본 논문은 독일고용체계의 전환과정에서 나타난 비정규노동의 변화양상을 살펴보기 위해서 적극화 노동시장정책과 파견노동의 탈규제화조치가 노동시장에 미친 효과를 분석하였다. 먼저 독일모델의 위기로 인해 발생한 고용체계의 전환이 고용관계에 미친 영향을 살펴보았다. 독일은 80년대까지 사회적 시장경제형 고용체계를 유지하였다. 노동시장제도, 노사관계 및 사회보험제도의 주요 특성은 무기계약방식의 전일제근무를 기본원칙으로 하는 정형적 고용관계의 발전과정과 긴밀하게 연관되어 있었다. 정형적 고용관계는 일반적으로 단체협약이 적용되고, 연금, 의료, 산재 및 고용 등 법정 사회보험제도에 의무적으로 가입하고, 직접적 계약관계를 맺는 고용형태를 일반화시켰다. 그러나 90년대 이후 지구화와 금융화에 의한 주주자본주의의 유입, 재통일의 압력과 유럽통합의 강화 등 구조환경적 조건변화가 나타나면서 독일고용체계는 구조적 전환을 하게 된다. 노동시장제도의 탈규제화와 고용유연화전략의 확산으로 인해 노동시장에서 취약고용과 저임금노동자가 증가하였다. 노사관계의 분권화와 단체교섭의 조절력 약화는 고용형태에 따른 임금 및 노동조건의 격차를 확대시켰다. 한편 보수주의적 사회보험제도는 고실업과 재통일에 의해 초래된 재정건전성의 악화로 인해 시장화의 길로 한 걸음 더 나아갔다. 이와 같이 독일고용체계에서 나타난 노동시장제도의 탈규제화, 노사관계의 분권화, 사회보험제도의 시장화는 그동안 정형적 고용관계에서 금기시되던 양적 고용유연화와 비정규노동의 확산을 촉발시키는 제도적 토대로 작용하였다. 90년대 중반 이후 정규직 고용은 정체되고 저임금과 단기일자리를 가진 비정규 노동자가 늘어난다. 이들의 상당수는 사회보험혜택은 물론, 단체협약의 적용에서 제외되었다. 이러한 고용의 취약화로 인해 근로빈곤과 임금불평등이 심화되는 노동시장의 이중화가 독일에서도 본격화되었다. 이어 본 논문은 2000년대 들어서면서 본격화된 적극화 노동시장정책과 비정규노동 관련 법제도의 탈규제화조치로 대표되는 정부의 고용정책 변화가 고용관계와 노동시장에 어떤 영향을 미쳤는가를 분석하였다. 고실업과 낮은 경제활동참가율이라는 노동시장의 구조적 문제가 고착화되면서 정부의 노동시장정책은 적극화 기조로 전환되었다. 노동시장제도의 탈규제화로 상징화되는 ‘하르츠개혁’과 ‘아젠다 2010’ 등이 추진되면서 고용관계와 노동시장은 극적인 변화를 하게 된다. 정형적 고용관계의 비중이 급격히 줄어들고 비정형적 고용은 빠른 속도로 늘어났다. 노동시장제도의 탈규제화조치로 인해 단체협약, 해고보호 및 사회보험 등과 같은 제도적 보장기제가 약화되면서 노동시장의 불안정성은 강화되었다. 단체교섭구조가 분산화되고 협약의 포괄범위가 감소하면서 저임금부문을 확산시키고 임금격차를 높이는 결과를 초래하였다. 해고보호규정 등 법제도의 탈규제화로 인해 비정규직의 고용안정성은 심각한 위협을 받고, 사회보험적용의무를 지닌 일자리의 비중 또한 현저하게 줄어들었다. 즉 적록연정에 의해서 추진된 노동시장제도의 탈규제화조치는 정형적 고용관계를 약화시키고 비정규노동을 확산시키는 효과를 발휘하였다. 이러한 노동시장의 이중화를 보다 분명하게 확인하기 위해 독일 정규직과 비정규직 노동자간 임금격차에 대한 회귀분석을 수행하였다. 