계획을 수립할 수 있어야 한다. 한편, 영국에서는 소년범죄문제가 증가함에 따라 범죄위험이 있는 소년들에게 적절한 지원 및 도움을 주는 정책이 필요하다고 인식하였고, 소년범죄문제를 해결하기 위해서는 다기관의 협력과 참여가 필요하다고 보았다. 이를 위해 소년사법위원회(Youth Justice Board, YJB)를 설립함으로써 전국적으로 통일되고 일관된 소년사법시스템을 갖추고자 노력하였으며, 다기관협력체계인 소년범죄대응팀(Youth Offending team, YOT)을 설립함으로써 소년사법 관련 기관의 긴밀한 협력체계를 구축하였다. 이를 통해 영국은 지난 10년간 소년범죄 수가 대폭 감소하였으며, 소년재범자의 수도 지속적으로 감소함에 따라 영국의 다기관협력체계가 소년재범방지에 긍정적인 효과를 보였다는 평가를 받고 있다. 영국제도의 연구를 통하여 다기관협력체계가 소년사법 관련 기관의 긴밀한 협력을 이끌어 소년사법제도에 전문성을 더해주고 각각의 기관에서 진행되었던 모든 서비스를 간소화하여 복합적으로 얽혀 있는 소년범죄문제에 신속한 개입과 과학적 진단에 따른 개별 맞춤형 지원이 가능하다는 사실을 밝혀내었다. 더 나아가 영국의 다기관협력체계가 가지고 있는 일정 부분의 한계를 통해 소년의 필요(Needs)에 맞는 개입이 필요하며 프로그램 효과에 대한 측정이 이루어져야 한다는 등의 시사점을 얻을 수 있었다. 본 논문에서는 다기관협력체계의 구성이 재범방지의 핵심 키(Key)라고 보았다. 다기관협력체계란, 소년범죄와 관련된 다양한 기관이 소년의 재범방지라는 공동의 목표를 달성하기 위하여 상호간 힘을 합하는 체계라고 정의할 수 있다. 이에 따라 소년범죄자가 소년사법시스템에 유입된 직후부터 모든 절차를 마치고 사회에 나갈 때까지의 전 과정동안 관계있는 모든 기관이 함께 노력할 수 있도록 소년법 제67조의3을 신설하여 국무총리 산하의 “소년범죄대책위원회”의 설치를 제안하고, 소년법 제67조의4를 신설하여 소년범죄대책위원회의 위원장과 위원의 자격 및 인원을 명시할 것을 제안하였다. 소년범죄대책위원회의 위원들은 판사, 검사, 경찰, 교수, 보호관찰소장, 소년원장, 청소년회복지원시설장(청소년회복센터장), 아동보호치료시설장, 한국법무보호복지공단 이사장, 청소년자립지원관의 장, 청소년자립생활관의 장 등 소년범죄와 관련 있는 자들로 구성되어야 보다 실무적인 정책 수립이 가능해지므로, 위원들은 모두 소년범죄 전문가로 구성된 협의체로 이루어져야 함을 제안하였다. 소년범죄대책위원회를 통해 통일되고 일관된 목표 하에 재범방지대책을 수립·시행할 수 있고, 소년범죄전담팀의 활동을 관리·감독함으로써 운영현황과 실태를 반영한 새로운 재범방지대책을 세울 수 있으리라 생각된다. 또한 소년법 제67조의5를 신설하여 소년범죄대책위원회의 실천기관으로서 “소년범죄전담팀”을 설치하고, 소년법 제67조의6을 신설하여 소년범죄전담팀의 업무를 구체적으로 명시할 것을 제안하였다. 소년범죄전담팀은 소년범죄대책위원회의 수립계획에 따라 이를 실제 행하는 기관으로, 전국 시·도청 소재지 마다 하나 이상의 소년범죄전담팀을 설치할 것을 제안하였다. 소년범죄전담팀을 시·도청 소재지마다 설치하게 되면 각 소재지의 소년범죄자에 대한 집중적 관리 및 개입이 가능하며, 지역사회의 협력을 바탕으로 기관 간 경험과 지식을 공유하고 적재적소에 조기 개입하여 소년의 범죄요인을 단절하는 최적의 개입 계획을 세울 수 있을 것이라 생각된다. 소년범죄전담팀의 핵심 업무는 다음과 같이 구성하였다. 첫째, 통계를 통한 양적 연구와 상담·관찰을 통한 질적 연구를 병행하여 소년이 체포된 순간부터 처분이 종료될 때까지 모든 절차에 개입함으로써 범죄유발·범죄단절요소를 발견하고, 이러한 내용을 개별화된 개입계획에 반영할 수 있어야 한다. 둘째, 현재 검사나 소년부의 필요성의 판단에 따라 임의적으로 이루어지고 있는 소년의 환경에 대한 조사를 필수적으로 진행하고, 조사의 일관성이 보장될 수 있도록 소년범죄전담팀이 조사의 제1주체가 되어 조사를 실시하며, 관계기관 간 소년의 환경에 대한 조사 내용을 공유함으로써 중복조사가 이루어지지 않도록 해야 한다. 셋째, 경찰단계에서 훈방처리되는 모든 사안에 대하여 선도심사위원회를 거치도록 하고, 위원회의 결정으로 훈방처리가 적절하다고 평가할 경우에는 소년범죄전담팀에 연계하여 회복적 사법의 요소가 가미된 선도프로그램을 이수하도록 해야 한다. 