본 연구는 1960년부터 2020년까지 한국의 ‘정신질환(자) 관리의 정치’의 역사를 ‘정신보건법’ 제·개정사를 중심으로 살펴보았다. 연구 자료는 정부 자료, 신문기사와 관련 학술 자료 등이었다. 이를 통해 ‘정신질환(자) 문제’를 둘러싼 이해관계 집단과 그들의 상호작용, 정치사회적 과정, 그 결과와 효과들의 역사를 밝혀내고자 했다. 주요 분석 결과는 다음과 같다. 첫째, 박정희 정부 시기, 정신질환(자)은 점차 ‘사회 문제’로 구성되고 그것에 대한 관리 요구의 여론을 불러일으켰다. 그러나 정부는 정신의학의 발전이나 비정신의학(자), 비정신의료시설의 퇴치에는 동조하는 모습을 보이면서도, 정신질환(자)의 관리는 비정신의학적이고 허가받지 않은 민간 영역에 방임·방조했고 ‘정신보건법’ 제정 등 공적 대응에도 무관심했다. 1970년 「정신위생법」 제정의 실패는 그러한 맥락에 놓인 사건이었다. 정신의학은 학문적으로 발전을 시작했지만, 치료 인프라는 거의 갖추지 못했다. 빈자리를 채운 것은 비정신의학자(무속인, 종교인, 무면허 의사 등)와 비정신의료시설(기도원, 요양원 등)이었다. 둘째, 전두환 정부 시기에는 ‘정신질환(자)에 의한 범죄사건’들과 시설의 인권침해 사건들이 누적되며 ‘정신질환(자) 관리’에 대한 정부의 개입 필요성을 회피하기 어려워졌다. 정부는 1984년 ‘정신질환관리종합대책’을 수립하여 민간 정신보건시설의 확장을 지원하고자 했다. 이는 한국의 ‘시설화’ 문제의 본격적 시발점이 되었다. 1985년에는 「정신보건법」을 제정하고자 했으나, 정권의 반민주성과 법안의 문제가 함께 비판되며, 시민사회단체들의 반대로 법안 제정이 무산되었다. 셋째, 민주주의의 안정화는 「정신보건법」의 악용 우려를 감소시켰으며, 정신장애인의 인신을 구속함에 있어 근거 법률의 제정을 더 이상 미룰 수 없게 만들었다. 보건복지부, 국회, 정신의학 전문가집단, 정신의료시설과 정신요양시설 이해관계자 등의 타협으로 1995년 「정신보건법」이 제정되었다. 「정신보건법」은 정신보건에 관한 종합적 법률이자, 정신장애인의 인신 구속의 법적 근거를 마련했다는 점에서 의의가 있다. 그러나 해당 법률은 그것이 목적으로 명시한 지역사회 정신보건과 반대되는 강제입원·장기입원의 시설화 경향을 강화하는 흐름에 기여하게 되었다. 무엇보다 「정신보건법」은 정신장애인 당사자에게 가장 큰 영향을 미치는 법률임에도, 당사자들이 법률 제정 과정에 배제되었다는 근본적 한계를 가졌다. 그럼에도 2000년대부터 정신장애인 당사자들은 조금씩 조직과 운동의 토대를 구축하며 장의 도전자 집단으로 등장하게 되었고, 그 영향력을 확대하기 위해 역량을 축적해나가기 시작했다. 넷째, 2016년 ‘정신질환(자) 관리의 정치’의 장에는 「정신보건법」 제24조(보호의무자에 의한 입원) 제1항, 제2항의 헌법불합치 판결, 「정신건강복지법」으로의 전부개정, 사회적으로 크게 화제가 된 ‘정신질환(자)에 의한 범죄사건’들이라는 「정신보건법」 제정 이후 가장 중요한 사건들이 발생했다. 특히 ‘정신질환(자)에 의한 범죄’와 그것의 언론 보도는 정신질환(자)에 대한 사회적 편견과 낙인, 차별을 강화함으로써 정신장애인의 삶에 극히 부정적인 영향을 미치고 있다. 그럼에도 정신장애인 당사자 단체들은 법률 제·개정 과정에 대한 참여뿐만 아니라 정신장애인의 존재를 가시화하고 주체로서의 역량을 강화하기 위한 다양한 운동을 전개하고 있다. 다섯째, 이와 같은 역사적 흐름에서 현재 ‘정신질환(자) 관리의 정치’의 장은 정신질환(자)의 범죄 위험을 우려하며 관리를 요구하는 비정신장애인 사회 구성원들의 요구와 의료·수용의 관리 패러다임에 이해관계가 얽혀있는 정부, 정신의학 전문가 집단, 정신건강 관련시설 소유·운영 집단, 정신장애인의 가족 일부와 그러한 패러다임을 비판하며 지역사회와 당사자 중심의 정신건강체계로의 변혁을 요구하는 정신장애인 당사자들과 운동단체들이 각축을 벌이는 사회 영역으로 존재하고 있다. 여섯째, 1960년대에서 2020년까지 여러 자료를 통해 ‘정신질환(자) 관리의 정치’의 장의 역사를 분석했을 때, 한국 사회는 식민지배, 탈식민, 전쟁, 급속한 산업화와 도시화, 권위주의에서 민주주로의 이행 등 거대한 정치·경제·사회적 사건들을 경험했지만, 배제·격리·수용 등을 핵심으로 하는 관리 패러다임과 실천이 크게 변화하지 않은 채로 지속되었다는 점이 무엇보다 중요하다. ‘정신보건법’은 표면적으로 그러한 현실의 개선을 선언했지만, 실제로는 관리의 지속을 지탱하는 중요한 토대가 되었다. 정신질환의 의료화와 의료화된 정신질환자 신체의 자본화, 자본화된 신체의 사회 외부로의 배제와 유기, 시설로의 격리와 감금은 정신장애인 당사자를 제외한 비정신장애인 사회 전반의 이해관계의 교합과 공모를 통해 성립되고 지속될 수 있었다. 일곱째, 정신장애인 당사자는 ‘정신질환(자) 관리의 정치'의 장의 가장 중요한 대상인 동시에 행위자다. 그럼에도 오랜 역사 동안 그 행위성이 부당히 말소되어, 자신에 관한 것을 결정함에 있어 그 자신이 참여하지 못하는 현실이 지속되어왔다. 권위주의에서 민주주의로 정치체제가 변화하고 나서도 시간이 더 흐른 2000년대에 이르러서야 정신장애인 당사자 운동과 조직이 출현하게 되었다. 이들은 자조모임에서부터 시작하여 법률, 정책 등 정치적 과정에 개입하고 정신장애인의 존재를 가시화하기 위한 문화운동 등을 전개하고 있다. 이들은 기존의 ‘정신보건 패러다임’이 치안, 비정신장애인, 시설, 의료계를 중심으로 구축되어왔음을 비판하며, 대안적 패러다임을 제시하고자 했다. 그것은 정신장애인의 존엄과 권리를 중심으로 하고 시설에서 벗어나(탈시설화) 지역사회에서 주체적으로 치료받고 생활하는 것(사회 참여)에 초점을 둔다. 민간의 경영·이윤 논리를 대신하여 정부의 공적 책임이 정신건강체계의 운영 원리가 되어야 한다. ‘정신보건법’ 등 정신건강과 관련된 법률, 정책 등이 생산되는 과정에 정신장애인 당사자들의 참여와 의견 반영이 보장되어야 한다. 또한 그동안 사회에 누적되어온 정신질환(자)에 대한 편견과 낙인의 해소를 위한 적극적 노력도 요구된다.

This study focused on the history of 'politics of managing mental disorder(ed)' from 1960 to 2020 and on the history of the 'Mental Health Act' in Korea. The research materials included government data, newspaper articles and related academic data. Through this, I tried to uncover the history of their interactions, political and social processes, and their results and effects with the interested groups surrounding the 'mental disorder(ed) problem'. The main analysis results are as follows: First, during the Park Chung-hee administration, mental disoder(ed) gradually consisted of 'social problems' and aroused public opinion in the demand for management of it. However, while the government seems to be sympathetic to the development of psychiatry, the eradication of atypical psychiatry(ist) and atypical psychiatry facilities, the management of mental disoder(ed) has neglected and aided the private sector, which is atypical and unauthorized, and has been indifferent to public responses such as the enactment of the 'Mental Health Act'. The failure to enact the Mental Hygiene Act in 1970 was an event in that context. Psychiatry began to develop academically, but had little therapeutic infrastructure. What filled the vacancy were the atypical psychiatry(ist)(the shaman, the religious, the unlicensed doctor, etc.) and the atypical psychiatry facilities(the prayer house, the nursing home, etc.). Second, during the Chun Doo-hwan