본 연구는 1부와 2부로 나누어 보고서 체계를 구성하였다. 1부에서는 본 연구의 필요성과 목적(Ⅰ장), 이론적 배경(Ⅱ장), 조사 방법 및 도구 타당화(Ⅲ장) 등 조사 분석을 위한 기초 조사와 분석을 제시하였으며, 2부에서는 수집된 자료를 바탕으로 학교 인권교육,인권의식, 인권 실태를 다각도로 드러낼 수 있도록 각 장별 핵심 주제와 질문을 중심으로 심층 분석 결과를 제시하였다.
□ 1부: 조사 분석을 위한 기초 조사 및 분석

본 연구는 1부와 2부로 나누어 보고서 체계를 구성하였다. 1부에서는 본 연구의 필요성과 목적(Ⅰ장), 이론적 배경(Ⅱ장), 조사 방법 및 도구 타당화(Ⅲ장) 등 조사 분석을 위한 기초 조사와 분석을 제시하였으며, 2부에서는 수집된 자료를 바탕으로 학교 인권교육,인권의식, 인권 실태를 다각도로 드러낼 수 있도록 각 장별 핵심 주제와 질문을 중심으로 심층 분석 결과를 제시하였다.
□ 1부: 조사 분석을 위한 기초 조사 및 분석
1장에서는 본 연구의 목적과 연구 방법 및 내용 등을 제시하였다. 기존 연구들이 아동‧청소년의 개인적, 사회적 수준에서 인권실태를 파악하는 데 초점을 둔 반면, 본 연구는 학생들의 주요 삶의 현장인 학교를 중심으로 인권교육이 어떻게 이루어지고 있는지, 학교 구성원들의 인권의식 수준은 어떠한지, 그리고 학교에서 학생과 교사의 인권보호/침해 실태는 어떠한지 등을 조사하고 분석한다는 점에서 선행연구와 차별성을 가진다.
Ⅱ장에서는 인권교육 및 학교 인권교육의 의미와 실천을 이론적으로 고찰하였다. 이론적 맥락에서 인권과 인권교육의 의미, 인권교육의 접근 방법을 고찰하였으며, 실제적 측면에서 17개 시․도교육청의 2019년도 업무 계획 자료를 수집하여 각 지역별 인권교육 관련 정책에 대해 분석하였다. 끝으로, 인권교육 현황 및 인권의식 도구 개발과 타당화를 위해, 국가인권위원회에서 실시한 국민인권의식조사 및 인권교육 실태조사, 한국청소년 정책연구원에서 실시한 아동․청소년 인권실태조사 등의 조사 항목과 내용을 검토하였다.
Ⅲ장에서는 예비조사 및 본조사 실시와 관련하여 조사 대상, 조사 방법, 조사 내용과 관련하여 세부적인 내용을 제시하고, 인권교육 현황 및 인권의식 조사도구에 대한 타당화 분석 과정을 상술하였다. 예비조사는 전문가 협의회, 교사 및 학생 8인의 검토를 통해 내용 타당도와 안면 타당도를 확보한 문항을 오프라인 설문방식으로 조사하였다. 예비조사에 응답한 초등학생 118명, 중학생 136명, 고등학생 135명과 초․중․고등학교 교사 265명의 자료를 활용하여 문항분석, 탐색적 요인분석, 문항과 요인간의 상관관계, 문항내적 일관성 신뢰도를 분석하여 문항을 수정․보완하였다.
본 조사는 17개 시․도교육청 소속 초․중등학교의 재적 학생 수에 따라 층화군집추출법(stratified cluster sampling method) 방식(학교 소재지, 학교유형(고등학교), 설립유형 등을 반영)으로 학교급별로 각각 105개 학교씩을 표집 하였다. 최종적 추출된 315개 학교 중 301개 학교(학생 13,524명, 교사 1,971명, 교감/부장교사 300명)가 설문조사에 참여하였다. 인권교육 현황 및 인권의식 조사 도구 문항의 타당화 분석 결과, 인권의식 척도는 인권판단, 인권 감수성, 인권 행동의사의 하위요인으로 나누어지며, 타당화 과정에서도 가정된 하위구인과 동일하게 추출되었다. 확인적 요인분석을 실시하여 구인타당도를 검토한 결과, 3요인(인권판단, 인권 감수성, 인권 행동의사) 모형지수의 적합도가 우수한 것으로 나타났다. 수렴타당도 및 판별타당도 또한 적절한 수준임이 확인되어, 학생용과 교사용 모두 인권의식 척도의 구인타당도가 확보되었다.
