오늘날 과학기술의 발전으로 인하여 종래 공상과학 영화에서나 등장하던 기술이 현실에서구현되고 있다. 생체인식기술도 그 중의 하나인데, 신원확인 수단으로서의 탁월성이 인정되면서동 기술은 다양한 분야에서활용 방안이 적극적으로 모색되고 있다. 예컨대, 정보보안 분야에서는 모바일기기의 보안상 취약점을 극복하기 위해 지문이나 음성 및 홍채 등을 이용한 신원확인 방법이 본격적으로 활용되고 있고, 의료 분야에서는 환자의 손발이나 동공 등을 인식하여 건강상태를 체크하는 기술이 도입됨으로써 원격지 진료 활성화의 발판이 마련되었다. 특히, 2001년

우리나라의 경우, 17세 이상의 국민이 주민등록증을 발급받을 때에 사진과 지문을 제출해야 하는 주민등록제도가 운영되고 있기 때문에 방대한 양의 데이터베이스가 구축되어 있고, 이로 인하여 범죄수사 분야에서지문인식기술이 효과적으로 구현되고 있다. 또한 출입국관리 분야에서도 생체정보를 포함시킬 수 있는 전자여권제도가 도입되었으며, 국내에 입국하거나 외국인등록을 하는 외국인의 지문과 사진정보도 수집․관리되고 있다. 기타 공공분야에서도 무인민원발급, 지문인감증명발급시스템, 지문인식 전자입찰시스템 등 생체정보를 이용한 시스템이 광범위하게 구현되고 있는 바, 이처럼 다양한 분야에 생체인식기술이 접목됨으로써 편의성과 효율성이 제고되고 있다는 평가가 내려지고 있다. 그러나 생체인식기술의 활용과 관련해서는 생체정보 수집에 대한 적정성을 비롯하여 정보 유출이나 남용 가능성에 대한 우려의 목소리가 높아지고 있다. 즉, 새로운 범죄현상에 대응하기 위해 과학기술을 적용함으로써 보안기능이 강화되고 사회안전망이 공고해질 수 있으나, 그 이면에는 프라이버시 침해라는 문제가 상존하고 있는 것이다. 이러한 순기능과 역기능 사이에서합리적 균형점을 찾기 위해서는 생체인식기술에 대한 일반 국민들의 인식을 파악한 후, 이를 토대로 출입국관리나 범죄수사 등 개별 분야에서 동기술이 어떻게 활용되고 있는지에 대해 형사정책적인 검토가 이루어져야 한다.
이에 본 연구는 생체정보 및 생체인식기술에 관한 일반 국민의 인식을 조사하였는데, 제주도를 제외한 전국의 20세 이상 성인 남녀 1,200명을 대상으로 2014년 9월 3일부터 같은 달 26일까지 1:1 대인면접조사방법으로 수집된 자료가 결과 분석에 사용되었다. 이에 의하면, 생체인식기반 시스템의 이용자(488명) 대부분이 동시스템의 사용으로 인한 편리성을 인정하였지만, 이와 동시에 이용자 10명 중 7명은 생체정보의 유출이나 다른 용도로의 남용에 대해 불안감을 표명하였다. 또한 응답자 10명 중 9명은 주민등록증에 날인되고 데이터베이스화된 지문이 범죄수사에 도움을 주고 있다고 긍정적으로 평가하였으며, 응답자 10명 중 6명은 국가기관이 범죄해결을 위해 지문 이외의 다른 생체정보를 관리하는 것에 대해서도 동의하였다. 한편, 주민등록증에 지문 이외의 생체정보를 더 추가한 전자주민카드 제도를 시행하는 것에 대해서는 응답자 10명 중 5명이 동의하였다. 나아가 생체정보 활용과 관련해서는 외국인이 국내에 입국할 때 이를 활용해서 신원확인을 해야 한다는 의견이 가장 많은 공감을 얻었고, 미아방지를 위한 지문 등록이나 범죄수사를 위한 용의자의 치과기록 열람 등도 긍정적으로 평가되었다.
한편, 본 연구는 공공부문과 민간부문에서의 안전 확보를 위해 생체인식기술을 활용하고 있는 전문가를 대상으로 면접조사를 실시함으로써 현장의 목소리를 적극적으로 반영하고자 하였다. 8월 19일부터 10월 23일까지 약 2개월간 이루어진 당해 조사는 총 60명의 전문가를 대상으로 방문 면접 및 E-mail을 이용한 서면 면접 방식으로 진행되었는데, 경찰청․검찰청․국립과학수사연구원․출입국관리사무소․보호관찰소․교도소․ 선거관리위원회 등 여러 공공기관의 실무자와 국내 대표적인 민간보안업체의 실무자 및 형사사법기관과 공조하는 학계의 전문가들을 그대상자로 선정하였다.
