I. 연구의 목적 및 방법
▶ 연구의 목적
○ 인공지능 기술의 발전은 생활의 편리와 삶의 질을 제고해주는 측면이 있는 반면에, 인간과 유사한 지능을 가지고 있기 때문에 머지않은 장래에 인간의 일자리를 대체하고 사생활을 침해하고 데이터를 오남용 할 수 있으며 인공지능 기술 향유에 있어서 격차 발생, 킬러 로봇의 등장 등 두려움도 야기하고 있음
○ 제4차 산업혁명도 인공지능을 핵심 성장 동력으로 보고 있으며 이를 통해 산업구조의 패러다임이 변화될 것이란 기대 하에 세계 각국은 기술경쟁력을 확보하고 시장 선점을 위해 불필
I. 연구의 목적 및 방법
▶ 연구의 목적
○ 인공지능 기술의 발전은 생활의 편리와 삶의 질을 제고해주는 측면이 있는 반면에, 인간과 유사한 지능을 가지고 있기 때문에 머지않은 장래에 인간의 일자리를 대체하고 사생활을 침해하고 데이터를 오남용 할 수 있으며 인공지능 기술 향유에 있어서 격차 발생, 킬러 로봇의 등장 등 두려움도 야기하고 있음
○ 제4차 산업혁명도 인공지능을 핵심 성장 동력으로 보고 있으며 이를 통해 산업구조의 패러다임이 변화될 것이란 기대 하에 세계 각국은 기술경쟁력을 확보하고 시장 선점을 위해 불필요한 규제를 완화함으로써 신 성장 산업을 발굴, 육성하고 있는데 반해, 우리나라는 그러한 변화에 적절히 대응하지 못하고 있음
○ 인공지능 시대를 맞이하여 우리의 법제는 관련 기술의 발전 및 보급에 치중해 있고, 지능정보기술 활용의 보편화로 인한 사회경제적 영향에 대한 본격적인 논의를 시작하지 않았음
○ 따라서, 본 연구는 인공지능 기술의 발전에 부합하는 법적 규제를 마련하는 동시에 인공지능의 확산이 가져올 수 있는 기본권 침해, 법적 책임 귀속, 알고리즘 규제 필요성 등 다양한 쟁점에 관해 국내외의 논의를 심층 검토함으로써 구체적이고 실효성 있는 법적 대응방안을 모색하는 것을 목적으로 함
▶ 연구의 방법
○ 문헌 연구를 주된 연구방법으로 하며, 이 분야의 선행연구자를 중심으로 워크숍 및 전문가회의를 개최하여 연구방향 및 연구 내용에 관한 의견을 수렴함
○ 인공지능에 관한 선행연구자, 인공지능 관련 입법, 행정, 사법 실무에 종사하는 전문가를 대상으로 하여 인공지능 법적 쟁점에 관한 설문조사를 실시하여 인공지능에 관한 다양한 법적 쟁점에 대해 중요성과 시급성을 기준으로 한 우선순위 및 법적 대응 방식, 방안 등에 대해 의견을 수렴함
Ⅱ. 인공지능 기술 발전 동향과 각국의 법정책적 대응과 논의
▶ 인공지능의 개념과 역사
○ 인공지능은 ‘인간의 지적능력을 모사하는 기계 또는 장치’로 정의하고, 인공지능은 로봇과 동일어가 아니며, 로봇 중에 인공지능을 탑재한 로봇을 지능형 로봇이라 하고, 인공지능은 소프트웨어에 해당함을 밝힘
○ 인공지능은 기술 발전 정도에 따라 강인공지능과 약인공지능으로 구분되며, 현재는 약인공지능이 대부분임
○ 인공지능은 앨런 튜링으로부터 처음으로 그 개념이 제시되었으며, 3번의 붐과 2번의 겨울을 거쳐 2016년 알파고의 등장을 계기로 제3차 붐의 단계에 와있음
▶ 미국의 법정책적 대응과 논의
○ 오바마 정부부터 인공지능 기술의 영향에 대해 관심을 가지고 정부의 역할을 중시하면서도 기술의 발전에 대해서는 개입을 자제하면서 학계와 산업계의 연구개발을 지원함
○ 트럼프 행정부는 인공지능을 국방뿐만 아니라 국가 연구개발의 최우선순위로 천명하고, “미국 국민을 위한 인공지능” 이니셔티브를 발표함
○ 미국 의회에서도 AI에 대한 연구 검토가 활발하며, 최근에는 자율주행자동차에 관한 법률을 비롯한 5개의 법안이 연방 상원과 하원에서 발의되기도 함
▶ 유럽연합의 법정책적 대응과 논의
○ 미국보다 앞서 집행위원회를 중심으로 로봇법에 대한 연구를 시작하여 로봇 규제 가이드라인 등을 발표하였고, 의회에서는 법사위원회에서 작성한 권고안에 근거하여 ‘로봇공학의 민사법 규칙에 관한 결의안’을 채택하여 로봇 등 인공지능 발전으로 초래되는 손해 등에 대한 법적 책임을 인정하기 위한 법리를 마련하고 이를 위해 전자인격을 부여할 수 있다고 밝힘