□ 2부: 주제별 분석
2부에서는 수집된 자료를 바탕으로 학교 인권교육과 현황을 다각도로 분석하기 위해 개별 장별 연구 방법과 주제를 달리하며 핵심 현상을 드러내고자 하였다. 구체적으로 인권교육 현황, 교사 및 학생의 인권의식, 학교 실태 분석(Ⅳ장)과 인권교육 및 인권실태에 따른 학교유형 분석(Ⅴ장), 인권교육의 인권의식 제고 효과 분석(Ⅵ장), 차별기능문항 문제를 보완하기 위한 사례제시법 분석(Ⅶ장)을 실시하였다.
□ Ⅳ장: 인권교육, 인권의식, 인권 실태 분석
Ⅳ장에서는 기초 통계(평균, 빈도 등)와 집단 간 차이 분석을 통해 학교 인권교육이 어떻게 이루어지고 있는지, 학교 내 학생들의 인권보호 실태는 어떠한지, 교사와 학생의 인권의식은 어떠한지, 교사의 전문성 정도는 어떠한지, 인권교육 내실화를 위해 교사와 학생은 무엇을 요구하는지 등을 분석하였다. 특히, 학교 간 인권보호 풍토의 차이와 교사-학생 간 인식 차이를 살펴봄으로써 학교의 인권 현황을 보다 구조적으로 밝히고자 하였다.
먼저 학교 인권교육 현황을 보면, 대부분의 학교가 학교교육 계획 수립 시 인권교육계획을 수립하고 있으나, 독립된 교육 프로그램으로 계획을 수립하기보다 유관교육 프로그램(민주시민교육, 인성교육 등)의 일환으로 인권교육을 다루고 있었다. 인권교육은 교과 수업시간, 창의적 체험활동 시간 보다 생활지도(조회․종례, 상담 등) 시간에 더 많이 이루어지고 있으며, 초등학교가 중․고등학교 보다 인권수업 시간이 많았다. 교사들은 학교교육 계획서에 반영된 인권교육과정 구성과 내용이 어느 정도 적절하다고 인식하였다.
그러나 조사 참여 학생 중 33.2%는 자신이 학교에서 인권교육을 받았는지 정확하게 인지하지 못하고 있었다. 또한 10가지 인권 영역별 인권교육 여부를 조사한 결과 권리 영역별 수업 여부의 차이가 컸으며, 사생활 자유와 비밀보장에 대한 권리 교육이 강화될 필요가 있는 것으로 나타났다. 교육의 효과 면에서 인권교육이 학생의 지식 이해와 태도변화에 어느 정도 기여하고 있지만, 수업 만족도는 상대적으로 낮아 이에 대한 개선이 필요한 것으로 분석되었다. 더불어 학교 간 인권 수업에 대한 만족도 차이도 큰 것으로나타났다.
학생과 교사의 인권보호 실태를 보면, 초등학교에서 인권이 가장 잘 보호되고 있으며,학교급이 높아질수록 인권보호 정도는 낮아졌다. 중등학교의 경우 사생활의 자유와 비밀보장, 표현의 자유, 자치 및 참여 권리에 대한 보호 정도가 특히 낮았다. 친구(선배) 간 권리 보호 정도는 중학교가 상대적으로 가장 낮았으며, 특히 폭력 및 위험으로부터 자유정도가 가장 낮았다. 교사로부터 인권침해를 경험한 학생의 비율은 학교급이 높아질수록 높아졌다. 반면, 친구(선배)로부터의 인권침해 경험은 학교급이 높아질수록 낮아졌다. 학생들은 교사로부터 차별관련 인권침해를 가장 많이 경험하였으며, 표현의 자유, 부당한 체벌 및 언어폭력 경험 비율이 높았다. 학생들이 교사로부터 인권침해를 받았을 때 부모,또는 전문가에게 도움을 받은 학생 비율은 소수에 불과했다. 더불어, 교사가 인식하는 학생 인권보호 정도와 학생이 인식하는 인권보호 정도의 차이는 큰 것으로 나타났다.