2000년대를 거치면서 노조조직률과 단체협약의 적용률이 급격하게 줄어들면서 정규직과 비정규직 노동자의 순임금격차는 확대되었다. 또한 노사관계의 제도적 요인으로서 단체협약이 고용형태별 임금격차에 미치는 효과는 여전히 강하게 작용하고 있었다. 하지만 노동시장제도의 탈규제화가 진행되면서 단체협약의 적용을 받는 노동자집단에서 노동시장의 구조적 요인으로 인한 정규직과 비정규직 노동자의 임금격차가 줄어들었다. 반면 단체협약의 적용을 받지 않는 노동자집단에서는 노동시장의 차별과 배제로 인한 고용형태별 임금격차가 점점 더 증가하는 것으로 나타났다. 이러한 분석결과는 노사관계의 분산화와 단체교섭의 탈집중화가 이루어지면서 고용형태에 따른 임금격차는 물론, 단체협약의 적용유무에 따른 임금격차가 동시에 나타나는 노동시장의 새로운 이중화추세를 증명하는 것이다. 마지막으로 본 논문은 파견노동의 사례연구를 통해 노동시장제도의 탈규제화과정에서 나타난 노사관계의 분권화가 비정규노동에 어떤 영향을 미쳤는지를 분석하였다. 90년대 말 적록연정이 들어서면서 파견노동에 대한 전면적인 탈규제화가 이루어진다. 대부분의 사용자들은 파견노동에 대한 활용전략을 고용유연화와 기업수익성의 담보를 위한 전략적 기제로 변화시켰다. 이에 대해 노동조합도 단체교섭과 기업협정의 중요성을 재인식하고 파견노동자의 차별금지 및 동등대우 등을 목표로 하는 참여전략으로 대응방식을 전환한다. 하지만 파견노동의 활용에 대한 단체교섭과 기업협정의 조절효과는 사용사업체의 노사관계의 성격에 따라 다르게 나타났다. 파견노동에 대한 노사협의와 사업장평의회의 경영참가를 통해 파견노동에 대한 조절능력을 확보한 폭스바겐의 사례가 있는 반면, 노조 조직력의 약화와 사업장평의회의 회피전술로 인해 파견노동자와 정규직노동자에 대한 노동규율효과가 강화된 하인츠-뮐러 유한회사와 같은 경우도 있었다. 즉 독일노동조합은 파견노동에 대한 정부의 탈규제화조치가 유발시키는 부정적 효과를 제어하기 위해서 단체교섭과 기업교섭을 적극적으로 추진했지만, 노사관계의 분권화로 인해 노동시장의 분할과 파편화를 제어하는데 한계를 보였다. 마지막으로 본 논문은 파견노동의 탈규제화조치가 노동시장에 어떤 영향을 미쳤는지를 살펴보았다. 2004년 노동자파견법의 개정 이후 파견노동자의 수는 급격하게 증가하고, 일부 업종에 한정되어 있던 노동자파견이 다양한 업종으로 확산되었다. 파견노동에 대한 임금차별로 인해 동일직무를 수행하는 정규직 노동자에 비해 파견노동자는 상대적으로 낮은 임금을 받고 있었다. 또한 기간제한 및 동시화금지조항이 없어지면서 파견노동자의 고용안정성은 더욱 약화되었다. 실업자와 구직자가 파견노동을 통해 새로운 정규직 일자리로 이동하는 ‘가교효과’는 유의미하게 나타나지 않았다. 오히려 새로운 노동자파견법은 사용자의 필요에 따라 임의적으로 파견노동을 활용하고 정규직의 고용안정성을 위협하는 효과를 발휘하고 있었다. 이와 같이 파견노동은 기업내부노동시장에서 발생하는 정규직 고용의 비유연성을 완충하고 필요노동력을 외부에서 공급하는 전략적 기능을 수행하였다. 그러나 노사관계의 분권화와 교섭구조의 분산화로 인해 파견노동자와 정규직노동자의 임금격차는 더 확대되고 파견노동자의 고용불안정성은 더욱 강화되었다. 이러한 파견노동의 ‘준-내부화’는 기업내부노동시장의 불안정성을 높이고 유동화시키는 효과를 발휘하였다.

