6. 결론적 고찰
형식적으로 독일통일과정에서 형법의 통합은 1990년 10월 3일 독일통일과 함께

6. 결론적 고찰
형식적으로 독일통일과정에서 형법의 통합은 1990년 10월 3일 독일통일과 함께
- 통일조약에 의해 시간적으로 제한된 효력이 부여된 몇몇 구성요건들을 제외하고
- 그 때까지 독일연방공화국, 즉 서독에서만 효력이 있던 형법이 구동독에까지 시행됨으로써 끝난 것으로 보였고, 구동독 형법은 더 이상 존재하지 않게 되었다. 하지만 이에 대해서는 독일통일이 가져온 독일전체를 포섭하는 새 형법을 만들 수 있는 절호의 “역사적 기회”를 놓쳐버렸다는 비판이 제기되기도 하고, 통일의 열기에 휩쓸려 협소한 관점에 갇혀서 구서독의 법질서가 구동독을 “덮쳐” 버리면서 구동독 형법의“창의적 요소”는 대부분 무시되었고 통일 이후에도 여전히 “보존할만한 것들”이 일방적 흡수통일 과정에서 사라져 버렸다는 지적도 제기되었다.
이런 문제제기에 대하여 구동독에서는 독재가 문제되었고, 의견의 자유, 집회의 자유 그리고 여행의 자유와 같은 시민의 기본권이 특히 형법과 형사 사법기관을 통해 체계적으로 침해되었던 것이라는 반론을 제기하며, 구동독에서 형법은 공산당의 억압수단 가운데 하나의 무기일 뿐이었고, 따라서 “창의적 요소”를 찾아보는 것은 원칙적으로 부정할 수도 있을 것이다. 독일사회주의통일당(SED) 독재가 인간의 존엄을 침해하였다는 점과 형법이 그 독재적 억압의 핵심 도구로 사용되었다는 점에는 의문의 여지가 없다.
그러나 그렇다고 해서 구동독 형법이 구성요건 형태를 중심으로 볼 때 원칙적으로 법치국가적 요구를 충족시키고 법치국가적 맥락에서도 수용될 수 있었다는 점까지 배제되는 것은 아니다. 구동독의 1968년 형법을 통한 형법전면개정은 서독에서도 동독이 몇몇 영역에서는 “오래 된 묶은 머리를 잘라버리고 현대적이고 진보적 법개혁”을 이루었다고 평가하기도 하였으며, 당시 연방법무장관이었던 하이네만조차도 구동독의 형법전과 독일연방공화국의 형법개혁안은 많은 차이점이 있지만 유사한 점들도있다는 견해를 피력한 바 있었다.
다른 한편 형법 영역에서는 두 독일 국가가 1968년까지 형식적으로 동일한 법적기초, 즉 제국형법전을 유지하고 있었다는 점에서 동서독 두 독일 법질서라는 “재료”를 독일 전체 법질서라는 한 단지에 종합하는 방안도 선택하지 못할 바가 아니었다는 견해도 개진된다.
통일독일에서의 형법통합의 실현의 기초가 된 통일조약은 본질적으로 독일연방공화국 형법을 구동독의 영토로 확장하는 데에 국한되었다. 법적 통합을 이루기 위한 다른 선택가능성들은 단지 예외적 경우에만 사용되었다. 여기서 구동독 형법에 독일연방공화국 형법으로 수용되거나 최소한 “법정책적 자극”을 줄 수 있었을만한 구성요건들이 존재하였는지 하는 물음에 대해서는 대부분 대답되지 않았다. 이 연구는 구동독형법전의 핵심요소를 독일연방공화국 형법의 핵심과 대조해 보며, 어떤 한도 내에서 구동독 형법이 수용될 가능성을 가지고 있었는지 또는 최소한 개혁을 위한 어떤 모범으로 기능할 여지를 지니고 있었는지에 대해 분석하였다.