또 선도프로그램에 참여하는 동안의 태도를 바탕으로 입건 여부를 결정할 수 있도록 하여 경찰의 입장에서는 섣부른 훈방이라는 비판을 면하고, 소년에게는 책임감을 갖고 프로그램에 참여하게 만들어야 한다. 넷째, 부모의 보호력이 약화되어 있는 가정의 소년에 대하여는 원가정을 대신할 수 있도록 지역사회 자원을 활용하여 대안가정을 발굴·연계하고, 이를 장기적으로 관리·감독할 수 있도록 해야 한다. 이를 위해서 소년범죄전담팀은 지역사회와의 원활한 의사소통을 하는 조정기관으로서의 역할을 수행해야 하며, 일자리 제공 등 자립을 위한 프로그램을 제공하고, 자립을 이룰 때까지 주기적이고 지속적으로 관리할 수 있는 관리책임자의 역할을 담당해야 한다. 다섯째, 영국의 트리아지(Triage) 모델과 유사한 방식의 ‘반성’ 프로그램, 영국의 음악프로그램과 유사한 방식의 ‘내면치료’ 프로그램, 영국의 고용프로그램과 유사한 방식의 ‘자립’ 프로그램을 개발하고, 이를 순차적으로 진행해야 한다. 행위에 대한 반성과 그것을 통해 새로운 삶을 살겠다는 의지가 스스로 생기면 더 이상 재범하지 않고자 하는 원동력이 마련되기 때문이다. 이를 위해서는 소년이 주체적으로 절차에 참여할 수 있도록 해야 하며, 소년의 필요(Needs)가 무엇인지 확인하는 과정을 거쳐야 한다. 여섯째, 집중·주요Ⅰ 보호관찰대상자에 대한 전담 보호관찰을 수행하여 소년보호관찰에 대한 전문성을 키워야 하며, 보호관찰 종료 후에는 자립지원을 위한 현실적인 고민들을 상담하고 문제해결에 도움을 줄 수 있는 상담가로서의 역할을 해야 한다. 사후관리는 소년이 안정된 삶을 살아갈 수 있게 지원함으로써 과거의 삶과 단절하고 재범을 방지하고자 하는 것이므로, 소년이 사회의 구성원으로써 안정적으로 살아갈 수 있도록 성행교정 뿐 아니라 앞으로의 삶에 대한 사회적 지지기반을 마련해주는 차원으로 접근해야 한다. 일곱째, 자원봉사요원과 소년범죄전담팀의 직원들은 자격 있는 전문성 있는 자들로 구성해야 하며, 이들을 위한 전문화 교육 및 성과평가도 연 4회 이상 주기적이고 장기적으로 이루어질 수 있도록 해야 한다. 소년범죄대책위원회와 소년범죄전담팀은 현재 다양한 주체와 절차로 진행되었던 소년보호제도를 한 데 모아 협력을 요청할 수 있는 구체적이고 총체적인 기관으로 구성한 것이다. 이를 통해 소년범죄자들에게 필요한 개별적 처우를 제공함으로써 소년법의 목적에 맞는 소년보호제도를 운영할 수 있을 것이라 기대된다.

한다. 여섯째, 집중·주요Ⅰ 보호관찰대상자에 대한 전담 보호관찰을 수행하여 소년보호관찰에 대한 전문성을 키워야 하며, 보호관찰 종료 후에는 자립지원을 위한 현실적인 고민들을 상담하고 문제해결에 도움을 줄 수 있는 상담가로서의 역할을 해야 한다. 사후관리는 소년이 안정된 삶을 살아갈 수 있게 지원함으로써 과거의 삶과 단절하고 재범을 방지하고자 하는 것이므로, What is concerning is that the juvenile law does not achieve the results of environmental adjustment and behavioral correction that it aims to achieve, because it is difficult to treat juveniles according to their individual characteristics, and the recidivism rate of juveniles is reaching a serious level.
If juvenile recidivism continues and extends to adult crimes, it can eventually contribute to an overall increase in the recidivism rate. Therefore, it is crucial to break the chain of criminality before it progresses to adult crimes.
In order to uncover the reasons why boys continue to commit crimes, this paper reviewed a total of 208 criminal cases searched for “juvenile protection cases.”