교사 전문성 측면에서 보면, 교사들은 학생 인권이 중요하다고 생각하지만, 실제 수업에 대한 준비도는 중요도만큼 높지 않았다. 인권 중요도 및 수업 준비도 면에서 초등학교교사들이 중․고등학교 교사보다 인권이 중요하다고 인식하고 있으며, 가르칠 준비도 역시 잘 되어 있다고 인식하고 있었다. 교사 양성단계 및 현직에서의 인권 관련 연수는 충분히 이루어지지 않고 있으며, 교수-학습 방법, 학급 운영 방안 등 실천적인 연수에 대한 교사들의 요구가 높았다. 인권 연수 내용은 지식으로서 인권 이해 교육의 비중이 높은 반면, 교수-학습 자료 개발 방법, 네트워크 구축 방법, 학부모 연수 자료 개발 등에 관한 내용은 잘 다루어지지 않고 있는 것으로 나타났다. 연수가 인권교육에 도움이 되는 정도는 보통 보다 조금 높은 수준이었다. 교사들은 시간 확보의 어려움, 교수-학습 자료의 부족, 목표와 의미에 대한 공유 부재로 인해 인권교육에 있어 어려움을 겪고 있으며, 인권교육 내실화를 위해 교육 시간 확보, 교수-학습 자료 보급, 민주적 학교 풍토 조성, 교육과정 통합 프로그램 개발 등이 필요하다고 인식하였다.
□ Ⅴ장: 학교 유형 분석
Ⅴ장에서는 단위학교의 인권교육 및 인권실태를 보다 심층적으로 파악하기 위하여, 단위학교의 인권교육 정도, 학생 인권 실태(교사-학생, 학생-학생), 교사 인권 실태(교사-교사, 교장 리더십)를 기준으로 학교를 유형화하였다.
전체 301개 학교를 인권교육 및 인권실태에 따라 유형화한 결과, 5개 유형-유형1(22.3%), 유형2(17.3%), 유형3(35.2%), 유형4(19.6%), 유형5(5.6%)-로 분류되었다. 유형 1 학교는 인권교육이 내실 있게 운영되고 있으며, 학생과 교사의 인권이 모두 잘 보호되고 있는 학교이다. 유형2 학교는 학생의 인권교육 만족도와 학생의 인권보호 정도는 평균보다 높은 수준인 반면, 교사가 인식하는 인권교육의 질과 교사 간 인권보호 실태 및 학교장 리더십 등 교사 관련 항목은 평균보다 낮은 수준의 학교이다. 유형3 학교는 유형 2 학교와는 반대로, 학생의 인권교육 만족도와 학생 관련 인권보호 실태는 평균보다 낮은 반면, 교사가 인식하는 인권교육의 질과 교사 관련 인권보호 실태는 평균보다 높은 수준이었다. 유형4 학교는 인권교육, 학생 및 교사 관련 인권보호 정도가 모두 평균보다 낮은 수치를 나타내, 인권교육과 학교의 인권보호에 관심을 가지지 않는 학교로 볼 수 있다. 마지막으로, 유형5 학교는 인권교육 정도와 학교 구성원의 인권보호 수준이 유형4학교와 비슷한 수준이거나 이보다 낮은 학교들로, 특히 교직원에 대한 차별이 심각하게 인식되고 있었으며, 인권교육과 관련한 학교장 리더십이 상당히 낮은 것으로 나타났다.
이렇게 분류된 학교 유형과 학교특성 간에 연관성이 있는지를 분석한 결과, 학교유형은 학교급, 학교소재지, 설립유형에 따라 통계적으로 유의미한 차이를 보였다. 유형1 학교는 초등학교, 군‧읍‧면지역 학교, 국‧공립학교가 많았고, 유형2 학교에는 고등학교, 특별광역시학교, 국‧공립학교가, 유형3 학교는 중학교, 중소도시 및 군‧읍‧면지역 학교, 국‧공립학교가 많았다. 유형4 학교에는 고등학교, 중소도시, 국‧공립학교가, 유형5 학교에는 고등학교, 특별광역시학교, 사립학교가 많이 분포하고 있는 것으로 나타났다. 더불어, 잠재프로파일분석 3단계 접근법(3-step approach)을 학교 유형 분류에 영향을 미치는 요인을 제시하였다.