독일통일이라는 “프로젝트”는 매우 짧은 순간에 이루어졌다. 베를린장벽이 무너지고 통일이 될 때까지 불과 일 년이 채 되지 않는다. 여기서 구동독의 시민 다수의 의지가 결정적 역할을 하였다. 그 의지는 분명히 신속한 통일을 원하는 것이었다.이점에서 기본법 제23조 제2문을 통한 편입이라는 헌법적 방식을 결정한 것은 정치적으로 일관된 것이었고, 이런 방식은 통일을 이루기 위해 가장 간단할 뿐만 아니라 가장 빠른 선택가능성이기도 하였다. 이와 달리 다른 가능성, 특히 새로운 헌법의 제정은 처음부터 거의 실현가능성이 없는 것이었다. 1990년 처음이자 마지막으로 자유로운 선거를 통해 수상으로 선출되어 구동독의 역사를 이끌었던 로타 드 메지어는 2015년 6월 25일 “쥐드도이체차이퉁”과의 인터뷰에서 다음과 같이 말한 바 있다:
“파산한 상태에서 통일을 이루도록 압박받았던 1600만 독일민주공화국(구동독)인들이 6200만 독일연방공화국인들로 하여금 새로운 헌법을 제정하도록 할 가능성을 갖고 있지못했다.”
하지만 헌법에 따른 편입절차를 선택했다고 해서 이것이 필연적으로 독일연방공화국 전체의 법질서가 구동독 법질서를 완전히 대체해야만 했던 것을 의미하지는 않았다. 여기서 구동독의 법을 상당 부분 수용하는 것을 생각해 볼 수 있었을 것이고,경우에 따라서는 더 나아가 바람직한 것이었을 것이다. 드 메지어도 위에서 언급한 인터뷰에서 “독일민주공화국(구동독)의 많은 것들이 독일연방공화국보다 더 진전된것이 있었다.”고 고백하면서, 그 예로 무엇보다 상속법을 언급한다. 이런 점에서 법질서의 단일화를 위해 대안적 방법들(상호적인 효력의 확장, 일시적으로 나눠진 효력 또는 종합적 방법)을 더 포괄적으로 고려했어야 했다.
구동독의 긍정적 착상에 관한 지금까지의 연구를 통해 통일조약이 예외적으로 수용하기로 했던 구성요건들(임신중절, 토양오염의 형법적 보호, 국제법 범죄에서 공소시효 배제)은 결국 새로운 조문에서 구동독 형법의 요소로서 다시 찾아볼 수 있다. 더 광범위한 수용이 몇몇의 경우에는 생각해 볼 수 있는 것이었다. 그 예로는 베를린 장벽이 무너진 시점에 독일연방공화국이 뒤떨어져 있던 국제형법의 영역을 언급할수 있다. 그밖에 몇몇 구성요건들(예를 들어 사기 또는 살인죄)은 구동독에서 더 분명하고, 시대에 맞는 구성요건적 표현을 담고 있었다. 또한 나치의 법적 사고에 뿌리를 두고 있는 조항들을 삭제하였던 것도 긍정적 측면으로 강조해야만 한다.
전체적으로 보면 구동독 형법전은 독일연방공화국의 형법전보다 명백성과 일관된 체계를 확보하기 위해 더 많이 노력했다는 점이 눈에 띈다. 이것의 배후에는 정치지도부가 이해가능하고 시민에 친화적인 형법을 원했던 것이 자리 잡고 있다. 이런 형사정책적 목표를 가장 잘 보여주는 것은 예를 들어 총칙과 각칙에서 법적 정의 조항을 사용했던 것과 구성요건들을 일목요연하고 일관된 체계로 배열했던 것을 들 수 있다.하지만 이런 긍정적 착상을 강조하더라도 형법이 구동독에서 종합적으로 평가할때 이데올로기적 교육수단으로 여겨졌다는 점을 잊어서는 안 된다. 즉 이데올로기로부터 자유로운 영역은 구동독 형법에서 존재하지 않았다. 이런 점에서 긍정적 착상들이 언제나 정치적・이데올로기적 목표지향을 갖고 있었다는 점이다.
남북한 통일시 형법통합의 기본원칙으로서 민주주의원리와 법치국가원리를 기본원리로 하는 대한민국의 헌법질서에 부합하는 통합이 되어야 한다는 점에서 우리나라 형법의 원칙적 적용을 전제로 할 필요가 있다. 이것이 의미하는 것은 북한 지역에 대하여 우리나라 형법전이 일관적으로 관철되어야 한다는 것뿐만 아니라 더 나아가 우리나라 헌법과 형법에 각인된 형사법의 기본이념까지도 그대로 관철되어야 한다는것이다. 이것은 겉보기에는 너무나 당연한 것처럼 보이지만 그 필연적인 귀결로서 북한 지역에서 통일 후에 발생한 범죄뿐만 아니라 ‘통일 전에 발생한 범죄’까지도 우리나라 형사법의 기본이념에 따라 처리하여야 함을 의미한다.