It is generally accepted that the main factors contributing to juvenile recidivism are as follows: experiences of dropping out of school, the frequency of running away from home, the age of the first offense, experiences with drinking or drugs, criminal history, and the presence of a broken home.
In addition to these, this paper uncovered that personal factors like impulsive temperament as well as systemic issues including the involvement of a 'run-away family,' which is one of the delinquent groups, a decline in the functional role of the family, minimal post-management, difficulties in social reintegration, arbitrary implementation of post-offense risk assessment, and a weakening of expertise in evaluation were found to be factors contributing to an increase in the recidivism rate.
In order to improve these factors, it is necessary to provide juvenile delinquents with various achievement experiences to increase their self-efficacy, improve their social skills through impulse control, and elicit responsibility and reflection on their crimes. There should be a stable guardian and protective space for juvenile delinquents and a systematic support and protection system for their social rehabilitation after disposition, preparing them to become members of society by providing jobs and education.
Furthermore, a predictive and enhanced recidivism risk assessment tool should be developed, and all juvenile delinquents should undergo assessment with it. This will enable the formulation of individualized intervention plans based on the assessment results.
On the other hand, the UK has recognized the need for policies to provide appropriate support and assistance to juveniles at risk of crime as the problem of juvenile crime increases and the need for multi-agency cooperation and participation to solve the problem of juvenile crime.
To this end, it established a unified and consistent juvenile justice system nationwide through the establishment of the Youth Justice Board (YJB) and established close collaboration among juvenile justice-related organizations through the establishment of the Youth Offending Teams(YOTs), a multi-agency cooperation system.
This has led to a significant reduction in the number of juvenile crimes in the UK over the past decade, and the number of juvenile recidivists has continued to decline, showing that the UK's multi-agency cooperation system has had a positive effect on preventing juvenile recidivism. Through the study of the UK system, it was uncovered that a multi-agency cooperation system brings expertise to the juvenile justice system by bringing together agencies involved in juvenile justice and streamlining the services provided by each agency, allowing for rapid intervention and individualized support based on the scientific diagnosis of complex juvenile crime problems.
Furthermore, with certain limitations of the UK's multi-agency cooperation system, it was possible to derive implications such as the need for interventions tailored to the needs of juveniles and the importance of measuring program effectiveness.

It was suggested that the members of the Youth Crime Countermeasures Committee should be composed of judges, prosecutors, police officers, professors, probation officers, directors of juvenile detention centers, directors of juvenile rehabilitation centers, directors of child protection treatment centers, directors of the Korea Legal Protection and Welfare Corporation, directors of juvenile independence support centers, and directors of juvenile independent living centers, all of whom are experts in juvenile crime, so that more practical policies can be established.
Through the Youth Crime Countermeasures Committee, recidivism prevention measures can be established and implemented under a unified and consistent goal, and by managing and supervising the activities of the Youth Crime Task Force, new recidivism prevention measures reflecting the operational status and reality can be established.

Thirdly, it should be ensured that all cases receiving cautionary dispositions at the police level undergo a leading review committee. If the committee determines that a cautionary disposition is deemed appropriate, coordinate with the Youth Crime Task Force to enroll and complete the individuals in a rehabilitative program infused with restorative justice elements. In addition, the police should be able to decide whether to file charges based on the juvenile's behavior while participating in the diversionary program, avoiding the criticism that it is a hasty release on warning and making the juvenile participate in the program responsibly.
Fourthly, for juveniles from families where parental guardianship is weakened, it is crucial to utilize local community resources to find and link alternative families to substitute for the original family setting, which should be allowed to be managed and supervised over the long term. For this purpose, the Youth Crime Task Force must function as a coordinating body with effective communication with the local community, which should provide programs for self-reliance, such as job opportunities, and take on the role of a supervising authority, ensuring periodic and sustained management until independence is achieved.
Fifthly, it is essential to develop programs such as a 'Reflection' program similar to the Triage model in the UK, an 'inner healing' program resembling the music programs in the UK, and an 'independence' program structured similarly to the employment programs in the UK, and these programs should be implemented sequentially. It is because this leads to the will to refrain from further offenses being established when there is self-reflection on behaviors and a genuine determination to lead a new life. To achieve this, it is crucial to enable the juvenile to actively participate in the process and undergo an assessment to identify their needs.
Sixthly, they should develop expertise in juvenile probation by conducting dedicated probation for Intensive and Major I Probationers. After the end of the probation, they should serve as counselors who can help them solve practical problems to support their own independence. Post-management aims to prevent re-offending by supporting the juvenile in leading a stable life disconnected from their past. Therefore, the approach should not only focus on behavioral correction but also establish a social support foundation for the juvenile to live stably as a member of society, considering both corrective behavior and future life perspectives.
Seventh, volunteers and staff members of the Youth Crime Task Force should possess qualifications and professionalism. Their specialized training and performance assessments should be conducted regularly and over the long term, at least four times a year.
