Ⅰ. 배경 및 목적 ▶ 배경 ○ 1987년 헌법개정 이후 사회현실의 변화와 헌법개정의 필요성 - 2018년 현재 국민들의 헌법의식이 대폭 고양되었고 민주주의와 지방자치의 경험 축적이 축적됨으로써 중앙집권적 통치형태에서 탈피하여 지방분권 개헌 및 이에 따른 미래 지향적 지방자치 모델을 구축하는 것이 시대적 과제로 제시됨.
▶ 목적 ○ 호주 지방자치제도의 국내 소개와 이해 - 호주는 영국의 정치체제를 기본으로 하면서도 미국의 연방제도와 사법심사제 등을 혼합하여 제3의 독특한 법제를 발전시켜왔고,
Ⅰ. 배경 및 목적 ▶ 배경 ○ 1987년 헌법개정 이후 사회현실의 변화와 헌법개정의 필요성 - 2018년 현재 국민들의 헌법의식이 대폭 고양되었고 민주주의와 지방자치의 경험 축적이 축적됨으로써 중앙집권적 통치형태에서 탈피하여 지방분권 개헌 및 이에 따른 미래 지향적 지방자치 모델을 구축하는 것이 시대적 과제로 제시됨.
▶ 목적 ○ 호주 지방자치제도의 국내 소개와 이해 - 호주는 영국의 정치체제를 기본으로 하면서도 미국의 연방제도와 사법심사제 등을 혼합하여 제3의 독특한 법제를 발전시켜왔고, 또한 연방과 더불어 주·지방 정부도 100년 이상의 역사를 가지고 각자 정부로서의 독특한 특색을 가지고 있기에 연구의 필요성이 있으나 그동안 국내에는 본격적으로 소개된 바가 없었음.
○ 우리 지방자치제도 법·정책 연구의 기초자료로 활용 - 비교법 연구를 통해 지방분권 개헌과 이에 연계된 우리 지방자치제도 법·제도적 정비에 시사점을 제시함하고자 함.
Ⅱ. 주요 내용 ▶ 자치행정의 제도적 내용 ○ 호주의 3단계 정부구조 - 호주의 정부구조는 3층 체계로 연방정부, 주(States) 및 준주(Territory) 정부, 지방정부(Local Government)로 구성. 호주의 연방과 주정부의 권한은 연방헌법에서 규정하고 있으나 실제로는 다양한 분야에서 권한의 중첩이 발생. 연방헌법과 주 헌법의 불일치가 발생할 경우에는 연방헌법이 법적 우위를 가짐.
○ 호주정부협의회와 지방정부협의회 - 호주정부협의회는 연방총리(Prime Minister)와 주 및 준주의 총리들(First Ministers), 그리고 호주지방정부연합(Australian Local Government Association: ALGA)의 의장(president)으로 구성 - 호주 지방정부협의회(The Australian Local Government Association: ALGA)는 호주의 6개 주와 북부준주의 지방정부 537개가 모여서 만든 기관

▶ 자치입법의 제도적 내용 ○ Constitution Act 1902 No 32 [NSW] 주 헌법상 주민투표 - 주 헌법상 주민투표(State Referendums)는 주 헌법을 바꾸거나, 주 헌법 제5B조의 경우와 같이 상하 양원 간에 법안에 관해 교착상태(deadlock)가 발생한 경우 이를 하원이 주민투표를 통해 주민들에게 직접 승인을 구하는 방식.
○ Local Government Act 1993 No 30 [NSW] 지방정부법상 주민투표 - 지방정부법 제16조는 지방정부 주민투표의 대상에 대해서, (a) 선거구(wards) 조정 및 폐지, (b) 시장 선출방법 변경(시의원에 의한 선출인지 아니면 주민에 의한 선출인지), (c) 동법 제224조의 한계 내에서의 시의원수 변경, (d) 지방의원 정기선거(ordinary election) 방법의 변경에 관해서는, 주민투표에 의해서 승인을 받지 않으면 이를 지방의회가 할 수 없음. - 위 주민투표 결과는 지방의회를 기속함.
○ 2013년 연방헌법에 지방정부를 명시하는 헌법개정 시도 - 호주 대법원의 최근 판결들(2009년의 Pape 판결과 2012년의 Williams 판결)로 인해 연방정부의 직접적인 지방정부에 대한 재정지원의 헌법적 정당성에 의문이 제기됨. - 2011년 지방정부 헌법 명시를 위한 전문가 패널(Expert Panel on Constitutional Recognition of Local Government)이 구성되어 재정적 명시(Financial Recognition)가 가장 적합한 안으로 보고됨. - 종래 연방헌법 제96조는 재정지원의 대상을 주(State)로만 한정하였었는데, 2013년 국민투표에 붙여질 예정이었던 헌법개정안에서는, 주법에 의해 성립되는 지방정부기구(local government body formed by a law of a State)도 재정지원의 대상으로 추가됨. 그러나 결국 불발에 그치고 말았음.

Ⅱ. Major Content ▶ Governance in Australia ○ Levels of Government in Australia - In Australia there are three elected governments - Federal, State (or Territory) and Local. The Federal Government is responsible for the conduct of national affairs. Its areas of responsibility are stated in the Australian Constitution and include defence and foreign affairs, etc. Under the Australian Constitution, the States are responsible for everything not listed as a Federal responsibility. However, sometimes both levels are involved. Local Government areas vary greatly in size and character. The power of local governments is controlled by Acts of State Parliament such as the Local Government Acts. Local Councils are concerned with matters close to our homes.
○ COAG & ALGA - The Council of Australian Governments (COAG) is the peak intergovernmental forum in Australia. The members of COAG are the Prime Minister, state and territory First Ministers and the President of the Australian Local Government Association (ALGA). The Prime Minister chairs COAG. - The Australian Local Government Association (ALGA) is the national voice of local government, representing 537 councils across the country. In structure, ALGA is a federation of 6 states and Northern Territory local government associations.
▶ The Legislative Power of State (focusing on New South Wales) ○ State Referendums in Constitution Act 1902 No 32 [NSW] - State Referendums are held to gauge voter opinion on certain issues; to change certain parts of the New South Wales Constitution Act (especially concerning the Legislative Council); or because a Bill has reached a state of deadlock between the two Houses of Parliament. In the latter instance, the Legislative Assembly may direct that the Bill be submitted by way of referendum to the electors for approval. This is the rarest form of referendum in NSW.

○ 2013 Local Government Referendum - The referendum seeks to amend the Constitution to give ‘financial recognition’ to local government. It would amend section 96 of the Constitution so that it reads (new words underlined): During a period of ten years after the establishment of the Commonwealth and thereafter until the Parliament otherwise provides, the Parliament may grant financial assistance to any State, or to any local government body formed by a law of a State, on such terms and conditions as the Parliament thinks fit. - The main purpose of this amendment is to give the Commonwealth the power to directly fund local governments, rather than having to provide funding indirectly through the states. Currently, the Commonwealth’s constitutional ability to provide direct funding (which supports the Roads to Recovery program, among others) has been cast into doubt by recent High Court decisions- Pape v Commissioner of Taxation Paper, [2009]; Williams v Commonwealth [2012].

Expected Effects ○ This paper presents new options for the future of Korean local autonomy system ○ This paper provides an opportunity to comprehensively understand the issue of local autonomy in relation to federalism and central government ○ This report shows that local autonomy, along with the improvement of local governments, requires the participation of the people.