이와 관련하여 관건이 되는 기본이념으로는 바로 법치국가와 자유주의 이념에 의하여 각인된 형사법의 책임원칙(Schuldprinzip)이다. 형벌이란 개인의 자유에 대한 중대한 침해를 나타내는 것인 만큼 형벌부과 여부의 판단은 특히 국가집행권력과는 독립되고 중립적인 법원에 의하여야 하고 자의적인 재판이 되지 않도록 하여야 한다. 이를 위하여 ⑴법률에 의하여 정해진 법관에 의한 재판을 받을 권리, 법관의 독립 그리고 법관의 법률에의 구속의 원칙(헌법 제27조 제1항 및 제3항), ⑵평등한 재판을 받을 권리를 저해하는 특정인의 특정 사안을 처리하기 위한 개별사건법률 또는 개별사건법원 설립의 원칙적 금지(헌법 제11조 제1항), ⑶무죄추정의 원칙(헌법 제27조 제4항), ⑷일사부재리의 원칙(헌법 제13조 제1항) 등이 있다. 그리고 재판의 공개주의와 구두변론주의를 통하여 국민에 의하여 재판의 감시와 통제가 이루어짐으로써 재판의 민주적 정당성이 보장된다.
자유주의적 책임원칙은 특히 법치국가원리의 형법적 표현이라고 말할 수 있는 죄형법정주의에 의하여 보장된다. 즉 우리나라 헌법 제13조 제1항은 “모든 국민은 행위시의 법률에 의하여 범죄를 구성하지 아니하는 행위로 소추되지 아니하며, 동일한 범죄에 대하여 거듭 처벌받지 아니한다.”고 규정하여 죄형법정주의, 특히 법률주의와 소급효금지의 원칙, 그리고 일사부재리의 원칙을 명시적으로 선언하고 있을 뿐만 아니라 형법 제1조(범죄의 형립과 처벌) 제1항은 헌법이념을 그대로 이어받아 “범죄의 성립과 처벌은 행위 시의 법률에 의한다”고 규정하여 죄형법정주의(그리고 해석상 그 파생원칙인 법률주의, 소급효금지의 원칙, 명확성의 원칙, 유추금지의 원칙)를 선언하고 있다.또한 소급효금지의 원칙과 관련하여 당사자에게 불리한 소급효는 원칙적으로 금지하면서도 당사자에게 유리한 법률의 제정・개정 및 폐기의 효력은 당사자의 이익을 위하여 예외적으로 소급효를 허용하는 것이 우리나라 형법의 기본입장이다(형법 제1조 제2항 및 제3항). 그리고 우리나라 형법 제7조(외국에서 받은 형의 집행)는 “범죄에 의하여 외국에서 형의 전부 또는 일부의 집행을 받은 자에 대하여는 형을 감경 또는 면제할 수 있다”고 규정하여 동일 범죄로 인한 이중처벌의 위험을 회피하려고 한다. 즉 우리나라 형법 제1조는 현행 형법규정이 적용되기 이전에 발생한 범죄를 어떻게 처우하여야 하는지에 대하여 그리고 형법 제7조는 이미 형의 전부 또는 일부의 집행을 받은자를 어떻게 처우하여야 하는지를 명확하게 규정하고 있으며, 따라서 통일 전 북한지역에서 발생한 범죄도 형법 제1조와 제7조에 따라 처리하면 될 것이다. 즉 원칙적으로 행위시법을 원칙으로 하고 경한 재판시법 우선의 원칙을 적용하면 될 것이다.형법각칙의 통합과 관련해서도 이러한 원칙들은 그대로 적용되어야 할 것으로 생각한다. 그러나 전쟁범죄나 반인권범죄에 대해서까지 소급적 청산을 금지하는 것은 아니며 이것이 법치주의의 예외를 의미하는 것도 아니다. 왜냐하면 법치주의가 전제로 하는 것은 국민의 존립근거가 되는 근본적인 기본권을 보장하는 자유민주적 체제를 전제로 하고 있기 때문이다. 이것은 형법각칙의 통합에서도 그대로 적용된다.