administration, 'crimes by mental disorder(ed)' and human rights violations at facilities were accumulated, making it difficult for the government to avoid the need to intervene in 'management of mental disorder(ed).' In 1984, the government sought to support the expansion of private mental health facilities by establishing 'comprehensive management measures for mental disorder(ed)'. This was the start of the 'institutionalisation' issue in Korea. In 1985, the Mental Health Act was intended to be enacted, but the anti-democratization of the regime and the issue of the bill were criticized together, and the enactment of the bill was canceled due to opposition from civil society organizations. Third, the stabilization of democracy reduced the concerns of abuse of the Mental Health Act and made it impossible to delay the enactment of the Evidence Act any longer in constraining the human body of the mental disorders. The Mental Health Act was enacted in 1995 by compromise between the Ministry of Health and Welfare, the National Assembly, a group of psychiatrists, and stakeholders of mental health facilities and mental care facilities. The Mental Health Act is meaningful in that it provides a comprehensive law on mental health and a legal basis for the arrest of persons with mental disorders. However, the Act has contributed to the trend of strengthening the tendency of compulsory and long-term hospitalization against community mental health as stated for its purpose. Above all, the Mental Health Act had fundamental limitations that the parties were excluded from the legal process, even though it had the greatest impact on the mental disorders. Nevertheless, from the 2000s, the mental disorders parties gradually emerged as a group of field challengers, laying the foundation for organization and movement, and began to accumulate capacity to expand its influence. Nevertheless, organizations of the mentally disorders are launching various campaigns to visualize the existence of the mentally disorderd and strengthen their capabilities as subjects, as well as to participate in the process of enacting and revising the law. Fifth, in this historical trend, the current field of 'Politics for the Management of Mental Disorder(ed)' exists as the social domain of the heated competition, which concerns the criminal risks of mental disorders and calls for management by members of society with atypical mental disorders, a government, a group of mental health experts, a group of mental health-related facilities owned and operated, some of the families of the mental disorders that has interests in the management paradigm of health care and acceptance, and a group of the mentally disordered who criticize such paradigms and demanded the transformation into a mental health system centered on the community and parties. Sixth, when analyzing the history of the 'politics of managing mental disorder(ed)' field through various data from the 1960s to 2020, it is more important than anything else that Korean society has experienced huge political, economic, and social events, including colonization, decolonization, war, rapid industrialization and urbanization, and the transition from authoritarianism to democracy, but the management paradigm and practice of exclusion, isolation, and acceptance, have not changed much. The 'Mental Health Act' ostensibly declared improvements in such realities, but in practice it became an important foundation for sustaining the continuation of management. The medicalization of mental illness, the capitalization of the medicalized mental disorders body, the exclusion and abortion of capitalized body outside society, and the isolation and imprisonment of facilities could be established and continued through the co-operation and public contest of interests of the society as a whole except for the mental disorders. Seventh, the mental disorders parties are both the most important subject and the actor of the field of 'mental illness management politics'. Nevertheless, for a long time, their behavior has been unjustly eliminated, and there has been a reality in which they themselves have not been able to participate in making decisions about themselves. It wasn't until the 2000s that more time passed after the political system changed from authoritarianism to democracy that movements and organizations for the mental disorders emerged. Starting