□ Ⅵ: 인권교육이 인권의식에 주는 효과 분석
Ⅵ장에서는 학생들의 인권교육 참여 및 인권교육에 대한 인식, 학교에서 제공되는 다양한 인권교육 및 관련 제도가 학생들의 인권의식 제고에 어떠한 영향을 미치는지 살피는 한편, 교사들을 대상으로 한 인권교육 관련 연수가 교사들의 인권의식에 미치는 영향을 실증적으로 분석하였다. 분석 결과 학생의 인권교육 참여 및 인권교육에 대한 인식이 학생들의 인권의식에 미치는 영향은 학교급에 따라 차이가 있으며, 경우에 따라서는 부정적인 영향을 미칠 가능성도 존재하였다. 학생들이 단순히 인권교육에 참여하는 것보다는 인권교육이 어떠한 수업 풍토 속에서 이루어지며, 학생들이 인권교육을 어떻게 인식하고 만족하는지가 교육의 효과성을 결정하는 데 주요한 것으로 나타났다. 한편, 현재 학교에서 시행 중인 다양한 인권교육 프로그램 및 이의 운영, 관련 제도가 학생들의 인권의식에 미치는 영향에 대한 분석 결과, 학교급에 따라 학교 인권교육의 효과가 상이한 것으로 나타났다. 즉, 고등학교의 인권교육은 인권판단 제고에는 효과적인 것으로 나타났으나, 초등학교 및 중학교 단계의 인권교육은 그 영향력이 상대적으로 약한 것으로 나타났다. 초등학교에서 이루어지는 인권교육은 인권 감수성 제고에 비교적 효과적인 것으로 나타났지만, 중학교 및 고등학교 단계에서의 교육 효과는 거의 없는 것으로 나타났다.
행동의사 측면에서는 오히려 중학교의 인권교육이 효과적인 것으로 나타난 반면, 초등학교와 고등학교의 인권교육 효과성은 그리 크지 않은 것으로 나타났다. 마지막으로 교사대상 연수가 교사들의 인권의식에 미치는 영향 분석 결과는 현행 인권교육 관련 연수가 교사들의 인권의식 함양, 특히 인권판단 및 인권감수성 측면에서 오히려 부정적인 결과를 초래하고 있음을 보여준다.
□ Ⅶ장: 응답 편향성 문제 보완 가능성 탐색
Ⅶ장에서는 학생과 교사의 인권의식을 조사하는 과정에서 발생할 수 있는 응답 편향성의 문제점을 보완하기 위한 방안으로 사례제시법을 탐색적으로 적용하여 분석하였다.
분석결과, 성별, 학생의 성취수준, 학생의 사회경제적 배경, 학교 소재지, 설립유형, 인권조례 제정 여부 등과 같은 특성에 따라서 인권의식 문항에 대한 응답 경향성이 다르게 나타났다. 또한, 사례제시법을 적용한 이후 혁신학교 여부에 따른 교사의 인권판단과 인권 감수성 차이에 있어 통계적 유의성이 달라졌다. 이러한 결과는 자기보고식 설문조사의 경우 응답 편향성으로 인해 그 결과가 달라질 수 있음을 의미하며, 향후 본 연구에서 적용한 사례제시법과 같은 방법론을 탐색하는 후속 연구가 지속될 필요가 있음을 시사한다.
□ 본 연구의 의미
Ⅷ장에서는 본 연구의 주요결과를 중심으로, 각각의 분석이 가지는 학술적 의미와 후속 연구를 위한 제언을 제시하였다. 본 연구의 학술적 의미를 제시하면 다음과 같다. 첫째, 본 연구에서는 인권을 보다 종합적으로 파악하기 위하여 인지적, 정의적, 행동적 측면에서 인권의식을 개념화하고자 하였다.
둘째, 본 연구는 학교의 풍토가 교사-학생, 학생-학생, 교사-교장 등 학교 구성원 간 매일 매일 맺는 관계적 특성에 따라 변화한다는 점과, ‘인권교육’이라는 정규 과목이 없는 상황에서 이루어지는 학교 인권교육은 교원의 관심과 학교의 노력 여하에 따라 교육의 질이 달라질 수 있다는 점에 특히 주목하고, 학교별 인권보호 풍토의 차이, 인권의식의 차이, 인권교육 만족도의 차이 등 선행연구가 다루지 못한 학교 내 학생인권(교육, 의식, 실태) 현황을 드러내고 향후 관련 연구 수행의 기초 데이터를 제공하고 있다는 점에서 의미를 가진다.