○ 그밖에 2018년에는 유럽연합 차원에서 AI 이니셔티브를 발표하였고, 현재 AI 윤리 가이드라인을 수립 중임 또한, 개인정보보호규정(GDPR)이 같은 해 5월부터 발효되어 유럽 전역에 개인정보에 관한 권리를 강화할 것을 천명함
▶ 독일의 법정책적 대응과 논의
○ 자율주행자동차와 관련하여 도로교통법을 개정하였고, 윤리 가이드라인을 수립하여 발표함에 따라 자율주행자동차의 사고시 판단기준을 제시하기도 함
○ 최근 국가 인공지능 전략을 수립하여 뒤늦게 인공지능 기술개발과 산업육성을 중요한 아젠다로 제시함
▶ 영국의 법정책적 대응과 논의
○ 1950년대부터 정부 차원에서 인공지능 연구개발을 지원하였으나, 그 성과를 제대로 거두지 못하였고 2016년부터 의회를 중심으로 AI에 대한 보고서를 발간하는 등 입법적 대응을 위한 준비를 시작함
○ 2017년 영국 상원에는 AI 특별위원회가 설치되었고, ‘영국에서의 인공지능’이라는 보고서를 발간하였고, 최근에는 영국 정부에서 데이터 윤리의 중요성을 강조함에 따라 데이터 윤리 프레임워크를 구축, 시행함
▶ 일본의 법정책적 대응과 논의
○ 정부 차원에서 총무성을 중심으로 AI네트워크화를 추진하면서 국내외의 동향에 관한 연구를 지속하면서, 국제적 논의를 위한 AI 연구개발 가이드라인을 발표하는 등 선도적 역할을 함
○ 2016년부터 4차 산업혁명에 대비한 지식재산 제도의 대책을 마련한 바 있고, 최근에는 AI의 이용에 관한 원칙을 수립하고, 자율주행자동차의 안전 확보 및 책임 등에 관한 기본원칙을 발표함
▶ 소결
○ 각국은 급속도로 발전가능성이 있고, 경제, 사회의 대변혁을 가져올 수 있는 파급력을 가진 인공지능에 대해 산업적 측면의 기술개발 활성화, 촉진을 국가 전략을 삼아 적극적인 지원을 하고 있는 동시에 인공지능이 초래할 수 있는 여러 가지 위험에 대해서는 국가 차원의 법제도를 구축하기보다는 학계, 산업계를 중심으로 진행되는 연구를 지원하고, 윤리적 차원의 가이드라인을 수립하여 공표하고 있는 것이 특징임
Ⅲ. 인공지능 관련 법적 쟁점과 검토
○ 인공지능 관련 법적 쟁점들 중에 전문가들이 가장 중요하고도 시급하다고 응답한 것은 바로 ‘인공지능의 오작동 등 사고로 인한 손해발생에 대한 책임 귀속’에 관한 것임
○ 그밖에도 법인격 부여 등 법적 지위의 문제, 데이터의 활용과 개인정보 보호의 조화 등의 쟁점이 높은 응답을 차지하는 것으로 나타남
○ 입법적 대응 방식은 기술의 수준에 따라 차등적인 접근이 필요하지만 아직은 시기상조라고 응답하였고, 별도의 법률을 제정하기보다는 기존의 법체계를 유지하면서 필요한 규정을 수정하는 형식이 바람직하다고 응답함
○ 인공지능 기술 및 산업의 발전에 장애가 되는 요소로서 주로 데이터 활용을 억제하는 개인정보보호법의 규정을 들고, 법적 쟁점에 대한 윤리적 접근과 법적 접근방식에 관해서 양자를 동시에 진행하는 것이 바람직하다는 의견을 제시함
▶ 인공지능의 법적 지위 검토
○ 민법상 권리능력은 인(人)에게 인정되고 있고, 권리의 객체로서 물건을 규정하고 있으므로 인공지능 또는 인공지능을 탑재한 로봇은 원칙적으로 권리 주체성이 부인됨
○ 인공지능에게 그 행위의 법적 책임을 묻는 것과 같이 권리주체성을 인정해야 할 정책적 필요가 있는 경우에도 자연인과 같은 권리주체성을 인정할 수는 없고, 법인(法人)과 같이 제한적인 인격 부여 가능성을 검토해볼 수 있음
○ 유럽연합에서는 2017년의 로봇공학에 있어서 민사법 규칙에 관한 결의안을 통해 인공지능에 별도의 전자적 인격(e-person)을 부여할 수 있음을 인정한 바 있으나, 인공지능에게 권리주체성을 인정하자는 차원이 아니라 인공지능에 의하여 발생한 문제를 해결하기 위한 도구로서 인정한 것임
▶ 인공지능의 불법행위에 대한 민사적 책임
○ 우리 민법상의 과실책임의 원칙과 예외적으로 인정되는 무과실책임에 대해서 검토해본 결과, 이러한 불법행위 책임도 인간의 자유의지에 의한 행위를 전제로 하는 것이므로 이를 인공지능 또는 인공지능을 탑재한 로봇에 적용하는 것은 타당하지 않음