with self-help groups, they are engaged in political processes such as laws and policies and conducting cultural campaigns to visualize the existence of mental disordered people. They criticized that the existing 'mental health paradigm' has been built around the security, non mental disorders, facilities and medical circles, and wanted to present an alternative paradigm. It centers on the dignity and rights of the mentally disordered and focuses on being treated and living independently in the community away from the facilities(deinstitutionalisation, social participation). On behalf of the private management and profit logic, the public responsibility of the government should be the principle of the operation of the mental health system. The participation and reflection of the opinions of the mentally disordered should be guaranteed in the process of producing laws and policies related to mental health, such as the Mental Health Act. It also calls for active efforts to resolve prejudice and stigma against mental disorders that has accumulated in society.

Fifth, in this historical trend, the current field of 'Politics for the Management of Mental Disorder(ed)' exists as the social domain of the heated competition, which concerns the criminal risks of mental disorders and calls for management by members of society with atypical mental disorders, a government, a group of mental health experts, a group of mental health-related facilities owned and operated, some of the families of the mental disorders that has interests in the management paradigm of health care and acceptance, and a group of the mentally disordered who criticize such paradigms and demanded the transformation into a mental health system centered on the community and parties. Sixth, when analyzing the history of the 'politics of managing mental disorder(ed)' field through various data from the 1960s to 2020, it is more important than anything else that Korean society has experienced huge political, economic, and social events, including colonization, decolonization, war, rapid industrialization and urbanization, and the transition from authoritarianism to democracy, but the management paradigm and practice of exclusion, isolation, and acceptance, have not changed much. The 'Mental Health Act' ostensibly declared improvements in such realities, but in practice it became an important foundation for sustaining the continuation of management. The medicalization of mental illness, the capitalization of the medicalized mental disorders body, the exclusion and abortion of capitalized body outside society, and the isolation and imprisonment of facilities could be established and continued through the co-operation and public contest of interests of the society as a whole except for the mental disorders. Seventh, the mental disorders parties are both the most important subject and the actor of the field of 'mental illness management politics'. Nevertheless, for a long time, their behavior has been unjustly eliminated, and there has been a reality in which they themselves have not been able to participate in making decisions about themselves. It wasn't until the 2000s that more time passed after the political system changed from authoritarianism to democracy that movements and organizations for the mental disorders emerged. Starting with self-help groups, they are engaged in political processes such as laws and policies and conducting cultural campaigns to visualize the existence of mental disordered people. They criticized that the existing 'mental health paradigm' has been built around the security, non mental disorders, facilities and medical circles, and wanted to present an alternative paradigm. It centers on the dignity and rights of the mentally disordered and focuses on being treated and living independently in the community away from the facilities(deinstitutionalisation, social participation). On behalf of the private management and profit logic, the public responsibility of the government should be the principle of the operation of the mental health system. The participation and reflection of the opinions of the mentally disordered should be guaranteed in the process of producing laws and policies related to mental health, such as the Mental Health Act. It also calls for active efforts to resolve prejudice and stigma against mental disorders that has accumulated in society.
