Ⅰ. 배경 및 목적
□ 중국이 체결한 12개 FTA의 서비스관련 규정들을 살펴보고 여기에서 한ㆍ중 FTA의 체결시에 참고할 만한 시사점을 찾아보고자 함
○ 분석대상 FTA의 서비스 관련 주요 조문들을 비교분석하여 그 특징을 살펴보고 GATS 규칙의 관련 조항들로부터 어느 정도까지 진전된 내용을 담고 있는가를 검토하였음
- 중국의 FTA들에 대해 상대국이 선진국인 경우와 개발도상국인 경우 어떻게 다른가 그리고 그 의미는 무엇인가를 살펴보았음
- 최근 중국의 서비스산업과 무역에 대한 정책변화와 그 내용에 대해서도
Ⅰ. 배경 및 목적
□ 중국이 체결한 12개 FTA의 서비스관련 규정들을 살펴보고 여기에서 한ㆍ중 FTA의 체결시에 참고할 만한 시사점을 찾아보고자 함

* 객관적인 관점에서의 평가를 위하여 중국 논문 외에도 외국의 관련 저서와 논문 그리고 WTO 등에서 공표한 통계자료들에 대해서도 분석의 대상에 포함시켰음
Ⅱ. 주요 내용
□ 중국의 FTA 체결현황과 전략, 서비스무역으로의 확대와 관련된 입장과 조문의 설계에 관한 기본입장을 소개하였음
○ FTA 체결시 경제적 관점의 고려 외에도 자원의 공급, 지정학적인 전략과 더불어 규칙의 재정립이라는 비시장경제국가로서의 지위 탈피를 위한 규칙 재정립에 유의하고 있음
- 서비스자유화에 관한 진행중인 TPP, TTIP 및 TISA 등 다자간 협상과 관련하여서도 타당성 여부를 진단하고 있음
- 국내서비스산업의 육성과 서비스 시장의 개방을 위하여 국내 법령의 개혁을 강화
○ 2007년 《서비스부문 발전 가속화에 관한 국무원의 약간 의견》에서 서비스 부문에 중점을 둘 것이며 서비스의 부가가치가 중국 GDP의 50%를 넘도록 하겠다고 선언
- 2011년 《服务贸易发展"十二五规划纲要》는 2015년까지 지식집약ㆍ기술집약 고부가가치의 서비스무역이 중국 서비스무역 수출총액에서 차지하는 비중이 45%가 넘도록 한다는 발전목표를 제시
□ 중국이 모든 FTA에 서비스무역에 관한 장을 두고 있는 한편, 별도의 서비스무역협정을 체결한 국가도 있는 바, 후자는 중국 측이 전통적인 서비스 부문에서 유리한 경우임
○ 대부분 GATS 조항들을 모델로 삼고 있지만, 중국에 유리하다고 판단되는 경우에는 그보다 훨씬 개방적인 내용을 담고 있음
- 중국의 최근 FTA의 중요한 특징 중의 하나는 ‘자연인의 이동’인 바, 12개의 FTA중에서 6개만이 규정을 두고 있음

○ 중국의 개방약속은 환경서비스, 금융서비스, 항공운송서비스, 물류서비스 외에 기계 설치ㆍ수리 서비스 등 단기적 도급서비스 공급자, 건축기사 및 엔지니어를 위한 추가적 개방부문을 포함
○ 타방 당사국은 민간훈련서비스, 금융서비스 및 계약상 서비스에 관한 고도의 자격을 가진 공급자를 통한 기타 활동과 관련하여 추가적 개방 부문을 포함
- 중국은 FTA 타방당사국에게 외국인 소유권, 법인 유형, 지사 설치 등 상업적 주재에 관한 제한들을 우대적 차원에서 완화
* 중국의 몇몇 FTA들은 서비스도 그 대상에 포함하는 투자보호규범을 포함하고 있으며 중국의 자유화 약속은 주로 상업적 주재(mode 3)에 초점이 맞추어져 있음
□ 서비스자유화에 대한 중국의 태도는 철저하게 자국의 이해관계에 따라 개방 범위와 수준을 정하고 있고 상대방에게 자국보다 더 광범위한 분야를 개방하도록 하고 있음
○ 중국의 FTA가 점차 서비스무역을 확대하여 다루고 있지만, 다른 국가들의 FTA에 비해 상대적으로 서비스시장 개방범위가 협소
- 실체적인 규범과 규칙은 GATS를 벗어나지 못하고 있는 바, 서비스무역 세이프가드 조항, 보조금 규칙, 국내규제(domestic regulations) 등이 특히 그러함
- 음향영상, 통신 및 자연인의 이동 등 민감한 부분에 대해서는 개방약속을 거의 하지 않고 있다는 점도 특징 중의 하나
Ⅲ. 기대효과
□ 중국과의 FTA 협상에서 서비스 무역 분야와 관련, 중국 측이 어떠한 요구를 할 것인가 우리는 어떻게 대비하고 무엇을 요구할 것인가에 관하여 시사점을 얻을 수 있을 것임
○ 중국은 노동집약형 서비스부문에서 한 걸음 더 나아가 기술집약형 서비스 산업을 육성, 서비스무역의 질을 높이고자 함
- 중국은 단기적으로 기술집약형 서비스 부분의 개방에는 동의하지 아니할 것임
- 서비스 부문 개방은 상업적 주재에 관련한 것으로 국한할 것으로 전망됨
- 중국의 인력수출을 위한 자연인의 이동에도 일정한 요구가 있을 것임

○ China has entered into 12 FTAs, all of which contains provisions for he liberalization of trade in services, and also concluded agreements on trade in services with several countries separately from them.
○ Those FTAs and Agreements have different provision concerning the liberalization of trade in services based on economic circumstances involving China and the other party states.
□ Purpose of this study
○ This report is designed to analyze such provisions to find some implications in preparation of Korea-China FTA
○ For this purpose, this report adopts the approach to compare and analyze the major provisions concerning liberalization of trade in services in all the FTA and agreements which China has concluded until now, in oder to find out the their respective characteristics and background. □ This report introduced the current situations of China’s FTAs and China’s strategies for FTAs which differ from the counterpart states
○ China has put emphasis on the reestablishment of new trade rules through its FTAs network, thanks to which it can escape from the status of its non-market economy on the basis of which China obtained the membership of WTO in 2001

○ China has adopted and implemented the policies for further strengthening its traditionally competitive labor-intensive services sectors and promoting the technology-intensive service sectors to enhance the quality of its international service trade structure as well
- China is expected not to agree to open its domestic technology- intensive service markets for a while until it has competitiveness of the relevant services
- China is expected to agree to open the service market of mode 3 (commercial presence) alone
- China is expected to demand, to some extent, work permits and residence permits to facilitate the chinese peoples’ movement into Korea.