북한형법의 전반적인 불명확성 문제는 법치국가형법의 관점에서 큰 문제로 지적된다. 많은 규정들에서 ‘대량’, ‘엄중한 결과를 일으킨 경우’, ‘정상이 무거운 경우’, ‘절반정도’ 등과 같은 불명확한 용어들을 사용하고 있는데, 이러한 불명확성은 죄형법정주의에 반하는 것으로서 수범자인 국민으로 하여금 자신의 행위가 처벌대상이 되는지,어느 정도 처벌을 받게 되는지 등에 대한 예측을 할 수 없도록 만든다. 반대로 법집행기관으로 하여금 자의적인 기준으로 법을 적용하거나 권한을 남용할 여지를 주어 인권보장에 역행하는 결과를 낳게 된다.
북한의 형사제재(형벌 및 행정벌)는 제도 자체에 존재하는 일부 창의적인 요소에도 불구하고 북한형법의 사회주의적 계급주의에 편향된 예방형법 일변도의 법적용지침으로 인하여 실무상 법치국가원리에 반하여 집행이 이루어지는 경우가 허다한 것으로 판단된다. 죄형법정주의원칙, 책임주의원칙, 적정절차의 원칙 등이 무시되고 있기 때문이다. 그 결과 형사제재의 상당부분은 조선로동당의 정치적 목적에 따라 자의적으로 이루어졌을 가능성이 높고 책임이 원용되기는 하지만 사실상 기능하지 못하는 관계로 책임의 범위를 넘어 이데올로기적 예방목적의 이름으로 과도한 형사제재가 가해지는 경우도 많은 것으로 판단된다. 형법과 형사제재 분야의 통합에 있어서 공통적인 과제는 어떻게 북한형법에서 이데올로기적 요소를 걷어내는가 라고 하여도 과언이 아닐것이다.
동서독 형사법통합은 서독의 제도를 중심으로 이루어진 결과 동독 지역의 실정을 충분히 고려하지 않았고, 이로 인해 규범과 현실의 괴리가 발생하였다. 이 같은 문제는 남북한 형사사법제도통합의 경우에도 얼마든지 발생할 수 있다. 따라서 남한 형사법제를 북한 지역에 확장 적용하여 형사사법제도를 통합할 경우 이로 인해 발생할 수 있는 여러 가지 문제에 주의를 기울일 필요가 있다.
동서독의 형사사법제도 통합은 서독의 형사사법제도를 중심으로 통합이 이루어지기는 하였지만 동서독의 합의에 따라 일정한 절차를 거쳤다. 이는 남북한 형사사법제도 통합의 경우에도 남북한의 합의에 따라 일정한 절차를 거쳐 통합이 이루어져야 함을 시사한다. 남북한의 통일은 북한 붕괴 또는 급변사태 등으로 인한 급속통일이 될 수도 있고 이와는 달리 교류협력을 통한 점진적・단계적 형태의 통일이 될 수도 있다. 어떤 형태의 통일이 되든 독일통일처럼 합의과정을 거치는 평화적 통일이 되어야 하며, 남북한의 평화적 통일을 위해서는 남북통일합의서의 체결 및 이행이 필요하다. 남북한의 형사사법제도 통합은 이 합의서의 틀 내에서 추진되어야 한다.
독일통일 사례는 급속하게 이루어질 수도 있는 남북통일을 사전에 준비해야 함을 시사한다. 통일 이후 남북한 간의 형사사법제도 통합을 위해서는 통일 이전에 북한의 사법제도가 민주적이고 인권 친화적인 사법제도로 발전하여 남북한의 형사사법제도가 수렴해갈 수 있도록 북한의 사법제도 정비를 지원하는 방안이 모색되어야 한다.차선책으로는 형사사법제도의 한시적 분리 운영을 고려할 필요가 있으나, 이를 위해서는 법적 근거를 마련해야 한다. 그러나 북한 사법제도의 활용 가능성 여부, 북한법률의 적용 여부, 북한 사법조직이 실시한 사법작용의 효력 인정 여부 등 복잡한 법적 문제들이 대두된다는 점에서 통일 이후 한시적인 기간 동안 북한 지역을 하나의 특별행정구역으로 지정하여 분리 운영하는 체제를 택하더라도 형사사법제도는 여기에 포함시키지 않고 즉각적인 통합을 기본 방향으로 삼는 게 규범적・현실적인 측면에서 타당하다.