이와 같은 생체인식기술에 대한 일반 국민들의 인식조사 및 전문가 대상 심층면접 결과를 토대로 본 연구는 향후 동 기술이 형사정책적인 측면에서보다 적극적으로 활용될 수 있는 분야를 중심으로 다음과 같은 정책제언을 제시하였다.
첫째, 출입국관리 분야에서는 국경관리의 안전한 체계 구축과 효율적인 행정서비스 제공을 목적으로 통합국경관리시스템(IBMS)이 마련되어 있다. 여권자동판독시스템(APRS), 자동출입국심사시스템(SES), 출입국관리정보시스템(ICRM), 외국인 지문확인시스템(FBIS) 등에서생체인식기술을 기반으로 생체정보가 활용되고 있는데, 최근에 헌법재판소가 지문날인제도와 디엔에이 채취 및 정보 보관 등에 대해 연이어 합헌결정을 내리면서국가의 생체정보 활용에 힘이 실리고 있지만, 여전히 사생활 침해의 논란이 제기되고 있다. 헌법상의 기본권과 비례성 원칙을 준수하면서출입국관리 분야에서생체인식기술을 활용하기 위해서는 첫째, 전자여권에 수록되는 정보의 범위를 조정할 필요가 있다. 지문정보를 수록범위에서제외시킨 것은 고무적인 일이나, 주민등록번호도 외국에서의 정보유출 위험을 감안하여 삭제시키는 것이 바람직하다. 둘째, 전자서명법이나 전자정부법의 규정에서처럼, 보안을 위한 여권전자인증체계의 구축과 운용에 관한 구체적인 사항은 여권법 내에 명시되어야 한다. 셋째, 출입국관리법을 통해 수집된 정보의 남용과 유출은 동법을 통하여 규제되도록 하는 규정을 신설하여야 하고, 여권 위․변조 행위도 여권법을 통하여 처벌되는 것이 바람직할 것이다. 이외에도 자국의 국민과 외국인의 정보를 동시에 보호하기 위한 국제적인 구제수단이 마련될 필요가 있고, 생체인식 기술을 통해 사생활을 강화시킬 수 있는 방안, 생체정보 데이터베이스 관리 방안,생체정보관리를 위한 사후적인 감독기구의 설립 등을 법적․ 제도적으로 보완할 필요가 있다.
둘째, 범죄수사 분야에서는 수사의 효율성 제고와 과학적 증거 확보를 위해서 생체인식기술이 적극적으로 활용되고 있다. 생체인식정보를 범죄혐의를 받고 있는 피의자로부터 직접 채취할 때에는 신체에 대한 검증으로 파악되는바, 그 실행을 위해서는 원칙상 영장이 필요하다. 경찰청의 범죄수사규칙상 피의자를 체포하거나 구속할 경우 지문을 채취하고 사진을 촬영하는 등 감식자료를 작성해야 한다는 규정이 마련되어 있으나, 이는 어디까지나 행정규칙에 불과하고 형사소송법상으로는 영장이 필요한 것이다. 다만, 실무상 필요성과 디엔에이 감식시료 채취의 예에 비추어볼 때 채취대상자가 동의하는 경우에는 영장 없이도 생체인식정보가 채취될 수 있도록 그 근거 규정이 형사소송법에 마련되어야 한다. 한편, 생체인식기술을 접목시켜 범죄수사의 효용성을 제고시키기 위해서는 다양한 생체정보식별자를 활용해야 할 것인바, 현재 운영 중인 자동지문검색시스템(AFIS)에 장문이나 3차원 얼굴 정보 등을 추가할 필요가 있고, 범죄수사 과정에서의 효율성 및 편의성 제고라는 측면에서범죄자의 지문이나 얼굴 등을 스캔해서식별할 수 있는 휴대용 장치의 개발 및 보급 방안이 모색되어야 한다.