셋째, 학교 내 인권조례에서 제시하고 있는 권리 영역별로 학생의 인권이 어느 정도보호되고 있는지를 살펴봄으로써 향후 보다 관심을 가져야할 학생 권리 영역에 대한 정보를 제공한 점 역시 주목할 만하다. 특히, 인권교육이 단순히 수업 시간에 이루어지는 교육 내용으로서의 인권교육 못지않게 생활을 통해 체득되는 인권교육(인권을 통한 교육)의 중요성을 고려할 때 본 연구에서 제시한 학교 별 인권보호 문화의 차이에 관한 정보는 우리나라 학교의 인권 상황을 보다 구조적으로 드러내고 있다는 점에서 의미를 가진다.
넷째, 본 연구는 개념 및 실태 분석 중심의 선행연구들과 달리, 인권교육의 효과 즉학교 교육에서 이루어지는 인권교육 활동이 실제 학생들의 인권의식 수준을 제고하는 데 미치는 영향을 실증적으로 분석한 연구라는 점에서 의의가 있다. 특히 이 과정에서 학생의 인권교육 활동에 참여 여부, 인권교육에 대한 만족도 및 수업 풍토, 학교 내 인권교육관련 교육활동, 인권교육 계획 주체, 인권교육 관련교원 연수 등과 같은 다양한 요인들과 학생의 인권의식 간의 관계를 최소자승법(OLS)과 고정효과모형 및 확률효과모형 등 정교한 통계분석 기법을 활용하여 실증적으로 규명하였다는 점에 주목할 필요가 있다.
다섯째, 본 연구는 인권의식 관련 문항에 대한 학생의 응답에서 차별기능문항이 존재할 가능성이 높다는 것을 실증적으로 규명하고, 이 문제를 완화하기 위한 비모수적인 방식의 사례제시법을 적용하였다는 점에서 의의가 있다. 이를 통해 차별기능문항의 식별하는 노력에 머무를 것이 아니라 이 문제를 해결하기 위한 노력을 보다 적극적으로 강구할 필요가 있음을 제안하였다. 향후 인권의식과 같이 자기보고식 인식 조사를 수행하는 과정에서 조사한 문항이 차별기능문항에 해당하는지를 면밀하게 검토하고, 자기보고식 인식 조사에서 차별기능문항으로 인한 문제점을 보완하기 위한 노력을 지속적으로 경주할 필요가 있다.

In chapter I, the purpose of the study, research methods, and contents were presented. While previous studies focused on identifying overallhuman rights education status and human rights conditions at theindividual level such as children and adolescents, this study examined andanalyzed how human rights education is being conducted at schools,which are the main sites of students' lives; what the status of human rights protection/violation of students and teachers is in schools; and thelevel of school members' consciousness of human rights.
In chapter Ⅱ, the meaning and practice of human rights education and school human rights education were discussed. In order to grasp the latest trends in human rights education, we collected data on the 2019 work plans of 17 metropolitan and provincial education offices that set a big direction for human rights education in schools and realize policies;and analyzed policies related to human rights education in each region.
In addition, to develop and improve the ‘Measuring instruments for the status of human rights education and human rights consciousness’, we analyzed the survey of human rights consciousness and human rights education status conducted by the National Human Rights Commission and the survey on the human rights conditions of children andadolescents conducted by the Korea Youth Policy Institute.
In chapter Ⅲ, detailed information regarding the subjects, methods and contents of the pilot test and main survey were provided and the process of validity for the ‘Measuring instruments for the status of human rights education and human rights consciousness’was explained. The preliminary survey was conducted through an offline survey method with the questions secured by an expert council for content validity and a group of students and teachers (8 persons) for face validity. Using the datacollected by 118 elementary school students, 136 middle school student,135 high school students, and 265 elementary, middle and high school teachers who answered the preliminary survey, we conducted the question analysis, exploratory factor analysis, question-factor correlation,and question consistency reliability and modified the questions.
This survey was conducted nationwide in order to identify human rights education, human rights consciousness and human rights conditions.
According to the number of students enrolled in 17 elementary and secondary schools (reflecting the information of region, high school type, national/public status, etc.), the target schools were sampled using the stratified cluster sampling method. Each of 105 schools was sampled per unit school. Out of 315 schools extracted finally by the stratified cluster extraction method, 301 schools (13,524 students, 1,971 teachers, 300 vice-principals/directors of research) participated in the survey. Student questionnaire and teacher questionnaire are composed of questions about human rights education status, human rights conditions, human rightsconsciousness, response propensity analysis, and personal characteristics.