○ 따라서 민법상 과실 책임의 법리는 원칙적으로 적용되지 않고, 무과실 책임 중에서 공작물의 소유자 책임, 자동차 운행자 책임을 일정한 경우에 유추 적용할 수 있음
○ 제조물 책임은 인공지능을 탑재한 로봇에 대한 제조물성을 인정할 수는 있지만, 제조물책임법상 결함의 존재, 그리고 결함과 손해 간의 인과관계 입증 등은 인공지능에 대해 적용하기 어려우므로 인공지능 로봇에 대한 제조물책임을 인정하기 위해서는 제조물책임법상의 규정의 수정이 필요함
○ 제3의 책임으로서 위험책임이나 편익책임이 논의되고 있으나, 위험책임이 인정되기 위해서는 인공지능에 ‘특별한’ 위험이 인정되어야 한다는 점에서 적용되기 어렵고, 편익책임의 경우에는 인공지능의 도입을 통해 일정한 편익을 얻은 행위에 책임 귀속의 근거를 찾는 것으로서 인공지능을 보유한 자에게 인공지능을 도입함으로써 편리성, 효율성 등이 편익을 얻게 되었기 때문에 그에 따른 책임도 져야 한다는 논리로 구성이 가능함
▶ 인공지능 기술의 활용과 개인정보 보호
○ 데이터의 적절한 이용과 활용은 인공지능 분야의 활성화에 관건이 됨에도 불구하고, 개인정보보호를 목적으로 하는 개인정보보호법제가 데이터의 이용과 활용에 장애가 되고 있음
○ 고도의 ICT 융합기술의 발전으로 인해 개인을 식별할 수 있는 가능성이 높아짐에 따라 비식별화된 정보도 제한적으로 활용될 필요가 있으므로, 개인정보를 보다 구체적으로 가명정보, 익명정보로 나누어 익명정보는 동법의 적용대상에서 제외하고, 가명정보는 추가 정보를 이용하여 개인을 식별할 수 있다는 점에서 개인정보로 취급할 필요가 있음
○ 사전 동의 요건을 실질화하고, 자동화된 의사결정이 가능한 시스템 하에서 개인이 그 결정을 거부할 수 있는 권리 등 정보주체의 권리를 강화하는 방안도 동시에 모색해야 함
Ⅳ. 인공지능 시대에 부합하는 법제 개선 방향
▶ 현행 법제 및 관련 법안 검토
○ 인공지능 관련 법제로는 지능형 로봇 개발 및 보급 촉진법, 소프트웨어 산업 진흥법 외에 국가정보화기본법, 정보통신 진흥 및 융합 활성화 등에 관한 특별법 등을 들 수 있음
○ 그런데, 이들 법체계는 아직 인공지능 기술을 비롯한 지능정보기술이 급속도로 발전하고 있는 현실과 그에 따라 발생할 수 있는 문제들을 제대로 다루고 있지 못해서 인공지능 시대의 법제도로서는 미흡함
○ 2017년과 2018년에 각각 지능정보사회 기본법안과 로봇 기본 법안이 발의되었으나 새로운 기본법의 제정으로 인해 기존 법체계와의 중복, 불일치 문제, 그리고 책임의 일반원칙, 이용자 권리보호 등 매우 중요한 법적 쟁점을 담고 있어서 좀 더 충분한 논의를 거칠 필요
▶ 법제 개선 방향
○ 인공지능 시대에 부합하는 법제의 개선 방향에 관해 다음과 같은 점을 제언하고자 함
- 첫째, 법제 개선의 기본 방향은 인간에게 이로운 방향으로 인공지능 기술이 연구개발, 활용될 것을 보장하는 것으로서 인공지능 기술이 향후 국가의 경쟁력을 좌우하게 될 것이라는 측면에서 관련 산업을 육성해야 하는 동시에 인공지능에 대한 통제권을 확보하고 이용과 활용에 있어서 일정한 기준을 제시할 필요가 있음
- 둘째, 현재의 기술 수준에 맞추어 약 인공지능(Weak AI)을 기준으로 법적인 대응을 모색해야 할 것인 바, 인공지능은 설계된 알고리즘에 따라 제한적인 자율성을 가지는 존재로 보아 법인격 부여 등은 아직 논의하지 않고, 인공지능 기술개발의 윤리 헌장 마련, 이용자 보호, 사고 발생시 책임 소재 등의 쟁점을 포함해야 함
- 셋째, 입법의 방식은 별도의 기본법 등 입법 체계를 마련하기 보다는 기존의 법령 체계를 유지하면서 필요한 부분을 개정하는 방식이 적절함. 다만, 현재의 인공지능 관련 법체계는 인공지능 기술을 비롯한 지능정보기술과 그로 인한 사회경제적 변화 및 법적 문제 등을 담기에는 미흡하기 때문에 관련 법령을 면밀히 분석하여 확대, 개편하는 방식의 입법을 모색해야 함
- 넷째, 인공지능의 오작동에 의한 손해발생시 책임 귀속과 관련하여 무과실 책임을 인정한다면 어떠한 규정을 유추 적용할 수 있을 것인지, 아니면 제3의 책임모델을 새로 고안할 것인지에 관해 사회적 합의를 도출해야 함. 다만, 입법이 시급한 자율주행자동차에 대해서는 별도의 특별법 등의 제정을 통해 선제적 대응하는 방식도 고려