This thesis analyzes the effects of activation labor market policy and deregulation of temporary agency work on the labor market, in order to provide an overview on the changes of irregular work caused by transition of the German employment system. Firstly the thesis examines the effects of transition of employment system on the employment relationship caused by the crisis of German model. Germany maintained an employment system based on social market economy style until the 1980s. The characteristics of labor market institutions, industrial relations, and social insurance institutions are closely related with the development of standard employment relations based on permanent contract of full-time employment. With collective agreements being generally applied, standard employment relations generalized direct contract relationships and statutory social insurance such as pension, medical care and employment. But due to change of conditions in structural environment such as strengthened European integration and pressure from reunification, and adoption of shareholder capitalism fuelled by globalization and financialization, the German employment system undergoes structural transformation. Deregulation of labor market institutions and spread of employment flexibilization led to the increase of precarious employment and low wage workers in the labor market. Decentralization of industrial relations and decrease in control power of collective bargaining intensified the differentials of wage and work conditions between workers with different employment status. On the other hand, conservative social insurance institutions took a step forward to commercialization due to weakened fiscal sustainability caused by high unemployment and reunification. Thus, deregulation of labor market institutions, decentralization of industrial relations, and commercialization of social insurance institutions in German employment system, performed as the institutional background that triggers quantitative employment flexibility and the increase of irregular work, which were considered to be taboos under standard employment relationships. After the mid-1990s, while regular employment was stagnant, low-wage short-term employment forms increased. Large portion of these irregular workers were excluded from social insurance benefits and the coverage of collective agreements. Due to such precariousness of employment, dualization of the labor market represented by the increase of the working poor and wage inequality started to rapidly appear in Germany. Subsequently, this thesis analyzed the effects of government labor policy exemplified by activation labor market policy and deregulation of irregular employment institutions starting on the 2000’s. As labor market’s systematic issue of high employment and low labor force participation rate become persistent, government’s labor market policy switched to the activation policy stance. As ‘Hartz-reforms’ and ‘Agenda 2010’ exemplified by deregulation of labor market institutions was proceeded, employment relationships and labor market underwent dramatic change. Proportion of normal employment relation dropped and non-standard employment rapidly increased. Labor market instability increased as institutional security mechanism such as collective agreement, dismissal protection, and social insurance weakened due to deregulation of the labor market institutions. Localization in collective bargaining structure and its declining coverage led to the proliferation of low wage employment and increased wage differentials. With removal of legal protections regarding employment security such as dismissal protection, irregular laborer became extremely vulnerable and employment with obligatory application of social insurance declined significantly. In other words, deregulation policy that red-green coalition pushed resulted in weakening of standard employment relationships and increasing irregular workers. In order to clearly identify the dualization of labor market, this study undertook regression analysis on wage gap between regular and irregular workers in Germany. Throughout the 2000’s, the level of unionization and collective bargaining coverage dropped dramatically while the net wage differential between regular and irregular workers increased. Collective agreement as the institutional factor of industrial relations has also become increasingly influential in wage differentials among various forms of employment. However, as deregulation procedure taking place in labor market institutions, within the worker group that is affected by collective agreement, the wage differential between regular and irregular employees caused by structural factors of labor market is diminishing. On the other hand, within the worker group unaffected by collective agreement, the level of discrimination in labor market seems to be relatively higher and the wage differential due to exclusion appears to be bigger. These results prove that a new trend, or the dualization of labor market which is characterized by the spread of wage differential according to not only various forms of employment but also the existence of collective agreement, is resulted by the localization of industrial relations and decentralization of collective bargaining. Finally, the thesis, which focuses on case study on temporary agency work, delineates the effects of localization of industrial relations on the irregular work in the process of deregulation of labor market institutions. In the late 1990’s, the emergence of red-green coalition led to an overall deregulation of temporary agency work. The most of employers implemented change in temporary agency work utilization strategy in order to use it as a strategic instrument that would assure employment flexibility and company’s profitability. Trade unions gained a new understanding on the importance of collective bargaining and company agreement and thus switched to participation strategy that aims to prohibit discrimination against workers and to secure equal treatment. However, the control effects of collective agreement and company agreement on the utilization of temporary agency work differed depending on various characteristics of labor-management relations of client firms. As differentiated from Volkswagen, which retained ability to adjust temporary agency work through joint consultation on temporary agency work as well as management participation of works council, Heinz-Müller GmbH gained strengthened labor discipline effect due to the weakened organizational power of the labor union and the dodging tactics of works council. In other words German labor unions, though they actively pushed ahead both collective agreement and company agreement in order to hold back negative effects of deregulation actions led by the government, were faced with limits in controlling fragmentation and segmentation of labor market caused by the decentralization of industrial relations. Lastly, the thesis examines the effects of the deregulation measures of temporary agency work on labor market. After the Temporary Agency Work Law was amended in 2004, temporary agency workers did not only grow in number but also proliferated in various industries. Due to economic discrimination, temporary agency workers received less in wages than regular employees did, which undertake the same work. Also as duration restriction of temporary agency work and prohibitive provision of synchronization were abolished, the employment stability was waning. This study did not find any compelling evidence of ‘bridge effect’ which means that the unemployed and job seekers transform into new stable jobs through the experience of temporary agency work. Rather, the new Temporary Agency Work Law did not only allow employers to optionally utilize temporary agency work but also endangered employment stability of regular workers. Thus, temporary agency work functioned strategically to buffer inflexibility of regular employment and to provide workforce from the outside if needed. However, both the decentralization of industrial relations and the localization of bargaining structure expanded wage differentials between temporary agency workers and regular workers and intensified employment instability. ‘Quasi-internalization’ of these temporary agency workers raises instability of firm internal labor market and exhibits fluidity effect.