셋째, 국민 ID 프로젝트는 국민을 식별하고(identify), 국민임을 확인할 수 있는 (verify) 데이터베이스 시스템을 구축하여, 국민에게 공정하고 공평한 행정 서비스 (교육, 건강보험 수급, 고용 서비스, 여권 및 비자 발급, 연금 수급, 선거인 등록등)를 제공하여 국민의 생활수준을 향상시키는 것을 궁극적인 목표로 추진하는 것이다. 또한 신원사기나 테러방지 등과 같은 범죄예방 목적도 동시에 추구한다. 프랑스, 인도네시아, 인도 등 현재 많은 국가들이 국민을 식별하는-정보의 기밀성,보안성, 내구성 등의 장점을 갖는- 국민 생체인식 ID 카드를 도입하여 사용하고 있고, 그 밖에 미국, 영국 등도 도입 시도를 하고 있다. 그러나 국민 생체인식 ID카드를 부분적으로 도입하고 있는 프랑스나 영국에서는 국민의 프라이버시 침해우려가 있는 중앙 데이터베이스로의 개인정보의 집중화에 대한 반발이 있었으며, 또한 이러한 데이터베이스의 목적 외 이용에 대한 우려와 함께 충분한 데이터 보호조치에 대한 요구도 함께 나오고 있다. 우리나라에서도 신분증의 위․변조 방지및 개인정보보호 강화를 위해 전자주민등록증 도입을 시도하고 있는 상황이다. 그러나 국민 생체인식 ID 카드의 도입은 중앙 중심적 데이터베이스화, 정보유출, 목적 외 이용 가능성, 인권침해 등 그 위협요인에 대한 충분한 검토와 국민의 공감대 형성을 기반으로 추진되어야 할 것이다.
넷째, 민원서류에 대한 편의성 향상을 위한 지문 이용 무인민원발급, 인감위조 방지를 위한 전자지문인식 인감증명발급시스템, 대리․허위교육 방지를 위한 지문이용 운전면허시험 관리, 미아방지를 위한 지문 사전등록제, 부정대리입찰 및 담합 방지를 위한 지문인식 전자입찰시스템, 부정투표 방지를 위한 사전투표 지문본인 확인제도 등 다양한 공공분야에서생체인식정보 , 특히 지문정보가 활발하게 활용되고 있다. 그러나- 미아방지를 위한 지문 사전등록제를 제외하고- 위의 모든 경우 명확한 법률적 근거 없이 민감한 생체인식정보가 활용되고 있다. 이 때문에 생체정보의 취득, 관리 및 폐기에 대한 명확한 기준도 설정되어 있지 않다. 따라서 생체정보 활용에 대한 명확한 근거를 법률에 규정할 필요가 있다.
마지막으로 민간부문에서의 생체인식정보의 활용은 제한된 범위 내에서 활용된 다는 특성 때문에 공공부문에서의 활용에 비해 인권침해나 정보유출 우려 등의 문제가 다소 완화된 형태로 나타날 수 있다. 그러나 역으로 이러한 특성 때문에 개인의 생체인식정보의 수집, 관리, 폐기 등에 대한 인식이나 규제로부터 자유로운 영역으로 남아있을 개연성도 크다는 점에 유의할 필요가 있다. 본 연구의 조사결과에서도, ‘민간기관에서 생체정보가 남용되는 것이 염려된다’(3.35점)와 ‘민간기관에서생체정보가 유출되는 것이 염려된다’(3.34점)는 의견이 가장 높은 공감을 얻은 것으로 나타났다. 민간부문에 있어서생체인식정보를 활용하는 경우에는 생체정보는- 사적 영역에서계약 등에 근거하여 이루어지는 경우라 할지라도-개인의 민감정보로서이를 강제적으로 운용하는 것은 자기결정권을 침해하고 과잉금지원칙 등에도 위배될 수 있다는 점에 유의할 필요가 있다.

While biometrics technology based on an individual’s unique features such as fingerprint, iris, face, voice, and gait, etc. has been used to improve convenience and effectiveness and enhance security in a variety of fields, there is also a growing awareness of personal data collection, and misuse and disclosure of collected data. In order to seek a balance between the benefits and drawbacks of biometrics technology, public perceptions on the technology should be examined.
According to the result of our interview (one-on-one based) with 1,200 participants aged over 20 who live in Korea except Jeju-do, conducted between 3rd and 26th September, 2014, while 488 people who have used a system based on biometrics technology reported to have found it convenient, 70% of the respondents were concerned of system malfunction, and disclosure and misuse of biometrics information. Ninety percent of the respondents found the system effective, reporting that fingerprints stored in a database are contributive to crime investigation, and 60% of the respondents agreed that different types of biometrics information including fingerprints should be subject to management of government authorities for solving crime cases. Moreover, a half of the respondents agreed with the idea that the new national identification card which is to contain different types of biometrics information including fingerprints should be implemented. In regard to the use of biometrics information, the largest number of the respondents supported that biometrics information should be used to check foreigners’ identification at an entry of Korea, and they are also supportive of the registration of fingerprints in dealing with missing children cases and criminal justice agencies’ access to suspects’ dental history for crime investigation.
