본 연구는 건설공사 중 공공 건설공사를 대상으로 계약이행단계에서의 발생가능한 분쟁에 대한 예방 및 해결방안에 한정하여 연구를 진행하였으며, 주요 연구내용은 다음과 같다.
첫째, DRB의 개념 및 프로세스, 국내외 분쟁해결제도, 클레임 발생유형과 분쟁해결방법, 건설 분쟁조정 및 중재 현황, 선행 연구의 고찰 등을 통하여 국내 DRB 활성화 방안에 대한 연구방향을 수립하였다.
둘째, 행복청, 서울시, FIDIC, 미국 등에서 수행하고 있는 분쟁조정위원회 설치, 예방 및 해결활동, 운영현황 등을 분석하였으며, 이를 통해 DRB 설치근거, 위원의 공정성 및 전문성, 분쟁 예방활동, 분쟁 해결활동에 대한 주요항목을 도출하여 국내외 현황을 비교분석하였다.
셋째, 사례분석을 통해 DRB 적용의 문제점으로 1)관련법령 및 규정 측면, 2)공정성 및 전문성 측면, 3)클레임 및 분쟁 예방활동 측면, 4)분쟁 해결활동 측면을 도출하였다. 이를 기반으로 입법적 측면과 설치 및 운영 측면, 사후관리 측면으로 구분하여 DRB활성화 개선방향을 제시하였다.

While there have been many studies on the causes of, preventive management for and measures to resolve construction claims, only a few studies have focused on dispute prevention and resolution plans. A dispute may lead to negotiations, adjustments and mediations, or even lawsuits among contract parties, making it difficult to solve problems. Long-drawn out lawsuits may cause manpower and material loss. To prevent and solve such construction disputes, a reasonable construction dispute management system is required. Recently, advanced countries including the US are proactively introducing a dispute resolution board (DRB) system with excellent effects.
In order to expand and introduce a DRB that reduces the resolution term of disputes and supports at a minimum cost to construction projects in Korea, this study proposed a DRB activation plan anchored on the establishment of a DRB system, to select fair and specialized committee members who can perform dispute prevention and resolution functions.
This study limited its scope in the prevention and resolution plan for disputes applicable to the contract realization phase of public construction projects. Key contents are discussed below.
First, the study established its direction for the DRB activation plan in Korea by reviewing the concept and process of DRB, Korean and foreign dispute resolution systems, the types of claims and dispute resolution methods, the current conditions of construction dispute adjustment and mediation, and existing studies on the subject.
Second, it analyzed the establishment of a dispute adjustment committee, the prevention, resolution and operation of dispute mediation activities conducted by the Multifunctional Administrative City Construction Agency in Seoul City and Federation International des Ingenieurs Conseils (FIDIC) in the US. Through these analyses, the study then compared and analyzed the domestic and foreign conditions surrounding key issues in DRB establishment, the fairness and specialties of committee members, and functions relation to dispute prevention and resolution.
Third, through the case analysis, the study extracted the following issues of DRB application: 1) related laws and regulations; 2) fairness and specialties; 3) claim and dispute preventive functions; and 4) dispute resolution activities. Based on these problems, the study proposed directions for improving DRB activation in legislative, establishment and operation, and post-management aspects.
Fourth, using the questionnaires, the study proposed a DRB activation plan centered on the aforementioned four key issues: 1) for the “improvement of related laws and regulations,” the study proposed a plan to improve the general and special conditions of national contract laws, construction-related ordinances, and construction contracts; 2) for the “acquisition of the fairness and specialties of DRB,” the study proposed to acquire fairness in selecting committee members, activate the specialist training programs, introduce a registration system for special manpower, and strengthen the committee members’ evasion and avoidance regulations; 3) to “prevent claims and disputes,” the study proposed a plan for DRB to perform dispute preventive functions in areas where claims are frequently made, such as differences in site conditions, contract documents, contract changes, term delay and reduction; and 4) to activate the “dispute resolution functions,” the study proposed a DRB activation plan that included the preparation of a DRB guide book and relevant standards, reduction of dispute resolution time, acquisition of the effectiveness of the decision, establishment of a DRB specialty institution, and activation of construction mediation.
Fifth, through interviews with specialists on the proposed DRB activation plan, the study validated the applicability of the four key improvement items.
