Human rights and environmental protection are two of the most fundamental concerns of modern international law, The fields of international human rights law and international environmental law have been the two areas modem international law that have experiences the most prolific growth during the last thirty years. They represent different but overlapping social values with a core common goals. Efforts on behalf of both seek to achieve and maintain the highest quality of human life. In this regard, human rights depend upon environmental protection and environmental protection depends upon the exercise of existing human rights such as the rights to information and the right to political participation. This Article examines the nexus between international human rights and environmental protection. Clearly, there is a strong nexus between international human rights and environmental protection. Human rights and an ecologically sound environment are interdependent and indivisible. However, the precise relationship between human rights and environmental protection is far from clear. Two alternative approaches are being taken to the relationship between international human rights and environmental protection. The first viewpoint provides the recognition of environmental rights is a necessary prerequisite for the ultimate realization of fundamental human rights. This supporters advocate the creation of a universal system environmental protections as a means of ensuring compliance with minimum standards of human rights. The second viewpoint holds that international human rights are a launching point from which environmental rights may be derived. This approach relies on the derivative nature of civil and political rights, such as the right to life, the rioght to respect for privacy and family life, the right to obtain information concerning risks to health and safety. Existing human rights instruments may be interpreted, in various ways, to encompass environmental rights. None of three treaties concerned with civil and political rights which have been surveyed in this articles, The B Covenant, the European Convention and American Convention, contains an express right to a decent environment. There are, however, other rights contained in the treaties - the right to life, the right to freedom from interference with one"s barre and property, and the right to a fair trial - which are potentially applicable to the protection of environment. This derivative rights found in those treaties with an individual complaints machinery have rarely been invoked to protect the environment. A few cases involving derivative rights therefore reinforces the doubts about the usefulness of human rights treaties as a means of protecting the environment. There are the advantages of using a human rights approach rather than an approach based in regulation, criminal law or the law of tort. First, it may help to raise ecological awareness amongst humanity which may in turn encourage the evolution of a new environmental ethic. In particular, it may playa useful role in the transition of environmental law from an anthropocentric perspective to an ecocentric perspective. Second, it assists in bridging some of the gaps in current international environmental law. It can be utilised to protect a state"s own environment. It can potentially be used to protect areas beyond national jurisdiction. Alternatively, it is capable of recognising and protecting the earth"s global environment. Third, it may inherently encompass the rights of future generations of humanity (but not future generations of other living things). Forth, It may be enforceable against states by individuals. Fifth, it offers good potential for prevention of harm.