As we seek a way to utilise biometrics technology for criminal justice policy, on the basis of the result of the examination of public perceptions on biometric technology, our suggestions for the public and private sectors in relation to immigration management, crime investigation, and national identification card are as follows:
First, in the field of immigration management, the Immigration Office of Korea has established IBMS (Integrated Border Management System) for secure border management and effective administration. Biometrics information is also used for APRS (Automated Passport Recognition System), SES (Smart Entry Service), and ICRM (Immigration Custom Relation Management), and the Constitutional Court of Korea ruled recently that the collection and retention of fingerprints and DNA samples do not violate the Constitution, weighing the benefits of biometrics information. However, there is, still, an issue of privacy infringement. In order to observe the fundamental rights enshrined in the Constitution and the principle of proportionality while utilising biometrics information at the same time, first, the range of information which is to be contained in an electronic passport should be adjusted. Regarding this, it is reasonable to have excluded fingerprint from the information stored in the passport but it is equally important to delete citizens’ registration number for identification, in consideration of the potential risk of personal information disclosure, especially in abroad. Second, in the light of the provisions under the Digital Signature Act and Electronic Government Act, a new set of provisions about the establishment and management of an electronic authentication system for passport should be spelt in detail in the Passport Act. Third, a new provision that regulates misuse and disclosure of data which are collected under the Immigration Control Law should be spelt in the Immigration Control Law, and falsification of a passport should also be subject to punishment under the same law. In addition, there needs to be an international measure to protect individuals’ personal data regardless of nationality, and the issues of the enhancement of privacy with biometrics technology and the establishment of an inspection body to manage biometrics information should also be addressed in legal and practical terms.
Second, in the field of crime investigation, biometrics technology has been in active use to improve the effectiveness of investigation and ensure the collection of scientific evidence.When a DNA sample is taken from a criminal suspect, a warrant is required in principle. There is a provision under the Enforcement Regulation of Crime Investigation of the Korean National Police Agency. The provision requires the police to establish a set of identification documents including fingerprints and photos of a suspect when they arrest or detain the suspect. However, the provision is merely a part of administration rules and, thus, a warrant should be issued under the Criminal Procedure Law. In case that a person subject to DNA sample collection gives a consent to the police who do not have a warrant, a provision permitting the police to collect a DNA sample from the consenter should be included in the Criminal Procedure Law. Also, a range of biometrics identifiers should be used to improve the efficiency of crime investigation so it is necessary to store additional biometrics information such as palm prints, and three-dimensional facial information, etc. in AFIS (Automated Fingerprint Identification System) which have already been established. It is also suggested that a portable device which scans the fingerprint and face of a criminal be developed to increase the effectiveness and convenience in crime investigation.
Third, the purpose of the National ID Project is to identify individual citizens, establish a database to verify citizens, and provide administration service - education, health insurance, employment, issuance of passport and visa, pension, and registration for electorship, etc. - with fairness and justice for citizens, thereby improving the standard of living of citizens. The project also pursues crime prevention at the same time such as identity theft or terrorism. A number of countries such as France, Indonesia, and India, etc. have introduced the national biometrics ID card to identify their citizens, which has the confidentiality of information, security, and durability, and the U.S. and the U.K. are now taking steps to introduce the ID card. There has been, however, a concern on the centralisation of personal information stored in a database, which might possibly infringe on citizens’ privacy, and a growing voice for an appropriate measure to protect personal data from being mis(ab)used. The Korean government is taking steps to introduce the electronic identification system for the purpose of preventing the falsification of identification and enhancement of personal information protection. Thus, the introduction of the ID card must be based on a national consensus of the public and a deliberative process of examining the risk factors such as the centralised database, personal data disclosure, mis(ab)use of data, and human rights impingement, etc.
Fourth, the use of biometrics information, especially fingerprint, has proliferated in an array of public sectors; automatic issuance of civil documents, issuance system of the certificate of personal seal impression based on fingerprint recognition technology, driver’s licence test with fingerprint recognition - all of which are introduced for preventing the falsification of identification -, and registration system of fingerprint for dealing with missing children cases, electronic bidding system with fingerprint recognition for preventing proxy bidding and price fixing, and identification system based on fingerprint recognition for early voting. However, with the exception of the registration system of fingerprint for dealing with missing children cases, biometrics information is used for all the systems above without clear legal provisions, thereby no clear criteria for the collection, management, and deletion of biometrics information. Thus, a set of specific criteria for the use of biometrics information should be established in law.
Lastly, the issues of human rights infringement and disclosure of personal information in private sectors are, rather, diluted in comparison with those in public sectors, due to the limited use of biometrics information in private sectors. It should be noted that due to the limited use in private sectors, the issues might remain ‘under the radar’ of the regulations on the collection, management, and deletion of biometrics information. According to the survey in this report, it is found that the respondents are most concerned on the abuse and disclosure of biometrics information in private sectors. Thus, we should be aware that the use of biometrics data as sensitive personal information in private sectors - even in the cases based on a contract in private sectors - might encroach on the right to self-determination and the principle of proportionality.