In chapter Ⅳ, we analyzed how the school's human rights education is being conducted, what the status of students' human rights protection is in schools, what the human rights consciousness of teachers and students is, what the degree of teachers’ professionalism is, and what teachers and students request for the substantiality of human rights education.
According to the current status of school human rights education, most schools plan human rights education when planning school education, but they reflect it as part of the relevant education program (democratic citizens' education, personality education, etc.) rather than as an independent subject. Human rights education is conducted more during the guidance (morning assembly, end-day meeting, counseling, etc.) than in regular subject classes and creative experience activity classes, and elementary schools had more human rights classes than middle and high schools. Teachers recognized that the composition and contents of the human rights curriculum reflected in the school education plan weresomewhat appropriate. Not a few students were aware of whether they received human rights education or not at school. In addition, a survey on 10 areas of human rights, asking whether or not students received education on each area, showed that there was a wide gap between each area of human rights, and therewas a need to strengthen education on the right for privacy and confidentiality.
While human rights education contributes to students' knowledge understanding and attitude change to some extent, improvements in teaching methods, understanding contents and data activities are needed. In addition, there was a wide gap in satisfaction with human rights classes among schools.
According to the status of human rights protection for students and teachers,human rights are best protected in elementary schools, and the higher the school level, the lower the level of human rights protection. For secondary schools, the degree of protection for freedom of privacy, confidentiality, freedom of expression, autonomy, and participation was low. Middle schools had the lowest degree of rights protection between friends (senior) and, particularly, showed the lowest degree of protection in the right of freedom from violence and danger.
The proportion of students who have experienced human rights violations from teachers increases as their school levels rise. On the other hand, the experience of human rights violations by friends (senior) decreased as school levels rose.
Students experienced the most discrimination-related human rights violations from teachers, and the ratio of infringed freedom of expression, unfair corporal punishment, and verbal abuse experience was high. When students were subjected to human rights violations by teachers, only a small number of students received help from their parents or experts. The consciousness degree of human rights protection between teachers and students is significantly different.
In terms of teachers’ professionalism, teachers think students’ human rights are important, but the readiness for actual classes is not as high as the importance they perceive. In terms of the importance of human rights and the preparation of classes, primary school teachers recognized that human rights were more important than middle and high school teachers did, and that the degree of preparation to teach was also good. There are not enough human rights training in the training and in-service stages, and teachers have high demands for practical training such as teaching-learning methods and classroom management.
While the percentage of education on understanding human rights as knowledge is high, information on how to develop teaching-learning materials, how to build a network, and the development of parental training materials has not been well addressed. Also, the degree to which training is helpful in human rights education was slightly higher than usual. Teachers found that they were having difficulties in human rights education due to difficulties in securing time, lack ofteaching-learning materials, lack of sharing of goals and meanings, and that they needed to secure time for education, disseminate teaching-learning materials, create a democratic school environment, and develop integrated programs for curriculum to substantialize human rights education.
In Chapter V, we categorized schools by comprehensively considering diverse factors related to human rights in order to grasp in depth the actual status of human rights and their education at each school. Thecategorization of the total 301 schools according to their human rightseducation and actual status showed that there were five types: Type Ⅰ(22.3%), TypeⅡ (17.3%), Type Ⅲ (35.2%), Type Ⅳ (19.6%), and Type Ⅴ(5.6%). Type Ⅰ is the satisfactory group in all areas related to human rights education and actual status. Type Ⅱ had a higher score than the average in items related to students, such as the students’ level of satisfaction with human rights education and the status of students’ human rights protection in the teacher-student relationship and student-student relationship. However, they scored below the average initems related to teachers, such as the quality of human rights education that teachers perceive, as well as the human rights friendliness of the teaching staff culture and the head of school leadership. On the other hand, Type Ⅲ scored below the average in areas related to students,while the quality of the rights’ education that the teachers perceived and the status of human rights protection related to teachers were higher than the average. Type Ⅳ scored lower than the average in the actual status of human rights friendliness both related to students and teachers, as well as human rights education. Last, Type Ⅴ scored similarly to or lower than Type Ⅳ in the status of human rights education and human rights protection, and they showed the particular features of theirrecognizing serious discrimination against the teaching staff and of theheads of the schools manifesting a significantly low degree of humanrights friendliness in their leadership.
