Ⅰ. 배경 및 목적
□ 셰일가스는 에너지 산업의 판도를 바꿀만한 잠재력을 갖고 있지만 셰일가스를 개발하는데 있어서도 환경적인 부분과 관련하여 장애요인이 존재하는 것도 사실임.
□ 환경적 장애요인들을 극복할 수 있다면, 셰일가스는 화석연료 중에서는 가장 청정한 연료로, 온실가스 배출감소 목표를 달성할 수 있는 효과적인 에너지원으로 평가받을 수 있음.
□ 이러한 이유로 세계 여러 나라들은 셰일가스 개발에 관해 개발법제를 채택하기도 하지만 반개발법제를 채택하기도 함

□ 우리나라도 이제 이러한 국제정세 흐름에 맞춰 셰일가스개발 참여 및 수입에 더 큰 관심을 가져야 할 시기라고 생각 됨.
- 우리나라에는 셰일가스층이 발견되지 않으므로 개발에 투자 하거나, 개발사업에 참여하고, 또 수입에 따른 적절한 조치를 취하여야 함.
- 셰일가스에 관한 정책선택에 앞서 셰일가스를 둘러싼 각국의 상황 및 제도를 정확히 이해하는 것이 필요함.
□ 세일가스가 부존되어 있지 않다고 하더라도 반드시 셰일가스의 개발에 따른 이점을 누리지 못하고 수입비용만 증가한다고만 볼 수 없음.
- 우리나라의 경우 “오일쇼크” 사태에 직면하여서도 중동시장에 진출하여 오일머니를 회수하고 경제성장을 지속한 경험이 있음.

□ 셰일가스관련 정책의 초석을 다지기 위해서 본 연구는 셰일가스 개발에 박차를 가하건, 금지시키던, 관심을 가졌던 나라들의 법제를 분석하였음.

Ⅱ. 주요 내용
□ 제1장에서는 본 연구의 목적과 필요성을 살펴보고, 제2장에서 셰일가스와 관련한 정치적 경제적 함의를 파악하여 셰일가스가 에너지 산업의 판도를 바꿀만한 잠재력이 있음을 보여줌으로써 그 함의를 구체화하고 있음.
□ 제3장에서는 셰일가스 개발법제를 두고 있는 각국의 입법내용을 다루고 있음.
- 미국, 폴란드, 호주, 캐나다, 아르헨티나 등의 셰일가스 개발법제를 법체계, 규제기관, 중앙정부와 지방정부간에 권한 배분 관계를 중심으로 분석하였음.
□ 제4장에서는 셰일가스 반개발법제를 두고 있는 각국의 입법내용을 다루고 있음.

Ⅲ. 기대효과
□ 본 연구는 셰일가스 개발과 관련한 세계 각국의 법제 및 정책을 분석하는 것을 주요내용으로 삼고 있음.
- 이러한 분석을 통하여 시사점을 제시함으로써, 우리나라가 셰일가스 개발에 대한 투자 및 개발이익에 참여하고, 우리나라의 에너지 주권을 확보하기 위한 정책 및 법제정비의 필요성을 인식할 수 있는 계기가 마련될 수 있음.
□ 본 연구는 특히 셰일가스를 개발하고 수입함으로써 경제적인 이득이 있다는 점과 환경규제가 필요함을 역설하고 있다는 점에서 셰일가스 개발과 관련한 입법방향을 제시함에 있어서 균형적인 시각을 갖는데 도움이 될 것으로 판단됨.

□ A controversy over the environmental and health impacts induced by hydraulic fracturing for the extraction of shale gas appeared in 2010, especially by the “study the drinking water and public health” and the publication of the first synthesis by American Scientist decided by the EPA at the request of the U.S. Congress.
○ After three years of use, there have been several important cases of “leakage” of gas in the United States, and contamination of groundwater by superficial gas and fracking fluids, according to the French Institute petroleum due to the defect in the upper portion of cementing the drilling.
○ Demonstrations of citizens and associations have taken place in various countries in opposition to this method of extraction as well as the continued use of fossil fuels when they argue for a transition to renewable energy.
○ A film, Gasland, itself the heart of a technical controversy helped alert people about it.

□ A documentary film Gasland (2010), Josh Fox, looks at the impact (water and health) of hydraulic fracturing. The documentary puts serious doubts on the claims of industrial process safety.
○ It’s criticized the exemption from the Safe Drinking Water Act (to secure drinking water resources and maintain quality) for this new industry, thanks to the Energy Policy Act (Energy Policy Act) passed July 29, 2005.
□ This law exempts liquids used in the extraction of gas by hydraulic fracturing protection devices established by the Clean Air Act, the Clean Water Act, the Safe Drinking Water Act process, and CERCLA.

○ Following this information, users' associations have called for a moratorium on the controversial gas exploration .
□ In France, mobilizing opposition to the exploitation of shale gas has been remarkably fast and was jointly referred to “rapid mobilization” or “flash mob.”
○ In May 2011, more than 110,000 people signed a petition against the exploitation of shale gas by a chemical process that environmentalists feel extremely hazardous to the environment.
○ After five months of protest, the Parliament voted on 11 May 2011 a bill proposed by a deputy from 'Seine-et-Marne' Christian Jacob, developed “in the name of the precautionary principle” and with the support of government.
○ This prohibits the exploration and exploitation of “oil and gas” by “drilling followed by hydraulic fracturing.” It makes France the first country to implement such a legislative scheme.
○ The government will not follow the recommendations of the report by not accepting “the resumption of research on the exploitation of shale gas from major projects to boost competitiveness.”
○ However, on November 13, 2012, President François Hollande said that research on other techniques that hydraulic fracturing “continue” adding that “As long as there is no new technique, during my term, there would be no authorization for exploration of shale gas.”
Ⅲ. Expected Effect
□ The exploitation of this gas has allowed the United States to increase greatly their gas production and are thus shifted from exporting to importing gas, which has contributed to the decline in gas prices in the country.
○ This fall of the price bring advantages to American industry at the expense of that of Europe, especially in the area of chemical and petro-chemical industry, with a growing gap in competitiveness on both sides of the Atlantic. It transfers considerable capacity from the Europe and Asia to the United States.
□ Günther Oettinger, Commissioner for Energy, said in September about unconventional gas, that he wanted to “common standards of environmental protection, so that Member States may grant operating licenses in a clear limit.”
○ He added that member states should have “high demands on safety and environmental standards.”