형사사법제도 및 형사사법기관 통합과 관련하여 최근 국제사회에서 많이 논의되고 있는 전환기 정의(transitional justice)가 중요한 문제로 제기될 것으로 전망된다. 첫째,독일 통일 이후 국제형사법적인 환경이 크게 변화하여 통일 이후 전환기 정의를 실행할 경우 변화된 국제형사법이 국내형사법과 조화를 이루는 방향에서 적절하게 반영되어야 한다. 둘째, 집결소, 구류장, 노동교화소 등 북한의 구금 및 교정시설은 모두 이에 상응하는 우리의 구금제도 내지 교정제도에 통합되어야 한다. 노동단련대는 이에 상응하는 제도 및 시설이 우리나라에 없고, 통일 이후 존치할 이유가 없다는 점에서 폐지되어야 한다. 정치범수용소는 법적인 근거를 발견하기 어렵고, 국제사회에서 대표적인 북한인권 침해 사안으로 지적받고 있는 바 통일 즉시 폐지되어야 한다. 셋째,가해자에 대한 처벌, 피해자에 대한 보상 및 복권, 진실규명과 화해 등의 전환기 정의를 위해서는 기록 보존이 중요하다. 우리의 경우에도 북한인권법이 제정될 경우 북한인권 기록을 담당하는 기관을 구성되어 전환기 정의를 준비 기구될 것으로 사료된다.통일독일은 구동독의 사법절차 가운데 경미범죄 관련 규정을 수용하였다. 경미사건의 신속하고 간편한 처리는 체제를 초월한 형사사법 과제라는 점에 있어서는 구동독과 서독의 경우에도 마찬가지였다. 경미범죄는 개별사건으로는 범죄피해가 경미하지만 발생건수는 많기 때문에 전체적인 범죄피해는 무시할 수 없다. 구동독에서는 이러한 문제를 해결하기 위해서 사회적 법원을 설치하여 해결하였다. 통일 후 독일에서도이 제도의 도입을 검토하고 도입하자는 주장도 제기되었다. 그리고 제재수단도 전통적인 형벌 이외에 경고나 원상회복의무 등을 부과하도록 하는 주장이나 경미한 재산범죄를 질서범죄로 취급하자는 주장도 있다.
사회적 법원은 특히 기존의 사법체계 밖에 존재하는 법원이기 때문에 도입에 상당한 반대가 있을 수 있다. 또한 구동독의 체제에서 명목상으로는 경미범죄를 간단하게 처리하기 위한 제도라고 하지만 이면에는 인민들의 결속을 통해 사회주의 체제를 강화하는 효과적인 수단으로 악용된 측면도 있었음을 부인할 수 없다. 그러나 통일후 독일사회에서는 이러한 체제 연계적 평가보다는 제도 본래의 기능적 측면을 포착하여 제도 도입의 실익을 주장하고 있다는 점을 주목할 필요가 있다.
이러한 통일독일의 형사사법 통합의 관점은 청소년형사사법의 경우에도 마찬가지였다. 통일 후 청소년법원법의 영역에서 동독과 서독은 체제비교를 통한 제도정비보다는 청소년의 재범방지와 사회복귀를 촉진하기 위한 차원에서 소년법을 정비하였다.즉 구동독의 제도라고 해서 폐기하기 보다는 제도적 장・단점을 평가하여 새로운 통일독일의 소년법원법을 개정한 것이다.
실질적 절차에 있어서는 사회통제에 악용된 측면이 있는 동독의 청소년 관련 절차에 대해서도 검토의 필요성은 존재한다. 그럼에도 불구하고 사회주의 이념이 표방하고 있는 소년에 대한 이상상(理想像)이 청소년 문제의 해결에 있어서는 의미있는 내용으로 활용 가능한 부분이 존재하기 때문이다. 또한 통일독일의 법률도 이에 관하여 공통분모를 가진 조문들을 상당 부분 지니고 있다는 점도 그 이유의 하나가 된다.통일 후 북한지역에서 적용되던 사법제도를 통일한국에서도 적용할 부분이 있는지에 대해서 고려해야 할 사항은 제도에 대한 북한주민들의 인식태도가 중요하다고 할 수 있다. 제도에 대한 부정적 인식을 기반으로 한 제도는 그 장점이 있다고 할지라도 효과적인 적용이 어렵다고 보아야 하기 때문이다.
앞서 기술한 바와 같이 북한의 법제도는 사회주의 법 체제라고 하기 보다는 권력세습을 기반으로 하는 독재체제라고 보아야 한다. 이러한 국가시스템에서 제정된 법제도가 민주주의 정치체제에서 순기능을 하기는 어렵다. 물론 구동독의 경우에도 독재체체로서 법 제도가 국가권력을 유지하고 사회적 저항을 억압하기 위한 것이 중요한 목적이었다고 평가되고 있다. 그러나 구동독의 경우는 우선 권력세습이 없었고 나름대로 경제적 발전을 통해 주민들의 생활을 향상시키는 것이 사회주의 체제를 유지하기 위하여 필요하다는 인식이 존재하였다.