An analysis of the school characteristics related to each of the above five human rights types showed that there were statistically meaningful differences according to the school grades, location, and establishment type. There were many public schools, schools ub ryrak areas, and elementary schools of Type Ⅰ, while schools of Type Ⅱ were mainly found among high schools, schools in metropolitan and big cities, and public schools. As for Type Ⅲ, there were manymiddle schools, schools in mid-sized cities and rural areas and public schools.Schools of Type Ⅳ were mainly found among high schools, small and schools in mid-sized cities, and public schools. On the other hand, Schools of Type Ⅴ were highly distributed among high schools, schools in metropolitan and big cities, and private schools. In addition to school grades, location, establishment type, and the ratio of vulnerable groups, we analyzed other factors impacting the categorization of each school type, including whether they were located in regions that have enacted human rights ordinances as a human rights-related policy factor and whether they were innovative schools.
In Chapter Ⅵ, we examined how the students’ participation in and their consciousness of human rights education as well as the diverse human rights education and related systems provided at the schools impacted the improvement of the human rights’ consciousness among the students. At the same time, we conducted an empirical analysis of how the rights’ education and training for teachers influenced their consciousness of the rights. Results showed that there were differences in the impact that the students’ participation in and consciousness of human rights education had on their human rightsconsciousness depending on the school grades. In some cases, the possibility of negative impact also existed. Our analysis showed that the ambience in which the education took place and how the students perceived and were satisfied with the education more decisively determined the effectiveness of the education than just the students’ participation in it. Meanwhile, an analysis of the impact of diverse human rights education programs, their management, and related systems, currently implemented at the schools, on the students’ human rightsconsciousness showed that differences existed depending on the school grades.
That is, while the education effectively enhanced the rights’ judgment among students in high school, it had a relatively weak impact among students in elementary and middle schools. While the education showed to be relatively effective in enhancing sensitivity to the rights in elementary schools, there wasalmost no educational effect in middle and high schools. In terms of the intent to practice the rights, the education was more effective in middle schools and not much in elementary and high schools. Lastly, an analysis of the impact of theteachers’ human rights training in their human rights consciousness showed thatthe current training provided actually negatively impacted their cultivation of therights’ consciousness, and in particular, their judgment and sensitivity to the rights.
In Chapter Ⅶ, we applied the anchoring vignette method as a way to supplement the problem of differential items functioning that manifests during the investigation process. The results of the analysis showed that the answer tendencies to the consciousness questions differed depending on various characteristics like sex, students’ level of achievement and socio-economic background, the schools’ location and establishment type, and whether a human rights ordinance had been enacted. In addition, in the process of applying the anchoring vignette method, constant changes manifested in the students’ different sensitivity to human rights depending on certain features like whether the schools were private schools and whether they had enacted human rights ordinances. Similarly, the statistical significance shown in the different teachers’ sensitivity to and judgment of human rights depending on whether the schoolswere innovative, changed after applying the anchoring vignette method.
In Chapter Ⅷ, we presented academic implications and policy suggestions based on the main results of this study. First, in this study, we attempted to conceptualize human rights consciousness in terms of cognitive, emotional andbehavioral aspects in order to understand human rights more comprehensively.
Second, the study emphasized the importance and role of schools as the ground for human rights education and promote changes for it to become an educational course, or at least a potential course, that reflects the students’ and teachers’ life experiences. Third, it is noteworthy that this study provided information on which areas of students’human rights should be more concerned about in the future by looking at the actual status of how students' human rights are protected in our schools more structurally. Fourth, this study empirically analyzed the effect of human rights education in enhancing such human rights consciousness. The study results confirming the negative impact of teachers’ training in the cultivation of their human rights consciousness mean that the actual and current status of the rights’ training currently being provided to teachers shall be more strictly investigated and that the courses and programs for the education shall be corrected and supplemented. Fifth, this study examined whether differential items functioning existed and applied the anchoring vignette method, asnon-parametric approaches. Efforts need to be made to develop a new analyzing method wherein both the answer conformity assumption and vignette equivalence assumption can be applied even in a relaxed status, then it would be possible to more elaborately measure the non-cognitive educational achievements made by the education, including the level of human rights consciousness.
