To achieve two research goals, this thesis analyzed whether to distinguish between the basis and LCM(Life cycle management) of patentability decisions and Evergreening through research on patent application strategies and dispute cases regarding Evergreening. Based on this they also analyzed the effects of patent strategies on pharmaceuticals market share by comparing the variables of prior research in Korean pharmaceuticals market. Consideration of prior research needs the conceptualization of LCM and an Evergreening strategy. To achieve this, a current decrease in the productibility of new pharmaceuticals development required by pharmaceutical companies to make innovative efforts, among which LCM or Evergreening drew attention as representative important strategies. These strategies can be divided into five types, one of which is "Line extension.” This is an Evergreening strategy using patents, which is stronger than any other type and has become a means to maintain market exclusiveness. Therefore, stake holder people say that the LCM and Evergreening strategy is an innovative effort to develop new pharmaceuticals, while others say that it is an effort to block generic pharmaceuticals from entering the market and permanently dominate the market by generic pharmaceuticals manufacturers or health economic perspectives. As such, it is translated differently from each position and perspective. In addition, the structural aspects and their effects on the pharmaceutical industry in pharmaceuticals market competition have been reviewed. Through this, we have prepared the analysis framework of research through marketing that affects the pharmaceuticals market and health economics aspect, consumer aspects, and industry policy aspects. To achieve the goal of first research, we presented the bases for patentability and decisions to discern LCM and Evergreening strategies through patent application strategies for 14 pharmaceuticals for APIs and case studies for disputes. If these patent strategies for analysis had bases for stricter patentability in the process of patent application registration, unnecessary lawsuits can be prevented and consumer access to cheaper generic pharmaceuticals would be further enhanced. Considering such aspects, it is important to prepare for more objective bases for patents. However, the bases for deciding patentability may vary by era. This shall be applied with appropriate and balanced decision bases that can overcome the interest of the respective nations and problem of trade. Apart from the decision on patentability of LCM or Evergreening strategies, it is important to know how to discern among them. Previous studies regarded these strategies as the same ones and they only thought that they were the only differences in viewpoints. However, through this thesis, these two concepts shall be expressed differently. That is, if LCM, the effort of innovation, is just regarded as a mere means to prevent the market entry of LCM, there would be no motivation to lead new innovation from the viewpoint of a new pharmaceuticals developer. Through this thesis, LCM is getting patent rights for the results of research at the initial R&D stage and as such this shall be regarded as part of an effort for technology innovation. As the decision on the patentability may differ conditions of each era, LCM shall separately decide on the patentability decision. However, Evergreening is granting patent rights for the results by making high permission barrier to prevent the market entry of generic pharmaceuticals in the late development period during the pharmaceuticals development process or after their launch. This may lead to the problem of getting weak in health economic aspects and consumer welfare aspects by lowering the market accessibility of cheap generic pharmaceuticals. To achieve the second research goal of this thesis, patents in the patent strategies case study were reviewed to compare them with their patent strategies in the Korean pharmaceuticals market and the effects (variables) in previous studies. The aftermath effects were statistically analyzed for overall market and sub-market (drug effect group, shape, or single type) using a total of 558 pharmaceuticals market information. All variables have shown meaningful results in all markets and the sales of competitor companies by each variable affects the results the most. Sales of competitor companies in this thesis were used as proxy-variable to substitute the data of marketing data, because, It is hard to approach about direct advertising of ethical pharmaceuticals and direct advertisement of products in Korea's situation. Next, entry time difference, entry order, etc. similarly affected and regarding patent strategy, the patent expiration date of patents under review of original pharmaceuticals, and patent dispute affected the market share in a similar level. In case of sub-markets, most variables were analyzed as not meaningful. This seems to be evident because there is multicollinearity among variables and if not, the population is relatively low to be meaningful enough. Although the meaningfulness of such variables is low, the effects of each variable analyzed is similar to those for the overall market. These results showed that currently, patent strategies and related variables affect market share in the Korean pharmaceuticals market, and therefore, once the Korea-U.S. FTA takes effect, issues related with patents may further affect market share. Therefore, the patent permission linkage of the Korea-U.S. FTA shall prepare the system in terms of problems of automatic grade, and authorized generic pharmaceuticals.