통일한국에서 참고할 만한 북한의 제도를 형사법 분야에서 찾는다면 북한주민이 수용할 수 있으며 독재체제와 무관하게 적용가능한 제도가 그 대상이 될 수 있을것이다. 그 예로는 정식의 형사절차를 거치지 않더라도 신속하게 처리할 수 있는 경미한 사건이나 소년사건이 될 수 있다고 본다. 이러한 제도가 북한에서 독재체제와 무관하게 적용된 것은 아니지만 제도의 본래적 취지나 목표가 정치체제와 무관하게 적용 가능한 분야에 해당하기 때문이다.
구동독도 북한과 마찬가지로 사회주의 체제유지와 권력유지를 위한 법 제도의 창안과 유지에 몰두하였다. 사회주의형법체제에서 나타나는 전형적인 법현상은 법제도가 외견상 표방하는 목표와 실질적으로 추구하는 목표가 다른 경우가 많았고, 많다는 점이다. 법문언으로 외견상 표방하는 목표에는 제도적 창의성이 담겨 있는 경우가 많으나 운용의 실제는 정치적・이데올로기적으로 변질된 경우가 허다하다. 이로부터 자유로운 사회주의법제도는 존재하지 않는다고 하여도 과언이 아니다. 공공연히 사회주의혁명과 계급주의를 천명하고 지향하며 이를 모든 제도의 정신으로 삼기 때문이다.이 정치적・이데올로기의 장막을 한꺼풀 벗기고 제도들을 들여다보지 않는 이상구동독이든 북한이든 그 형법과 형사사법제도로부터 취할 수 있는 것은 거의 제로라고 할 것이다. 그러나 남북통일도 형사사법통합도 체제가 아닌 사람의 문제라는 점에서 그 체제 속에서 수십년, 반세기 넘게 살아온 사람들에게는 원불원 간에 “어떤”의미가 있는 제도라는 점을 감안하여 그 최소한의 의미를 찾을 수 있는 제도를 중심으로 창의적이며 인간적인 통일・통합의 법제도를 디자인하여 나가야 할 것으로 생각된다. 이런 점에서 이 연구에서 시도된 동서독 형법비교와 남북한 형법비교 및 제도비교는 그러한 접근의 하나의 시도이며 시작이라 할 것이다.

The integration of criminal laws during the German re-unification seemed to be completed on 3 March 1990 with the extension of the criminal law which was, at that time, only effective in the Federal Republic of Germany (FRG, West Germany) to the German Democratic Republic (GDR, East Germany), except for some provisions that were effective only for a limited period of time in accordance with the Unification Treaty.The criminal law of the GDR, therefore, ceased to exist. However, this approach faced criticism that a “historic chance” brought by the German re-unification to create a new criminal law that governs the entire Germany was missed. Some further pointed out that, due to the excitement for the re-unification and narrow perspectives that only focus on Germany, the West German legal system “swept” the East Germany. Consequently,“creative elements” of the criminal law of the GDR were mostly not taken into account and “those worth preservation even after the re-unification” were ignored in the process of such a unilateral re-unification.
Regarding this, a possible objection is that the political system of the GDR was dictatorship and people’s fundamental rights, e.g. freedom of expression and freedom of assembly, were systematically infringed upon by the criminal law and criminal justice institutions. It could therefore be argued that the criminal law was no more than just a tool for the communist leadership to suppress people and it was in principle impossible to find “creative elements.” There is no doubt that the dictatorship of the Socialist Unity Party of Germany (SED) violated human dignity and that the criminal law was used as a main tool for the dictatorship.
Nevertheless, this does not exclude the fact that criminal law of the GDR, in particular its elements, met the requirements of the rule of law and therefore were acceptable to a law-governed country. The revision of East German criminal law pursuant to the criminal code in 1968 was regarded in West Germany as “a modern and progressive legal reform that cut off the old and tied hair.” The then Justice Mister, Gustav Heinemann, also expressed his opinion that the criminal code of East Germany had many differences from the reform bill of criminal code of the FRD, but still the two shared similarities at the same time.
