(What Every Artists and Collector Should Know About the Law)를 출판한 이래 이 분야에 관한 서적이 다수 출판되었고, 점차 미술품에 관한 독립된 법안 제정의 필요성이 논의되었다.

Even in foreign countries where there are world famous art auction houses with long history such as Sotheby and Christy, counterfeiting works of art is a serious threat to the art industry. In Korea, exact statistics on the problem are not yet forth-coming, but many guess that the works of art in Korea may be systematically forged on a large scale. According to “Art Law in a Nutshell” of Leonard D. Duboff and Christy O. King, it is estimated that about 10% of the works of art traded in the U.S. are fakes. It is said that, among the 2,525 works appraised by Galleries Association of Korea from 1982 to 2001, genuine works accounted for 68.5%, fakes for 29.5%, and the works impossible to appraise formed 2.1%. In spite of its high growth, the art market in Korea is not acknowledged its authority of appraising the works of art due to its lack of experts such as connoisseurs and of public confidence. In the U.S., as the trading of works of art increased after 1960"s, Scott Hodes who was the first author handling an legal issue on the rise of artwork deals published “What Every Artist and Collector Should Know About the Law” in 1974. Since then, lots of books in this field have published, and people have started to discuss the necessity of independent enactment on works of art. In 1983, an independent act, “Arts and Cultural Affairs Law” was enacted. In Korea, an act related with works of art is not enacted, but the things related with the works are specified in the liability for warranty against defects under civil and commercial laws. “Study on basic concepts of taking measures against fakes” announced by Ministry of Culture, Sports and Tourism in Dec. 2008 suggested that legal and institutional improvement as well as the efforts of the art sector were required to basically resolve and eliminate various problems caused by distributing fake works of art determined by false appraisal. Thus, this paper suggests and reviews several plans on legal and institutional improvements to prevent creating counterfeits caused by intentional or unintentional false appraisal of artwork appraisers. In addition, it proposes law revision based on the plans suggested by Ministry of Culture, Sports and Tourism.