- 다섯째, 데이터의 자유로운 이용과 활용을 제한하는 개인정보보호법제는 개인정보의 보호와 활용을 조화시키는 방향으로 개선이 필요함
- 여섯째, 법적 쟁점에 대한 대응 방식에 있어서 법제도의 구축을 위해서는 상당한 시일이 소요될 수 있으므로 각국에서 활용하고 있는 윤리적 접근 방식을 충분히 활용할 필요가 있음
- 일곱째, 인공지능 관련 법체계의 지속가능성과 안정성을 확보하기 위해서는 그 기술 및 법제에 관하여 상시적 영향평가 제도를 수립하여 인공지능 기술의 발전으로 인한 긍정적·부정적 영향을 상시 평가하여 관련 법정책의 개선에 활용할 수 있는 체계를 마련해야 할 것임
Ⅴ. 기대효과
○ 인공지능 시대를 맞이하여 발생할 수 있는 여러 가지 법적 쟁점에 관해 고찰함으로써 인공지능 관련 법이론의 발전에 기초 자료를 제공함
○ 인공지능 기술의 발전에 대비한 각국의 법정책적 대응과 전문가 의견을 제시함으로써 향후 인공지능 관련 법제의 개선에 유용한 근거가 될 수 있을 것으로 기대함

○ While AI is the key growth engine in the fourth industrial revolution and the paradigm of industrial structure will be changed, countries around the world are finding and nurturing new growth industries by failing to secure technological competitiveness and easing unnecessary regulations to preoccupy markets.
○ In the era of artificial intelligence, our legislation focuses on the development and dissemination of related technologies, and has not begun to discuss the socio-economic impact of the universal use of intelligent information technology.
○ Thus, this study provides legal regulations that are consistent with the development of artificial intelligence technologies, while seeking internal and external discussions on various issues such as the infringement of basic rights, imputation of legal responsibilities and the need for algorithm regulation.
Ⅱ. Major Contents
▶ The Concept and History of Artificial Intelligence
○ The definition of artificial intelligence as ‘machine or device that simulates human intelligence’ made it clear that artificial intelligence is not the same language as robots, and that robots equipped with artificial intelligence are intelligent robots and that artificial intelligence is software.
○ Artificial intelligence is divided into strong artificial intelligence and weak artificial intelligence depending on the degree of technological development.