On the other hand, given that criminal laws of the two Germanys were based on the same criminal code until 1968, there is also a view that it could have been an option to put the legal systems of the two Germanys, i.e. “materials”, into the same pot of the legal system of the unified Germany.
Against this backdrop, this study, commemorating the 25th anniversary of the German re-unification, analyses the integration of criminal law and criminal justice during and after the re-unification in an attempt to widen the perspectives for integration of criminal laws of North and South Korea.
First, Part Two analyses the integration of criminal laws for the unified Germany by conducting research on the substantive criminal law of East Germany. It also discusses what constitutional options were available for the German re-unification and possible ways to integrate criminal laws. By comparing general provisions and particulars of the criminal code of East Germany with those of West Germany, it is reviewed what elements of the criminal law of East Germany could have been positively considered for the integration of criminal laws. This comparison mainly focuses on the general provisions of criminal law and takes into account only some of the particulars that are deemed to be worth such comparison. Based on this, Part Three analyses issues on the integration of criminal laws of the two Koreas taking into account the suggestions from the German case.
Regarding criminal procedures, Part Four discusses the integration of criminal justice systems, and Part Five, criminal justice procedures. As done above for the integration of substantive criminal laws, the process of integrating procedural laws during the German re-unification is analysed and it is also reviewed what lessons can be learned for the Korean re-unification. In particular, regarding criminal justice procedures, an analysis is done mainly on special procedures to deal with minor crimes and juvenile cases through the “Social Court” system of the East Germany, which has been an issue of interest in the East German academia before the German re-unification. This consequently leads to identifying the significance of the integration of criminal justice.
The Unification Treaty, which served as a basis for the integration of criminal laws for the unified Germany, was no more than an extension of the criminal law of the FRD to the territory of the GDR. Other options for legal integration were used only in exceptional cases. Questions regarding whether there existed elements that could be accepted, or provide “legal-political stimulation at least, to the criminal law of the FRD were mostly not answered. This study compares key parts of the criminal code of East Germany with those of West Germany to find out to what extend the East German criminal law could have been accepted or whether it had a potential to serve as a model for reform.
In compliance with such analysis, positively evaluated ideas of East Germany were examined and elements that were exceptionally incorporated into the Unification Treaty, e.g. those regarding artificial abortion, criminal law protection against soil pollution, and exclusion of the period of prescription for the prosecution regarding crimes under the international law, are envisaged in new provisions.
In some cases, a more comprehensive acceptance could have been made in, among others, the area of international criminal law where the FRD was lagging behind at the time of the fall of the Berlin Wall. Other elements (for example, fraud or murder) were expressed in a clearer and up-to-date manner in the criminal code of the GDR. In addition, the deletion of provisions that are rooted in Nazi legal concepts should also be emphasized as a positive aspect.
The criminal code of the GDR, as a whole, stands out in that more efforts were made to make a clear and consistent system compared to that of the FRD. This was possible because the political leadership wanted a criminal law which was understandable and people-friendly. This intention is best illustrated in the fact that provisions on legal definitions were set forth in both general provisions and particulars of the criminal code and elements were arranged in an organized and consistent way.
Notwithstanding this, however, it should not be ignored that criminal law of the GDR was used as a tool for ideological education. Any part of the East German criminal law was not free from ideology. The aforementioned positively evaluated ideas were, in fact, always policy- and ideology-oriented. This means that criminal law of South Korea should be extended to North Korea, and that fundamental concepts of the constitution and criminal law of South Korea should also be maintained.
One basic concept at issue is the principle of quilt (Schuldprinzip) of criminal law, which is held up by the rule of law and liberalism. The principle is complied with through nulla poena sine lege, a representation of the rule of law in criminal law. These principles should also apply to the integration of particulars of criminal law. This is because the rule of law is based on the system of liberal democracy which guarantees people’s fundamental rights.
Despite some creative parts of North Korea’s criminal sanctions (criminal and administrative punishment), they are in many cases executed in violation of the rule of law due to the application of preventive criminal law focused on the socialist hierarchy of the North Korea’s criminal law. The nulla poena sine lege, principle of guilt, and due process are all ignored. Consequently, it is likely that many of criminal sanctions were carried out in an arbitrary way for political purposes of the Workers’ Party of Korea.Responsibilities are invoked, but they are not properly taken into consideration. Thus, excessive criminal sanctions are frequently imposed for ideological purposes. It is not too much to say that the common issue for the integration of criminal laws and that of criminal sanctions is to remove ideological elements from criminal law of the North.