Proportion of normal employment relation dropped and non-standard employment rapidly increased. Labor market instability increased as institutional security mechanism such as collective agreement, dismissal protection, and social insurance weakened due to deregulation of the labor market institutions. Localization in collective bargaining structure and its declining coverage led to the proliferation of low wage employment and increased wage differentials. With removal of legal protections regarding employment security such as dismissal protection, irregular laborer became extremely vulnerable and employment with obligatory application of social insurance declined significantly. In other words, deregulation policy that red-green coalition pushed resulted in weakening of standard employment relationships and increasing irregular workers. In order to clearly identify the dualization of labor market, this study undertook regression analysis on wage gap between regular and irregular workers in Germany. Throughout the 2000’s, the level of unionization and collective bargaining coverage dropped dramatically while the net wage differential between regular and irregular workers increased. Collective agreement as the institutional factor of industrial relations has also become increasingly influential in wage differentials among various forms of employment. However, as deregulation procedure taking place in labor market institutions, within the worker group that is affected by collective agreement, the wage differential between regular and irregular employees caused by structural factors of labor market is diminishing. On the other hand, within the worker group unaffected by collective agreement, the level of discrimination in labor market seems to be relatively higher and the wage differential due to exclusion appears to be bigger. These results prove that a new trend, or the dualization of labor market which is characterized by the spread of wage differential according to not only various forms of employment but also the existence of collective agreement, is resulted by the localization of industrial relations and decentralization of collective bargaining. Finally, the thesis, which focuses on case study on temporary agency work, delineates the effects of localization of industrial relations on the irregular work in the process of deregulation of labor market institutions. In the late 1990’s, the emergence of red-green coalition led to an overall deregulation of temporary agency work. The most of employers implemented change in temporary agency work utilization strategy in order to use it as a strategic instrument that would assure employment flexibility and company’s profitability. Trade unions gained a new understanding on the importance of collective bargaining and company agreement and thus switched to participation strategy that aims to prohibit discrimination against workers and to secure equal treatment. However, the control effects of collective agreement and company agreement on the utilization of temporary agency work differed depending on various characteristics of labor-management relations of client firms. As differentiated from Volkswagen, which retained ability to adjust temporary agency work through joint consultation on temporary agency work as well as management participation of works council, Heinz-Müller GmbH gained strengthened labor discipline effect due to the weakened organizational power of the labor union and the dodging tactics of works council. In other words German labor unions, though they actively pushed ahead both collective agreement and company agreement in order to hold back negative effects of deregulation actions led by the government, were faced with limits in controlling fragmentation and segmentation of labor market caused by the decentralization of industrial relations. Lastly, the thesis examines the effects of the deregulation measures of temporary agency work on labor market. After the Temporary Agency Work Law was amended in 2004, temporary agency workers did not only grow in number but also proliferated in various industries. Due to economic discrimination, temporary agency workers received less in wages than regular employees did, which undertake the same work. Also as duration restriction of temporary agency work and prohibitive provision of synchronization were abolished, the employment stability was waning. This study did not find any compelling evidence of ‘bridge effect’ which means that the unemployed and job seekers transform into new stable jobs through the experience of temporary agency work. Rather, the new Temporary Agency Work Law did not only allow employers to optionally utilize temporary agency work but also endangered employment stability of regular workers. Thus, temporary agency work functioned strategically to buffer inflexibility of regular employment and to provide workforce from the outside if needed. However, both the decentralization of industrial relations and the localization of bargaining structure expanded wage differentials between temporary agency workers and regular workers and intensified employment instability. ‘Quasi-internalization’ of these temporary agency workers raises instability of firm internal labor market and exhibits fluidity effect.