▶ Current Status of Legal Policy and Discussion on Artificial Intelligence in Countries
○ United States of America
- The Obama administration was interested in the impact of artificial intelligence technology, valued its role as a government, but refrained from intervening in the development of technology, while supporting research and development of academia and industry.
- The Trump administration has declared artificial intelligence as a top priority for national R&D as well as defense, and announced the “Artificial Intelligence for the American People” initiative.
- The U.S. Congress is reviewing AI research and recently five new laws, including the Act on Self-driving cars, being proposed by the Federal Senate and the House of Representatives.
○ European Union
- The European Union began its research on robot law with executive committees ahead of the United States and published guidelines for robot regulation. Based on recommendations made by the Legislation and Judiciary Committee, the National Assembly can adopt a resolution on civil law rules of robotics to prepare a law to recognize legal responsibility for damages caused by artificial intelligence, such as robots, and grant electronic personality.
- In addition, AI initiatives were announced by the European Union in 2018 and AI ethics guidelines are being established. In addition, the Privacy Regulations (GDPR) went into effect in May of the same year and are pledged to strengthen the rights to personal information throughout Europe.

In 2017, the British Senate set up a special AI committee, published a report titled ‘Artificial Intelligence in the UK’, and recently established and implemented a data ethics framework as the British government emphasized the importance of data ethics.
○ Japan
- Japan continues to study trends at home and abroad, focusing on the government's general affairs, and plays a leading role by announcing guidelines for AI R&D for international discussions.