The integration of German criminal laws was focused on the system of West Germany, without adequately considering situations in East Germany. Hence, a gap exists between the law and reality. When criminal laws of the two Koreas are integrated by extending the criminal law system of the South to the North, attention must be paid to problems that may arise.
Although the integration of criminal justice systems of the two Germanys was carried out focusing on the system of West Germany, it went through certain procedures in accordance with mutual agreement between East and West Germany. This suggests that the integration of Korean criminal justice systems should also follow suit. Re-unification, in whatever form, should be accomplished in a peaceful manner through agreement as shown in the German case. This requires that a Reunification Agreement between the South and North be concluded and implemented. The integration of criminal justice systems of the two Koreas should be made within the framework of such Agreement.
The German case shows that the re-unification of the two Koreas, which may be done quickly, should be prepared for in advance. For the integration of criminal justice systems of the North and South after the re-unification, it is first necessary to find ways to help North Korea’s criminal justice system develop into a democratic one that respects human rights so that it can be incorporated into the integrated system of the two Koreas. Secondly, it is needed to consider implementing the two systems separately on a temporary basis, which however requires legal grounds. Given some complicated issues including the possibility of utilising North Korea’s legal system, application of North Korea’s law, and recognition of effects of legal actions taken by North Korea’s legal authorities, North Korea may be designated as a special administrative zone and governed separately on a temporary basis. Nevertheless, it is appropriate that criminal justice systems of the two Koreas be integrated without being included in such a temporary approach considering the norms and realities.
In relation to the integration of criminal justice systems and institutions, it is expected that transitional justice, a much-discussed issue in international fora, will become an important subject. Re-unification and integration should be carried out gradually in a way that allows the transitional justice to be applied.
The Unified Germany accepted provisions of the criminal law of the GDR concerning minor crimes. Prompt and simplified procedures to handle minor crimes were an issue to be sorted out to both East and West Germany. Even though such a crime may be considered minor in nature, entire damage it creates cannot be ignored given the frequency of its occurrence. East Germany established Social Courts to deal with these cases. Some argued that the social court system should be considered and introduced to the unified Germany as well. Social Courts, which lie outside the existing legal system, may face many objections. However, it is worth noting that the German society after the re-unification focuses on the system’s functions and supports the actual benefits of introducing it.
The same applies to the case of juvenile criminal justice. The two Germanys compared their juvenile court law systems and made a revised law of the unified Germany not by just discarding the system of East Germany but by analysing good and bad aspects of both systems. This is because the socialist system to realize an ideal model for juveniles could be used as a meaningful tool to deal with juvenile cases even though it used to be abused for social control. Furthermore, the law of the unified Germany also contained many provisions based on the same reasoning.
As discussed above, the legal system of North Korea is not a socialist legal system but a dictatorship based on the succession of powers. Such a legal system cannot perform a proper function in a democratic political system. Of course, an important purpose of the legal system of the GDR, as a dictatorship, was to maintain the state power and suppress any social resistance. Nevertheless, there was no power succession in the GDR and there existed perception that it is necessary to improve people’s lives through economic development.
A unified Korea may take into consideration some of the North’s criminal justice systems which may be accepted to North Korean people and applied independently of the dictatorship. A case in point can be those for minor crimes or juvenile cases, which can be handled promptly without going through formal criminal procedures. This is because, although those systems were influenced by the dictatorship of the North, the original intentions and purposes of the systems can be applied without being influenced by the political system.
The GDR also focused on the establishment and maintenance of a legal system to maintain its socialist system and power as North Korea did. In many cases, purposes that are advocated on the surface by the criminal law of a socialist regime are different from those that are actually pursued. The former usually contains creativeness of the system, but they are often transformed into political or ideological ones while being implemented. It can be said that no socialist legal system is free from this, because socialist revolutions and classism are openly advocated and considered as the spirit of every system.
Unless we unveil the political and ideological curtain and look into the systems, we can take nothing from the criminal laws or criminal justice systems of East Germany and North Korea. However, it should be at the same time considered that re-unification of the two Koreas and integration of criminal justice systems are both all about the people, and that every system could have some degree of significance for the people who have lived for tens of years, or for more than half a century, under the system.This makes it necessary to devise a legal system for re-unification and integration which is creative and respects people with the emphasis on those systems that we find meaningful. In this regard, this study which compares criminal laws of East and West Germany and those of North and South Korea will serve as a meaningful attempt and first step towards such an approach.
