최근 우리 사회에서 '16개월 입양아동 사망사건' 등 아동학대 사건이 잇따라 발생하고 심각한 사회문제로 대두되고 있다. 아동학대는 아동의 인권을 현저하게 침해할 뿐만 아니라 아동의 신체에 상처를 남기거나 때로는 생명에도 위협을 주고 있다. 이에 피해아동을 안전하게 보호하고 건강하게 성장할 수 있도록 수차례 아동학대 관련 법이 개정되고 관련 제도가 정비되었지만, 아동학대 사건은 계속 발생되고 있다. 따라서 아동학대 범죄를 예방하고 피해 아동을 보호하는 실효적인 대책 마련이 시급하다. 이에 본 연구에서는 아동학대의 개념 및 관계법령을 비롯하여 현재 아동학대 현황 등을 살펴보고, 미국의 아동학대 법제 및 아동보호체계와 비교하여 아동학대에 실효적으로 대응할 수 있는 대응방안을 제시하고자 한다.

Recently, child abuse cases such as the "16-month death of adopted children" have occurred one after another in our society and have emerged as a serious social problem. Child abuse not only significantly violates children's human rights, but also leaves scars on the child's body and sometimes threatens their lives. As a result, laws related to child abuse have been revised several times and related systems have been reorganized to protect the affected children safely and grow healthy, but child abuse cases continue to occur. Therefore, it is urgent to come up with effective measures to prevent child abuse crimes and protect affected children. Therefore, this study examines the concept and related laws of child abuse, the current status of child abuse, and suggests countermeasures to effectively respond to child abuse compared to the US child abuse legislation and child protection system.

아동학대자를 엄하게 처벌하는 것만이 아동학대 문제를 근본적으로 해결할 수 있는 방안은 아니다. 아동학대 피해자에 대한 보호정책이 함께 이루어질 때 비로소 아동학대 문제가 성공리에 정착할 수 있을 것이라 생각되며, 아동학대 범죄 예방과 재발방지에 대한 국가적인 발전이 이루어지기를 기대해본다.
아동학대는 단순히 가정 내부의 문제가 아니고 사회, 국가 문제로 연결된다는 점에서 아동학대에 대한 국가의 책임성과 국민들의 관심이 높아지는 만큼 앞으로도 아동학대 신고와 발견율이 증가할 것이라고 생각되며, 아동학대에 효과적으로 대응하기 위해서는 아동의 복리를 최우선으로 하는 적극적인 방안을 구체화해 나가야 할 것이다.
이에 장시간 근무와 책임 의무 등 다양한 이유로 인하여 전담공무원들이 아동학대 업무를 기피하고 있으므로, 전담공무원 인력을 보충하여 1인당 맡는 사건을 줄여 업무 강도를 낮추고, 전문성을 갖춘 인력을 채용하는 등의 방식을 통해 제도를 합리적으로 운영해야 할 것이다.
이에 향후 아동학대 피해자를 실효적으로 보호하기 위한 방안으로 첫 번째, 미국의 경우처럼 아동학대 사망 사건에 대한 진상조사를 위해 「아동학대특별법」에 따라 진상조사위원회를 설치하여야 할 것이다. 두 번째, 아동학대신고 증가 및 지자체의 실질적 인력·재정운영 요건 등을 종합적으로 고려하여 아동학대 전담공무원 인력을 증원하고, 아동학대 전담공무원에게 직접적인 권한 등을 부여하여 적극적으로 개입할 수 있도록 해야 된다고 생각한다.