- The Japanese government has been preparing measures for the fourth industrial revolution since 2016, establishing principles for the use of AI, and announcing basic principles for securing safety and accountability of self-driving cars.
○ In regard to the various risks that artificial intelligence can lead to rapid development, economic and social transformation, while actively supporting the development and promotion of technology development at the industrial level through national strategies, the government supports the development of the technology.
▶ Expert opinion survey results
○ Experts say that the most urgent and important legal issues related to artificial intelligence are the responsibility of artificial intelligence. In addition, issues such as granting corporate status, utilization of data, and harmony of personal information protection are high.
○ The legislative response method requires a different approach depending on the level of technology, but it is still too early to do so. They also said that it is desirable to maintain the existing legal system and modify the necessary regulations rather than to establish separate laws.
○ It was suggested that both parties should proceed simultaneously with ethical and legal approaches to legal issues, with provisions of the Privacy Act, which mainly restrict data utilization as a barrier to the development of artificial intelligence technologies and industries.
▶ Reviewing the Legal Status of Artificial Intelligence
○ According to civil law, a robot equipped with artificial intelligence or artificial intelligence is usually denied its identity because the subject of the right is a person and the object of the right is an object.

○ Therefore, artificial intelligence does not apply in principle the law of civil responsibility, but it can be applied to the owner of a work piece and the driver's responsibility of a car if the responsibility of a work piece is constant.
○ As the law of human error is not applied to artificial intelligence in principle, the owner's and driver's responsibilities of the workpieces can be applied to the artificial intelligence.
○ In the case of product liability, it is possible to recognize the manufacture quality of robots equipped with artificial intelligence, but the existence of defects under the Product Liability Act and proof of causal relationship between defects and losses are difficult to apply to artificial intelligence.
○ Risk liability or benefit liability is discussed as a third responsibility, but it is difficult to apply in that ‘special’ risks must be recognized by artificial intelligence in order to be accepted. A person with artificial intelligence has gained convenience and efficiency by adopting artificial intelligence, and thus has responsibility.
▶ Utilization of artificial intelligence technology and privacy
○ Although proper use and utilization of data is related to the activation of artificial intelligence, privacy laws aimed at protecting personal information are a hindrance to the utilization and utilization of data.
○ Since unidentifiable information needs to be used in limited ways due to the development of advanced ICT convergence technologies, anonymous information needs to be excluded from the application of the same law.
○ It is also necessary to seek to increase the right of information entities, such as the right of individuals to reject the decision under a system that enables automated decision making.
▶ The Direction of Legislation Improvement in line with the Al Era
○ The artificial intelligence laws include the Development and Promotion of Intelligent Robots Act, the Promotion of Software Industry Act, the Framework Act on National Information Service, and the Act on Promotion of Information Communication and Convergence.
○ However, these legal systems are not sufficient for the legislation of the AI era as intelligent information technology, including artificial intelligence technology, has yet to properly address the rapidly evolving reality and the problems that could arise.
○ In 2017 and 2018, the Framework Act on the Intelligence Information Society and the Robotics Act were introduced, but the establishment of the new Framework Act included more important legal issues such as overlapping, inconsistent, general principles of responsibility, and user rights protection.
○ The following points are to be suggested regarding the improvement of legislation consistent with the AI era:
- First, the basic direction of legislative improvement is to ensure that artificial intelligence technology can be used in a beneficial direction to humans, and to foster related industries, while securing control over artificial intelligence and providing a certain standard for utilization and utilization.
- Second, it should seek legal responses based on the current technology level, and AI does not discuss the issue of corporate identity. ○ We provide basic data on the development of artificial intelligence-related laws by examining various legal issues that may arise in the era of artificial intelligence.
○ It is expected that this could be a useful basis for improving AI related legislation in the future by providing expert opinions and responses to each country's legal policies in preparation for the development of artificial intelligence technology.
