히 반영하여야 할 필요가 있다. 셋째, 공익증진을 위한 민간의 공공기여가 활발히 이루어질 필요가 있다. 민간이 추진하는 개발사업이기 때문에 협상기준이 명확하여야 사업성 예측이 가능하게 되어 면밀한 사업계획수립이 가능하게 된다. 따라서 민간에서 추진하는 다양한 개발사업유형에 따라 세분화된 기준이 마련되어야 민간에서도 토지활용에 따른 공공기여량 등을 사전에 충분히 고려한 사업계획수립이 가능하게 되어, 도심기능 회복과 공공기여를 통한 도시재생 기능도 가능하게 된다. 더불어 협상완료 이후에 민간의 사업성이 예측 불가능한 사정변경이있을 시에는 협상완료 이후에도 협상안 변경이 될 수 있는 방안이 필요하다. 간개발사업의 사전협상제도는 성숙된 제도는 아니다. 또한 협상의 비공개성, 행정절차 및 적용법률의 다양성에 따른 연구의 한계가 있다. 향후 공공기여 제고를 위한 사전협상제도가 좀 더 활발히 운영되어 공공성 목적을 달성하기 위하여 부분별 세분화된 연구가 필요하며 이러한 세분화된 연구를 토대로 종합적인 연구가 이루어질 필요가 있다.

The pre-negotiation system for public contribution has been implemented for land of more than 10,000㎡, a large-scale site, and has been expanded to more than 5,000㎡ due to the revision of the Land Planning Act. Changes in use areas or urban planning facilities shall be deemed accidental profits, and the monetary value of land equivalent to 40-60% of the increase in floor area rate shall be set as the total amount of public contribution to society. The negotiation organization varies slightly from local government to local government, but there is not much difference in that it is centered around a negotiation coordination council consisting of public, private and external experts. Negotiations will be carried out as a step toward feasibility assessment, preliminary negotiations, main negotiations, and implementation of the results of the negotiations. The feasibility assessment process examines the need and rationality of urban plan changes, and the preliminary negotiation process reviews specific urban plan changes proposed by the private sector, public contribution plans and private business plans to coordinate the scope or direction of negotiations. During the negotiation phase, the development plan will be reviewed and adjusted, and the location, scale, and performance of public facilities and public facilities to be secured both inside and outside the site will be agreed. At the stage of implementation of the results of the negotiations, when the public decides on the district unit plan through the urban planning process, the private sector will arrange a plan to guarantee the public contribution and make a donation. Negotiations stem from private proposals, and in some cases, negotiations have not been reached between the parties, or negotiations have been completed, but subsequent procedures may be delayed or not implemented due to residents' opposition or administrative procedures. In response, this study was intended to conduct detailed research as follows to check various problems and obstacles in the negotiation process for public contribution to find ways to improve and revitalize private development projects. First, various problems and solutions emerged from prior research related to the pre-negotiation system and public contributions were derived to extract various obstacles that could arise from pre-negotiation of urban planning changes. Second, FGI was conducted through a survey of experts, and then AHP analysis was conducted. First of all, the experts related to this study were extracted, and the FGI was conducted on the improvement of the private development project, and the factors were extracted to experts in the relevant field to analyze the relative importance was analyzed (AHP). Third, the factors for improving public contribution were first extracted and classified, then added and removed through discussion with a number of experts in the relevant field, and the final factors for improvement were selected. The final improvement factors for the study were summarized by re-examining whether there were any missing parts. Fourth, the number of respondents to the survey was small, so the normality test was carried out prior to the subsequent analysis. The normality test method employed a more conservative Shapiro-Wilks method with fewer than 30 respondents. Since the collected data do not satisfy normality, analysis using the data in this survey was conducted in the form of nonparametric statistical analysis. The survey was conducted with 19 experts, all with a consistency index (C.I) of less than 0.1 and no statistical exception, and 19 people were divided into two groups for empirical analysis of the general survey. AHP analysis showed that among the six top evaluation indicators, "fast negotiation decision-making" and "securing transparency and publicity of negotiations" are the most important. On the other hand, "improving the method of calculating public contributions" is considered the least important, with both relative and absolute importance showing the lowest values. Looking at the median evaluation indicators, the median indicators were important: "disclosure of negotiation process", "listening to pros and cons", "improving public decision makers", "clearing the criteria for negotiation" and "change of negotiations after negotiation. On the other hand, the median evaluation index for "improving the method of calculating public contributions" and the median evaluation index for "improving the method of providing public contributions" differed somewhat in the ranking of importance. The final sub-evaluation indicators showed common high rankings for "guarantee of business continuity on the public side," "pre-negotiation basis for post-negotiation", "disclosure of minutes", "fast processing of negotiations after negotiations", "support for residential environment improvement". On the other hand, items such as "organization of residents' representatives," "expanding civic discussions," "expanding the number of people in negotiation coordination councils," and "providing public contributions to project zones" were generally low. Based on the results of the analysis above, quick decision-making betwee the public and the private sector is important to prevent the business from developing by pre-negotiation. Second, it is necessary to ensure transparency and publicity of the negotiation process in order to prevent the project from being natural or subsequent procedures from being delayed even though negotiations have been completed due to residents' opposition to the preliminary negotiation process or outcome. This is because the negotiations can be carried out quickly after negotiations because they are fully open to residents in the negotiation process and are transparent. It is necessary to fully disclose the negotiation process and fully reflect the opinions of the residents in favor of the project as it is a precondition for public contribution. Third, private public contributions to the promotion of the public interest need to be actively made. Since it is a development project promoted by the private sector, it is possible to predict business feasibility only when the criteria for negotiation are clear, enabling close business planning. Therefore, when detailed standards are prepared according to various types of development projects promoted by the private sector, it is possible for the private sector to establish a project plan that fully considers public contributions from land utilization. In addition, if there is an unpredictable change in the private sector's business feasibility after the completion of the negotiations, a measure that can be changed even after the completion of the negotiations is needed. The pre-negotiation system for private development projects is not a mature system. There are also limitations of research based on the non-disclosure of negotiations, administrative procedures and diversity of applicable laws. In the future, the pre-negotiation system for enhancing public contribution will be more actively operated, requiring partial and comprehensive research to be conducted based on these detailed studies to achieve public objectives.
