이에 본 연구는 성인지적인 관점에 입각한 새로운 중립성올 제안한다. 성인지적 관점은 여성들의 경험과 요구 그리고 현실속에서 우선순위등을 고려하면서 성불평등의 영향이나 결과의 평등을 중시한다. 성인지적 중립성은 몰성적인 관점이 성차나 성역할을 판단의 기준으로 삼는 것을 비판하면서 성차나 성역할은 불평등을 시정하기 위한 현실적인 조건으로 이해되어야 한다고 본다. 또한 남성만의 경험에서 여성의 경험까지 포괄하는 새로운 중립적 기준들을 모색하면서 불평등의 영향이나 결과의 평등을 평등원칙의 새로운 적용기준으로 제시하고 있다.

I ask the following questions in this paper: why has gender inequality persisted in the courts in spite of neutrality, and if the problem is the implementation of neutrality, how is it possible to develop an alternative neutrality through the gender perspective. To find answers, I analyze the mechanisms of applying neutrality, the principle of equality, and search for an alternative neutrality. Until now the feminist jurisprudence has criticized gender inequality in the law and courts resulting from the male standard underlying the current form of neutrality. In addition to this, my opinion is that neutrality should be redefined through a gender perspective. In the courts and law, neutrality and the male standard have coexisted. I refer to this coexistence as a duality. This duality is working in the process of applying the principle of equality, "the same should be treated as same, the different should be treated as different". The problem is that this only works through a gender blindness. In "the same as same", preexisting gender inequalities are not considered. And in "the different as different", the court regards the gender-difference and gender role as fixed. Moreover, this gender blindness takes these fixed gender differences and gender roles as a criterion for judging. For eliminating gender discrimination from the law and courts, I suggest a new neutrality based on a gender perspective. Gender-sensitive neutrality recognizes the experiences, needs and priorities of women and then takes the impact of gender inequality or disadvantages of gender as the criteria for judgement. In this gender-sensitive neutrality, understanding gender differences and gender roles is the real condition for women"s equality, but gender differences and gender roles are not criteria for judging.
